Adjourned meeting of the Common Council of the city of Eugene, Oregon was called to order by His Honor
Mayor Lester E. Anderson at 7:30 p.m. on November 30, 1970 in the Council Chamber, with the following
Councilmen present: Messrs. McDonald, Teague and Purdy; Mrs. Hayward and Mrs. Beal; Messrs. Gribskov
and Mohr. Mr. Williams was absent.
I. Public Hearing, Uniform Plumbing Code - The proposed ordinance has been endorsed by the city of
Eugene Plumbing Advisory Board and the Builder's Association recommends addotpion of a uniform
plumbing code. The ordinance would increase sewer connection fee from $1.00 to $5.00; include
uniform swimming pool code; regulations for mobile home park sewer and plumbing installations.
Council Bill 9301, regulating plumbing and drainage systems and inspection thereof; providing
for issuance of permits and collection of fees; providing penalties and declaring an emergency
was submitted and read in full. Upon proper readings the bill was passed and numbered 16104.
Formal action may be read on page 16 of these minutes. e
II. Public Hearing, Motor Vehicle Visible Emissions - The ordinance sets standards by comparison
with an opacity chart (attached to ordinance), and provides fifteen days for correction of
violation.
Mrs. Mary Briscoe, President, League of Women Voters, spoke in favor of this ordinance, and said.
it strengthened the action of the EQC by officially recognizing the importance of automobile I
pollution. The League recommended that funds be allocated for enforcement, recognized that this
improvement in environmental quality would mean economic hardship, but suggested concrete alterna~i

tives be promoted.
Mrs. Margaret Weller, 788 East 11th, felt penalties were not enough and that money should be
allocated for enforcement.

Mr. Charles Potterf, 2685 Floral Hill, said he was not speaking for or against the ordinance, but
felt the worst auto pollutants were those not visible.
Pete Boone, 2053 City View, suggested that car pooling would not be the answer, since the offend-
ing cars would still be used in the pool.
Councilwoman Hayward thanked those speaking and agreed that there were problems not covered by
the ordinance. She explained that the ordinance was just a beginning.

, Mr. John Gribskov, 1230 Ferry, read a statement prepared by the Councii of the poor, saying
visible emission might well be one of the less dangerous pollutants, and opposing this ordinance
as a solution to the problem. His group felt enforcement of the ordinance would work a hardship
on them, since their older cars were some of the worst offenders. He requested that the city:
1. Fund cooperative garages to enable poor people to repair their own cars; 2. Recommend to
the Governor that two representatives of the State-wide Council of the Poor be included on the
Environmen'tal Quality Commission; 3. Actively push the state legislature to institute a new
car profits tax which would be used to fund repair of autos with visible emissions and pay for I
suits against auto and oil corporations who violate anti-pollution statutes; and 4. Ban sale
of new cars having internal combustion engines which are not 90% efficient by 1975 and actively
lobby for the State Legislature to enact a similar measure.

Mr. Kenneth Bylund, 1110 West 27th, said the Council was coming down hard on those who could not
afford to fix their cars., He felt the law should be on a county-wide basis, and that more exper-
tise was needed before it was enacted.
Jan Jarvis, 416 Jefferson, felt the bill was only appeasement and would allow the real polluntants ~
to escape notice. She felt the large corporations were the worst offenders, and that this was
a disriminatory bill.
John Wyatt, 2322 Augusta, said as much pollution comes from people smoking cigarettes, as from
cars and mills.
Councilwoman Beal explained the bill, and that it would adopt state law alreaq,i_~~n effect. The
bill does not provide for appropriation of money by the city nor indicate that the question
should be referred to the budget committee. Enforcement would be part of police department
routine, and a requirement for additional officers is not foreseen.

I Councilwoman Hayward pointed out that the Council had expressed concern the ordinance might
~, discriminate against low income people, and had talked about the possibility of giving assistance
in some form.
Councilman Mohr said it seemed the argument that the ordinance affected those least able to pay III
was heard whenever proposals were made to enforce pollution controls. Mr. Mohr did feel that -
some data was lacking, and that the Council had not taken a long enough look at the ordinance'.
Mr., Ron Householder, Department of Environmental Quality, pointed out that this was now state
law, and that many hearings had been held before the law had been passed, and that this law
may be enforced by cities and counties.

II atmosphere. He agreed there were invisible pollutants, but said this was certainly a beginning. Ii

: Mr. McDonald moved seconded by Mr. Teague that the bill be read the second time by council bill
II number only with unanimous consent of the Council. Mr. Mohr voted no, so the bill was held to
the meeting of December 14 for the third reading.
III. Public Hearing - Amendments to Electrical Code - This ordinance provides for mandatory wiring
capacity informational sticker on breaker panel and provides for double fee for electrical
permit issued after work has started.
Council Bill No. 9303 - amending electrical code providing for final inspection and approval
of service and amending permit fees, was submitted and read in full.

number only, with unanimous consent of the Council.

The informational sticker will inform buyers that the service in the building 1s designed to ;1
serve equipment installed when built. This is in compliance with 'Council instructions when the ,I
electrical ordinance was adopted.
I Councilman McDonald questioned whether the homeowner had any guarantee his house would be pro-
tected. Councilwoman Hayward suggested this could become another amendment to the Code. If
there are shortcomings to the electrical code, it should be examined.
In reply to Dr. Purdy's suggestion that the sticker could outline how far in excess of present
load the owner could go, the Manager said wording on the sticker is intended to alert the
'i buyer, but does not give any specific information regarding capac1ty. I

:: IV. Traffic Control - 24th and Agate - Minutes of Committee meeting 'of November 18, 1970. ~': ,;

i: II. Traffic, 24th and Agate - After a change from a two-way stop to a three-way stop with
I' free right turn southbound on Agate to West on 24th at this intersection, a petition
, was received from residents of the neighborhood requesting a re-evaluation of the
change. The petitioners maintained that the present method is extremely hazardous for
pedestrians, and were concerned because a great number of school children use the inter-
section.
'i Copies of the Traffic Engineer's report were previously circulated to Councilmen.
I ;: After a re-evaluation, his findings did not support the 'position of the petitioners, "
and his recommendation was to not change the patter of the intersection at the
present time. If the Council did wish to make a change, he recommended that they 'I
change it back to the two-way stop. He suggested that the intersection be signal- I
ized as soon as funds were available.,

it had 500 additional names. She agreed that the present system did a good job of

~ facilitating traffic, but said it was an extreme hazard to pedestrians, and she

Mrs. Beth Campbell, councilwoman-elect, said Mr. and Mrs. Disney and Mr. Eaton Conant ;:
had spoken to her prior to the meeting about the hazards of the intersection, but
they had been unable to remain until the meeting began, since it had been late starting.

In answer to Mrs. Beal, the ~affic Engineer said he had spent an hour and a
half wi th Mrs. Kemmler and Mrs. Alltucker showing them video tape and discussing,
!i the problems wi th the intersection. He explained that prior -to the change there :;

! ~ on record 100 signatures from members. He wished to emphasize the point that pre-schoolers "

Ii Mr. Ed Eisom, driver for Mother Cookie Company, said he had been driving that intersection

!I more than ten years, and that he felt traffic flow was a lot heavier now. He agreed that a

four-way stop would improve safety and facillitate pedestrian crossing.
Mr.. Jerry Burke, Laurelwood Lane was surprised there had been only two accidents in ,the last two
months. He requested a four way stop and that cross walks be designated.
Mr. Robert Leeper, 2760 Agate, 'said he had been driving this street for 33 years, and that it
had been difficult to adjust to the change. He suggested that any change in the pattern be e
marked in the street, in addition to installation of signs.
Traffic Engineer explained that the change was made to improve traffic movement. He said this
is a unique intersection because of topography. He explained the pedestrian problems, and
that school children are in the habit of crossing 'at points other than the intersection. With
regard to marked crosswalks, he explained the department hesitancey to mark crosswalks, because
most pedestrians then have a false sense of security. He explained the criteria for four way I
stops, and that the volume at this intersection did not nearly approach this cri teria,~, When a
four way stop is initiated at such an intersection, it creates a policing problem.
Patricia Helmers, 2720 Central Boulevard, said she has four children who say they do not have
as much trouble as they did before the pattern was changed.
Mr. Henry Dizney, 2530 Fairmount Boulevard, said it would be interesting to try the four way stop.
Councilman Gribskov said the primary purpose of streets is to move traffic; and asked the
Traffic Engineer whether a four way stop would impede movement of traffic. Traffic Engineer
pointed out that with a four way stop, vehicles would remain at the intersection for a longer
period of time than with the stop pattern there now.
Councilwoman Beal was very impressed with the study prepared by the Traffic Engineer, but felt
when it came to small children and their parents concerns the Council had to look at the matter
differently.
The Traffic Engineer recommended that, rather than approving a four way stop, the original two
way stop be returned.
The City Manager outlined the problem had, and said that, even though the Traffic Engineer did
not feel a four way stop was justified, the large majority of the people in the neighborhood r!

were very concerned about the problem and had requested this solution. He suggested the Council ~ !
return the signing to its original arrangement. :i I

Councilwoman Hayward agreed that Council action was difficult, and moved seconded by Gribskov ,i
that the Council consider changing the existing traffic pattern at 24th and Agate to revert to 'i

a two way stop and re;t.ain parking restrictions adopted since the new traffic pattern went into il

effect. "

Mr. Alltucker suggested that a four way stop would be safer, and said this was what his group il
had requested. He could see no reason to apply a blanket rule when this intersection was con- e

sidered unique. :!

Vote taken on motion. Councilmen Beal, Mohr and Hayward voted in favor; Councilmen Purdy, :,

Teague, McDonald and Gribskov were opposed. The motion failed.
Mr. McDonald moved seconded by Mr. Teague to install a four way stop at 24th and Agate with
marked pedestrian cross walks.
The Traffic Engineer reminded the Council that there was a marked difference in the degree of
pedestrian safety with marked crosswalks, and urged the Council to delete this portion of the
motion.
Councilwoman Hayward agreed with this theory. She felt the Council had an obligation to see
if it could provide a safer intersection.

Mrs. Betty Niven, Planning Commission member, explained that this amendment did not represent
a change in the way the Planning Commission had been operating in interpreting the Planned
Unit Development ordinance, but that, in connection with an item before the Commission last
spring, the Assistant City Attorney had indicated that the ordinance was not clear unless
the entire ordinance was read. He suggested an amendment to remove ambiguity. She pointed
e out that this amendment had nothing to do specifically with low income housing.
Mr. Otto Vonderheit, attorney, said he had been retained by a group of people living in the

I area of 25th and Chambers, the location of an application for low rent housing which will
be bBfore the Planning Commission December 1. He felt this amendment was definitely tied
to the low cost housing request. He protested that the Planning Commission had not heard
this amendment when it was originally before them, and that they had not been properly
I notified when it would be heard. He asked that the Council at least hold over action on the
bill so that the public could be ~are and have an opportunity to present additional
information.
Mr. David Gordon, 1895 West 25th, said the proposal was misleading, and that, rather than
resolving ambiguities, it may create more, and that the ordinance is adequate the way it
is. He requested that the emergency clause be removed, if the Council wished to pass the
ordinance.
Mr. George Hemphill, Jr., 1750 West 24th, asked what would be accomplished by the amendment.
j, He felt the scope would be entirely too broad. He felt too much land was being developed
into parking.
Mrs. Niven explained the Planned Unit Development and its requirements, and that there were
no outright uses in PUD. It was all subject to review. The amendment was proposed to get
the ordinance into clearer form.
Mr. Pierre Van Rysselberghe, 877 Willamette, said it had been suggested there was a conspir-
acy to make special legislation, but he felt this was not the case. He 'Said this applica-
tion had been filed before this amendment was proposed, and as far as it was concerned the
ordinance was adequate. He also outlined notification, and that it had been sufficient.
The City Manager explained the addition of the emergency clause on an ordinance to Council-
man Mohr, and that routine ordinances do not actually take effect until thirty days after
I passage by the Council and signing by the Mayor.
The City Attorney read the section pertaining to the emergency clause to the Council, and
explained that they should weigh the facts to determine if an emergency was in fact present.
I Councilwoman Hayward agreed that it would be a mistake to make a decision on the need for
, this amendment on the basis of feeling concerning the project proposed for 25th and Chambers.
This project will come before the Council for decision at a later time.
e Mr. Gribskov was not convinced the emergency clause was necessary or that an emergency existed.
Mr. Teague agreed, and suggested the ordinance not go into effect for thirty days.
Councilw0man Hayward was concerned that the Council, by taking this action on the amendment,
would actually be making a decision on the proposed project without actually ever discussing
it.
After further discussion regarding the effect of postponing action on the ordinance, Dr.
Purdy moved seconded by Mrs. Hayward to amend the motion to remove the emergency clause.
Motion carried.

A vote was taken for second reading of the ordinance by unanimous consent of the Council.
Councilmen Purdy, Hayward, Beal, Mohr and Gribskov voted in favor. Councilmen McDonald and
Teague voted no. Further action on the ordinance will take place at the meeting of December
I 14.
VI. Zone Change Recommendations:
1. Zone Changes Recommended (Planning Commission meeting of November 4, 1970)
a. State Finance Co. (Minutes of November 25, 1970)
South and east of Willakenzie Road, west of Goburg Road and north of Cal Young
Road; C-2 to R-2 PD - Construction of a Planned Unit Development consisting of
484 living units plus support building and service commercial buildings is pro-
posed on 16.25 acres of land located south and east of Willakenzie Road, west

and the amenities will be included in the first phase.
Councilman Williams objected to construction of a large number of units::,in that area
at the present time, becuase of the traffic problem at the ,Ferry Street Bridge.
The City Manager said this 'particular project will affect onlya.small portion of
the problem, because there is space' in the Willakenzie area.for many times that
number of people. There are no plans at the m0ment for improvement of. this
traffic facility.
The Public Works Director said' it would be difficult to.declare such a ,moratorium,
i and that it is' hoped . development .of the Washington~Jefferson' Str.ee.t.overpass will
! ease the traffic problem somewhat.
Mr. McDonald moved seconded by Mr. Teague that the Planning Commission.recommendation be approved. e
Motion carried.
b. Planning Commission Initiated - Area between 11th and 12th Avenues, .Chambers and
Hayes; R-l .to RG - Based on the General Plan, it appeared, to the Planning Comm-
ission that the property should be reclassified RG and that, where appropriate,
encouragement be gi ven for residential development and/0r rezoning to RG of the I
" C-2 property along the south side of 11th Avenue and west side'of Chambers Street
I' between 11th and 12th Avenues. No action taken.
Mr. McDonald moved seconded by Mr. Teague that the Planning Commission recommendation be approved.
Motion carried.
2. Zone Changes, Recommended Denial:
John Steinmuller, northwest corner 12th and Grant; R-l to R-3. Approval of the fore- :;
going item would cover this area, which makes the request moot.
Dr. Purdy moved seconded by Mr. Gribskov that the Planning Commission recommendation be upheld.
Motion carried. Mr. McDonald abstained because of a possible conflict of interest.
VII. Zoning of Newly Annexed Areas:
November 4, 1970 Planning Commission Recommendation:
a. North of Green Acres, west of Balboa to RA - This property is a thirty foot strip of
land at the extreme northerly portion of Mobile Parks West, which has been recently
annexed to the City. RA zoning is recommended.

Mr. McDonald moved seconded by Mr. Teague to approve the Planning Commission recommendation. Motion
carried.

Planning commission recommendation for zoning of property annexed by order of the
Boundary Commission.
In answer to Councilman Gribskov's concerns, the City Manager said recommendations
match, as closely as possible, the county zoning now in effect.
Mr. McDonald moved seconded by Mr. Teague to approve the Planning Commission recommendation. Motion
carried.

e The City Manager explained that, prior to Police Department approval of tavern licenses,
police activity for the year at the taverns in the city was reviewed. The four listed
above had considerably more calls than any others in the City. He outlined the reasons
for calls, and said the information was based on written, formal police officer reports,
and complaints filed in Municipal Court. To further determine a staff recommendation, a
meeting was held with members of the staff of the Oregon Liquor Control Commission. It
was concluded the records indicated lack of good management and use of the Police Depart-
ment for control. It was concluded the staff should recommend these licenses be trans-
mitted to the OLCC without recommendation, and the results of the study should be for-
warded to the Commission. If the Council felt a responsibility to make a recommendation,
staff suggested that the renewals be approved, but that a letter should be forwarded to
the Commi~sion indicating concern about the management of these outlets and the amount of
} police activity, and a request that the Liquor Control Commission and city staff keep

I Mayor Anderson said it was his feeling the state statute obligates the City Council to
make a recommendation, and that the Council should approve the renewals with a letter of
concern to the Commission indicating the activity taking place and a request for the
City and the Commission to keep a careful record of the activity of these establishments.
Councilman Mohr suggested that the Council institute a series of phhlic hearings to
try to develop a legislative policy concerning liquor control standards and their appli-
cation. Mayor Anderson said the League of Oregon Cities, is at the present time actually
e developing public hearings on this subject and working on proposed legislation to improve
the situation.

Commission.

b. Report, Bicycle Staff Committee - Mr. Ernest Drapela of the Parks and Recreation
Department reported on the progress of the staff committee and recommendations they
had made to the Council. A three phase approach has been proposed, and the first,
which is to collect data to develop a sound plan of action, is expected to be com-
pleted wi thin thirty days.
Councilwoman Bea~ asked whether the committee had considered requesting lay members e
to serve on the committee. The City Manager said Mr. Drapela is a member of a lay
bicycle organization, and that he was sure lay members would provide input into the
,I commi ttee .
" Mr. Dan Herber, architect, said the 1990 General Plan cites the relationship of

bicycles with the various transportation systems, and he was glad to see them "
being considered as a mode of transportation.

e d. Wai ver of Fee, Sorgenfri - A letter was received from Lutheran Laymen of Lane
County who are building a low rent housing project for the elderly. They
requested that the City waive a design fee of $973.73 for work done on Hawthorne
Street facilities by the Department of Public Works. This amount would not be
recoverable in mortgage proceeds. This precedent has not been followed in the past
because has not been received. At a previous meeting the Council did make an ex-
I ception on a suorm sewer assessment, and the amount calculated to be carried by
I' the City did not quite use up a one-year difference between the tax production of
the project and what it would produce if publicly owned. The Council could use
:' this as a guideline to comply with this request.
Councilwoman Beal could see no reason the.Council should not accede to this request.
She moved seconded by Mr. Gribskov to approve a wai ver of design fee for Lutheran
Laymen of Lane County.
Several members of the Council voiced the opinion every effort should be made to
encourage construction of 92 addi tional units of housing for low income elderly in
the city.

:' f. Traffic Code, Discussion - Previous to the Comrrd ttee meeting, the Council met to
,. discuss the traffic code chapter which is the first of nine chapters recodified
and presented for City Council consideration.
I Discussion ensued whether to continue to study recodification prior to comrrdttee
meetings. It was the consensus that more time would be needed and that some special
mee,tings should be scheduled for consideration of future chapters. It was proposed
to tentatively set Monday nights when the Council did not meet in regular session
for study of recodification chapters.
Councilman Williams requested that the code be set up in such a manner that amend-
ments qould be mailed to keep copies up to date. ( approve)
e g. Justice System of Local Government - Councilman Mohr presented a proposal for
initiating a model program for developing a justice system of local government.
The proposal suggested elimination of the city jail through increasing use of citations
in lieu of arrest, establishment of a regional detoxification center, abolishment of
criminal sanctions from the municipal code and establishment of regional correction
facilities which will combine both adult and juvenile programs managed by administrators
! rather than police. Councilman Mohr recommended that the Council form a subcomrrd ttee
to define action lines to achieve this goal, saying this would be another step
toward perfecting the system of justice in Eugene.
Mayor Anderson asked how this would relate to the criminal law comrrdttee. He fel t
a conflict might possibly occur.
Mr. Mohr agreed, but felt the subconmlittee would get direction from a report of
I the criminal law coRmrittee.
The City Attorney said this proposal was related to the entire problem of the
municipal court system and whether it should continue. He felt the only use the
city 1fB.de of the jail was to hold people for appearances in court.

concerning dates the cross on Skinner's Butte will be lighted. ( approve) ,
ci ty Manager explained the charter amendzrent, and that it mentions lighting during
I the "Christmas season," but does not set out any exact time. The staff recommen-
dation has been that it be lighted December 20 through December 28.
Councilmen discussed implications of lighting the cross, relation to seasons, and e
were about evenly divided on the question of whether it should be lighted for a '
period from Thanksgi ving to New Years, or for the shorter period of two weeks at
Christmas time.

k. Cooperative Low-Cost Laundromat - Councilman Mohr reminded the Council of a dis-
i: cussion in the past regarding a laundromat for low income persons, and that the
Council had taken a posi tion in favor of development of such a faci1i ty. He ex-
plained that a group has negotiated for use of a warehouse belonging to the
Highway Department, located near the Washington-Jefferson ramp, and has asked for an
indication of Council support.
City Attorney was concerned there might be a zoning problem with this location. !
Ci ty Manager suggested a letter could be drafted which was favorable to this idea,
after the zoning matter has been determined.
I Councilman McDonald was concerned the City might be obligated financially.

m. Vacation, East 21st Avenue, between Agate Street and Fairmount Boulevard - City Council e
referred this request to the Planning Comrrdssion September 14, 1970. Planning Com-
mission recommended denial, since this street relates to the intersection at 22nd
Avenue, and would create an added traffic load on that already dangerous intersection.
Mayor Anderson asked whether any consideration had been given to making this a
one-way street. Staff said none at this time.
Public Works Director said the Traffic Engineer had explained the problems with ;
the proposed vacation, and the inconveniences that would be caused to people
1 ving in the area.
Mr. McDonald moved seconded by Mrs. Bea1 to support the Planning comndssion denial

" n. Water Service Request, Virgil Baker - EWEB policy does not permi t providing water I
" service to property outside the city limits unless the area is within a water
district, or unless a health problem exists which can be improved by availability
of ci ty water. Mr. Baker proposes to develop multiple family units on Country
Club Road just west of the Eugene Country Club. It is recommended that the City
Council recommend to EWEB that an exception to their policy be considered for the
following reasons and under the following condi tions :
Reasons - 1. The area is not conti~ou~:~ to existing city boundaries
2. The area is zoned for the proposed use. e
3. The proposed use conforms to long range plans, and should, be encouraged.

Renewal Agency vacancy have been received and should be considered at an informal

the City Hall on December 2 to consider names submitted to fill a vacancy in Eugene
Renewal Agency and requested the list of names to be submitted to Councilmen prior
