Anderson at 7 :30p. m. 6n December 28, 1970, ,in the Council Chamber, with the II " following Councilmen present: Mr. Teague;_ Mrs. Hayward and Mrs. Beal; Messrs. Gribskov, Mohr and " II !l Williams. ~ ' , :: " I' I. Planning Commission Report of December 1, 1970 ,! \ A. Recommended Denial R-2 to RG; Lane Propertjes, Inc. - 36, 62, 90 North Lawrence Street and 425 Clark Street 'i , , *Planning Director explained that this request had been made several times previously. I' The area is surrounded by R-2 and therefore, the Commission felt approval of this I ,I request could be considered to be 'spot zoning. e Mr. James Britton, speaking for the appellant, said the project would be designed in order that some units would be available for subsidized housing. He explained that, under the ordinance, houses could be built with more bedrooms under R-2 ; than RG and he felt the request was valid. Mr. Teague moved seconded by Mrs. Hayward ,that the.request be denied. " I ;, " " " il Mr. James Britton, speaking for the petitioners, asked to update the description to include :i " II another lot on the corner of Clark and Lawrence. He explained that the owner was not Ii proud of this property and would like to develop it, removing existing structures and , making something worthwhile. He said the refusal of the Planning Commission to rezone " i, the property dates back to 1965, and that until this time, no mention had been made of I spot zoning. They had been requested at that time to wait until studies had been , " completed. He stated that, in the 1966 Central Lane Planning Council study, this entire ': !i , area had been shown as garden apartment. Mr. Britton said sewers needed to be replaced " I, 'i in the area, and that this request would have no bearing on them. " , " I, " " :1 , He said he owned proper~y , Mr. Max Ansola, ~633 Fox Hollow, spoke in favor of the request. ; ~ " I in the area which was in the same condition as that of the petitioners. He felt the 'I " whole section should be RG and he could not understand how it could be spot zoning. " " :' I :i ,I 'I There was discussion concerning the condition of the neighborhood, and what steps could I :' be taken for improvement. " [, il In answer to Mr. Mohr, Planning Director Porter said it would be best if the developers " II waited until a land use plan for the area had been completed. A request for a neighbor- :i r: hood development project will be submitted which will set forth detailed planning for " i! the neighborhood. :i 'i 'I , I, " I: Councilman Mohr felt it was important to encourage private development, and that I it private enterprise should not have to wait for the city to decide what it was going I ~ I to do. " :, I: I I The Pilianning Director pointed out that, besides improvement of housing, street and sewer " :1 " improvements were needed. :1 't Vote taken on motion as stated. Motion carried with Mr. Mohr voting no. " :, ,I I: e jl B. Recommended approval of zone changes: " ii l. RA to R-2, Land Associates, Inc. - west of 1-5, east of Garden Way, south of " Harlow Road, Planned Unit Development I ~ 2. R-l to RP, Citizen's funk, northeast corner Hilyard and 30th, PUD I' ,I I! " There was no action taken on these requests at the committee meeting. Request I: ;1 number one was to allow low density multiple family housing to be developed :! under the FHA 236 program. Development under PUD was recommended, with a I: maximum density of fourteen units per acre. Final approval should be withheld pend- i; " ,I ing approval of Planned Unit Development. I, I' ,I I' , ,. No one at this meeting spoke either for or against this item. p it Request No. 2 was to allow construction of a banking facility. The Planning " Commission recommended approval, subject to development under Planned Unit -~I \1 Ii Development procedures and regulations, and requested that final reading be II withheld until final approval of the Planned Unit Development. i ii , I !i Mr. Norman Oswala, 2940 Alder, spoke in opposition to this request, and asked for " clarification of some points. He felt the location of this bank would be detrimental ,\ I' to tmffic, and asked if studies had been made. He asked what this rezoning would If mean to neighboring residences, and said there are quite expensive houses with :' " ,I their backs to this area. "...- 1Z9 e 12/28/70 .~ ii ;1 I- i: The Public Works Director explained plans for widening of Hilyard and elimination of ,I i 1 turning lanes. I I, I' " I' Mr. Craig Robinson spoke for Citizen's Bank and said traffic at the intersection was I admittedly heavy, but he did not feel the'bank would create a problem. He explained " that peak traffic was from 7:30 to 8:30 a.m. and 4:30 to 5:30 p.m.. The bank did not open until 10:00 a.m. and 70% of its business was completed before 3:00 p.m. He said the facts presented to the Planning ~mmission spoke for themselves. For reading of the ordinances and Council action see Page 10. of these minutes. \1 , The City Manager eXplained that, as soon as the Planned Unit Development is approved, the Council will give the ordinances final reading and final approval. 3. R-3 to C-2, McKay Investment Co., east of Oentennial Loop, north of Centennial Boulevard. Si te Review. The site review request is consistent with previous Planning Commission actioni:'for e property adjacent to Alton Baker North Bank Park. Approval of C-2 Community Commercial zoning is recommended. I For reading of the ordinance and Council action see Page 10 of these minutes. II. Planning Commission Report, December 7, 1970: I A. Recommend that east-west alley running east from Olive, south of 11th terminating in mid-block by Eugene Hospital be made one-way eastbound. City Manager explained the location of this alley, and that there had been no protests. The Planning Commission had some discussion at its meeting regarding signing in order to warn people there would be a dead-end to the north-south alley, and .recommended signing be sufficient to keep people from entering. " ., ,I Recommendation regarding this alley was made due to its conflicts at its easterly terminus. I: The Planning Commission requested that some signing be instituted at the intersection of the two alleys to indicate that there is a limited extent of thoroughfare to the north. Mrs. Hayward was concerned that this alley should remain two-way, since she felt it would be part of an ideal bicycle route. The City Manager explained the location of this alley, and that the alley a little further south would provide a better route, since it was open from Willamette to Olive. Mr. Teague moved seconded by Mrs. Hayward to adopt the Resolution (For Council action on the resolution see page 11 of these minutes.) B. Recommended denial of annexation - Ernest Gose property, Tax Lot 1700, on Bertelsen Road between 18th and Bailey Hill Road. The Planning Commission recommended denial of this annexation and suggested the I' Lane County Local Government Boundary Commission be informed that, should they annex the property, they should also consider inclusion of the entire area to the north between Bertelsen and Four Oaks Grange Road. The advice of the County I: Sanitarian concludes that this entire area is a potential health hazard, due to ,; failing septic tanks. ,I I Mr. Teague moved seconded by Mrs. Hayward that this request be denied, and that the Ii " Boundary Commission be requested to consider annexation of the entire area to the II e north between Bertelsen and Four Oaks Grange Roads, should it be inclined to approve this request for annexation. Motion carried. III. Proposed Agreement, University Land Exchange A draft of a proposed agreement wi'js.'Jprevious1y mailed to Councilmen. It has been " approved by both the University and the State Board of Higher Education staffs, " and would provide for an exchange of land to permit vacation of 13th Avenue from \1 University to Kincaid. 'I I, :1 The City Manager explained changes made in the agreement, especially regarding !I a proposal for a traffic carrier near the river. Mayor Anderson said ,he had reviewed the document, and comp1imented'the staff for arriving at a satisfactory agreement. Councilman Mohr questioned the effect which signing of the agreement would have I on University zoning and the Planning Director explained that long-range planning will merely be implemented by the zoning ordinance; There will be no effect on the agreement. Councilman Williams asked that the record show that he has a conflict of interest and has refrained from commenting or voting. Hayward ,that .the, Council approve the agreement and direct staff to ii :, i: transmi tit to the State Board of .Higher, Education. Councilman Teague expressed his, concern that the City was not receiving adequate compensation , for vacation of this street. " I' i City Manager explained that the agreement does.notprovide for specific compensation, but provides that, if the State agrees to proposed future traffic carrying facilities, it will provide: to the city, free of charge, right of way on property in its ownership. He outlined further ~: provisions of the agreement. , I ,i , Councilwoman Hayward was concerned that the discussion concerned trade of land for, streets and " movement of vehicular traffic. It ,was her feeling the Council should not be committing itself e to wilding more roads at this point. Mayor Anderson felt that agreements between units of government were difficult to work out, and he hoped that future representatives of various constituencies would have the same interest for the entire welfare of the community which this Council and State Board of Higher Education had. I A vote was taken on the motion as stated. The motion carried with Mr. Teague voting no. r> I: , ': IV. County Assumption of Dog Control Lane County, Springffeld and the city of Eugene have worked for several months toward unified dog control service. An agreement has been reached which has Springfield Council approval and is already in effect in Cottage Grove. The proposal provides that all licensing and enforcement will be done by the County, that two full-time dog control officers will be provided to work in the city year round, and that two additional men will be provided during the spring and summer months. The contract will provide for enforce- ment of the Eugene ordinance in the Ci ty, even though it is stricter than the County ordinance. ,) I, The proposal will include turning over our dog control van to the County for the " I' duration of the contract. The contract is for one year, and may be renewed only i ~ I if both parties agree. Net cost to the City is estimated at $13,000., Current Ci ty ,I cost is $18,000~ Staff recommends approval. I', I ;1 In answer to Dr. Purdy, City Manager said pet owners would be cited into Municipal Court, and revenues achieved would be credited against billing from the County. " 'i Ii Mrs. Hayward moved seconded by Dr. Purdy to proceed with an agreement to allow I' ! ~ the County to assume dog control enforcement. Motion carried. Mrs. Hayward moved seconded by Mr. Gribskov that the City proceed with the agreement to allow I the County to assume dog control enforcement. Motion carried. I V. I I' (Committee meeting of December 23, 1970) ~ j !' A. Bwcycie Study - Councilwoman-elect Campbell reported that she had a communi- cation from Dr. Robert Sommer, Department of Psychology, Davis, California, regarding the bicycle program in Davis. He has forwarded a report to her which should be of value to the bicycle comndttee. I Councilwoman Hayward called attention to the fact that her family had eight bicycles stolen, and that she wished the City could instigate a program of public I' : ~ information and education concerning theft of bicycles. " I' " Councilman Mohr felt it should be possible for the City to paint recovered bicycles in an orange or pink color and put them on the campus for public use. Approve Mr. Thomas Hedgpeth, 939 Jefferson, was interested in the suggested public information program e regarding stolen bicycles. I, " I! I' Mr. Hedgpeth suggested that more bicycles be licensed, or that persons be,. better informed regard- >I I: ing the importance of keeping a record of seriaL numbers. He' said many stolen bicycles leave :, " the area, and that a check should be made of ,other cities when a bicycle is reported stolen. i' !i .. . Ii B. Historic Preservation Conference - Councilwoman-.elec;t Campbell was : interested in I' the' woik~being' done in connection .wi th preservation of buildings of interest in ,I " " the~City, and suggested an ordinance might be drafted 'to insure such preservation. Ii She explained that Portland has a model ordinance in this regard, and suggested Ii i: staff obtain a copy. Approve :I " ': Cr~minal ?aw Report - In answer to Councilman Mohr's.query concerning. a hearing " C. Council President McDonald , E. ii " had distributed a notice of a special ,Councilmge,ting January 11, 1971. 'He~said that 'I he had set January 4 as the time to ,ini tiate new members., and. ,they would then be eligible for this special meeting. The Mayor felt the meeting on January 4 should not be a regular Council mgeting with public hearings or other. public items. Approve F. Acquisition of Property Easement Vacation, Eugene Water & Electric Board ~ EWEB will redesignate an electric line easement in Victoria Heights area to clear titles for properties in the area. " This has been reviewed by Public Works Department, and approval is recommended. Acquisition of Property, Quackenbush - Located just north of the Neighborhood Devel- opment Project in State Street Area - an A-2 Channel right of way which the City . may purchase for $7400. Staff recommends approval. Acquisition of property~ John W. Nielson - Broperty located in the area of the Eugene Treatment Plant site. The City has previously attempted to purchase property adjacent to the sewage treatment plant site as it comes on the market. Negotiations with John " W. Nielson for a 71/2 acre site have proceeded and it is recommended the land be Ii " purchased for $7500. " !! " Mr. Gribskov moved seconded by Dr. Purdy that the Council approve the staff I' ,I recommendations in the above three items. Motion carried. I, Approve I I' 1! , G: Disposal Procedure, City Owned Lots in Danebo Neighborhood Development Area - The City Ii previously agreed to use the property management services 'of the Eugene Renewal Agency I: 'I to dispose of lots received from the County in lieu of sewer assessment payments.
