Adjourned meeting of the Common Council of the city of Eugene, Oregon - called to order by His Honor
Mayor Lester E. Anderson - at 7:30 p.m. on January 25, 1971 in the Council Chamber with the following
Councilmen present: Messrs. Teague, Mohr and McDonald; Mrs. Beal; Messrs Gribskov and Williams; Mrs.
Campbell and Mr. Hershner.

Public Hearing, Ordinance Relating to Trespassing - This ordinance relates to trespassing on priv-
ate property in the city of Eugene. It came about as the result of constitutional challenges to
an ordinance which was in the code for many years. This ordinance has been written to replace it.

Assistant City Attorney Wayne Allen commented on the provisions of the ordinance, and reasons for
them. He explained that state law, as presently written, does not cover trespass on real property!
in this city, and without this ordinance, there is no way of prohibiting ~respass upon private
property in the city of Eugene. He explained amendments that have been made since the original
draft, upon suggestions of attorneys for organizations interested in such an ordinance.

Mr. Robert Peters, 1444 East 21st, Chairman of the American Civil Liberties Union, said he had
recei ved an early draft of the ordinance, and had offered suggestions to the Attorney's office :
which might eliminate problems which might be anticipated because certain sections of the ordinanc~:
were vague. He was concerned that the final draft had not been improved in this respect, and "
requested that the council delay action on the ordinance until some refinements could be made.
Mr. Roy Dwyer, attorney for the Central Labor Council, agreed with Mr. Peters request for delay,
and felt that vagueness in Section 4b could cover disorderly conduct, rather than trespassing.
He felt advantage could be taken of this section to request persons to leave who actually had
legitimate business on the premises. He felt perhaps there should be further breakdown regarding
"public" and "private" property.

Councilman Mohr commented that he had posed some questions at the Committee meeting which had been"
covered in~a memorandum prepared by the City Attorney's office; but that the Council had not
received this material in sufficient time to stujy it prior to the meeting. He felt passage of
the ordinance should be delayed until the Council had more time to reflect on it.
Councilwoman Beal agreed and suggested action be delayed for two weeks, and that it be
discussed at a committee of the whole meeting.
Since the Council has asked for another committee session to discuss the ordinance, the Manager
suggested that, to give the matter adequate consideration, a future date not be set. The con-
tinuation of the public hearing can be well advertised.
Councilman Hershner agreed there were some vague points in the ordinance, and was concerned with
statements regarding persons in charge of public property, and in Section 4b, what would limit
it to "public property." He, too, was in favor of spending more time considering the ordinance.

Since it was the Council consensus to give this ordinance further consideration, Mr. Teague
moved seconded by Mr. Mohr to withhold action on Council Bill No. 9340 untill sufficient material
is available. Motion carried.
Mayor Anderson pointed out that the public hearing will be continued to another date, and public
notice will be given.

Mr. Ken Bylund said that Mr. Roy Dwyer had been retained by organized labor to work with this
bill, and he would appreciate an opportunity to work with "the Attorneys to upt it into a form
acceptable to them.

II. Public Hearing, Planning Commission Reports
A. December 21, 1970 Report
1. Vacation of a portion of cul-de-sac on Lambert Street
Located south of West 18th Avenue and west of Hawkins Heights Boulevard. Petitioner
is Larry Kelso. A smaller cul-de-sac could be constructed in the same location without
creating problems. Vacation would permit better use of the adjoining lot.

Denial of Annexation Requests
a. 19.3 Acres south of Centennial between Lindley Lane and 1-5 (Boundary Board Referral)
Upon request from Boundary Board and advice from Lane County, Planning Commission
recommended denial of this request until the City can provide services and the
traffic problem is resolved.
This is unsubdivided area which has no trunk sewer anq cannot receive sewer service.
There is a problem with andangerous intersection. The Planning Commission feels
the annexafion is premature, since trunk line sewers are not scheduled for this area
in the near future.

regarding the above items be approved.
Mr. Walt Sands, 1121 Balboa, said residents of this area have "no septic tank
problems and no reason to want annexation.

Mr. Willis Beebe, 123 Holly, said his main objection to annexation was the
traffic situation on Holly. He said the reason they lived in this area was they
didn't want to live in the City.
Vote taken on motion as stated. Motion carried.
B. January 5, 1971 Planning Commission Report
1. Zoning recommended (newly annexed area) Tax Lots 800, 900 and 1000 located on the
north side of River Avenue, east of River Road and south of Beltline Road.

member present to act on the recommendation.

Mr. Hal Cross, 172i'Santa Rosa, said he represented the Sign Industry, and they concurred with
the recommendation offhe Planning Commission.
Mr. John Tiffany, Tiffany Davis Drug, agreed with the recommendation of the Planning Commission.
Mr. Vernon Gleaves, representing Obie Sign Company said the northerly 100' along Beltline
which is classified outlying commercial should be classified highway oriented. He pointed out the
area he was concerned with, and suggested that this was a~heavily travelled highway, and bill-
boards should be allowed along it. He said other portions of the Beltline which are industrial

Brian Obie, 1000 Obie Street, explained the reason billboards had been allowed on a portion of
Beltline Road, and felt the same criteria could be applied to this portion. He felt billboards
were of service to the driving public, and he reminded the Council that if the Highway Oriented
designation was not utilized, this would be a means of eliminating his business in the city of
Eugene. He could see no reason this designation could not abut the Beltline Road.

C. January 11, 1971 Planning Corrmussion Report
1. Recommended Denial of Vacation
West of 24th between Larence Street and,Wasrrngton Street
Petitioner expressed wish to withdraw request if condition of vacation
was paving of alley at his own expense.
Mr. John Gange, 2421 Washington Street, said several people were concerned about the effect
of vacation of this street, since it is already a v~ry narrow road.
Fern Mansfield, 2125 Carmel, said this would take 15' off the access to her property, which
was already extremely narrow.
Mr. Teague moved seconded by Mr. Mohr that the Planning Commission recommendation be approved.
Motion carried.

2,. Zoning Ordinance Amendment Reconunended
Provides the Planning Comndssion may request final reading of zone change
ordinances involving Planned Unit Development or Conditional Use be held until
Planning Commission has given final project approval.
The Comrirission has been following this procedure for some time, but there is
no ordinance indicating this should be done.

Joint Housing Comndttee Recommendation
Request that housing code compliance be limited to safety standards.
The Planning Commission recommended that the City Council accept the recommendation of
the Joint HOusing Committee to limit housing code compliance to safety standards in areas
under study for any renewal program. This is acceptable practice to the Department of
Housing and Urban Development, as far as workable program enforcement is concerned.
This came about because people might be required to bring housing up to standard in
areas which are being considered for renewal. If the property was then razed, it might
have been an unnecessary expense for low income people.
Mrs. Niven explained that it had been a continuing concern that codes had not
been enforced in areas which might be subject to renewal, and that they might not be
considered safe. With this provision, the obligation to safety can be fulfilled
without making long~term improvements.
In answer to Councilman McDonald, Mrs. Niven said this would not apply to the entire
City, but only to areas being considered for redevelopment or renewal. She outlined
items that would be considered under the term "safetY." and those which might not be
enforced for a short term. She explained the shortage of housing for low income
persons, and that this program might eliminate the possibility of putting someone into the
street. The distinction is difficult, but most things incorporated into the building
code w0uld be enforced. The Building Superintendent sees no problem with this
recommendation.

City Manager pointed out that the housing code, as opposed to the building code,

those relating to safety would be something considered hazardous at the time, which
could be injurious to the occupant.

Mrs. Campbell was concerned that this program would only give landlords in areas of
congestion, such as the university area, a license to rent substandard dwellings to students::
without fear of reprisal.
Mrs. Niven explained that they would be required to comply with safety standards. Other-
wise, rather than go to unnecessary expense, landlords might simply close their buildings,
leaving many people with no' place'to rent. This recommendation is a compromise to insure
that safety standards are met.
Mr. Teague moved seconded by Mr. Mohr that the Planning Commission recommendation be approved.
Motion carried with Mr. Hershner and Mr. McDonald voting no.

City Manager explained differences between fees charged electricians and plumbers in answer
to the Councilmen's query at a previous meeting. There is a difference in responsibility and
title between plumbers and electricians.

Councilwoman Beal still expressed interest in the application for license and examinations.
Manager said Mrs. Beal could meet individually with the Building Superintendent to resolve
her questions.
Mr. Teague moved seconded by Mr. Mohr that the proposed changes in,license fees as recommended
by the administration be approved, with the understanding they can be reviewed again. Motion
carried.
IV. Items to be considered with one motion after discussion of individual items, if requested.
These items were discussed at Committee meetings of January 13 and 20.
A. Dog Control Ordinance - Councilman Hershner was concerned with the section of this
ordinance dealing with dogs wearing collars with licenses attached, and suggested that an
addition could be made to include fenced yards in the exclusions. He, also suggested that
a deadline of March 1 for purchase of license be included, to, bring the ordinance into
conformity with that of the County.
The City Attorney agreed that these amendments were proper and should be included.
Mr. Robert Wright, 1974 North 16th, Springfield, was concerned that the dog control ordinance
was unconstitutional and he felt Eugene should operate under its own ordinance. The City
Attorney explained that, under contract between the City and the County, the County enforces
the City ordinance. However, there has been a conflict regarding fees and age of animals.
Mr. Wright objected to impoundment of dpgs without prior notice to owners. He felt purchase
of a license entitled an owner to allow his dog to run free.

Councilman Mohr explained that the reason for having an ordinance is to insure that dogs are
not allowed to run free, and are kept under, control.

Renewal Agency will provide certain staff services to prepare applications for devel-
opment and renewal and for a workable'program. An outside consultant had been budgeted

resolution will be submitted for app~oval at the next regular meeting.
The Planning Director explained the applications needed by the City in the, future, and
that the office of Housing and Urban Development encourages use of the Renewal Agency

Mr. McDonald moved seconded by Mrs. Beal to accept the recommendation of Councilman
Mohr for Mr. Bryan Hodges to serve on the budget committee for Ward 1. Motion carried.

Salvage and Recycling of Glass --''Councilwoman Beal introduced Mr. Zed Crawley of the
Uiliversity of Oregon, Catherine Crutchfield and ProfessdJr McGregor, who have been
interested in disposing of solid 'waste' through recycling, particularly with regard
to glass.
Mr. Crawley announced the proposed creation of B.R.I.N.G., an organization devoted to
solid waste disposal and indicated that that organization was sponsoring a meeting at
the Presbyterian Church, 7:30 p.m. January 28, to establish a committee to begin
collection and distribution. He requested the Council to endorse this meeting.
Professor McGregor said this., project was a natural follow-up to the "Can Man 'Survive"
course which was of such interest to citizens recently. He explained that they hoped
to take the income from recycling of glass ,to enter into other areas of recycling.
Councilman McDonald asked whether plans had been made for distribution and disposal
of glass. He was assured that the group had contacted a. Portland firm which would
provide containers and pickup the glass 'for recycling.
Mrs. Beal moved seconded, by Mrs. Campbell that the Council endorse the meeting called
by _the newB.R.I~N.G. group, and do everything in its power to insure a good turn-out
at this meeting.
Mrs. Beal and Mrs. Campbell amended their 'motion to include Mr. Williams suggestion that
the Council encourage all efforts to ameliorate solid waste disposal and encourage
recycling wherever possible.

Independent Audit, Annual Contract - City Manager explained that the annual, audit
is a Council audit, not an 'administration audit, and that the decision regarding an
audit contract is a Council decision. The staff has reviewed the contract, and has
found it similar to that of the previous year, which sets a deadline for development
of the audit report. This enables the Council to receive the audit sooner. Technically,
the contract is in order.
Mr. Williams moved seconded by'Mr. Mohr to approve a contract with Lybrand, Ross Bros.
and Montgomery for an audit for fiscal year 1970-71.
In answer to Mayor Anderson, the Finance Director explained that the auditors have been
coming in on a quarterly basis, which decreases theamount'of time spent. Since the
bookkeeping process of ,the ,city has been'improved, the auditors can now spend their
time in audi.ting, rather than bookkeeping work.

Communi ty Service Facility,,;Downtown Mall- Eugene, Renewal Agency ,in response to several
requests, has prepared a ,map .showing suggested location of a, community services building
in a central location in the Mall. In' a memorandum to the'~'Council, they outlined
possible uses for such 'a structure, andi ts benefits to the general public.

Mr. Dave Hunt of, the Renewal Agency 'explained the suggested location, and said there was
some merchant opposi tion ,to' location of a ti cket booth in the area. His Agency has
prepared a bill for submission to the legislature which woumd permit the City to use the
Mall for purposes of this kind. At the present time t~e Mall is considered a street,

Mayor Anderson said he shared this concern, but felt the concept..was ,essentially good.
He felt perhaps the facility could be located in another area of the mall.

After further discussion of location of the facility, Mr. McDonald moved seconded by
Mrs. Campbell to authorize the Eugene Renewal Agency to proceed with plans for construction
of a community services building in the Eugene Mall. Motion carried. approve

Legislation, Request forCoun6il Attitude - Mr. Jordan outlined proposals for legislation
to be proposed to the State Legislature as follows:
1. OLCC Statute Changes - Mr. Jordan outlined several proposed changes in this statute
and said the bill had not been written, but provisions have been decided upon.

Councilwoman Beal was concerned that the changes still did, not , resolve problems
met by the city of Eugene. She felt the 'burden QE proof should not be put upon
the City, and that a criteria for granting a license should be approval of the
governing body in the ci ty in which the liquor outlet is loca ted. Councilman
Mohr agreed, and felt the City should have authority to grant or deny a license,
if a public hearing was held on that license.
Mayor Anderson felt there were certain provisions in this proposed bill which
were good, and that there were advantages to having statewide standards. What
the Council had asked for was actually in the bill, and he felt the Council
should support the bill.
The City Manager pointed out that, if the OLCC was- the appelate body, the City
would have to take responsibility for many things which are now the responsibility of
the OLCC.
Councilwoman Beal did not feel the City wanted to be in the licensing business,
but that it wanted some attention paid to its recommendations. She felt the
Council should endorse the idea of additional conditions and procedures, but
should make it clear'that they wished some technical amendments. Mr. Mohr
suggested a Council committee be formed to prepare an analysis of the bill and
make appearances at the legislature when it comes up for hearing.

legislation, which give more weight to the City's point of view. Motion carried.

2. Municipal Jury Trials - Mr. Jordan outlined a bill now prepared which would'
provide that requests for municipal jury trials would automatically cause the
case to be ~eferred to the Circuit Court.

with circuit court, as most of these cases now go there for a trial de novo
anyway.

S. Abandoned Bicycle Sale - Councilman Mohr has received a staff report concerning the
1/20/71 contract with the City ~garding abandoned vehicles and the conditions of the
contract. He questioned whether bicycles could be sold in one lot, or had to be
sold at public auction. City Attorney explained that the City could buy them, but
they had to be offered to the public item by item.
Mr. McDonald was concerned with the cost to the City of such a project.
Mayor Anderson suggested this item'be placed on a future agenda for discussion. file
T. Report, Bicycle Study - Ernie Drapela of the Parks Department reported on the progress
1/20/71 of the bicycle committee and that several lay members have been contacted to serve as ad-

RESOLUTIONS

RESOLUTION NO. 1888 - Contract relating to modifications of a major subdivision pertaining to
garages, driveways, fending and landscaping (hackett) was submitted and read in full.
Mr. Teague moved seconded by Mr. Mohr that the resolution be adopted. Motion carried unanimously.
RESOLUTION NO. 1889 - Making application for certain street and traffic signal construction under
the urban traffic operations program to increase capacity and safety was submitted and read in full.
Mr. Teague moved seconded by Mr. Mohr that the resolution be adopted. Motion carried unanimously.
