Councilman Williams suggested that the motion could be amended to allow a temporary
180 day variance to Tiffany Drug Company for this sign, and at the end of that time
perhaps the ordinance would be amended or a variance permanently granted.
I: In answer to Councilman Teague, the Mayor said passage of this amendment would allow

,I erection of the sign requested by the appellant for a designated length of time.

ii Councilwoman Hayward was concerned with the implication of that kind of sign, and how I
" difficult it would be to remove the sign, once it was in place.

" Mrs. Beal agreed that the sign code should be corrected to take care of the problem,
and did not feel a variance should be granted, even on a temporary basis.
Mr. Williams argued that he had no quarrel with this particular variance, but he did -
feel the Council should seek to correct the problem. The Council would still have
, the option to revoke the permission at the end of 180 days.

Building Superintendent explained that only one item of several amendments
had beEm contested, which was an amendment to the prealnble to the billboard
section.
I Dr. Purdy recalled that the Council had made a tour before conducting sign
ordinance hearings and it was his recollection that at that time the
proposed code allowed billboards closer to the property line. Building
Superintendent explained that the signs Dr. furdy referred to were business identity
signs and they were allowed to extend to the property line;
Mrs. Phyllis Loobey spoke for the League of Women Voters to support the
amendment which would clarify the intent of the original wording under Section 6.
Mr. Vernon Gleaves_, attorney for Obie Sign Company, said the proposed change
appeared to be minor. However, the outdoor sign industry had been of the opinion
e that billboards, under the ordinance, would be required to comply with setback
provisions of the zoning ordinance, and had proceeded on that assumptillon. He
believed that the present interpretation of the ordinance was in conflict with the
original interpretation of the building department. Mr. Gleaves had obtained
transcripts of all council meetings held in connection with the sign ordinance, and
very early in the meetings a change had been 'made in setback requirements to be reason-
able and consistent with present practices. Since billboards are for advertising
I pupposes, they should be considered the same as commercial buildings, which are
allowed to be placed on the prop~rty line. If this setback ruling remains, it will
destroy the billboard,indmstry. Mr. Gleaves explained conflicts in rulings when
new billboard placements were made. He outlined the number of sign placements the
Obie Company would lose if this amendment were adopted and urged the Council not to
change the present wording of the code, saying it would constitute a major change
in the ordinance itself.
Allen Reynolds, who had an advertising agency, said he believed ,the interpretation
II of the building department and Planning Commission was that billboards would
follow the formal building setback line. He felt the 15' designation was
arbitrary, and said many signs could not be used in this area if this setback was
enforced. He felt this was discrimination against the billboard industry.
Mr. Ken Freeman, independent advertising counselor, felt this was an attack on the
advertising industry, and he felt this would be an inequitable change.

Mr. John Timmons" Lincoln National Life, said billboard advertising was used I
extensively by his industry, and this restriction would work a distinct hardship I
on them. I
Professor W. L. Winter, University School of Journalism, said he had a great fear II

of the tyranny of the majority, and Obie advertising served local businesses and I'
was a responsible, tax-paying industry. I
I Brian Obie said when the ordinance was originally adopted he had felt he could save
2/3 of the signs in the community, but if this amendment is endorsed by the Council, !
only 1/3 will in fact be saved. This would crea~e a financial burden he would be unable i
I
to bear. He said he was only asking to be allowed to put his signs out as far as I
I
the building, and to remain a good ci ti zen of the community. II'
Mr. Bill Reynolds, independeri~businessman, felt passage of this amendment would I
I
- cripple a small business, and he could see no reason billboards could not be set I
I back the same distance as buildings. I
I Mr. Dennis Miller, a new resident of Eugene, said billboard space is in great Ii
I
I demand"and he felt other businesses would suffer if this amendment was adopted.
II In answer to Councilman Mohr, Mr. Gleaves ffiid there may very well have been taking
II without due process in the original passage of the ordinance, but the ordinance did
Ii have a phase-out period. The actual taking will not occur until the five-year

Ii In answer to Mrs. Hayward, City Manager said the installation of a sign within the
I 15' setback had been the result of a misunderstanding by an employe responsible
I for checking locations, and it was corrected after it was discovered.

I by Obie Sign Company through this amendment.

I Mr. Teague was concerned with the hardship on Mr. Obie and the resultant hardship on
I
I many merchants. He felt when the code had been drawn the Council was aware there
I would be hardships, but he wondered why a 15' distance had been chosen rather than
,
I la' or 5'. City Manager explained that there had been a great deal of discussion
I concerning hardships, ,and this was the reason for the amortization period.

e II Mr. Morven Thomas, Planning Commission, explained that some restriction on signing
II was necessary, and the Planning Commission had taken things such as speed of

automobiles or whether people would be walking, into consideration. This wording
was the clear intent of the Planning Commission, as it related to billboards. .
City Manager explained that, at the time of discussion of Highway Oriented District,
15' was considered to be the minimum necessary to prevent blanketing.
Mr. Teague suggested that the Council refer this question to the PlanniDg Commission
I for review. Dr. Purdy did not believe the original intent of the ordinance was to

restrict billboards to 15' setback.

Mr. Mohr moved seconded by Dr. Purdy to table discussion on amendment of the sign code.
Messrs. Mohr, Teague, Purdy and Gribskov were in favor. Mrs. Hayward, Messrs. Williams,
McDonald and Beal and Mayor Anderson voted no. The Motion failed.

I Mayor Anderson suggested the public hearing be closed and further information could
II be presented when the ordinance was given a second reading.

I Mrs. Beal moved seconded by Mrs. Hayward that the public hearing be closed. Motion

carried.
City Manager pointed out that the ordinance in question had several other amendments
to the sign code which have not ben controversial;

11 Mayor Anderson suggested in view of the fact there is some quest~on of intent when
II the original ordinance was prepared, that the Council adopt those amendments which are
11 not controversial, omitting the section dealing with b~llboards for further consider-
ation.
I Mr~ McDonald moved seconded by Mr. Teague ,that Council Bill No. 9199 be read the
second time, with unanimous consent of the Council, except Section 7, which would be
referr~d to the Planning Commission for discussion at a joint City Council-Planning
Commission meeting.
I Mr. Mohr suggested that the motion not include reference to a joint meeting, but
I delete Section 7. Mr. McDonald and Mr. Teague were agreeable to that proposal and
II a vote was taken on the motion as amended. Motion carried.
I In answer to Mr. Mohr, City Mangger said joint meetings of Council and Planning
Commission are not public hearings, but they are open meetings.

I Mr. McDonald moved seconded by Mr. Teague to authorize the City Manager to schedule
a joint meeting with the Planning Commission to discuss amendment of the sign code,
with reference to billboard setback. Motion carried.
I C. Appeal from Condi tionalUse Condition (Snellstrom) ... I
I Mrs. Sylvia Snellstrom was granted a conditional use permit for operation of a day
care center at the corner of 23rd Avenue and University Street. She has appealed a
I condition imposed by the Planning Commission for ten children in the center in any
j one day, and has suggested that this limitation be changed to sixty children in
any given six day period.
Mr. Morven Thomas said the Planning Commission had. discussed this matter at its noon
I meeting and voted unanimously to P?ss a motion to allow the nursery to have twenty
I children in one day, in compliance with county and state requirements. They were -
only concerned wi ththe i!Ilpact of traffic on the neighborhood, and any problems can
I be corrected by using the complaint procedure set forth in Section 17.04 of the
zoning ordinance.
I Mr. Wayne Helliksen, representing Mrs. Snellstrom, said they would accept this ruling
II of the Planning Commission. They felt this would be easier to police than their ori-
I ginal suggestion of sixty children per2six day period.
I Mr. Leo Stauffer, 2263 University Street, objected to this ruling and asked if this
I was a hearing on the question of granting the coriditional use, or merely the matter
I of number of children in attendance. City Attorney ruled that the latter was the
case. He assured Mr. Stauffer that neighbors would have the opportunity to register
I complaints if operation of the center caused problems in the ne~ghborhood.
There was discussion about procedure for complaints for conditional uses, and why I
I certain conditions were imposed.

I Mrs. Walter Moberly, 2260 University, objected to expansion of this use, and felt~it
I
I would increase noise and cause traffic problems.
Mrs. Hayward pointed out that there is a park and school yard in the neighborhood
now, which generate noise of children.
Mr. Thomas explained that neighbors at the public hearing had stated that the e
existing operation was unoffensive and that no problems had been created. I

I Mr. Mcdonald moved seconded by Mr. Teague to uphold the Planning Commission recom-
mendation to allow twenty children per day in attendance at the day care center on
the Snellstrom property at 23rd Avenue and University Street, and that conditions
set forth by the Planning Commission in the original conditional use permit be
complied with, including the complaint procedure of Section 17.04 of the zoning
ordinance. Motion carried.,
D. Bids, Public Works Department - Opened August 7, 1970
Assistant Director of Public Works outlined the bids, and said the basic bid was
low in each case, and that award of each low bid was recommended. Bids follow:

I involved a badly damaged concrete street which the Department had considered redoing in

Informal bids were received July 29, 1970 for construction of parking facilities for
Skinners Butte Park and Campbell Center. It is recommended the low bid of $15,401.88

Mr. McDonald moved seconded by Mr. Teague to adopt budget measure No. 51 authorizing
$1,051,988 tax levy. Rollcall vote. . All councilmen present voting aye, the motion carried.

l. Items from Mayor and Councilmen
a. Passage of Budget - Mayor Anderson commented regarding passage of the budget e
that he was gratified at the size of the turnout, and that it indicated an
I increased interest on behalf of the City. Had the budget not passed, many
services 'might necessarily have been curtailed.
Mayor Anderson thanked all those who worked with the budget committee, parti-
cularly Mrs. Hayward and the telephone committee, radio and TV stations and I
I the press. He commented that a committee will be moving to seek out new avenues
I and sources of revenue to attempt to relieve some of the property tax burden.
I' b. Note of Appreciation - Councilman Williams thanked the Council for his appoint-
ment last fall, and announced that he had filed for Councilman in Ward 2.
I c. Appointments, Procedure - Councilwoman Hayward said she had been concerned with
a lack of procedure regarding appointment of people to commissions and boards
I for which the Council is responsible. She suggested it would be appropriate
I for the President of the Council to appoint a committee to recommend procedures
for making such appointments.
I Mr. Teague moved seconded by Dr. Purdy to place Items la, Ib and lc of the Committee report

2. Progress Report, Social Goals - Councilwoman Hayward introduced members of the
Social Goals committee present at the meeting.
!I She explained the need for social goals in the community, and how the committee
I had gone about establishing goals and means for reaching them. She said that the
committee had prepared a preliminary social goals statement and had recommended
I to the City Council establishment of four task forces to prepare working papers
ontthe following subjects: The right of all citizens to privacy; the right of
I all citizens to equal treatment; the right of all citizens to freedom of belief I
and expression; the rights that all citizens have in the use of their property.

Mayor Anderson asked at what point the responsibility of the city government
II
would be delineated. Mrs. Hayward said the committee would want to make recom-
Ii mendations not only to the city, but to other governing bodies.
After further discussion, Mrs. Beal moved seconded by Mr. Williams to adopt the
report presented by the Social Goals Committee and direct it to continue along
the lines it has been proceeding. -
Mayor Anderson s.aid he thought their approach, on the basis of individual rights,
was an excellent one, and he hoped it would develop into a good conference. He
I expressed thanks on behalf"'ef the Council to Mrs. Hayward and members of the
committee, and said he would welcome suggestions as to the report or any assist- '.
I ance needed.

3. white Bird Clinic Presentation - White BirdClinic Players challenged membeFs
of the City Council to a baseball contest by dropping of a gauntlet. Councilman
Mohr said they would take the challenge. Mayor Anderson thanked the challengers

I 4. Riviera Annexation - Annexation of this area was on condition the sewer system needed
to serve that area 'would be financed entirely by the people in the area, at no cost
to the City for construction purposes, be~ause the system could not be considered
I permanent. The annexation was under the jurisdiction of the boundary commission,
and a corporation composed of people in the annexed area was created to fund the
system. Since the annexation was completed there has been a series of elections held
in the area challenging the annexation. The Attorney General has ruled that the
challengers have no legal basis for their challenge and that the annexation is valid.
Members of the corporation have requested a letter from the City assuring them that
sewer service will be provided and that their sewage will be treated, as is provided
by agreement with the City. The Manager requested authorization to assure them, in
writing, that in the event the challenge proved successful, the City would continue
e to provide sewer service on a cost basis until the annexation has been settled.
MI'. Williams moved seconded by Mrs. Hayward to authorize the City Manager to forward
a letter as outlined above to the corporation formed of citizens of the Riviera
, Annexation. Motion carried.

Mr. Teague moved seconded by Dr. Purdy to approve Item 4 of the Committee report. Motion carried.
I 5. Marshall Avenue Drainage Ditch - Authorization is requested to exercise an option on
easement for Marshall Avenue Drainage ditch for property owned by Bassel H. and Nola
Montgomery, 1120 Echo Hollow Road, for $1750.
MI'. Teague moved seconded by Dr. Purdy to approve Item 5 of the Committee report. Rollcall vote.
All councilmen present voting aye, the _motion carried.
6. Liquor License Request, Approved by the Police Department
Class A Dispensers License - Charter Oak Restaurant, No. 1 Oakway Mall
Request for greater privilege.
II The City Manager explained that the restaurant owner had been anxious to get approval
of this request so that he could forward the license to the OLCC before its next meeting.

Mr. Williams said there had been public concern when this location was fir~t licensed,
and felt there should be some public notice. It was therefore held over to the regular il
meeting. 'I

Mayor Anderson said the League of Oregon Cities had a communication from the OLCC I
I
regarding guidelines for local governments in handling liquor license applications I
II and renewals, and requested the Council to discuss any ideas regarding procedures
I
which could be more successful. Ii

I The City Manager explained that thismmatter had been held over to allow anyone who wished to speak II
il the opportunity to be heard. No one was present to speak.

7. Field Burning- Councilwoman Beal commented that the grass growers have filed suit to Ii
I be allowed to burn cereal grain fields, and suggested the City might offer aid to the
Department of Environmental Quality. The City Manager said Mr. Harms had informed him I
e I this was purely a legal matter, but if there was need for City testimony, he would
notify the administration. I

Mr. Teague moved seconded by Dr. Purdy to receive and file Item 7 of the Committee report. Motion

I 8. Skinner Butte Cross Lawsuit - Councilman Mohr suggested the Council should develop I
a position regarding the cross, since a lawsuit has been filed in circuit court by I
one of the origin~l defendants who is now the plaintiff. I
I The City Attorney said he would make pleadings available for Council review.
The City Attorney outlined previous court action on this matter and explained the present complaint.
He asked for Council direction on the position he should take. He explained the avenues open to
the Council and the action that would be necessary in each case.

I MI'. Teague moved seconded by Dr. Purdy that the Council continue to maintain neutrality in this
matter.
I
Councilman Mohr was concerned that maintaining neutrality would mean doing nothing, and he did not
feel the Council had that option in this suit, since they had been named as parties. He suggested
that the Council had been named improperly in the case, and asked how the City Attorney would
argue the case. I
Ii The City Attorney explained that if the Council wanted to take a stand, it would have to determine I
e whether to support the majority of the City's voters. Ii

Councilman Mohr suggested that the City Attorney file a demurrer based upon the impropriety of the
suit against the City.
Mr. Mohr moved that the wording of the motion be amended to direct the City Attorney to file a
demurrer on behalf of the City that the plaintiffs have no action against these defendants.
Mr. Williams argued that this would not be a position of neutrality, but would be arguing that the
cross was improperly placed and that the Council believed the Charter Amendment to be invalid.
I Dr. Purdy reminded the Council that a former Council had established Skinner's Butte Park in 1934 as
I a memorial park, and in 193~ the legislature had passed a statute allowing memorials; on May 26,
1970, the citizens of Eugene passed a Charter Amendment to allow this cross to be designated' as a
war memorial. He felt that the Council had a mandate from toe people. ;His interpretation of the
Supreme Court ruling was not that the cross was unconstitutional, but tpe action of the City of
Eugene in granting a retroactive permit was unconstitutional.

Mayor Anderson felt the motion was correct and that moving into any legal action whatsoever would e
remove neutrality and' would leave the parties the same witho~t the City being affected.
After further discussion of the Council position, Mr. Mohr requested a determination on another
matter on the agenda - that of the Maxon suit aginst the city of Eugene. He felt these were
parallel matters. The City Attorney stated that unless instructed otherwise, he would support the
majority of voters in the city of Eugene that the vote to postpone the nuclear power program for
four years was a proper matter for an initiative. This was analogous to the cross case. I
Mayor Anderson assumed neutrality meant allowing the complaint to go by default.
I Councilman Mohr said that as representative of the voters he could not be a party to anything that
would allow this to go by ,default in ,court. This would establish a dangerous precedent.

Dr. Purdy moved seconded by Mr. Williams to amend the motion to support the people in their electoral
mandate that the cross is a war memorial.
In answer to the City Manager, the City Attorney said this was contrary to the original motion.

In answer to Councilman Mohr, the City Attorney said if the Council voted to support the electoral
mandate of the people, his staff would employ every legal strategy to obtain a court decision that
the Charter Amendment'is valid and does not violate any constitutional prohibition and that the
cross on the Butte as a war memorial is a valid designation of that structure for purposes set forth
in the Charter " Amendment. The City will, in effect, be joining the plaintiff's position in the
case. I
A vote was taken on the Motion. Mr. Mohr and Mrs. Hayward opposed the motion. Motion carried.

The City Manager read a letter from the League of Oregon Cities requesting the City to advise them
regarding its position concerning the desirability of a statewide uniform building code. A memo
was distributed from the Building Superintendent supporting the League position. The City
Council could still decide whether inspection should be local or by-the state agency. The legis- It
lative interim committee will meet to make this decision.

! in its efforts to establish state-wide building codes. "-
In answer to Councilman Teague, the City Manager said that the action of the League would pro-
II hibit the City from having local amendments except when local jurisdiction can show that condi-
tions warrant a departure.
Councilwoman Beal was concerned that lobbying and pressure could tend to make codes more rigid,
\ and thus increase the cost of housing. The City Manager said that the League intends to support
I the National Electrical Code, which is generally less stringent than state amendments, but at no
time would the City be committed to something more restrictive than the national codes. If the
City did not agree with the state code, it could lobby against it.

2. Petition for Sanitary Sewer, Strayer Subdivision (100% Petition)
