A. Sign Ordinance Amendments - Amendment of the ordinance was delayed at the request of Obie Sign
Company because of their concern with sections dealing with billboard locations. A letter I

i was read from Vernon Gleaves, attorney for Obie Sign Company, stating that Mr. Gleaves had not t
I been aware that the hearing had been set, and requesting a delay to the meeting of August 10, i e
I because he had arranged to represent another client at this time. II

I the League of Women Voters said she would like to speak to the issue, but would reserve comment

11 Councilwoman Hayward pointed out that this matter had been delayed several times at Mr. Obie ' s I:
:1 request, and she felt the Council should set some guidelines for postponement of hearings. Mrs.

:1 B. Appeal from Sign Code (Tiffany Davis) - Tiffany Davis Company, located in the Oakway Mall, has

II requested a variance to place an S & H Green Stamp sign on the front of the building. This

:1 location is not permitted in the integrated shopping center sign district. I

11 Mr. James Spickerman, Assistant City Attorney, stated the city's position, and explained that
, I
" the Coun~ilcould consider a variance, as requested in this appeal, or could consider changing I
"

the sign district.
Mr. Rick Cleveland, Attorney for Tiffany Davis, explained their position, and outlined hard- I
ships caused by the restrictions imposed. He suggested possible solutions to the problem. I
I
He said the Board af Appeals had been ~ovided with photographs, and that staff was to have II
furnished them to the Council for review.
City Manager commented that the staff had been unable to locate the photographs, but that the
Council had viewed the site on tour. II

,: Planning ,Director ,commented that this type of sign would be permitted if the sign district was I
" outlying commercial. There had been some discussion during the period the code was drafted

'! whether this center should be outlying commercial, rather than integrated neighborhood. His I
;t department would suggestethat the Council consider this, rather than a variance. I

f Councilwoman Hayward was concerned about other signs in the shopping center if the Council
changed the sign district~ Superintendent of Building explained that if the Council~cbanged
the district to highway oriented, signs would not be liwited in number, but in area. He-'sald
there is in fact an identity problem, whichccould be solved by placing the sign on the building
itself.
Dr. Purdy was concerned with the aesthetics of the sign, and felt that it might be better I .-
close to the wall, rather than in the parking area. He did not feel, however, that this II
should be done through variance procedure.

Mayor Anderson suggested that the Council might review this request. There have been no 'I
other appeals like this, and the issue will have to be defined clearly. II
Mrs. Hayward asked if the Council would have to make a decision now, or might delay its decision!
to the next Cou~cil meeting. Th~ historic implications of the decision were great, and a 'I
" delay might aid the Council in this decision. She did not feel the delay would cause hard- 1
I ship for the appellant. I

" Mr. Teague was also concerned about the importance of the Council decision, and felt a 1

delay would allow time for further study. I
Mayor Anderson suggested that a member of the Sign Board of Appeals attend the next meeting. I I

Teague that action on this appeal be deferred to the I

j On Item ~, Public Works Director recommended award, subject to the bid being reduced by one I
II property owner. The last, property on Fillmore owned by Mildred Judd, wants to hire a private
contractor. It is recommended her property be deleted from the project, and a permit issued
Ii for not longer than two weeks to complete the project. If not completed within that time,
this would be added to the contract. This can be arranged when the contract is awarded.

Item No. 6 _ Public Works Director explained this project had been enlarged from the original
" concept and the difference would be picked up in other bids. The Department thinks it is a

,I good bid and should be awarded.

II Item 7 - Councilman Teague asked for clarification of this bid. Public Works Director said
:1 the difference in amounts could be explained because engineering costs would be included

II Item 8 - Public Works Director said the School District will be paying a portion of this

Ii assessment and concurs in the recommendation.
I' Mr. McDonald moved seconded by Mr. Teague that the contracts be awarded to the low bidder e

II on Items 1, 3, 5, 6, 7 and 8, and that the bid be rejected on Project No. 2, and that
II Project No. 4 be awarded, subject to conditions. Rollcall vote. All councilmen voting aye, I

II a. Closure, 21st Avenue - Councilman Mohr requested a report on the feasibility of
1j closing 21st Avenue between Fairmount Boulevard and Agate Street.

,I b. Drug Task Force - Councilman Mohr requested that an item be placed on the

" regular meeting agenda for a request for a budget for the drug task force. Until
" now they have operated on administratively funded programs.

I' City Manager said the Council had received copies of a proposed budget from the Drug Task Force,
which would include pUblication and distribution of brochures. The total amount requested is
, $1517.00. Funds can be used from the new Police Department budget. Some brochures have already
..
" been printed, but these have already been used.

Councilman Mohr commented that he had previousiliy reported to the Council concerning the success
of this project, and urged that this expenditure be approved.

Dr. Purdy requested that this item be placed on a Wednesday committee meeting to allow further
i' discussion. Councilman Mohr was concerned with a suggested delay, and said any questions the
i-
" Council might have could be answered now. There are no brochures available now, and authorization
is required to publish a new supply.
Dr. Purdy was not sure this was entirely a city responsibility. Councilman Williams suggested .'
that some of the federally funded programs might be available. Mr. Mohr explained that federal
programs are not available until demonstration programs have been started and are successful.
Mrs. Hayward pointed out that the Council was concerned who would be responsible for administra-
tionoof the funds. City Manager indicated expenditures would be governed by the City Manager's
office, based on invoices received. It is felt this is an important program from a police
standpoint.
There was further discussion about the cost of printing and how the program would be administrated.
Dr. Purdy moved seconded by Mrs. Beal to approve expenditure of $1517.00 for expenses for the
Drug Task Force, and recommended that disbursement be supervised and approved by the city adminis-
tration. Rollcall vote. All 69UDcilmen voting aye, the motion carried.
2. Holiday Pay, Eugene Police Benevolent Association - A memorandum was received from the I~
" Chief of Police requesting that, as the result of a departmental meeting, this I
item be deleted from the agenda. The Chief of Police will meet with the Manager I
to resolve this matter. I

3. Charter Amendment, Collective Bargaining - It appears there is some conflict between
the Fire Fighters Charter Amendment for collective bargaining and the Public Employe
Relations law. The City Attorney has recommended that th~ city administration
'I request authorization to file a declaratory suit against the Fire Fighters Union.

It seems desirable that a bargaining unit be designated in some fixed manner, because II
membership of the Firefighters Association includes management people. The Firetighters

I have not been willing to accept this interpretation, or to submit the matter to the
Public Employe Relations Board for determination of the bargaining unit. There are
some other questions about the charter amendment which will need resolution, and
these could also be considered.
Mrs. Hayward moved seconded by Mr. Mohr to authorize the administration to proceed with
preparation for declaratory judgment. Motion carried.
Mr. Teague moved seconded by Dr. Purdy to approve Items 2 and 3 of the Committee report. I
Mr. Gary Jensen, attorney for the Firefighters, commented on the wording of the motion. He said
there were legal objections to the action proposed, and he was in opposition to such a motion.
He stated that the Charter Amendment had. been passed by the voters of the city, and such a
il law suit would be flying in the face of the voters determination. Mr. Jensen said he would
provid the City Attorney's office with a memo of the firefighters position, and he did not believe
II the Council should decide on this motion antil such a memo was received.
e Councilman Mohr asked how, on grounds of propriety, a charter amendment, passed by the voters, II
which was found to have administrative difficulties, coald be remedied. Mr. Jensen could not II
answer, but felt a lawsuit should be the last resort. II

rather than a lawsuit.

Jensen said a letter of intent to begin negotiating had been sent to Council members, and II

he felt these matters could be ironed out. The bargaining unit should be decided pursuant to Ii

Mayor Anderson reminded Mr. Jensen that, in his statement, he had indicated the futility of further I:

II negotiation. II

I City Manager said the Charter Amendment had ind~cated bargaining agents, but did not say for whom
they were bargaining. As representatives of the City Council, staff had questioned this, and
had, suggested that PERBBwas the logical body to determine the bargaffirlting unit. This was not
"
acceptable to representatives of the firefighters and they suggested the matter be resolved by ;'
court action. It was on this recommendation that the matter was brought to the Council. The Manager's
office would be ha~py to meet,' with them. The management had offered to continuengargaining on other ~:
I items while this matter' was being determined but were denied the opportunity. ::
Mr. Jensen again said a lawsuit would not be the proper resolumion to the problem, and he felt
i
I good faith bargaining could proceed.
In answer to Mayor Anderson's question whether bargaining could proceed on other items, Mr. Jensen
said he would have to discuss this with members of the firefighters. He 'said the firefighters had I
I requested a special council meeting August 3, 1970 to discuss th~se matters. ,
Councilwoman Hayward said the Council was again in the throes of having to resolve difficulties
between the administration and firefighters, and she did not choose to be put in that position. The
eity Manager had been designated as Council representative in matters of bargaining with employes,
and he must be permitted to continue in that regard. She pointed out that proceeding with prepar-
ation of a suit did not necessarily mean the Council would find it necessary to continue with it,
!' but if their agent had requested this tool, the Council should allow him to have it.

Mr. McDonald moved seconded by Mr. Teague that the City Manager be authorized to file a declaratory
I judgment without further Council authorization. Motion carried.

I 4. Room Tax Allocation Committee Recommendations - City ~anager explained that the City
i Attorney has advised him there may be some problem with' the statute which provides

! for a $10,000 limitation on cities for advertising purposes. If there is a problem,
I it will have to be resolved.

I Manager explained that the charter amendment had provided certain uses for this money, and that
I the recommendations for allocation had to be approved by the Council.

11 Mr. McDonald moved seconded by Mr. Teague to approve the allocations recommended by the Room Tax
Allocation Committee as outlined above.
11 Councilman Teague asked if there were any plans to create a sinking fund. Manager explained that
II the success of the auditorium would depend on a successful financing program. The money will be
Ii held in a fund and allocated as it is available. The Council has no obligations as to allocations
:! of the fund.

!I 5. Guistina Appeal, City Attorney Opinion - The City Manager said the legal opinion is
II that this antenna does not violate the zoning ordinance of the city of Eugene.

I, Mr. Douglas Combs, speaking for_residents in the area, argued that this structure

il was abbuilding, and as such was subject to height limitations of the zoning ordinance.

;1 Mr. Sam Hughes, speaking for the appellant, felt this was a matter of legal inter-
:1 pretation. If Mr. Guistina had been in error, he would have to take corrective action.

II He felt the question was whether the use of the proper.ty was permissible under the
'. existing ordinance.

Ii Mr. James Spickerman, Assistant City Attorney, said the question had been fully
It treated in his memorandum to the Council, and that he had found nothing to indicate

II the neighborhood. Mr. H~ghes said he had no authority to offer a proposal at

There was further discussion about the building permit, and what Council action
II could be at this meeting.
I, Mr. Teague requested that Mr. Hughes meet with the City Attorney and the attorney .

11 retained by the residents, and try to work out an amicable settlement. He felt Mr. I

I' Gui~tina would certainly want to be a good neighbor, and that this matter could be

II resolved. Mr. Hughes agreed to discuss the matter with Mr. Guistina, and to then
:, meet with the attorneys.

Ii Mayor Anderson asked Mr. Hughes if it was his opinion that the tower would not be
,I erected, even though his client had the legal right to erect it. Mr. Hughes said if

I point, but that the intent of the law was something different than appears in the law,
and that certain corrections are in order. He, therefore, asked if the matter could
be settled so that the tower would not be erected at all.
Mr. Hughes replied that he could nclrfanswer this question until next week.

Mayor Anderson suggestedc that, the matte;l?~\;;b-ehElld over, discussed privately and Ii
brought back to the Council with a proposal. Mr. Hughes agreed. Ii
Mrs. Hayward felt the ordinance could be amended in the same fashion as had been II
done with 'non-conforming buildings. Mr; Spickerman agreed that there could be a I!
reasonable phasing-out period. ['

Mayor Anderson suggested that the City Manager submit to the Council suggested I
amendments to this section of the zoning ordinance. Mrs. Hayward suggested that
some discussion be held regarding phasing-out such towers within a reasonable I
length of time. ' ,

Purdy moved seconded by Mr. Mohr that an analysis be made of these sections of

the zoning ordinance, and that it be referred to the Planning Commission. Motion I,

Mr. McDonald moved seconded by Mr. Teague to approve Item 5 of the Committee report. Motion carried. II

I In answer to Mayor Anderson the Assistant City Attorney said the attorneys had met and felt
they were close to agreement. The Planning Commission has studied the ordinance and has proposed
some height restriction amendments.
,_ 6. Ambulance Rate Increase - Eugene-Springfield Ambulance Service has requested approval
-~, of a new rate scfiedufe'~-' Staff recommended that a ~o~mittee~be appointed composed of
representati ves of-- the cl ty- -of -Eugene and city of Sprlngffeilld Coun-ell and staff and of
the ambulance service to review the proposal and return a recommendation which both
cities could use.
Mr. Mohr moved seconded by Mr. Williams that the Mayor appoint a committee as I

recommended by staff to review the proposal for an increase in ambulance rates. Ii
Mr. McDonailld moved secon ded by Mr. Teague to 'approve Item 6 of the Committee report.
Mayor Anderson appointed Councilman McDonald to serve as Council representative on the committee I
to review the Ambulance Service proposal. I

7. Sidewalk Installation, Frances Willard School Area - Staff has recommended a public II
hearing for neighborhood conmaeration of this proposal. Public Works Director said
this is not a PTA proposal, but the result of a restudy of the area under terms set :1
forth by the Council at a public hearing March 23, 1970. He said mhe recommendation I,

Dr. Purdy suggested Public Works Department meet in advance with representatives of Ii

the PTA and people opposed to the proposal. Public Works Director said he would be I

agreeable to holding a special administrative hearing. A public hearing could be I
I
scheduled after review. i

Mrs. Hayward moved seconded by Mr. Mohr to call a public hearing at a later date to !I

discuss sidewalks in the Frances Willard School area. Motion carried. II

8. Paving and Sewers, Spring Boulevard - Spring Boulevard to 500 feet north of Firland. I
I Staff recommends extending the contract an additional 70 feet in accordance with the I
I property owners request. il
Ii 9. Neighborhood Development Project, State Street Area - City owns ten lots which were !I
'i
deeded by the County in lieu of paying sewer assessments. It is proposed to sell I!
:i
II these lots and use the money to purchase park property in accordance with the I'
,I
redevelopment plan. It is recommended to ask ERA to act as the city's agent in I'
I 'I
disposal of these lots. I,

I In answer to Mr. Teague, the Manager explained that these lots were deeded to the II
City by the County, and were not foreclosed by the City. Ii

I problems created by the delay in passage of the Electrical Code. Work on a project has been stopped
, because wiring is not in accordance with the present ordinance, and he is being financially damaged
I by his inability to proceed. The Manager suggested that it might be possible to consider final
j passage of the proposed code, deleting by special motion the proposed new fee schedule, and leaving
i the existing schedule in operation. The September 14 hearing could proceed to decide administrative

II questions and the question of inspection procedure.
The Manager read a letter from the Home Builders, requesting that the Citz Council proceed with
II passage of the ordinance.

2. Kiosk Location, Mall - Mr. David Hunt explained that the owner of a small snack
! stand will be displaced by purchase of Masonic Temple property by the Agency, e
, and that an attempt has been made to find a location for him. He has expressed

, interest in a location at Broadway and Olive, and it has been found that this

r small building could be located in the Mall itself without interference with
fire lanes. However, provision for utilities must be made at the present time.

I Mr. Hunt displayed a preliminary drawing and said the building would be approxi-

\, mately 9 x 12 plus overhangs. Owners of adjoining properties have no objections, l-
and the contractor has agreed to build it at his cost. There are some legal
problems that must be worked out later. t

I alarm newspaper reports that the City was abandonmng its own inspection of

1 milk. He had talked with physicians and the Lane County Sanitarian, and was
convinced that this would contrubute to the spread of disease in the City
J because raw milk would no longer be prohibited. He asked the Council to
, recon~Qer this decision.

II Mr. John Stoner, Lane County Sanitarian, agreed with Mr. Wolf's statements,

II and said there were other items in the health budget with which he was also
I concerned. He felt the restaurant program should be retained as it is now

'I and the question was whether the Council wished to reconsider it.

I I Mrs. Hayward explained that this decision was made at a budget committee meeting
when the press was not in attendance, and therefore the meeting at which the cut
was made was" ,not publicized. She felt the public should have an opportunity to

be heard.
Councilman Williams requested that a report'be made to what extent people
actually drink raw milk, and that an attempt be made to 'correlate consumption
of raw milk with typhoid or like diseases.
Mrs. Beal requested a representative of the State be present, and asked to know
what the differences are in the inspection service, what the sales of raw milk
are throughout the State, location of typhoid outbreaks, and whether this could
be linked to consumption of raw milk.
I Mr. Teague agreed with this request.
Mayor Anderson suggested that the Council be presented with the alternatives
e I that might be available at other levels of government to protect the community
against the sale of raw milk. 'He pointed out that the City is part of a larger
community, and an attempt should be made to get other areas to cooperate.
Mr. Mills pointed out that it might take considerable time to get some of the
information requested.

1970. The State has agreed to assume the inspection service as of August 1 and has expressed the
possibility of employing one of the city employes for this service. He asked for direction if the
Council wished, during this interim period, to be covered by state inspection.
Mr. Teague asked if raw milk would be available in the City August 1, 1970. He asked if there was
any way, under state inspection, that such sales could be excluded. The Manager explained that
the sale of raw milk in this City could be prohibited by ordinance, but this would be superseded
by state law. He said he was not sure when the- information requested by the Council could be pre-
I pared, but felt it would not be more than a month.

Mrs. Beal said she had not expected the staff to research answers to questions she had asked, but I
only wanted material readily available. I:

Mr. Kenneth Carl, from the State Sanitarian's Office, said theypplanned to assume inspection service
on August 1, 1970, and that it was important there be no lapse in inspection programs. He explained
the sale of raw milk, and assured the Council that it must pass rigid tests, and be plainly lab~led.
In reply to Dr. Purdy, the City Manager said, regarding restaurant inspection, that it was the
staff's intention that the County maintain this service for Eugene, as it does for the rest of the
County.
I Mr. McDonald moved seconded by Mr. Teague that the City Council approve the public hearing to be
held when staff has assembled information to consider reinstatement of the milk inspection program.

II 4. Planning Commission Report, July 7, 1970 - The following items will be scheduled
for public hearing July 27, 1970. The Council toured the sites prior to this meeting.
a. Zone change Recommended - Bethel School site from PL public land to M-2
e ,I light industrial. On Bethel Drive, south of Allane Avenue.
b. Zone change, Denial Recommended - Moose Lodge, east portion of Moose
property between 12th and 13th, Chambers and Taylor. Requested from R-2
lim~ted mmltiple family to R-4 H~gh Rise Multiple Family.
The Planning Commission has tried to clarify the use of the Eugene Speech
and Hearing Center on this property and has scheduled a conditional use
permit hearing in August to make this an allowable use. The remaining
portion has a rifle range on it, which would not be a permitted use under
the requested R-4 District. The Planning Commission has recommended
denial because of the increased density allowed under this classification,
and because of the land use pattern which might be established. The area
is under review in connection with the General Plan and the Planning Com-
mission has discouraged any major changes at this time.

owned by the Moose Lodge.

Regarding Item 4d(3), Councilman Williams asked if this Highway Oriented District would be within

sidering Centennial Boulevard as a major arterial. It hasn't been all reclassified to Highway
Oriented District because of the adjacent park property.

5. Conditional Use Permit, Appeal (Snellstrom) - Conditional Use Permit for construction e

I approved with condition that no more than ten children (all younger than three years~
be accommodated at one time., The ten child limitation is being appealed.

A letter was read from Mr. Wayne G. Helikson, Attorney for Mrs. Snellstrom, in
which he contended that this provision makes the business economically unfeasible, I
and is unreasonable. She has suggested that the limitation be that no more than
sixty children be present in the building in any given six-day week period, which
would limit the average attendance per day to ten and add flexibility.

i Council asked for clarification of this proposal. Mayor Anderson felt it was
I not clear, and that the Council should talk in terms of daily attendance or

weekly attendance.
Planning Director requested that the Council schedule a public hearing for the first
II Eegular meeting in August.

request for review of conditional use (Snellstrom) for August 10, 1970. Motion

6. Sign Code Changes - Council had requested that this item be postponed until
Mr. Obie could be in attendance. It is understood hewwill return to the City
by July 27.
Planning Director outlined Mr. Obie's concerns, and explained Planning
Commission intent when the ordinance was adopted. 0 I
Mr. Spickerman, Assistant City Attorney, said this could be construed a change
in substance because of the ambiguity of the language used. Mr. Obie brought
this matter up when the building department would no longer issue permits to
allow signs in the 15 foot setback area.
Superintendent of Building said the point in dispute is a matter of enforcement,
and that it was his understanding the intent of the ordinance was as he had :-,
applied it - billboards were required to be set back 15 feet in the highway
oriented district. Otherwise, the whole criteria of highway oriented ~igning y
would have to be discarded.
In answer to Councilman McDonald, Mr. Spickerman said present signs owned by
Mr. Obie would be greatly affected because they would not be allowed to remain
in their location after the amortization period had expired.
Mrs. Hayward pointed out that the affect on Mr. Obie's business had been
discussed during hearings on the sign code, and that he had been aware that
his present signs would have to be. amortized. The amortization period was
designated to allow him to make financial arrangements.
In answer to Mrs. Beal, Superintendent of Building said 15 feet was the r
minimum thought possible to prevent blanketing of adjoining signs. I

I In reply to Mr. Williams, the City Attorney said there is no legal problem
involved with amortization. This was accepted by the sign industry when
the code was adopted.

Shirley Shepherd and Mr. Ron Burke to serve on the Traffic Safety Commission.
In answer to Mrs. Beal, Mayor Anderson said the Traffic Safety Commission is
advisory to the Police Department, holds- public meetings and brings up certain
problem areas. Chairman is Mr. Jim Dumas.

by the state of Oregon. This ordinance has been adopted in order to assess the local share. His
