Mr. Williams voted no, so the bill was held. * COUNCIL BILL NO. 9329 - Amending Sec. 2.1 of the Code relating to conditions required in labor contracts executed by the city of Eugene was submitted and read in full. Mrs. Hayward moved seconded by Mr. Mohr that the bill be read the second time by council bill number only, with uranimous consent of, the Council. Mr. Williams voted no, 90 the bill was held. COUNCIL BILL NO. 9331 - Levying assessments for paving, sanitary and storm sewers within Sweetland Industrial Park, was submitted and read in full. Mrs. Hayward moved seconded by Mrs. Beal that the bill be held over to the meeting of January 25, 1971 to allow proper notice of assessment to be given owners of affected properties. Motion carried unanimously and the bill was held. -- COUNCIL BILL NO. 9332 - Levying assessments for paving and sewers in Vine Maple Dell was submitted and read in full. Mrs. Hayward moved seconded by Mrs. Beal that the bill be held over to the meeting of January 25, 1971 to allow proper notice of assessment to be given owners of affected properties. Motion carried unanimously and the bill was held. I COUNCIL BILL NO. 9333 - Levying assessments for sidewalk repairs within Walnut Park, was submi tted and read in full. Mrs. Hayward moved seconded by Mrs. Beal that the bill be held over to the meeting of January 25, 1971 to allow proper notice of assessment to be given owners of affected properties. Motion carried. unanimously and the bill was held. RESOLUTIONS RESOLUTION NO. 1884 - Authorizing two-way traffic on Olive Street from 11th Avenue to the southerly terminus of the Eugene Mall north of 10th Avenue was submitted and read in full. Mrs. Hayward moved seconded by Mrs. Beal that the resolution be adopted. Motion carried. RESOLUTION NO. 1885 - Establishing tenth avenue from Willamette Street west of Charnelton Street as one way west to east was submitted and read in full. " -" Beal that the resolution be adopted. Motion carried. Mrs. Hayward moved seconded by Mrs. RESOLUTION NO. 1886 - Authorizing the city of Eugene to execute quitclaim deed to grant redeisgnation of electric line easement in Victoria Heights area (EWEB) was submitted and read in full. Mrs. Hayward moved seconded by Mrs. Beal that the resolution be adopted. Mot ion carried. I RESOLUTION NO. 1887 - Designating east-west alley running east from Olive, south of 11th terminating in mid-block by Eugene Hospital be made one-way eastbound, was submitted and read in full. Mrs. Hayward moved seconded by '.M:>s. Beal that the resolution be adopted. Motion carried. Upon motion duly made, seconded and carried, the meeting was adjourned to January 4, 1971. e ~~~ "Hugh McKinley ~ City Manager *Regarding Council Bill No. 9329, in answer to Mrs. Beal the Manager explained that the City had no corrective action against violators on contracts. This proposal would provide for removal of the offender from the bid list for a specified period of time. Mrs. Beal suggested that copies of the ordinance be forwarded with a'letter to the Labor Council. Councilman Williams felt denial of ones livelihood was too serious a penalty and that there was no provision for other penalties or fines. Mrs. Beal pointed out that this ordinance would only deny him the opportunity to bid on city contracts. I Mr. Teague asked how the matter would be handled if the employer could show that he had made a sincere mistake. City Manager said he did not read into the ordinance Mr. Williams had given it. He read parts of the ordinance and explained his interpretation. The Assistant City Attorney suggested the wording could be improved by insertion of the word "knowingly." Mr. Williams agreed to this amendment, but felt Section 3 should be amended so that suspension of the right to bid would not be automatic. Councilman Mohr felt the ordinance was addressed to the wrong problem, and that it should provide for 'I damages to the man whose wages were not paid. The rrty Manager explained that the state law was violated, and the laborer's claim would be settled through the State Bureau of Labor. The City problem was whether the contractor should be permitted to bid on city contracts when he had knowingly violated the existing contract. Council Chamber Eugene, Oregon January 4, 1971 Special meeting of the Common Council of the city of Eugene, Oregon was called to order by His Honor Mayor Lester E. Anderson at 7:30 p.m. in the Council Chamber with the following Councilmen present: Messrs. Williams, Mohr, Mrs. Hayward and Mrs. Beal, Messrs; Teague and Purdy. Messrs. Gribskov and McDonald were absent. Councilmen-elect Hershner and Campbell were present. e Mayor's Message . Mayor Anderson gave his annual message assessing accomplishments of the past year, and hopes and plans for the future. He outl~ned a proposed 3% state income tax supplement and his hopes for increased returns to cities and counties, which might ease the property tax burden for low and middle income citizens. I Mayor Anderson stressed a need for land use planning to discourage proliferation of suburban develop- ments which create added problems for the cities. He praised increased citizen participation in government, but saw the need for even greater cooperation and involvement. Mayor Anderson welcomed Councilmen-elect Beth Campbell and James Hershner. They were joined by re-elected councilman Tom Williams and sworn in by the City Recorder. Eugene Water and Electric Board member Richard Freeman was then sworn in by the Recorder. Re-elected Councilman H. C. McDonald and Board member John Tiffany were out of the city and will be sworn in at a later date.
