Anderson at 7:30 p.m. on September 28, 1970 in the Council Chamber, with the I following Councilmen present: Messrs. McDonald, Gribskov, Mohr and Williams and Mrs. Beal Minutes of mee'tipgs held August 31, September 2 and September 14, 1970 as mailed to Council members were approved. . PUBLIC HEARINGS I. Ordinance Defining Charitable Solicitation ~ Mr. William Horsfall, 1792 West 34th Place, asked about the wording in Section L F( 8) regarding costs of obtaining' contributions. He was con- ! cerned whether costs of entertainment used in obtaining contributions would be included and A whether under these circumstances a permit. would be granted. ' City Manager explained the section ,., ., and said a committee would rule on the nature of expenses incurred. TheCi ty Attorney said all costs of advertising and promotion are solicitation costs, but that the cost of entertainment or other consideration would not be included in the 20% limitation. Mr. Ned Risbrough, Eugene Hearing and Speech Center, spoke in favor of the ordinance. He said the Center had previously experienced problems with organizations representing themselves as solicitating for the Center, when in fact the Center did not realize any money from the fund I raising drives. These drives .:,were conducted without any' permiss ion on the part of the Center to use its name. Mr. Irv Molholm said legitimate charities do no! have to be protected, and this ordinance was designed to stop those who were not operating legitimately. He said United Appeal supports it. Mrs. Vivien Hinton, 788 West First, was glad the city had an ordinance to protect those who should be protected, and she felt the ordinance was terrific. Councilman McDonald said he had questions when the ordinance first came up, but after a meeting with representatives of the Chamber of Commerce they were very pleased with the wording and pleased that the Chamber of Commerce had sponsored the ordinance. I, , Mr. Mohr asked if organizations could be subjected to an audit.' The City Attorney said he was not sure, but they VDuld be required to make a report which would be scrutinized by the advisory committee. He felt they should be required to take out a permit for a year's duration, and at the end of that time it should be returned., He said the ordinance would require the Council to review each license for charitable solicitation. Manager suggested if the Commission approved an application the permit could be granted administratively. Any appeal could come before the , Council. The City Attorney said he would like an opportunity to make some amendments in the ordinance. Councilman Mohr recommended a change in the administration procedure, saying there were enough I standards in the ordinance that the commission could pass on applications. Mr. Me ,onald moved seconded by Mr. Mohr to direct theCi ty Attorney to bring back an ordinance with modifications as indicated, subject to further review by the Council. Motion carried. Mayor Anderson thanked those who took an interest in this legislation, and said he was sure it I' would mean much to the community and to the chari table organizations who are a part of it. II. Ambulance Rates, Proposed Increase - T.he City Manager read a memorandum written to the City e Council from the Director of Finance outlining the work of the committee with the ambulance service and the city of Springfield. He explained the rate changes, especially those for ,I multiple riders. Mr. Bill Leonard, Eugene-Springfield Ambulance Service spoke in favor of this proposal. Councilman McDonald explained the investigation of proposed increase~, and that it had been felt the company gave good service, and the increase was reasonable. He said the Committee recommended the Council approve this resolution. Mrs. Beal was interested in the difference in this rate and that of five years ago. Mrs. Jensen, a reppesentative of Renual, expressed approval of the proposed increase, and said she felt the company performed a valuable service to the community. I Mr. Tom Putman, 829 Sunview, felt the ambulance service was good, but that the rates were sufficient without an increase at this time. Mrs. Vivien Hinton feltcthe service was good, and that lives had been saved because of it. She was in favor of an increase. Mr. McDonald moved seconded by Mrs. Beal that the City Council approve the pr~p0~d resolution increasing ambulance rates. Motion carried. 4It Mayor Anderson thanked the committee for its excellent work in preparation for this hearing and those who participated. ' 9/28/70 - 1 ... ,...- 1 ~ 3 7 e 9/28/70 , _._-'__-'--_~""""-_ ':'d_<""~""---~_~_~__ ~ --...,---........------- I: r ,I I " I I: Mrs. Hayward entered the meeting Closure of Club Road - The City Manager explained the location.of this small diagonal street, III. . and that its intersection with Coburg Road,had created many accidents or near-accidents. He' displayed a drawing of a pr9Posed barricade and landscaping and said the cost of construction would be approximately $500. Mayor Anderson said this closure had been under consideration for some time, and it was felt this would solve the problem, at least for the present time. Mr. McDonald moved seconded by Mrs. Hayward to close Club Road at Coburg Road. Motion carried. NEW BUSINESS I. Items from Planning Commission A. August 24, 1970 meeting: l. Amendments to Zoning Ordinance increasing allowable parking area coverage - Planning e Commission recommended amendment of the zoning ordinance Article 19, Section 19.:13 to increase maximum parking area coverage for R-3 Districts up to 50% and the maximum parking area coverage for R-4 Districts up to 60%, upon application to the building official and approval of the design plan. 2. Vacation of Beech Street - Planning Commission recommended vacation of Beech Street south of 13th Avenue for 34', subject to provision for fire lane and service vehicle I access and resolution of the question of remuneration of costs for paving intersection. Mr. McDonald moved seconded by Mrs. Hayward that the City Council set a public hearing for Vacation of Beech Street south of 13th Avenue. Motion carried. B. September 1, 1970 meeting: l. Annexation, Ernest Wilson property - Planning Commission recommended annexation of property located west of Benson and south of Crescent be referred to the Boundary Commission. Public Works had been concerned with surface drainage, and that the drainage channel would not be constructed immediately. Planning Commission felt the entire area should be includ~~ in the annexation, since the city boundary in this vicinity is very irregular. - Property owners were notified the drainage problems could not immediately be solved. Councilman McDonald recommended the whole area be annexed, not just a small portion. Mr. McDonald moved seconded by Mrs. Beal the Council refer the annexation of Benson, south of Crescent and the area south of Bonnie View Drive to Beltline Road between Chuckanut and Gilham to the Boundary Commission, as recommended. Motion Carried. 2. Zoning Ordinance Amendment - Planning Commission recommended amendment of zoning ordinance Article 10, Section 10.03 Buildings and Uses Perm itted Conditionally in I RP District to add Section (g) General office use, provided that the use does not involve any retaifu activities. C. September 14, 1970 meeting: l. Easement Vacation, Breeden Bros. - Planning Commission recommended approval of easement vacation Lot 27, Block 6 Third Addition Foothills West (area north of 28th Avenue between Fillmore Street and Almaden Street) 2. Flags and Banners, Mall Plaza Area - Planning Commission recomme~de~_C~ty Council e approve use of flags in Mall Plaza Area as approved by the Mall A~t8 Committee. Since those to be flown include American ~lags, the Planning Commission felt they would be in conformance with ,the Sign Code. Mr. McDonald moved seconded by Mrs. Hayward to approve use of flags and banners in the Mall Plaza area as approved by the Mall Arts Committee. Motion carried. II. Christmas Village, Mall Plaza - A letter was read from Mr. George Mayor requesting permission to locate the Christmas Village within the Mall Plaza in the area of the former Broadway and Willamette Streets. Staff feels this area would create no more problem than any other area of the City. Mr. Mayer said he had contacted Mr. Longwood of the Mall Activities Committee and that this location had met with his approval. I Councilwoman Hayward was concerned that this committee is in the process of establishing rules and regulations, and felt permission should be granted only for this season. Mr. Gribskov was in favor of something that w-uld keep a street open, rather than closing one. Mr. McDonald moved seconded by Mrs. Hayward that the Council approve this request, subject to review by the Mall Activities Committee, and that the permit be extended for one year only. Motion carried. e ~ 9/28/70 - 2 - ""11II . 038 9/28/70 :j .~ II I :1 III. Petition, Sewer ~nstruction - Acacia Avenue from Tabor Street 800 feet east, was recommended ~! for approval by staff. Staff recommended that Lots 21, 22, 23 and 25 should also be included at this time. This would lower the percentage of the petition, but would avoid future tearing up of two lots. :1 Mr. McDonald moved seconded by Mrs. Hayward that the petition for sewer construction as listed above be given approval, and that Lots 21, 22, 23 and 25 be included. Motion carried. IV. Referral to Planning Commission - A letter was received from Lane Council of Governments seeking approval of Council and Planning Commission of the recently completed Eugene-Spring- field Interim Transportation Study, Central Lane Regional Parks Plan and Eugene-$pringfield i; Mass Transit Study. These should be transmitted to the Planning Commission for public hearing and recommendation. Mr. McDonald moved seconded by Mrs. Hayward that the City Council refer to the Planning Commission for hearing and recommendation the studies listed above. Millrace Culverts - The City Manager reported to the Cauncil a problem concerning a culvert in the millrace behind an apartment house an Garden Way, owned by Land Associates, Inc. A discussion with the awners resulted in an agreement to remave the small culverts which had created the problem, restaring the millrace to the candition in which it was several weeks ago. An alternative plan for parking will be submitted to the city for approval. ORDINANCES Cauncil Bill No. 9277 - Defining charitable solicitation; permits therefor; fees and certain prohibition. The City Attorney requested that this ordinance be held for amendment. The Council agreed.
