January 11, 1971
Regular meeting of the Common Council of the city of Eugene, Oregon was called to order by His Honor
Mayor Lester E. Anderson at 7:30 p.m. on January 11, 1971 in the Council Chamber, with the
following Councilmen present: Messrs. McDonald, Teague, Mrs. Beal, Messrs. Mohr and Williams, Mrs.
Campbell and Mr. Hershner. Mr. Gribskov was absent.

I. Announcement of Swearing-in of Councilman and EWEB member and Election of Council officers
for "1971.
Mayor Anderson announced that Coucilman McDonald had been sworn in by the Recorder earlier in the
day, and that Eugene Water and Electric Board member John Tiffany had been sworn in last week.
At a special meeting prior to the Council meeting, the Council, in executive session, elected
Councilman Charles Teague as president and Councilman Fred Mohr as Vice President to serve during
1971. Mayor Anderson thanked Mr. McDonald for his service as President during 1970, and
cong~atulated Messrs. Teague and Mohr on their election.
II.

Cigarette Tax - Three bills are presently being considered in connection with an
increase in the cigarette tax.

Mayor Anderson suggested that the Council support any legislation which would
bring additional revenue to the cities, and that revenue from the cigarette tax be
general in nature, rather than for specific purposes. This was the general

5. Statewide Ban on Sale of Raw Milk - The State Board of Agriculture will not
support a statewide ban on the sale of raw milk. It will probably be necessary
to attempt to amend the state law which provides that the city can bar the sale
of raw milk only if it maintains its own qualified inspection service. This,
in effect, causes double inspection.

Tax Deferment for Rehabilitation of Land .for Low Income and Elderly Persons

10. Jury Trials - The League of Oregon Cities will sUbmit three bilis, one of which
would repeal jury trials at the municipal level. The others are related bills.

11. Statewide Uniform Building Code ~ This would insure codes that are uniform
throughout the State, and that standards, would be k~pt up to date. No action
12. Litter Control - Mr. Jordan outlined eight bills which will provide for control of
litter and setting forth reasonable fines for littering. No action taken
13. Solid Waste Disposal - There are no provisions in the 'proposed bill which would
conflict with any city policy. There were no Council objections to provisions of
the bill. No action
14. Air Quality Control - Over 100 air quality bills have been submitted to the
legislature for this session. The Task Force on Air Pollution has a package
of seven bills, some of which are the same as those in the Eugene package.
The Council strongly supported those bills which are being proposed by the
coordinating committee in the Eugene area. Support
Trespassing Ordinance - Copies of a proposed trespassing ordinance were distributed some time
ago. The City Attorney has reworked a section of the original 'draft and copies 'of the changes
and proposed new language were circulated with the agenda. It is recommended that a date
be set for public hearing.
Councilman Mohr had some questions about the ordinance, and asked that the Attorney's office
submit an additional report. He was concerned that there would be no need for such an ordi-
nance if the report of the criminal law, committee is put into effect.'
Mr. Gribskov moved seconded by Mr. Mohr that a public hearing be set for January 25, 1971
for consideration of a proposed trespass ordinance. Motion carried. approve
Storm Sewer, Coburg Road, north 760' from Cal Young Road - Safeway Stores has proposed to
construct a system to the north to Willakenzie Road to discharge into an existing channel.
Its system would be parallel and a duplication of the proposed city system. It has been
recommended that the City construct that portionof its system at an estimated cost of
$30,500, since Safeway has agreed to contribut $5,000 toward the cost. This is the amount
which would be saved by Safeway Stores, doe to the City construction"
There was Council discussion whether this storm sewer would be needed by the entire area,
and whether abutting property owners would 'be assessed. Public Works Director explained the
policy regarding sotrm sewers when they cross a subdivision and ,that' abutting property
owners would not be assessed. He explained that this is part of a major trunk system to
be installed in the Coburg Road area and that the $5,000 that Safeway'will contribut toward
the cost would not ordinarily be assessed against them.
Mrs. Beal moved seconded by Mr. Teague .that'the Council approve the recommendation of staff
for construction of this project. Motion carried. approve
Resolution, North-South Basic Railroad Route - A resolution adopted by the Portland City
Council urging attention of Secretary of Tra~sportation to reconsideration of the proposed
basic railroad routes on the West Coast was 'distributed to Councilmen. The City of Eugene
has been requested to consider this resolution. Mayor'Anderson felt that the Council
should express its sentiments and-'~i1gge-stl"T<f~~Tnaf: ~taff-draft a similar resolution to forward
to the Secretary of Transportation. _.. ,
Mr. Gribskov moved seconded by Mrs. Beal that staff be directed to prepare such a resolution.
There was discussion of Council feeling regarding rail service, and whether there might
be a better transportation system available. Advantages of such a system were pointed out.
A vote was taken on the motion as stated. Motion carried.

Amendment, City Dog Control Ordinance - There are discrepancies between the City ordinance
and County ordinance which would make enforcement and administration difficult for the
County. It is recommended that County criteria'be adopted in these cases.
Mrs. Beal moved seconded by Mr. Gribskov that a draft be submitted of proposed amendments
which will bring the Eugene ordinance into conformance with that of the County. Motion carried.

Christmas Tree Salvage - Mr. Mohr was interested in the success of the Christmas tree salvage
program. The City Manager stated there had been a greater response than anticipated and
the success-of the ope;ation could not be determined until all the figures are calculated.
Apparently, this is a needed project, since so many Eugene citizens took advantage of the
program. file

Assistant City Manager called attention to a progress payment to S. F. Wilson for the Eugene
Overpark in the amount of 17,782.48. This sum is doe contractors pursuant to terms of the
contract which provided for arbitration in case of dispute. Rather than an excess of $40,000
as claimed by the contractor, the arbitrators directed that the City pay an additional
$17,782.48.
The Assistant City Manager ~urther explained that there is another matter concerning the
Overpark still under arbitration, and that a decision will be reached in a few days which
will require Council action.

Mrs. Beal called attention to the minutes of the Committee meeting of December 30, and requested
that Item 14 be corrected to show that the City did support the bills going before the legislature
regarding air pollution. She was concerned that the City was attempting to get other endorsements
and this should be made clear.
Regarding Item F on the Agenda, Mr. Williams was concerned with the wording of the ordinance.
The City Attorney agreed that it did leave a little to be desired and suggested deletion of the
words ttor permitted to run at largett would clarify the ordinance.
Since there was still some confusion, the City Attorney suggested the Council hold the ordinance to
give it further consideration. The ordinance was held.

Mr. Ken Bylund, Lane County Labor Council, asked for clarification, and said he could see no reason for

the ordinance to be passed.
The Assistant City Manager explained that there had been a problem concerning payment of wages. This
ordinance would not set aside the state law, but would give the Council remedies in the e~~~t a
contractor failed to perform his obligations.
Mr. Bylund felt the Council was evading its responsibility. He voiced concern that the ordinance
might create a hardship for workers. He felt there was a need for enforcement, rather than an
additional law.

The City Attorney said the City complies completely with the laws of the State regarding payment of
minimum wages. He explained the basis for the ordinance and that the ordinance makes certain condi-
tions specific, especially regarding violations regarding payment of wages and equal opportunity.
Coqncilman Williams was concerned that the rights of individuals might be wornged, and felt that
there were already adequate statutes. He felt that, not only the contractor would be put out of
business, but the employe would also be put out of business.

Councilman Mohr said the City was trying to accomplish something other than what he had suggested shou'ld
be accomplished, and that another layer of penalty would be added to State law. He noted that this
ordinance would not directly help the workman, as did the Human Rights Ordina~ce, by having the
City Attorney prosecute the workman's case.
Councilman Hershner was concerned that the penalty appeared to be mandatory. For the City to have an
option to review, the ordinance would need amendment.

RESOLUTIONS
RESOLUTION NO. 1887A - Urging designation of Portland, Oregon as intermediate point on a

Mayor Anderson requested that a copy of Resolution 1887A be forwarded to Commissioner Ivancie in

Councilman McDonald commented that rail mass transit has improved connections in San Francisco to the
airport, and that the rail connection urged in this resolution may be badly needed in the future.
