Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by His Honor
Mayor Lester E. Anderson at 7:30 p.m. on December 14, 1970 in the Council Chamber with the following
I' councilmen present: Messrs. McDonald, Teague, Purdy; Mrs. Hayward and Mrs. Beal; Messrs. Gribskov,
Mohr and Williams.
I. Public Hearing, Ordinance regulating motor vehicle emissions, and providing penalties -

" At the previous Council meeting this Council bill failed to receive unanimous consent for
second reading, and was held over to this meeting for further consideration. Councilman
" Mohr explained that he had failed to give unanimous consent to second reading because there

~ i were some unanswered questions, and several problems which should be resolved. He had inves- '/

t~gated the possibility of Lane Human Resources assisting with repairs on cars which had visible
e emissions.
Mr. Ron Levinson, Director of Lane Human Resources, said they had made some investigation of
'I cars with visible emissions, and had concluded that the number of offending cars was small,
but that it had been found passage of this ordinance would work a hardship on low income people,
since they seemed to own the greatest percentage of ears with emission problems.

I Councilwoman Beal felt that there were always drawbacks in any pollution bill, and that a
price would have to be paid for clean air. She pointed out that the requirements of this
bill were already state law, and that the city was not discriminating against a small portion
of the population.
Mr. Everett McVicker, 130 Azalea Drive, said the problem was not caused only by cars owned
by poor people, but also from those extra cars owned by two-car families. He felt there
should be some legislation to insure that used cars functioned properly before being put on
the road.
Mrs. Marion Frank, 2000 Elk Drive, explained that this bill, by imitating the state law,
meant one more level of commitment for enforcement. She felt the city should press for
further legislation at the state level, especially for efficient mass transit.

I Councilman Williams agreed with Mrs. Frank, and said this was one of the very real reasons
for creation of a Mass Transit District.
Mayor Anderson concurred with Councilmen and said if the city was to maintain a leadership
role in the fight for preservation of the environment, it would have to take whatever
strong steps it could. He pointed out that this ordinance would be difficult to enforce,
and would present a real challenge to law enforcement authorities.
Council Bill No. 9302 - regulating motor vehicle visible emissions, was approved and
given final passage. For formal action see Page 13 of these minutes.
I II. Amending Zoning Ordinance, Public Hearing
Council Bill No. 9304 - Amend zoning ordinance Article 18, Section 18.06, permitted
buiilldings and uses, add new Number (f), areas of public and semi-public use, was submitted
and read in full the first time on November 30, 1970.
!' At the November Council meeting, this bill failed to receive unanimous consent for second
reading, and was held over to this meeting for further consideration.
e ,I Mr. David Gordon, 1895 West 25th, spoke in opposition to this amendment. He read sections
of the Planned Unit Development section of the zoning ordinance and suggested that it pro-
vided sufficient flexibility. It was rot intended to include all uses now allowed in the
parent zone. He proposed that the City zoning ordinance be left as it is.
Mr. George Hemphill, Jr., 1750 West 24th, felt the amendment would not clarify, but rather,
would be an out and out change and would cause more confusion.
Mr. Ralph Par~, 2275 McLean Boulevard, asked why an alternative site for the project at
25th and Chambers could not be accomplished by an exchange with Laurelwood. He pointed
II out the advantages to this site.
Mr. Vernon Gleaves felt adoption of the proposed amendment would cause confusion.
Wayne Lee, 4851 Herman Street, felt the amendment would give flexibility to the City Council
I in putting human values before property values.
Mrs. Betty Niven explained what semi-public and public buildings could do in a Planned Unit
Development and how open space could be gained by their use in a development.
Morven Thomas, president of the Planning Commission, pointed out that, when legislation is
found not to be usable, it should be changed. Apparently the Planning Commission did not
word the ordinance correctly, and it should be amended. Wtiat the amendment accomplishes is
what the Planning Commission intended in the first place.

,I In answer to Dr. Purdy, the City Attorney said the purpose of the amendment was to correct ambiguities
in the original ordinance. The amendment allows uses allowable in the parent zone, but they are :
all subject to review and control by the Planning Commission under PUD principles and programs. i
The public is adequately protected if this ordinance is adopted, because of the process in the PUD :,
program. :'

Councilman Mohr explained that the Planned Unit Development process is part of the zoning ordinance ~l
and that nothing is permitted by this process in itself.:
In answer to Councilman Teague, Mrs. Niven said this amendment was proposed in good faith. Since
the Planning Commission was challenged, .it had to make sure that there was no ambiguity in the
Ordinance, and if there was, it should be corrected.

III. Resolution, Application for 1500 Units Low Rent Housing - December 9, 1970* ,;

Mrs. Betty Niven, chairman of the Joint Hous~ng Committee, explained meetings
she and Mayor Anderson had recently attended with Lane County Housing Authority, and
:: that some misunderstanding had arisen regarding the Department of Housing and Urban I
jj Development instructions. At.a recent meeting Mr. Sam Lesher, Portland housing office, ,I
'. explained what was required by HUD, and what requests .andrecorrunendations could be'
il gi ven by the City Council to the Housing Authori ty. Mrs. Niven distributed copies
I: of two Resolutions, and explained them to the Council. She said they should be read
ii as soon as possible, since HUD could soon recei ve financing for addi tional uni ts,
:i if Congress passes new legislation. It was at their direction that the request was
I: for 1500 units, rather than the previously requested 744. It has been found consider- :;
ably simpler to cut down on requested uni ts than to add them. ;1

Mrs. Niven asked to emphasize that there is no direct or implied criticism of the ,;
Pri vate sector, and that they have been doing everything. they can wi thin the limi ts,

I: Councilman Mohr was concerned about the stated policy regarding elderly housing. Mrs.
" Niven agreed with Mr. Mohr that some elderly persons preferred not to live in con-
gregate housing, but if this is the type housing the Authority prefers to build, the
other needs may be filled in by the private sector.
Mr. McDonald was concerned that too ,11, ttTe had been done nation-wide to solve the problems
of the elderly. He had just returned from a conference on elderly in Wasbi~gton, D. C.
and it appeared that not enough had been done.
I Mrs. Niven suggested that the Council could address a telegram to President Nixon
!i concerning housing for the elderly. I
,: Mr. Harley Lassen, 4462 Hawthorne, read a letter from the Home Builder's Association
stating that the Home Builders agreed that there was a critical need for housing for those -
of limited incomes, and supporting the Council action to obtain dwelling units. They
opposed existing policies and discriminatory actions of Lane County Housing Authority.
Mr. Lassen read a Resolution in which the Home Builders Association set forth guidelines to
the Housing Authority, and outlined reasons for an increase in privately-owned housing. 4It
The City Manager pointed out that the second Resolution proposed by the Council is directed
to the Housing Authority and speaks to these problems. The City has no authority over the ';
Housing Authority and can only make recommendations and indicate City Council desires.
" Mrs. Mary Briscoe, President, League of Women Voters, read a statement in support of the
I proposed resolutions, and asked to emphasize that the request was only intended to meet
the housing goals !hrough 1972. She felt approval of these resolutions was an essential
step in meeting the city's housing needs.
Mrs. Niven asked to correct the minutes of the committee meeting, and said the appropriation
she had spoken of might be passed within the next two weeks, and that funds would then be
available. She also corrected the suggested wording of correspondence to be directed to
President Nixon. ,:

Resolution' No. 1882, Authorizing and requesting Lane. County Housing Authori ty to submit I

, lution to Lane County Housing Authority, were submitted and read in full, and upon motion,

IV. Decision concerning animals at Skinner's Butte Park - December 9, 1970 :i
Since park facilities for animal exl1ibi ts are minimal, staff has.inquired.into .possibil-
bi~ities for disposition of the animals. The State Game COnmllssion has a site which
would offer some protection to animals while they became accustomed to their natural ~

I zoo had been investigated by the Humane Society, and that they had found they were well
taken care of. However, the care and maintenance of the zoo had become an increasing problem.
The problem'now' was what to do with the animals.
Ci ty Manager said every proposal. and .suggestion would. be gi ven consideration by staff.
Vote taken on motion. Motion carried.
V. Assessment Ordinances
Letters of protest from Pierre Van Rysselberghe for Mrs. Bertha Lindberg, and from J. "
Irvin Borthick for Bethel Christian Church, we~e read.
Councilman Teague said he was well acquainted with Mrs. Lindberg, and felt there should
be some relief for the elderly on fixed incomes.
City Manager agreed any kind of assessment was a hardship on. people with low incomes, that
under the Bancroft procedure they. can apply for a time payment ,. but over a period of tim~,
interest is accumulated. Any proposed relief would require a change'in State laws regard-
ing assessment ptocedures:
I Mrs. Niven said the Joint Housing Committee, at Council direction, had studied this I:
problem, but no satisfactory solution has been found as yet.
Mayor Anderson said this applied not only to assessments, but to the whole tax picture,
and that the citizens of the community were concerned.

! VII. Reduction of EWEB Board members term of office to 4 years, and election by Wards

I action is taken on recodification, but the matter could be taken as a separate item

Councilman McDonald felt this item should be taken at the next regular Council meeting.
Manager suggested it might be desirable to ask for the point of view of EWEB regarding this
!; proposal.

Councilwoman Beal asked to correct the committee minutes to show that the proposal for reduction :1
of term was made by Dr. Purdy, and that the Councll had taken action at that meeting. "
Councilman Williams said he had been appointed to a committee to study election procedures and
the ward system. He felt this matter could be inc?rporated into those studies. I"
Councilwoman Beal did not agree, saying that EWEB served an area far' outside the city limits,
and that there was no difference in service between one location and another.
In answer to Dr. Purdy, Mr. Williams said the procedure they had been considering had been
to nominate from wards and elect by the city at large.
City Manager felt it would be easier to set boundaries for Wards if EWEB members did not have
to be considered. He felt Mr. Williams suggestion had merit, that it should all be considered
by the committee, and a recommendation made to the Council. e
Mayor Anderson suggested that, as a first step, a communication should be directed to EWEB
requesting a recommendation from them regarding terms and election by wards.
Mr. McDonald moved seconded by Mr. Williams to instruct the Manager to forward a letter to
the staff or board of EWEB requesting a recommendation on length of terms and 'indicating a
feeling regarding a change in voting procedure. Motion carried.
VIII. Items to be considered with one motion, after discussion of individual items, if requested.

Ci,ty..Manager suggested that, since no changes have been made to the zoning and building
sections, and extensive hearings and discussions have been recently heard, Council
could dispense with ~pecial discussions on these sections.
Mr. Gribskov moved seconded by Mrs. Hayward that the Council not go through the study I

o. Improvement Petition - Sanitary Sewer between Delta Highway to 1500 feet east and between
Goodpasture Island Road and 500 feet south. Requested by one owner who represents 29%
" of the property to be assessed. The property owned by the petitioner was annexed with I
, no conmdtment about provision of sewers. A city investment of an estimated $25,000 would
be required for trunk sewers and it is probably deferral of $16,000 would be required in I
assessments for unsubdivided property with no dedicated roadway. It is believed the II

project is premature and should await subdivision. II

Lane County Health Department was contacted and reported no current problem with
subsurface drainage.
Dr. Purdy moved seconded by Mr. McDonald to defer this project. Motion carried. e
Mr. Wayne Shields, 2535 Tomahawk, explained reasons he was requesting sanitary sewer service I
to this pronerty, and that he could not develop portions of his property until the sewer was I
installed.
City Manager explained that, becuase of the distance the sewer would have to run to Mr. Shields ::
property, a large pprtion of the cost of the sewer could not be assessed. It was felt this
request was premature, since money was not budgeted for this purpose at this time. The County
Sanitarian had notified the City that the situation was not critical at this time.

Mayor Anderson suggested that this matter should be considered in preparation of the forth-

Mohr felt the ultimate goal would be abolishment of the municipal jail system.

this project.

Councilwoman Hayward commented that some student groups at the University have attempted
ii such a project, and perhaps they could work in conjunction with this operation in their

Councilman Mcdonald was concerned that this paper salvage material was being shipped
abroad, and felt it should be retained locally. The Ci ty Manager explained that the
material being picked up would ordinarily be burned at the sanitary landfill.

held over to this meeting to allow proper notice of assessment to be given owners of affected proper-
ties, and is brought back for consideration with two written protests on file.
Letters of protest from Pierre Van Rysselberghe for Mrs.. Bertha Lindberg, and from J. Irvin, Borthick
for Bethel Christian Chruch were read. I
Councilman Teague said he was well acquainted with Mrs. Lindberg, and felt there should be some relief
for the elderly on fixed incomes.
City Manager agreed any kind. of assessment was a hardship on people with low incomes, that under the
Bancroft procedure they can apply for a time payment, but over a period of time, interest is accumu-
lated. Any proposed relief would require a change in state laws regarding assessment procedure.
MJ9s. Niven said the Joint Housing Committee, at Council direction, had studied this problem, but no
satisfactory solution had yet been found.
Mayor Anderson said this applied not only to assessments, but to the whole tax pic~ure, and that the
citizens of the community were concerned. .
