'Adjiourned meeting of the Common Council of the city of Eugene, Oregon was called to order by His
Honor Mayor Lester E. Anderson at 7:30 p.m. on October 26, 1970 in the Council Chamber with the
following Councilmen present: Messrs. McDonald and Teague; Mrs. Hayward and Mrs. Beal; Messrs.
Gribskov, Mohr and Williams. Dr. Purdy was absent at the beginning of the meeting.
Mayor Anderson recognized and welcomed a class from Roosevelt Junior High attending the Council
meeting.
International Cooperation Committee - Mr. Kim Kimmerling, chairman of the International Cooperation
Committee, commented on the week-long observance of the United Nations Anniversary, and told of the
interesting programs which had been available to the public in the city during a three-day UN
Festival.
Mayor Anderson presented Mr. Kimmerling with a distinguished service certificate from the UN in recog-: e
nrtion of his work in making the UN Anniversary a success.
Minutes of themeeting held October 12, 1970, as mailed to Council members, were approved.
1. PUBLIC HEARINGS
A. Disorderly Conduct Ordinance - Copies -of the proposed disorderly conduct ordinance were I
previously distributed to Councilmen. It has been carefully reviewed, and the staff
recommends adoption.
Councilman Williams questioned sections six and seven regarding a lawful order by police to
disperse. Assistant City Attorney Allen explained that there are only certain occasions
where an order to disper.se may be considered lawful. The circumstances of the gathering
govern this.
Councilman Mohr felt the question of whether or not the activity was protected would not
arise until after the building was cleared. The burden was not on the police officer.
Mr. Allen explained that if what the people are doing is lawful, the order would then be
unlawful.
Mr. Mohr was concerned that the order to disperse might be misunderst0od, or perhaps not
even heard by some of the persons, and that some provision should be made to make the
notice clearly understood.
Council action taken on C.B. '9279 ,:Relating to disorderly conduct and obscenity and profanity
and establishing penalties for violation (Ordinance No. 16084 ) may be read on page
16 of these minutes.

I. State Street Area, Water User Charge - City Manager read a letter fpom Wanda Miller,
representing the Citizens Advisory Committee, requesting a variance from a $60.00 water
user charge. Cnar.ges levied in connection with sewer assessment and water meter were
I cited, and they said this added charge wouldbbe an unfair purden.
City Manager said the staff believed this charge to be justified, but that various means
had been investigated to attempt to ease this burden for the residents of the State
Street area. It is recommended that the charge be collected with the regular water
user bills over a period of thirty months, by increasing the monthly charge to $4.00
per month for that period of time.
e John Porter, Planning Director, said his office had been working with Eugene Renewal
Agency to attempt to include this charge in low interest loans for those who are
eligible.
The City Manager outlined the basis of this charge, and that it is felt to be equitable.
City Council discussed reasons for the charge, revenue received and means for collection.
Further action will be taken at the regular meeting.
City Manager explained this request and reasons the city instigated the charge. ' He said the staff
had discussed the matter and concluded that the charge could be collected at the,fa-ee:ef $2.00 per .-.
month, which would ease the burden on the property owner. A memo was received from the Housing Expe~>,:~
diter which said the charge could be included in loans received by property owners.
Mrs. Wanda Miller, chairman of the State Street Advisory Committee, said they had not been previously
I notified of this ordinance. She outlined charges residents in the area have for improvements, and
that this added burden would work a hardship on those with fixed incomes.
Mr. Cecil McCranie, 2093 Minnesota, expressed the feeling of the residents that this charge was
unfair and placed andundue burden on them.
The City Manager reminded the Council that, after this area came into the city, the Council did not
proceed to install sewers in the area immediately because they were concerned about the financial
impact on the people in the area. It was only after extensive requests from the people in the area
e to proceed that word was given to go ahead with the project. There was no question that the area

: Councilwoma? Hayward said she had great sympathy for those having a difficult time making finances
stretch, but she explained that the Council had no alternative but to make this charge. They had
tried to soften the blow by allowing the payments to be made over a two-year period.

Mayor Anderson said he assumed the request for waiver would not be acknowledged at this time, since
there had been no Council motion. He commented that, in the long run, the residents of this area
would have a very fine neighborhood. !
II. Legislation, Housing Committee Recommendation (Minutes of meeting of October 14, 1970 )
City Manager outlined action taken by the Legislative Commit~ee of the League at a recent
meeting. He asked for Council feeling on a number of items discussed so that he could sub-
mit proposals for a future meeting. He discussed in detail a proposed joint financing
program which would levy a supplement to the state income tax to be distributed to
cities and counties. An increase in in gasoline tax and license fee, as well as a
cigarette tax increase, have been proposed to provide some new revenue for local govern- e
ments and to attempt to find a solution to property tax problems~
The committee discussed the possibility of requesting a constitutional amendment
which would tie the 6% limitation to the tax rate instead of the dollars levied.
They will continue to work on annexation legislation.

With regard to personnel, the Manager and Personnel Director had prepared a draft to I
improve the wording in the proposed Oregon Municipal Policy.
The Council will further discuss proposed legislation at its next Commitee of the Whole
meeting.
.(Minutes of meeting of October 21, 1970) - City Manager read a memorandum from the
National League of Cities regarding amendments to their by-laws, and requesting a
vote from the City Council prior to November 18, 1970. There will be additbnal in-
formation regarding this, at which time the Council may determine its stand.
City Manager reported that the Joint Housing Committee had, at the Council's dir-
ective, discussed legislation to relieve the effect on low income prop~rty owners of
improvements to maintain city standards, and a possible relief or delay in taxing
for these improvements.
Some suggested legislation has been received from Mrs. Niven, chairman of the Joint Housing Committee.
The Planning Commission took a position opposing Ballot Measure #11, which is the measure requl1il?ing
a vote of the people in an area before any zoning proceeds. The Council has been requested to con-
sider similar action.
Mrs. Niven outlined the recommendation of the Joint Housing Committee which would provide for state
codes, based on nationally recognized standards. They are asking for legislation to deal with
uniform codes.
The Housing Committee has advocated creation of a state revolving fund to provide temporary emergency I
financing to provide housing for needy families.

The Housing Committee has requested that the Council support legislation to provide relief from
taxes on residential improvements which are primarily for maintenance and repair.
The Joint Housing Committee recommends support of legislation to implement a state housing policy
to establish a revolving loan fund, and to create a' division of housing in the department of human
resources which would coordinate and render technical assistance to cities and counties on housing e
and low income family issues. A second recommendation proposes property tax deferment on improvements
required to meet code standards.
There was discussion regarding what would be allowed under legislation to provide relief from property
taxes. There was some confusion what would be allowed for owner occupied multiple family dwellings.
Mrs. Niven clarified this, and that the relief, once allowed, would remain with the dwelling if it
was sold.
Mr. McDonald moved seconded by Mr. Teague to make recommendations to the League of Oregon Cities,
as outlined by the Joint Housing Committee. Motion carried.
Mrs. Niven explained Ballot No. 11 and that the people should be informed how broad the consequences
of passage of this measure could be.
Mrs. Mary Briscoe read a statement of the League of Women Voters in opposition to this measure. I
Mr. McDonald moved seconded by Mr. Teague that the City Council go on record opposing Measure #11,
and that it urge like action by the entire electorage of the City.
Mrs. Hayward asked if it would be possible to call a press conference to advertise Council opposition
to this measure. This would give the full we~ght to the Council recommendation.
A vote was taken on the motion as, stated. Motion carried.

III. Zone Changes Recommended by Planning Commission at its meeting of October 6, 1970 :
A. West of City View and south of Amazon Canal - Johnson and Cooke
The, request was to change from RA to R-3 to allow apartment construction
under FHA-236 Program. The Commission approved recommendation of
change to R-2, subject to PUD procedures. Final reading of rezoning
should be held until PUD is approved.
The City Manager stated that, at the public hearing before the Planning
Commission, the applicants were willing to accept R-2 rather than the requested
R-3. There were no objections from neighbors to the R-2 zoning.
Councilman McDonald questioned ownership of the property, as well as '
whether or not sufficient room would be left for the. City's future
e arterial planning.
The City Manager indicated the City was not certain of ownership of
the property. He felt that the Planning Commission wouid not approve
this action if it did not meet future city plan requirements, since
development must follow PUD procedures.
I Councilman Williams pointed out that 13th Avenue stops at this area.
The proposal would elearly prevent ever extending this street. Public
Works Director indicated there is an application on file for vacation of
this street.
No action was taken.

B. Northeast corner Coburg Road and Tomahawk, George F. Dobson - Rezoning was requested
from R-l to R-2 to allow construction of deluxe apartments. The Commission
recommended R-2, subject to PUD procedures, with'a limit of eight units. If a
"site review" procedure is adopted as an amendment to the zoning ordinance before
construction begins, the applicant will be allowed to develop under "site review"
with a maximum of seven units.
City Manager read the Commission recommendation, and pointed out that Item
6 on the committee agenda might appiy to this property, but this item was'
removed at the request of the City Attorney's office for additional review.
The City Attorney pointed out that PUD has a limit of eight units, while
"site review" has a limit of seven units.
Councilman Williams indicated he lives in this area, and there has been
I little objection to the R-2 zoning. However, there was objection to the
R-3 request. Mr. Williams also questioned the traffic flow.
Bill Sugaya of the Planning Department indicated that the Traffic Engineer
had requested the exit not be on Coburg Road. Mr. Williams questioned
what would be done about Tomahawk Lane.
Public Works Director indicated that th~Dugh the PUD procedure curbing
e and sidewalks would be required. TQere was some discussion about right of way
of property owners, and loc~~ion of sidewalks and curbs to provide better
traffic handling.
No action taken on this item.

" IV. Sign District Boundary Change (Planning Commission, October 6, 1970 - Oakway Mall
from Integrated Neightborhood District to Highway Oriented District, except 100'
at the southerly end.

This includes all the area originally zoned commercial, and eliminates a
problem with auxiliary signs such as S. 6, H. Green Stamps.
I Councilman Williams questioned whether this covered Oakway Road or Coburg Road. City
Manager said both sides of Coburg would be Highway Oriented and both sides of Oakway
would be commercial.

Superintendent of Building explained ,it would include, such, incidental signs as
gasoline prmces at service s~ations, rates at parking lots, service entrance signs
for automotive industry, etc., and that they must meet ordinance criteria.

VI. Recommended Annexation ,Goodpasture Island Road and Delta Highway (Planning Commission,
October 12, 1970)(Moyer Theaters)
This is property owned by Paul W. and Sabina M. Halweg, consisting of 2.72 acres.
City Manager reminded the Council that the aanning Commission and Council action is
only a recommendation to the Boundary Commission. He commented that it had been determined
the sewage system would be adequate.

VII. Mall Dedication Steering committee~;(Co~~itt;~~meeting, October 21, 1970)
The Chamber of Commerce and Eugene 'Downtown Association have volunteered to provide an
ad hoc committee for Mall Dedication. Opening of the Mall is scheduled for February I
13, 1971, with a week of celebration.
" The general consensus was that the Mayor should appoint a Mall Dedication Steering
Committee at the regular meeting of October 26. An important factor to consider is that
the committee should have representation of the people of Eugene, as well as from the
Downtown Association and the Chamber of Commerce.
The Chamber of Commerce has an informal steering committee, as outlined in a memo circulated to the
Council, which has requested designation as a Mayor's ad hoc committee.
Mayor Anderson said, if the Council wished, he would authorize this committee to constitute a
Mall Dedication Committee, and authorize it to proceed with planning of opening ceremonies.
Mr. McDonald moved seconded by Mr. Teague to authorize the Mayor to appoint,the Chamber of Commerce
informal commit~ee as a Mall Dedication Steering Committee. Motion carried.
VIII. Zoning Ordinance Amendments re: S~te Review
The City Manager said the Planning Commission had acted at its noon meeting to approve an amendment
dealing with site review, and had recommended it for approval. He read the ordinance and said its
purpose was to provide alternatives to the requirements of PUD'procedure in those instances where
development posed special problems, but would not entail all the requirements of PUD.

Committee Items to be considered with one motion, unless individual discussionis
requested:
1. Manager, Chamber of Commerce - City Manager introduced Mr. Don Mason, new manager
of the Chamber of Commerce, and said the Chamber of Commerce and the City have
started to work together. ~
2. Conditional Use Permit, Foremost Systems ~ The Planning Commission denied the
request for conditional use to permit construction of multiple family 50-unit
development for Foremost Systems in an RA zone south'of'West 28th between Ingalls
Way and Adams Street. A public hearing should be set to hear this matteJ;'.
Mrs. Hayward moved seconded by Mr. Williams to call a public hearing on the above
matter for November 16, 1970. Motion carried.
3. Abatements, Recommended by Public Wo~ks Department -
a. Bridge over Amazon Creek at Quaker Street Extended - Public Works Depar~ment has
~~ been unable to obtain removal or repair of a bridge over Amazon Creek or to
determine the exact ownership of the bridge. It is in very,)1azardous condition,~
and should be abated. Since ownership has not been determined, it is recommended
that all interested property owners be notified.
b. Substandard Vacant Dwelling, 1067 West 5th - Public Works Department has been I. .
unable to obtain repair or removal of the above dwellin~; which has been
determined to be in a'dangerous condition. A petition from fifteen neighborhood -
residents has been received, requesting removal. It is requested a public hearing
be set on abatement of this dwelling.
Mr. Teague moved seconded by Mrs. Hayward that the Council authorize a public

;, 4. Petition, Sanitary Sewer - Petition was signed by owners of 100% of the property
I; located south of Jeppesen Acres Road and west of Medina Street for construction
of a sanitary sewer.

Dr. Purdy moved seconded by Mrs. Hayward to accept the petition. Motion carried.
I 5. Traffic Control, Autzen Stadium - The City Manager said a complaint had been received
about movement of traffic at Autzen Stadium after football games. If the facts
are as indicated, corrective action should be taken.

e Council members made several suggestions how this traffic problem could be handled.
, Director of Public Works said this is a state highway, and traffic must move in both

City Manager said the Police Department has been alerted, and an effort will be made
to see that this kind of incident is not permitted. ,-
I !: 6. National League of Cities, Suggested Resolution - A resolution, proposed by the city
I of North Las Vegas, to get parity for Councilmen at the National League of Cities
Convention, was previously circulated to Councilmen. After discussion, it was
moved by Mr. Williams, seconded by Mr. Teague that the Council representatives to
the National League of Cities Convention be 'instructed to encourage broad Council-
man participation in League activities, without supporting the specific Las Vegas
resolution. Motion carried.
7. Mayor Meeting, Liquor Control Commission - Mayor Anderson entered the meeting (October "
14) and said he had just returned from a meeting with the Oregon State L~uor Control
Commission. He felt progress had been made, and some positive steps may be taken to
I provide guidelines for the cities in approving licenses, and to instruct cities as

!' to what constitutes standards.
There was Council discussion about the Liquor Control Commission, how its meetings
i' are conducted, and what the basis is for approval or denial. Mayor Anders on
I, explained the legal problems attendant to rescinding of a license, and that once
a license is granted, the Commission had reservations about rescinding. They
are examining the possibility of a change in the statute.
8. Planning Commission Recommendation (September 28, 1970), Two Way Traffic, Lawrence Street
Planning Commission recommended traffic be resuored on Lawrence Street between 5th
and 6th Avenue to two-way. The Public Works Director stated that, since Washington
and Olive streets have closed, this would be a proper move. Planning Commission
I recommended approval.
9. Zone Changes Recommended (Planning Commission, October 6, 1970), Newly Annexed Areas:
a. Lindley Street and Bardell - Rezone to RA Suburban Residential District

e :j Traffic Flow, 11th and Garfield - Councilman McDonald indicated that he had had

several complaints during the past few days regarding traffic flow on West 11th
off Garfield, where a new store is located. He felt a three way stop at
11th and Garfield was dangerous.
Public Works Director indicated this had been discussed on the tour. He felt
the best solution to this problem would be completion of 10th Avenue west of Garfield.
Mr. Gribskov stated all of West 11th had problems.;.
ll. Distribution for Council Review - Ordinance incorporating 1970 Edition Uniform Plumbing
Code. The proposed ordinance establishes new fees, incorporates a Uniform Swimming
:1 Pool Code and the latest criteria for mobile home sewer and plumbing installations.
The City Manager~uggested a public hearing be scheduled on this ordinance for the
last meeting in November.
I A representative from the Plumber's Association indicated that, although they had not
had an association meeting, there ffid been no controversy, and no opposition to the
ordinance.
-12. 'fo.reclosure, Delinquent Assessments - The Manager said the Finance Depar:lDment had
started foreclosure proceedings on 385 delinquent assessments involving 302
pieces of property involving $119,734.47.

:1 Council Bill No. 9278 - Levying assessments for storm sewer within Prescott's Estates Subdivision,
was submitted and read in full the first time on September 28, 1970, held over to this meeting to
allow proper notice of assessment'to be given owners of affected properties, and brought back for
consideration with one written protest on file.
Ii Frank Prescott, 1855 East 28th, said he was Mrs.
Mr. Isabel Prescott's son, and asked to explain her
protest. He said they had asked to have a drainage problem alleviated, but did not feel they should
e be charged for this assessment, and'that'the sewer installation would not directly benefit the pro-
perty.
The Director of Public Works said installation of the storm sewer was required with the platting of
, the subdivision. The Department had been unable to reach agreement with Mrs. Prescott until some
i: corrections were made, but the agreement'was now' signed. There may be some other work required in
:! the future, but this cannot be determined until there is use for storm sewers in the future.
I !: Councilwoman Hayward asked if Mrs. Prescott had' a written guarantee the City would assume responsi-
,
:! bility for correction.

" The City Manager said this is general city policy on any storm sewer. If it is built by the City and
needs further attention, that is the responsibili ty.',-of the City. The City has to maintain the system.
