Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by His
Honor Mayor Lester E. Anderson at 7;30 p.m. on October 12, 1970 i~_the Council Chamber, with the
following councilmen present: McDonald, Teague, Purdy, Bear, Gribsk.0v, _Mohr, Williams. Mrs.
: Hayward was absent.
Minutes of the meeting held September 28, 1970 as mailed to Council members were approved.
Mayor Anderson extended a welcome to South Eugene High School classes who were in attendance
in the audience.
COMMITTEE REPORTS
e Meeting held September 30, 1970:
Present: Mayor Anderson; Councilmen Purdy, Hayward, Beal, Gribskov, Mohr and Williams;
City Manager and staff; and others.
1. Items from Mayor and Councilmen
A. Bicycle Riding Lanes in the City - Mrs. Hayward said she had attended the bicycle
I races held by the Parks Department, and in discussion with spectators and participants ~-
had felt a need for better and more convenient facilities for bicycle riders.
She suggested consideration could be given to curb cuts in sidewalks, removal of
parking on one side of certain streets, or reservation of certain streets for
bicycle traffic.
Mrs. Hayward moved seconded by Mrs. Beal that the staff examine and make rec-
ommendations for means to increased use and convenience for non-motorized
bicycles in the city, and come back with a plan for such provision.
The City Manager said he had no knowledge of what had been done to provide
for bicycle riders in other cities, and suggested that the staff return to
the Council with an outline of a plan.
Vote taken on motion as stated. Motion carried.
; Mr. McDonald moved seconded by Mr. Teague to approve Item IA of the Committee Report.
City Manager said he had received a great deal of encouragement from a number of people in the
community - both the very young and the very old - to proceed with this study as rapidly as
possible. He asked that consideration be given to traffic hazards by those riding, and asked
that they obey existing ordinances.
I Mayor Anderson suggested that traffic regulations be consolidated from the ordinances and written
in language easily understood by laymen.
Mr. George DeAngeloantonio, a University of Oregon student, said he had contacted the City Manager
regarding the great need for bicycle routes. He said there are 33,000 bicycles in Eugene, and he
felt these should be accommodated.
Vote taken on motion as stated. Motion carried.
e B. Rental Property, Raising of Standards - Mayor Anderson said he had become increas-
ingly concerned about the low standard of rental property in particular areas
of the City. He realized that some of these units provided housing for those
with exceedingly low incomes, but he felt a study should be done and some
provision made for inspection.
Mrs. Hayward moved seconded by Mr. Williams that the Council request the Joint
Housing Committee to examine possible standards and submit a recommendation.
Councilman Williams, member of the Joint Housing Committee, said he had been
concerned with this problem, and it had been discussed at great length by the
Committee, but they had not made any recommendations. It had been recognized
that an increase in standards would undoubtedly be accompanied by an increase
in costs, which would work a hardship on students and other low income persons.
I Mayor Anderson said he knew the Committee's concern, but felt the Council should:-
direct the Committee to make such a study.
Dr. Purdy suggested that all property be included. Mayor Anderson said the
Housing Committee had been working over this for a long time, but that inclusion
of all property was largely a legislative problem. The Joint Housing Committee
was working on such proposed legislation.
Councilwoman Ha~ard felt some effort should be made to control rents in apart~
e ments. She felt they were extremely high.

I' Mr. McDonald moved seconded by Mr. Teague to approve Item IB of the Committee report.

Councilwoman Beal requested the Joint Housing Committee to consider the amount of rents paid.
Councilman Williams explained problems in this regard, and said the Joint Housing Committee had
discussed this point. If this issue was considered, cost control and wage control would also have to
be considered. Mayor Anderson said his intention had been that the Joint Housing Committee be
given a free hand to look into the matter of raising rental housing standards.
Vote taken on motion as stated. Motion carried.
C. Legislative Program, Council - Councilman Mohr felt there were a number of things
the Council should study for proposal to the legislature. He suggested a study
meeting with the Planning Department, Housing Committee and others to outline
ideas. Mayor Anderson said that the League of Oregon Cities is developing a
package, and such a study session should be held as soon as possible after the
League meeting of October 10. e
Mr. M~onald moved seconded by Mr. Teague to receive and file Item ICof the Committee report.
Councilman Mohr requested a date be set for a Council study session relating to legislation. The
Manager said a format could be determined at the next committee meeting. Mayor Anderson felt the
Council should instruct its voting delegate as to its wishes.

D. Community Relations Position - City Manager introduced Captain Dick Jones of the
Fire Department who will be assuming the Community Relations position on a
temporary bas is. Mayor Anderson welcomed Mr. Jones and thanked M~. Rutledge, who
is leaving that position to act as administrative assistant to the Police Chief.
Mr. McDonald moved seconded by Mr. Teague to receive and file Item ID of the committee report. Motion
carried. !
II. Disorderly Conduct Ordinance - The City Attorney outlined points in the ordinance, and
said his office felt it was in form for final consideration.

The Council discussed various points with which they were concerned. Dr. Purdy moved
seconded by Mrs. Beal that a public hearing be set for consideration of the Disorderly
Conduct Ordinance. Motion carried.
Mr. McDonald moved seconded by Mr. Teague to set a public hearing ~or consideration of proposed
disorderly conduct ordinance for the Council meeting of October 26, 1970. Motion carried.'
City Manager reminded the Council of a November 9 meeting conflict with the League of Oregon
Cities meeting and suggested the Council might wish to schedule the November meetings for November 16
and November 30. It was the Council consensus that the meetings ~llould be scheduled for November
16 and November 30. I
III. Reconsideration of City Milk Inspection Service - A letter received from the Department of
Agriculture was circulated with the Agenda which gave an up to date summary of the
status of sale of raw milk in the Eugene area. The staff has attempted to obtain
additional information concerning raw milk; but has been unable to obtain any statistics.
Councilwoman Hayward had been concerned that the Council abolished local inspection
without public notice. She felt interested persons should have been given an oppor- e
; tunity to appear.
" Councilman Purdy suggested that staff contact other states which allow raw milk
,. production, and request information concerning matters such as certification, labeling,
etc. He did not feel the labeling now used in this area was sufficient.
Mayor Anderson felt it might be well to table this matter and then discuss possible
legislatillon to be developed and proposed,:to the legislature. If this proved unsuccesssful,
the Council could then work at the local level.

Mr. Williams moved seconded by Mrs. Hayward that the Council postpone action on the matter
of milk inspection and request staff to prepare information for a legislative program,
prior to the legislative session. If this is not successful, a public hearing will be
scheduled. Motion carried.
Mr. McDonald moved seconded by Mr. Teague approve Item III of the Committee report. I
Mr. Jerry Fogelson, 70 East 23rd, suggested the Council reconsider its action to eliminate city milk
inspection service. He did not feel sufficient consideration:,had been given to the matter or to
public opinion. He was concerned that milk now being sold in the city was not of good quality,
and felt people should be protedted.
Mayor Anderson exp}ained that the city was advocating legislation to make state inspection more
effective.

il Councilman Mohr asked Mr. Fogelson if the raw milk he had seen in stores had been labeled as raw milk.

" high. Mr. Mohr explained that the Council had been concerned that persons might buy raw milk unknow-
!: ingly if it was not properly labeled.

IV. Petition, Balboa Drag Strip - A petition was received which requested closure of Balboa
Drag Strip. Reasons given are excessive noise, smoke, dust and litter. It has long been
recotnized that operation of Balboa Drag Strip has been a problem to residents of the
area, but the advantages of having such an outlet have also been recognized. It is
suggested staff study and report on the problems and advantages of the operation.
The City Attorney said the city receives a multitude of complaints regarding the
e operation continuing after 10:00 p.m. This is the biggest problem with the drag strip.
:i Dr. Purdy was not sure this matter should come before the Council. He felt staff
could work with the operators to solve the problem. He felt the community needed
this type operation.
Mayor Anderson said the Council should acknowledge receipt of the petition.
I Mrs. Hayward moved seconded by Mr. Gribskov to acknowledge receipt of this petition,
and direct staff to bring back a report for further consideration. Motion carried.
Mr. McDonald moved seconded by Mr. Teague to approve Item IV of the Committee report.

Councilman McDonald said this item had been before the Council approximately one year ago. He felt
the problem was that the noise did not cease before 10:00 p.m., and felt perhaps staff investigation
il could solve the problems.

, V. Assessment Deferral - Two requests have been made for deferred assessment in the Crest
Heights area. The City is requesting easements for sewer construction and parts of both
properties qualify for deferral. Properties and assessment to be deferred are:
Roland W. Eberhardt, 949 Crest Drive - $4,981.35
Eugene Development Center, 2121 Franklin Boulevard - $8,051
Mrs. Hayward moved seconded by Mr. Gribskov to approve this request. Motion carried.
Mr. McDonald moved seconded by Mr. Teague to approve Item V of the Committee r~port. Rollcall vote.
I All councilmen present voting aye, the motion carried.
" VI. Oregon Municipal Policy Statement - The League of Oregon Cities has developed

guidelines to reflect a unified policy position of the cities of Oregon. The City
Council has been invited to discuss and submit suggestions for revision at the meeting
of November :l0.
Councilman Williams was concerned with a statement regarding jury trial in municipal
courts. He 'felt it might be well to leave the door open for other techniques. Mr.
Mohr was surprised at the policy statement, believing it did not reflect the ree-
I commendations of the Governor's committee on courts. The City Attorney was con-

e " cerned the municipal courts would be greatly overloaded with jury cases and would
I not be capable of handling them.
Councilman Mohr recommended a statement on court system to square with the recommen-
dation of the Governor's committee on court reform. The municipal court should be
" de-emphasized as a function of the city and should be phased out.
Personnel - Mr. Mohr did not think the League policy was in line with the city
policies and city legislation. Councilman Williams did,not think a higher authority
should tell cities what they should do. The City Manager saw no conflict between this
statement and the way the city of Eugene had proceeded. A system for cities is
provided, but they have a choice whether they wish to go this way.
Housing - Councilman Williams was concerned with the statement "the administration
should establish a realistic housing goal...." He felt there was absolutely no doubt
I about the need for public housing, and he could see no reason to lower the goals 'in
face 'of the need. Ci ty Manager suggested the wording be changed to Hmaintain."
Mayor Anderson said the policy is set up to inspire and encourage smaller communities
to provide for programs and efforts of their own. This is an educational document
for all municipalities. There will be an opportunity at the convention to speak on it.
There was a discussion regarding the role of the voting member of the City Council.
The consensus was that this issue couid be decided at the meeting.

Ii VII. National Municipal Policy Statement - Deadline for submission of amendments to this I
d statement is November 8, 1970. Council members were requested to come in and look
I' at the document and recommend changes.

I VIII. Request for Council Recognition - Mr. Pat Flynn, Firefighters Local 851 inquired whether
the Council intended to take up the firefighters request for consideration of
amending regulations on living within a proximity of the city of Eugene. City'
. ,.
Council informed Mr. Flynn that this was a matter for discussion with the adminis-
tration and should be presented as a request for consideration in the collective
bargaining process.
Mr. McDonald moved seconded by Mr. Teague to receive and file Items VI, VII and VIII of the Committee
report. Motion carried.

A" Resolution supporting State Board of Higher Education - Counclman Williams moved I'

seconded by Dr. Purdy that the Council go on record supporting the action of the
,I State Board of Higher Education in positing a $5,000 reward:'for information leading
I to the arrest and conviction of the individual who damaged a building on the Univ-
I' I
! ersity of Oregon campus.
Mr. Williams suggested the Council might explore a means to increase that reward, , ~
either through private or city funds.
Vote taken on motion as stated. Motion carried.
'I Councilman Williams said considering the number of incidents which have occurred
in this community, the City should look at its responsibility in this area.
Perhaps there are ordinances available for the apprehension of individuals
responsible for such acts. Preventative measures might be undertaken regarding
" unauthorized possession of explosives within the City. Perhaps a reward fund
"
could be established. Mr. Williams asked for a review of this matter by the
Manager and the City Attorney.

Councilwoman Hayward said she was in favor of this approach, rather than adding to ;1

Dr. Purdy suggested it should be made illegal to possess explosives, and suggested
an escalating reward with regard to the degree of the offense. Mayor Anderson
agreed and said there were three areas to be considered: the matter of unauthorized
possession f explosives; damage to property; and consideration of acts against I
, public buildings. The City has a responsibility to protect public buildings through

any means possible. "
Mrs. Hayward said people who are lawfully in possession of explosives are not
always careful with storage of them, and this is sometimes tempting to those "
looking for explosive material. Mrs. Beal agreed. 'I

The City Manager said there is some national legislation being considered regarding ,
I,
inter-state transportation of this type material. The Mayor has written Oregon e
congressmen supporting this legislation.

, B. Pollution control, Automobiles - Mrs. Beal asked for consideration of memorializing

Senator Muskie's bill regarding pollution control for automobiles. ; ~
Mrs. Beal moved seconded by Mrs. Hayward that she draft a resolution to be forwarded
to the Congressional delegation supporting maximum measures to alleviate the cause ;,
of auto pollution.
After discussion whether Senator Muskie's bill should be supported, or maximum
anti-pollution in general, a vote was taken on the motion as stated. Motion carried. I
Mr. Gribskov entered the meeting. I

Mrs. Beal commented that this itme should be filed, since the Congress has now passed the National "
Air Quality StandaRds Act.

C. Award, Hiring of Handicapped People - Mayor Anderson said he was pleased to present
a plaque on behalf of the Governor's office which had been awarded to the Eugene Hotel -
and its manager Art Fairchila, for willingness to hire handicapped people.

II. Brown Concession; Mall Plaza - At the July 27 Council meeting the Council approved the
concept of a small concession in the block on Broadway between Willamette and Olive.
A petition has been received from five businesses in the vicinity asking for recon-
sideration.
, Dr. Purdy suggested the Mall Activities Committee look into this matter. Mayor Ander-
son was unsure whether this was the type of thing that committee would be concerned
:: with. The committee will recommend guidelines for activities which the mall provides.

Mr. Dave Hunt, Eugene Renewal Agency, agreed with Mayor Anderson. He reminded the
A ~I Council that this matter had been before them in July because the contractor was about
~ to pour concrete, and it was necessary to install plumbing and conduit ,if such uses
were to be permitted. There has been no agreement with Mr. Brown whether or not he
will actually want his stand in this location.
" There was discussion whether or not Mr. Brown actually wanted to locate on this spot.
: When questioned, Mr. Brown said he was concerned how much the rent would be. Mr.
I Hunt explained that there were many factors to consider, and that the Council would
!, have to app~Qve any agreement. There are legal problems involved.
M~s. Hayward felt the question was really what Council policy would be concerning
location of businesses in the Mall. The City Attorney explained that there are legal
problems with location of businesses in City property, especially since abutting
businesses have objected.
Councilman Williams suggested the City Attorney continue research on this question,
i and in the event he finds the Council is not authorized to grant this permission, he
draft legislation to submit to the legislature which would give City's this right.
Mayor Anderson suggested that the Renewal Agency might take the responsibility to
get this matter through the legislature.

Mayor Anderson said no action would be taken on this petition until legal clarifi-
cation was obtained as to uses of the Mall by commercial operations.
" Mr. Hunt said the Renewal Agency could work out some agreement with Mr. Brown
concerning a lease, and would bring it to the Council for approval.
Mayor ffiderson suggested the petition be placed on file until a final determination
is made on the agreement.
III Dr. Purdy requested that ownership of abutting property be determined.
Mr. Gerald Fields, owner of the Little King Sandwich Shop, asked the City to consider
types of business and possible conflict. He pointed out that 25% of his business is
soft drinks and coffee, and that Mr. Brown sells the same thing.'
, Mayor Anderson said the matter will be brought back for further consideration when the
e " legal problems have been clarified.
Mr. McDonald moved seconded by Mr. Teague to receive and file Item II of the Committee report.

: III. Council Procedures, Report - Councilman McDonald said the Council subcommittee appointed
, by the Mayor had suggested agenda reorganization and a recommendation on procedure
for filling committee vacancies.
Mr. Williams said recommendations had been made regarding format of Council and
Committee agendas.
Mrs. Beal commented items from the Council and Mayor should still be included,
, unless they involve a presentation. It was agreed that this procedure would be
:: followed.
I Councilwoman Hayward said this report had clarified appointment procedures, but
she hoped it would not preclude appointment of Councilmen in the way the Council
had acted in filling the last vacancy on the Council. It was explained that
:1 this report did not set out hard and fast rules for council action, and that this
same policy could be followed if the Council wished to do so.
Dr. Pur9Y suggested an amendment to the Resolution setting out by-laws to incorporate
suggestions in the report. ' ,
4IJ There was discussion regarding expense allowances, and whether Councilmen should be.
allowed a set fee for expenses. It was felt some citizens were precluded from runnlng

for office because of the expense involved. Mayor Anderson suggested there should be I
a per diem for Councilmen. This would eliminate listing of expenses of Councilmen.
After further discussion, it was decided to try submission of expenses as set forth
in the report.
Dr. Purdy moved seconded by Mr. Williams that a resolution be prepared concerning Council

procedures and amendment to by-laws concerning appointment procedure. Motion carried. "
Councilman Teague inquired if the expense allowance procedure outlined in the report was not the same
as the Council is now using. Dr. Purdy explained that it is essentially the same, but Councilmen

will be issued vouchers for submission of their expenses, which will simplify the process~ "

IV. Recommendation to Purchase Drainage Ditch Easement, Marshall Street-Danebo - Muriel C.
Roberts has agreed to sell this easement for $3,120.00. i e

V. National League of Cities Meeting - Mayor Anderson said the League of Oregon Cities
has blocked off a group of rooms for Oregon delegatessat the National League of Cities
meeting, and asked who would attend. Mr. Gribskov and Mr. McDonald will probably attend.

VI. Bicycle Routes - The City Maneger said the University press had not been quite accurate
in reporting action at a previous meeting. The staff has been asked to form a committee :i
to prepare a format for development of a study as to what can be done about movement
of bicycles in the city.
Mr. McDonald moved seconded by Mr. Teague to receive and file Items V and VI of the Committee report.

A. On April 14 City Council authorized condemnation proceedings to be brought against Mr. an
Mrs. Claire B. Brodkorb. Defendant had property appraised and filed an answer requesting \:
damages in the amount of $1,900. City appraisal was $200. City Attorney was able to
negotiate a settlement of the claim for $650.00. He recommends settlement for this amount.

B. Deertz - Council authorized condemnation for
acquisition of easement property of Vesta Shaffner and the estate of Ma~garet H. Deertz. "
Defendan had an appraisal made and filed an answer setting forth damage in the amount of
$1500 plus $750 attorney's fees. City Appraisal was for $110.00 City Attorney was
able to negotiate settlement of the claim for $300. and recommends acquisition of the
easement for this amount.
Mr. McDonald moved seconded by Mr. Teague that the Council approve settlem~nt of acquisition
of easements as outlined above. Rollcall vote. All councilmen present voting aye, the e
motion was carried.

Council Bill No. 9266 - Levying assessments for paving alley between Mill Street and Ferry
I Street from 16th Avenue to 17th Avenue was submitted and read in full the first time on September
" 14, 1970 and was held over to this meeting to allow proper notice of assessment to be given owners
of affected properties and is brought back for consideration with one written protest on file.

" Manager read a letter from Marquita Bennett protesting assessment for paving of alley, saying this
"
did not improve her property, and could in no way be used by her.
"
I The City Manager explained that 65% of the property owners had petitioned for this improvement, and
that all abutting property benefitted, even though the improvement could not be used by the owner
until a later date.
Mrs. Beal was concerned that apartment owners are able to have such improvements put in at the
I , expense of homeowners who do not benefit from the improvement.

Mr. Glen Gossler, 460 East 16th, felt this assessment was excessive, and was of benefit only to the
apartment owners. He also complained of the manner in which the paving had been done, and that his
property had not been left in good condition. Manager said the staff would check on the clean-up ~ -
on Mr. Gossler's property.

I The City Council discussed possible changes in assessment procedure regarding alleys, and what
e I! they would consider as sufficient number of petitioners to proceed with an improvement. It was felt
some attempt should be made to assess alleys more equitably when a large percentage of owners were
I apartment houses.

~ I Mr. Dean Owen, 1625 Elanco Lane, said he was speaking as president of the Lane County Muscular Dystrophy
Association and was concerned with Section 7 of the proposed ordinance. He felt entertainment should b~
included in the 20% allowed for expenses, and felt the section could be better drawn.
!' With regard to telephone solicitation, he felt provision should be made for requirement of personal "
contact following this type solicitation.
Mayor Anderson explained that a public hearing had been held at a previous meeting on this ordinance,
and that the matter of entertainment expense had been discussed at that time. He explained to Mr.
Owen that the proposed ordinance was new, and could be amended if it was found that portions were not
" satisfactory.

Councilman Teague suggested that the Council might work toward State legislation of this type activity., I
