November 16, 1970
Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by Vice
President Charles Teague in the absence of Mayor Anderson and President McDonald - at 7:30 p.m. on
November 16, 1970 in the Council Chamber, with the following Gouncilmen present: Messrs. Teague
and Purdy; Mrs. Hayward and Mrs. Beal; Messrs. Gribskov, Mohr and Williams. Mr. McDonald was absent.
I. Public Hearing, Wayne Johnson Request - The City Manager explained that Foremost Systems has
filed an appeal to Planning Commission'-denial of conditional use permit for fifty dwelling units
for FHA 236 low to moderate income housing on property located south of West 28th between Ingals
Way and Adams Street. He read a letter from Mr. Wayne L. Johnson appealing the decision, and
stating that the denial was improper and invalid and that the Commission did not wish to encour-
age provision of- an adequate supply of housing for low income families by cooperation of the city
with potential sponsors.
e Mr. Wayne Johnson, 932 West 7th Avenue, said he was appealing this decision because he felt the
ordinance in itself was ineffective and weak. He had asked for denial or acceptance of a
conditional use application for an unknown, non-profit sponsor, rather than postponement. He
explained that he could apply under Planned Unit Development, but that there were advantages to
requestigg approval under a conditional use permit.
I Mr. Robert Terrell, 2988 Ingalls Way, said he represented residents in the area, and that they
wished to reaffirm objections voiced at the Planning Commission hearing.
Mr. C. S. Gregor, 2990 Ingalls Way, agreed with Mr. Terrell and with the staff recommendation.
He felt the lot was too small for fifty units.
Mr. John Porter, Planning Directer said the staff notes covered the basic points of the Plan-
ning Commission denial. Since Mr. Johnson did not want a postponement, the Commission could not,
at that time, take any other action.
Mrs. Betty Niven, Planning Commission member, outlined the basic differences between planned
unit development and conditional use permits. She said the Commission could not approve this
request at the time because there were so many things unresolved.
Mr. Johnson explianed that the development, under PUD would be too expensive for low income
hous ing. Under conditional use, the requirements for landscaping, for instance, would not be so
stringent.
Mrs. Niven pointed out that this site would have to be developed under PUD because it is not
suitable for subdivision. She said the reason for the conditional use provision is to allow
variation in density.
Dr. Purdy moved seconded by Mrs. Hayward that the Council uphold the Planning Commission rec-
I commendation and deny a conditional use permit for construction of fifty dwelling units on
property located south of West 28th between Ingalls Way and Adams Street. Motion carried.
II. Public Hearings, advertised for this meeting.
A. Vacation of Beech Street from 13th Avenue 134' south - This vacation has been requested by
the University of Oregon. At the present time, no agreement has been reached regarding an
exchange of properties, and the property will be vacated at no cost to the University.

e. B. Vacation of Easement, Third Addition Foothnis West - It has been determined that this
particular easement is no longer required. A new easement will be dedicated in exchange.
For Council action on this item see Ord. No. 16099, listed on page 12 of these minutes.
C. Abatement, substandard building located at 1067 West 5th - The Council has received a report
regarding the hazardous condition of this building. A petition has Been received by residents
of the neighborhood objecting to the building and asking for its removal.
Mr. Richard Collins, 3110 RGyal, said 'he :was speaking ,for his father, Patrick Collins, who
was ill. He said his father, the owner of the p~operty, had ordered it boarded up, in
compliance with Building Department instructions, and planned to repair it within the
next month or two to bring it up to standard.
I The City Manager said it is not the purpose of the city to force removal of buildings if
they could be rehabilitated. If the building can be brought up to standard in six weeks,
the Council could proceed with the abatement resolution, but make it affective January 16,
1971. If rehabilitation has not been achieved, the Council would not have to repeat the
hearing procedure.

!i A report from the Building Department was previously circulated to the Council outlining the hazardous:, I

i: condition of a bridge over the Amazon Creek south of 11th Avenue West and located at approximately
r
Quaker Street extended. Exact ownership of the bridge has not been determined. Council has inspected
the bridge and found it unsafe even for walking.
Mr. Henry White said his father had built this bridge, and that nothing had been done to it for some
time. He said property had been dedicated for public right of way, and that his father felt the
decking should be repaired so that it could be used again.
: City Manager said Public Works'Department had no record of a dedication and that this should be
investigated. If there is a right of way, the Council would have to decide whether the City should
repair the bridge or not.
" Councilwoman Hayward suggested that the Council delay action on the Resolution until the Council had
more information. There was general agreement to this suggestion.
The Resolution was held for further information. e

!; III. Request for Variance to permit mobile home for nightwatchman at 171 Lawrence Street ~
Minutes from committee meeting of November~4, 1970 - Mr. Henry Baker has requested a
variance to allow use of a mobile home on industrially zoned property for night watchman
or caretaker accommodations. Mr. Baker operates an auto body repair shop, and has
insufficient building space to house customer's cars. The Council has viewed the property
" and should call a public hearing, if it wishes to proceed.

Mr. Gribskov moved seconded by Mr. Williams to set a hearing on this matter for November
16, 1970. Motion carried.
A letter was read from Mr. Baker requesting permission to locate a structure on the site of his
auto body repair at 171 Lawrence Street. The area is industrially zoned, and permission may be
granted, with the stipulation that it be reviewed' annually as to the necessity for continued
nightwatchman or caretaker quarters.
Dr. Purdy moved seconded by Mrs. Hayward to adopt a Resolution permitting a variance for mobile
home on industrially zoned property at 171 Lawrence Street. (See page 13 of these minutes)
Motion carried unanimously.
IV'. Saturday Market Review - (Minutes of Committee meeting of November 4, 1970) - Mrs.
Lottie Streisinger told the Council that the Saturday Market has ironed out problems
which concerned businesses in the area, and that they wish to remain in the location
at the overpark. She requested the Council to extend permission through December 19,
which is one Saturday beyond that authorized by previous Council extension. Operations
will then be suspended until May, and in the interim a proposal will be presented to
the Council for consideration of future operation.
" Councilman Mohr said one of the prime Council concerns had been with regulation. He
, had been pleased with the regulations and standards set up by the market committee.

Dr. Purdy was concerned consideration had not been given to changing Jhe location,
and suggested again that City Hall should be considered as an ideal location. . Mrs.
" Streisinger said they had considered it, but that it was not centrally located, and
they would miss a great deal of drop-in business. She felt the market should not be
moved in the middle of the season.
Mrs. Beal moved seconaed by Mrs. Hayward to extend permission for the' Saturday Market
until Saturday, December 19. -
Councilman Williams suggested that a public hearing be held to enable those interested
in the market to discuss problems and questions which have come up during its
operation.
Councilmen and Mayor Anderson agreed that this was a good suggestion, but felt a
hearing should be separate from considerationoof an extension. Dr. Purdy requested
that a hearing be held before the end of December. Mayor Anderson suggested that,
after the question of the extension has been decided, the Council hold a hearing to
evaluate the market, and that the Saturday Market Committee prepare a presentation
for the Council btween December and Mai.
Vote taken on motion as stated. Motion carried.
Councilwoman Hayward requested the committee planning to present a proposal to the Council regarding
a future location for the market give consideration to the park blocks which are County-owned. I
She felt, since many of those selling at the Saturday Market are not city residents, the park blocks
would be suitable for this use.
Dr. Purdy moved seconded by Mrs. Hayward that Saturday Market permission be extended through Dec-
ember 19, 1970. Motion carried.

I V. Joint Housing Committee Report.- Mrs. Betty Niven, Chairman of the Joint Housing Committee,
:, reminaea~the Council of its annual goal of 450 units of housing for low income families. At
the pr~sent time a total of 157 living units have been added, leaving a deficiency for
1969-70 of 744 units. The Joint Housing Committee would like instructions from the Council to
meet with the HousingAuthority to determine whether they can agree on the most appropriate
method of applying to HUD to obtain this badly-needed housing. A Council Resolution requesting
housing should not be too restrictive.
Dr. Purdy asked Mrs. Niven if the motion could just request the Joint Housing Committee to
report to the Council on housing goals for 1971.
Councilman Williams said he had attended a meeting with HUD with Mrs. Niven, and that they had
suggested a request for housing not be tied to specific types. He urged the Council to get
solidly behind a commitment to try to provide 450 units per year, and request the Joint Housing
Committee to try to fulfill this need.
e Councilman Mohr expressed concern at the percentage of income many citizens were paying for
housing, and felt every effort should be made to develop a program to increase housing for
low income citizens.
Dr. Purdy moved seconded by Mrs. Hayward that the City Council recognize the deficiency of 7~4
units of low cost housing for the two-year period 1968-70 and request the Joint Housing Committee
to attempt to solve this deficiency. Motion carried.
I VI. Policy, Use of 13th Avenue, Kincaid to University, During Closure Period
Since 13th Avenue is actually closed to motor vehicle traffic, it seems1desirable to provide
a method of screening and approving requests for its use. The University has agreed that
permission for use will not be given without University approval. Therefore, the University
has developed a proposal which is recommended for adoption by the Council as a guide to be
used by the University administration in considering requests and granting permits, with the
condition that no selling of any nature may be permitted within the right of way. It is
,; recommended that the Council also delegate the administration to the President of the
,
University, subject to modification by the City Councilor City Manager.
City Manager said the temporary closure of 13th Avenue results in the street right of way being
available to the university for its use. The question has arisen between University administa-
tion and City administration concerning supervision to requests for use. Unless the request is
contrary to city ordinances, the University should assume administrative responsibility, and
this has been agreed to in principle. The ~uncil has received copies of a tentative agreement for
use of the ~ight of way. Staff recommends Council endorse the policy, with the exception of the
portion dealing with commercial activities, which would be contrary to existing city ordinances.
Dr. Purdy moved seconded by Mrs. Hayward to endorse the policy proposed by the University for use
of 13th Avenue right of way through the campus, with the exception of portions dealing with
commercial use. Motion carried.
VII. Council Consideration of Codification Adoption - Recodification of the City Code is reaching
I the point where Oouncml consideration is necessary. It is proposed that each chapter be
forwarded to the Council as it is ready and that it be considered and adopted. After all
nine chapters have been considered and adoption motions approved, the ordinance will be
presented for final adoption in the same manner as any other ordinance.
Copies of the chapter for codification dealing with traffic were circulated to the Council previously.
The fureau of Governmental Research has been preparing the proposed chapters in the new code and
;, rearranging them in a manner to make them more easily used.
e Councilman Mohr suggested that each councilman be given a chapter to study and report to the Council,
rather than attempt to thoroughly study the entire code. After discussion, it was agreed the
Council would discuss the chapter on traffic prior to the committee meeting, and at that time make
a decision whether to designate a chapter for each councilman.
VIII. The following items were considered with one motion. Minutes of the committee report of
November 4 are quoted in instances where items were discussed at that meeting.
a. Minutes of the meeting of October 26, 1970, as mailed to Councilmen, were approved.
b. Introductions - Mayor Anderson introduced Councilwoman-elect Beth Campbell and
welcomed her to the Council.
City Manager introduced Keith Martin, who will act as Assistant Manager. He was

I c. Leaf Removal - Councilman Mohr asked for a report on the City leaf removal program.
He felt people should be reminded that they cannot burn. He commented that he had
" heard an advertisement regarding the leaf mulching give-away program, and that he
, thought this was an excellent program.
d. Prisoners Missing in Southeast Asia - Mrs. Thomas Perry, Eugene-Springfield Coordin-
ator for the League of Families of American Prisoners and Missing.in Southeast Asia,
e explained that she had just returned from a National Convention, and that a new
program had been developed to try different communications. They had a letter

ii return of United States prisoners. She asked that the Council adopt a resolution I

I: which would be delivered to Paris.
Mayor Anderson s'aid he personally supported the program, 'and suggested the Council pre-
pare a resolutIon containing (1) declaration of a month of concern for prisoners' of war
in Vietnam; (2) Encouragement for participation of citizens of Eugene in a letter-writing
program; ( 3) Direction to the ~uncil to transmit its concern to authorities of Hanoi
to observe requirements of the Geneva Conference.
Mrs. Hayward moved seconded by Mr. Gribskov to direct the staff to prepare a resol-
ution as outlined abo~e.
Dr. Purdy requested that the names of those people from Lane County be inserted in
the resolution. (approve)
Vote taken on motion as stated. Motion carried.
Mr. Allen Hanger, 380 Bush, suggested that the Council add to its resolution a section urging the e
, United States to comply with the 8 heva Conference and conditions formally declaring war, and urging
immediate withdrawal of troups.
Councilman Mohr pointed out that the Council was preparing a specific resolution dealing with a
specific point, and that the Council did not support generalized resolutions.
e. Motor Vehicle Visible Emissions Ordinance - Copies of the proposed ordinance were dis- I
tributed to Council members previously. The administration felt the Council should be
aware that enforcement of this ordinance would be difficult, and that the success of
the program is probably more dependent on publicity and voluntary compliance, than on
police action.
Councilwoman Beal commented that it would not be necessary for police to use the com-
parison chart in connection with emission from passenger cars, but that this applied
onlY,to diesel trucks.
Councilwoman Hayward was, concerned that assistance should be given to those on low
incomes, who would be the most apt to be in violation, since they could not afford
more modern vehicles. Mrs. B al assured her this had been considered, but that safety
was in important factor too. It was hoped an educational program could be worked out.
Mayor Anderson pointed out that these and other factors could be considered at the public
hearing. He suggested it be set for November 30, which would give the staff an oppor-
tunity to prepare material.
Mrs. Hayward moved seconded by Mr. Mohr to set a public hearing for consideration of the
Vehicle Emissions Ordinance. Motion carried. ( approve).

" f. Deferred Sewer Assessments - On March 7, 1968 the City Council authorized a two-year
deferment of sanitary sewer assessment to Terry J. Mathews, R. D. McKendrick and Eva I
C. Celorie. This was to give the city an opportunity to determine if the public could
benefit by acquisition of these lands. The parties concerned do not wish to dedicate
the land to the city of' Eugene, and since the original deferment was on a "no-benefit"
basis, thecondi tions have not changed. It is the staff recommendation that the defer-
ment be continued so that any possible future claim will not be invalidated.
Mr. Gribskov moved seconded by Mrs. Hayward to approve continuation of a deferred
assessment on properties owned by Terry J. Matthews, R. D. McKendrick and Eva C. Celorie.

g. Eugene Renewal Agency Appointment - Eugene Renewal Agency has reuqested the Council
to fill a vacancy created by the resignation of Charles Duncan. Under new. procedures,
the Council will provide tW0 weeks for names of nominees to be submitted, and will
then hold an informal meeting to make its selection.
Councilwoman Hayward suggested that the names should be submitted in writing.

i. Electrical Ordinance Amendment - This ordinance will implement Counil instructions to
J: establish a sticker which will inform home buyers that the electrical installation is
installed to minimum standards, if such is the case. It will provide a double fee for
" failure to secure permits before work starts.

j. By-Law Amendment, National League of Cities - A request has been made to enlarge
the NLC Board and change its name, as proposed by by-law amendments previously
circulated to Council. Since the Council has taken no action, the city will not
submit a ballot. ( file)
k. Purchase of Property for Airport Zone - Acquisition of lane needed for airport
clear zone was provided for by a bond issue vded by the people. The matter has
been in negotiation for over a year and there is a condemnation proceeding in
process. The recommended settlement is $1,192 per acre.
C. w. and 'Thea M. Kqkkeler, owners of th~ property, have agreed to settle for $31,000.

*Mr. . Oliver Wyman, 2281 Wisconsin, said he had not been notified of this assessment and had no
i, knowledge of it until he had received the assessment on one lot. He complained that the contractor
had torn up his lot and left a large lake of water which had not been corrected six months later.
He had finally corrected the problem himself.
City Manager explained that county records~are used for notification, and that when property is pur-
chased on contract which is not recorded, the original owner is notified. This happened in Mr.
Wyman's case.
Public Works Director said the contractor is nob allowed to trespass, and that his office should have
been notified of the problem. His office will investigate the matter to see why the contractor did
not repair the damages.

Resolution No. 1878 - Transmitting to Planning Commission amendments to zoning ordinance
for change of zone and calling public hearing for December 1, 1970 was submitted and read in full.
Dr. Purdy moved seconded by Mrs. Hayward that the resolution be adopted. Motion carried unanimously.
Resolution No. 1879 - Initiating minor boundary change for annexation to the city of Eugene
and withdrawal from Zumwalt Fire District and referring to Boundary Commission of Lane County
(Lawrence David Compan y)was submiued and read in full.
Dr. Purdy moved seconded by Mrs. Hayward that the Resolution be adopted. Motion carried unanimously.
Resolution No. 1880 - Abatement of substandard building located at 1067 West 5th Avenue
(Collins) to be effective sixty days from date of adoption unless brought up to city code, was
e submitted and read in full.
