BACKGROUND The City Charter, in Section 54, provides that the Toxics Board shall consist of seven members: three representing manufacturers required to report under the Toxics Right-to-Know Program, three with a record of advocating for the public’s right to know, and one who must be nominated by at least four of those six. This final position is Position 7 on the board. The term of office of the previous holder of Position 7 expired in October 2007. No applications for the position were received during the City’s normal recruiting process that year. Soon after, the Toxics Board directed a special recruitment process, with advertising in The Register-Guard and Eugene Weekly. Those advertisements attracted four applications for the position. After reviewing the applications, the board rejected one candidate, James Tarantino, who disclosed that he was working under contract for a business required to report under the Toxics Program. The board’s view was that this individual might encounter a conflict of interest as a member of the board, and the board also acknowledged the unlikelihood that the candidate would attract the four board votes required for nomination. The board interviewed the other three applicants – Stephen Flanagan, James Robertson, and Rex Stevens – on June 16, and voted 6:0 to nominate Mr. Flanagan for appointment to the board by the City Council. Mr. Flanagan’s application and supplemental questionnaire are attached. (For purposes of legibility, staff has taken the liberty of re-typing the handwritten submittal.) Decline to appoint the nominee and require the Toxics Board to continue recruitment and to nominate another individual. CITY MANAGER’S RECOMMENDATION The City Manager recommends Option 1, appoint the nominee. SUGGESTED MOTION Move to appoint Stephen Flanagan to Position 7 on the Eugene Toxics Board to a term expiring on October 31, 2010. ATTACHMENTS A. I currently work for the environmental toxicology department of UC Davis overseeing a USDA program that regulates pesticides in food crops. My scientific and regulatory background in toxic substances provides me with a unique understanding of the dangers and complexities involving toxic substances. 2. What specific contribution do you hope to make to the board or commission? Why do you want to become a member? I’m new to Eugene, love this town and think my skills and background are a good fit for this commission. NOTE: To allow a large number of citizens to serve on boards and commissions, the City Council policy allows individuals to serve on only one standing board or commission at a time. A current member of a board/commission who is a successful applicant for another board/commission will be required to choose between the two appointments. This policy does not apply to ad hoc committees or departmental committees or positions that are designated for members of specific advisory group ( e.g. the Human Rights Commission member assigned to the Police Commission). CITY COUNCIL POLICY REGARDING REAPPOINTMENT TO BOARDS AND COMMISSIONS 1. Members of city advisory groups may serve a maximum of two consecutive terms when the length of the term is three years or more. Individuals serving terms less than three years will be limited to a total of six consecutive years of service. 2. The deadline for applications from incumbents is the same as the deadline for new applications. 3. An individual may reapply for appointment to a board or commission after at least a one year hiatus from service. 4. City of Eugene employees may not serve on City of Eugene boards or commissions except as specifically provided by the City Code, or as required to perform official duties. If you choose to answer the questions on a separate sheet of paper, please remember to include your name. FOR ALL CANDIDATES: 1. Do you have any familiarity with federal, state, and/or local right-to-know laws? Please explain. Only in a general sense that these laws are intended to give communities clear information about potential hazards. 2. Please explain your understanding of Eugene’s right-to-know law. I’ve read the background on the City’s website and looked at who and what is reported. 3. How would you work to make decisions as a board member given that there may be persons on the board whose views are in direct opposition to yours? Do you have any experience doing this? Please explain. My primary approach would be examining issues from a technical, factual basis. I have served on volunteer boards in other settings and would work to find common ground on thorny issues. 4. Please describe your experience in the formation of or implementation of public policy and regulations. My professional life is governed by Federal EPA guidelines and state EPA guidelines throughout the U.S.; as such I’m very familiar with the implementation process, but not necessarily the formation process. 5. Why did you apply for the Toxics Board, and what do you hope to contribute? I think my unique background would serve the board as I have technical knowledge about toxics but am neither an industry representative or toxics advocate.
