Adjourned meeting of the Common Council of the city of Eugene, Oregon - called to order by His
Honor Lester E. Anderson at 7:30p.m. on June 22, 1970 - in the Council Chamber, with the
following Councilmen present: Messrs. McDonald, Teague, Purdy, 'Gribskov, Mohr and Williams;
Mrs. Hayward; and Mrs. Beal.
Minutes of meetings held May 25, 1970 and June 1, 1970 as mailed to Council members were approved.
Public Hearing, Budget - Mayor Anderson announced a hearing on the 1970-71 Budget. There was no
one present who wished to be heard either in favor of or in opposition to the budget. The hearing
was closed. Further action will be taken under "Ordinances."
e Public Hearing, Creation of a Mass Transit District ~ Under state law the City Council has authority,
by adoption of resolution, to take action tocreate a Mass Transit District. The resolution is
transmitted to the Governor, who will appoint a Board of Directors. Many letter.s have been received;
in regard to this matter, and the city of Springfield held an informal meeting, in which they sup-
ported adoption of the Mass Transit District Resolution. A letter was received from Governor
McCall in which he said he was aware of the problem and would act promptly if and when a resolution
was received from the city of Eugene. The League of Women Voters forwarded a statement supporting
I the idea of a Mass Transit District, but saying they would prefer another .method be used. They
were not in favor of the formation of another service district, but felt the urgency would over-
ride that consideration.
" Mr. McDonald moved seconded by Mr. Teague that the Council adopt thedresolution requesting the
creation of a Metropolitan Transit District, and that it be referred to the city of Springfield
and Lane County for support and comment.

Mr. Al Urquhart, 1960 Agate Street, urged the Council tQ support a Mass Transit System. He pointed
I, out that this move would be consistent with the goals adopted by the City Council in 1967, and
!;
, that this would be a major step to alleviate air pollution.
,
:1 Sarah Lawson said that the people from Springfield had chartered a bus totbring interested people
to the meeting. Most of these people have no other means of transportation.

Mr. Harry Hermiston, 3921 Virginia Street, Springfield, and Mr. William F. Stone, 225 North 41st
Street, Springfield, also spoke in support of this motion.
Mr. Kenneth Omlid, 350 Cherry Drive, .Chairman of the Lane County Commissioners, supported a mass
transit system but felt that the system should be publicly owned and operated. He objected to
authority being in the hands of a seven' man board, without:the vote of the people. He felt that
" the people should have a vote on the type of tax adopted.

~ Mr. Omlid felt that it was unfortunate that this problem had not been solved before it became a
L crisis, and said that the County had provided for a November ballot measure. He felt that the

voters-would sanction a small tax subsidy involved. .
Mr. Charles Potterf, 2685 Floral Hill, said that the formation of this district frightened him,
" and that he felt it. would be something he would have: to pay for , but would have nothing to say
" about.
"
In reply to.Mr. Potterf's -quest,ion, the City Manager said' that thi.shad nothing to do with the
airport, but provided for a transit. s5!rvice .within the metropolitan district.' After'its f,ormation
e it would be operated by a-Board appointed by the Governor, and the City would have no responsibility'
or authority for its operation.

, ~ Councilman Williams asked for clarification on the thirty-day referendum period. The City Attorney
I, explained the referendum and how it could be used.

Ii There was further discussion by the Council of the use of the referendum by voters, and how they
could go about this.
Mrs. Hayward said that she was concerned about keeping a mass transportation system in operation,
and that she felt this was an overriding consideration.

In answer to Mrs. Hayward's question, the City Manager said that to attempt to keep the Emerald
. 'Transportation System in' operation until after the November election 'would be a fairly expensive
operation because of several problems, the major one being the 'salary rate of drivers, and the
I purchase of new equipment. It would cost approximately eighty or ninety thousand dollars for a
six to eight month period. For a short period the system could keep running with a small subsidy.

In answer to Mrs. Hayward, Commissioner Omlid said that the County would propose to put a measure
on the ballot and that the district would have to be decided through a cooperative effort of the
Council of Governments and could be within the urbanized boundary.

I In answer to Dr. Purdy's fears, the City Attorney said that the organization of mass transit district -_
I provides for the alternative replacement by a metropolitan service distr~ct.

il Councilwoman Hayward commented that ,she would prefer the establishment of a metropolitan service dis-
:1 trict by the vote of the people, but only 10% of the voters need sign the petition to place the matter
I! on the ballot. The important matter is to keep the bus system operating.

;11 Mayor Anderson said that he could think of many reasons for voting down the resolution, the tax
j burden, mechanics of government, etc., but if the resolution was not passed, the City would watch the
Ii demise of the mass transit system in the area. Once lost, a system is usually gone for good, or
ill restoration is much more difficult. With the thought in mind of whether to pass the resolution or to I
i watch the demise of the bus system and the failure to meet the demands of the people in the area, the ,
il Mayor felt that the resolution must be passed.

,I Assessment Ordinance. Paving Willamette Street from 40th Avenue to south of the 7th Addition to
j! Edgewood ~ This project was initiated by the City Council after receiving requests from prop~rty ~
1! owners in the area. Because of the controversial nature of the project, the Council o'ieiue~gd=-an? i
'I assessment be made on the basis of estimated costs so the Council could be sure it could finance - - :
Ii the project prior to investing money. The assessment ordinance was read May 25, 1970, and held over ;
ti to this meeting to allow the proper notice of assessment to be given to owners of property. Written I
II protests have been received on the project from almost all those involved, including some who origi~al~
11 ly supported the project. I

:1 Mayor Anderson said that the Council had been quite realistic in its approach, and that this was one I
II way it could get the reaction of the people concerned. I - -

I! Councilwoman Hayward said that from the large number of owners opposed and the letters received, it
:1 had been indicated that this was not the time to pave Willamette Street.

!i Mr. Leonard Oswald, 4275 Willamette Street, was opposed to this proj ect and suggested that traffic
Ii control might solve the problem.

ill Mrs. Joy Goolsby, 18 East 47th, said that she had written various letters, and questioned the city's i
I; assessment procedures.

I: The ,City Attorney explained that the City Charter covers the rules regarding assessments of property
il for streets, sewers, sidewalks and other public improvements authorized by law.
"
il Mrs. Goolsby suggested that the Council should study assessment procedures of other cities, and
11 perhaps revise the charter so that a more equitable method may be devised.

Ii Mayor Anderson suggested that Mrs. Goolsby write to the City Manager .and request that this matter be I I-~
1'1 placed on a committee of the whole agenda.

1\ A. Mass Transit System - With the prospect of the immediate demise of the bus system
the City of Eugene, Lane County, the City of Springfield and others, met to work
Ii out a method to keep the system operating until a permanent method could be devised.
I
1/ Springfield and the County have been unable to contribute to the subsidy during this
interim period. During the past month, the operation has been continued by the pre-
sent owners with a subsidy by the city of Eugene to cover operating losses. The
continued only through the month of June. There are several alternatives possible:
1) Call a special election within the city to determine whether the city itself
should get into the bus business. This would require a charter amendment, and would I

e require that a financing program be approved at the same election; 2) Call a special :

Ii election or consider at the November general election the question of County operation
'I and a funding program; 3) The City Council adopt a resolution providing for creation
I: of a Metropolitan Transit District. This would require transmittal of the resolution
I to the Governor, who would appoint a Board of Directors for the District. The District
il
I' would consist of the entire County of Lane, but the Board of Directors could create
Ii
a service district within Lane County. The Board would have a wide variety of finan-
I It cing authority, and would be subject to referendum.

II Neither the City nor the County would be well-advised to try to operate the present
,I
il system for an extended period of time. It might be possible to continue for an
" interim period under the present system.

II Mayor Anderson and Councilwoman Hayward agreed that the present system should be

If utilized until another system could get into operation.
Kenneth Omlid, County Commissioner, said that the County could set up a special
Ii Mr.
Ii service district for transportation. After consideration, it was decided nothing could
Ii
Ii be done before the middle of August, and this would not be sufficient time to properly
I' inform the public. Therefore, the County felt it should wait for the November general
" election to present the question to the people. It concerns only a very few people,
Ii
Ii but it is very important .to them, and to the community. To be a successful operation,
it must' have the support of the people.

Mr. Pat Teague, Springfield City Manager, said that they were not in a position to
i assist in funding a transportation system during this period. He felt there was
.
I some question whether an election would be successful, since all agencies involved
,
,I have Budget problems.

Councilman Teague was concerned that the city of Springfield and Lane County were I'
II unable to participate in interim financing, and wondered if they would not work out :1
II ,
I I: something to assist in the meantime.
Ii Mr. Omlid said that the County could not legally subsidize private industry, and if
it was city-owned, there would be no problem.
Ii Mr. Teague said that any assistance from Springfield was impossible right now, and I
;i that the Council might find it possible to contribute after July. It was dependent I
I'
d upon the budget election.
- I! Councilman Mohr said that the City had just received a Mass Transit Study which he felt
I: i
II the City should subscribe to and undertake. He felt the Council had a commitment "

to maintain public transportation as a service to the community and that it had a i'
ii priority equal to police and fire protection. He suggested that the city initiate the
'I necessary action to establish a transiT district.

I' Councilman Williams suggested that possibility number one be eliminated. He felt
I! the system would operate with a loss, and that there was no possibility of a "
il federal subsidy to offset this loss. He felt the operating loss should be spread "
Ii over the entire area to be served. He said that two and three would accomplish the
I, same thing, but that option nu~er two would provide for a vote of the people, and
;1
, number three would require a referendum.

II In answer to Councilwoman Hayward, the City Manager said that a resolution could be
it adopted by the City Council at any regular meeting. The Governor would then have
I I: sixty days to appoint a Board.

I, There was further discussion on the length of time required for proposals and whether
ii
II or not the city should purchase the system in the interim.

Ii Mr. Fred Dyer, State Department of Transportation, said that there would be money
I: available July 1 to assist in mass transit, and that the Council should determine

I: what option it wishes to take, and get in touch with the administrator of the
e program.

Mayor Anderson asked at what stage the Council should establ&sh an advisory' committee. I
Mr. Dyer recommended that the Council appoint an advisory committee to address itself
to specific problems.
Mayor Anderson €aid to make a transit district workable, other jurisdictions should be
asked for at least their moral support in proceeding with a resolution.
Mr. Omlid did not believe in adding another level of government. He felt that it
would be difficult to get community support with this quick approach, and felt community
support was necessary to make it successful.
I Mr. Pat Teague said that the Springfield Council shared Eugene's concern regarding a

transit system, but that he questioned the speed with which this might take place. He
realized the urgency, but would appreciate the opportunity to discuss it with the Council
I to get a general feeling toward this approach.

I Mayor Anderson said that unless some kind of district was formed speedily, the bus system e
I would go out of existence.

I Councilman Teague said that he felt there was a definite obligation to those who utilize
the transit system as they are very dependent on it.
Mr. Omlid felt that, rather than a hurried-up approach to the solution, the best route
would be to let it take its course July 1 and try to have material prepared for the I
\ general election which would have the support of the community.
Mr. Mohr explained that the course the Council is proposing was developed by the 1969
legislature, and is not unknown-to the people. This is not an untried system, ~d
! speed is absolutely necessary.
I Mrs. Hayward said that there was unquestionably an obligation to keep the bus system
I running in the area, and that she agreed that the Council should move on the recommenda-
I tion of the Voorhees report.
I Mayor Anderson said that the mass transit would play an increasingly important role in
I the future. It is a significant answer to some of the problems of automobiles bringing
untold expenses to urban areas. The Mayor felt this was a regional problem, and that
the Council should propose the formation of a metropolit~ transit district, and seek
an opinion from the city of Springfield ~d Lane County regarding support to inform the
I public that this is a metropolitan problem.
I Dr.. Purdy requested that the City Attorney look into problems of the Portland Metro-
I
!I politan District as they might relate to the district being proposed.
II Dr; Purdy moved seconded by Mr. Mohr to authorize the City Attorney to draw up a resolu-
II tion asking for creation of a metropolitan transit district, and that such resolution
II be referred to the city of Springfield and to the Lane County Commissioners, for comment
and support of this ~ction. a

\ There was discussion concerning interim operation of the system, and how it could be
financed.
I Vote taken on Motion. Motion carried.
Mr. Mohr felt that the Council should be polled to let the public know where the city of
II Eugene stood as far as continuing bus service. He said that he would be willing, when
the budget was passed, to look at priorities to find money to maintain the present bus -

1\ B. Minimum Safety, Electrical Code - Councilman Williams was concerned that home purchasers
might not be aware that a home was wired only for minimum service and moved, seconded
! by Dr. Purdy, that an ordinance be adopted to require a sticker to be placed on the p~el
I which would show that the home is wired to minimum code standa~ds and does not allow f0r
expansion or additional service, and any changes should be made with a qualified advisor.

U He requested the City Attorney to determine if this could be done legally, and the Public
Works Director to draft such a statement. Vote taken on motion. Motion carried.
Mr. Teague moved seconded by Dr. Purdy to approve Item Ib of the Committee report.

I D. Convention Brochures, Chamber of Commerce - Mr. Ward Beck~ Manager of the Chamber' I
I of Commerce, distr~buted two brochures which the Chamber has been using to promote
I Eugene and its convention facilities. Money from the room tax was used for this
I purpose. Mr~ Beck explained that many cities have employed someone full-time for
II the purpose of seeking conventions, and that the Chamber has budgeted a person for

I at least part-time work strictly on conventions.

Beck exhibited a drawing designed to advertise Eugene as an All-America City

to those entering on the highways. He explained that it would be constructed
entirely of wood, and that it had been designed to comply with the sign ordinance
requirements.
In reply to Dr. Purdy, Mr. Beck said that the signs would be located at the South
11 entrance to the City on the Selvidge property, and on the north near the Beltline

\' the decision of the Zoning Board of Appeals regarding a T.V. antenna. The matter concerns

I interpretation of the zoning ordinance, as it applies to exceptions from the height limitations
i
I in residential zones. The appellant has erected a T.V. antenna which exceeds the height limi-

I tation permitted. The administration interpretation, upheld by the Appeals Board, is that the
Ii exception clause applies only to roof structures, and does not apply to independent structures,
II as is the case in the dispute.
II Sam Hughes, representing Mr. Guistina~ explained the appelant's position that the structure

Ii should be treated as an exception. He said that he had just received the City Attorney's
II opinion in the matter, and would comment on it at the regular meeting.

Mr. Clinton Hedrick, owner of a trailer sales at 1885 Highway 99 North, objected to this use, and II

the neighborhood.

all those living there were opposed to this tavern. II

Mr. John Langen said he was proposing to build the tavern. This is a commercial zone and taverns II
I are allowed. He said the objectors were mostly across a four lane highway, and that he would have II
I adequate parking.
Mrs. Margaret Hedrick said there are three taverns located in the area from four corners, three !I
places serving hard liquor and one place serving wine. She felt that was sufficient for the area.

considerations overrule.
Councilman Teague said he had driven by these locations, and that he was concerned that the proposed II
location at 45 West 29th was back of the liquor store, and whether there was a need for another out-
let at this location, and where the building could be placed on the 2nd and Washington location. II

There was some discussion regarding location of a store so close to the liquor store, and it was I
I thought there could be no reason to deny it, since the location does not seem to present any problems
from a police standpoint. I
Mr. Langen requested that the Council postpone action on his request so that he could provide de- ,

tailed plans. I
Mr. Mohr suggested that the Council enter remarks on the application to reflect the attitude of the I
Council, and that the only question was compatibility to the neighborhood.

I Councilman Mohr felt it,might be good strategy to separate the ordinance into two ordinances, one
I dealing with the code and the other with the administration of the code.

Mr. Mohr said that he had voted for the motion which provided a council committee to study certain
I kinds of administration procedures and arrive at new recommendations which could be brought back to
I Council.

I The City Manager said that it was his understanding that the Committee purpose was to review needed
.j amendments to the National Electrical Code and the State Code and to work with the City Administra-
, tion to seek changes at the state and national level. It was not his understanding that they were
II to be concerned with administrative procedures. As far as separating the ordinance, the second part
il dealt with service, inspection etc., and was really part of the code and should be distributed with
I, the code so that people using it would know what the ordinance provided.
If the Council wishes to separate it, the Electrical Board would like to consider it. The Council
could go ahead with the ordinance as presented, and could amend any administrative procedures.
Councilwoman Hayward suggested that the hearing be postponed until July 13, 1970.

" the request to construct a cabinet shop on this property. A joint meeting of the Council and the

Planning Commission was held subsequent to the Council meeting and the Planning Commission again
recommended denial.
Mr. William Wheatley, attorney representing Mr. Lanz, said that the property is almost surrounded
by M-2 and that this would be a logical change. He said that the Planning Staff had recommended
approval, and that it would be in conformity with the 1959 General Plan. He explained that Mr. Lanz
II would be agreeable to controls regarding buffering and landscaping, and would agree to a conditional

,I Mr. Theo Yang, a graduate student in architecture, exhibited preliminary drawings of the site and of I

I! the proposed shop. He said that the proposed 1990 General Plan indicates that this property is

1\ mind when doing the plan. He explained methods to provide sight barriers. He said that it would be

'I there was sufficient land zoned commercial or industrial, and that much of it could be reclassified

II residential. He said that industry is expanding in the area, and that it would be difficult to make

il the area compatible. If the Council approved this request a contract could be drawn, or the Council
II could require a conditional use permit.

!I Councilwoman Hayward had strong reservations about rezoning this particular property, and felt that
il there were certainly other uses for it. There had been strong objection from residents of the
neighborhood, and the Council would be doing them a disservice to change the zone.

Resolution 1835 - Amending Section 3 of Resolution 1754 adopted January 26, 1970, relating to
application of City for low rent housing units was submitted and read in full.
Thts resolution would amend an application for 300 units of turnkey housing approved by the Council,
and would delete sections referring to two bedroom homes for the elderly in order to comply with
federal requirements.
Mr. Teague moved seconded by Dr. Purdy that the resolution be adopted. Motion carried.
Resolution 1836 - Awarding bid for sewage treatment plant additions Project No. WPC ORE-254 was
submitted and read in full.
This adoption should be conditional upon federal approval. This statement is included in the
resolution.

Mr. Al Hoffman asked to be heard regarding a problem concerning the Oregon Electric Railway on I
Highway 99 North. He requested that the Council consider an ordinance limiting train speeds.
Councilwoman Hayward said that she had received a written request from Mr. Hoffman, and apologized
for not asking the City Manager to place it on an agenda. This item will be placed on a committee
agenda.
