I. Public Hearing, Zoning Ordinance.' Amendment

Mr. Teague moved ~h~t~tThe bill be read the second time by council bill number only, with
unanimous consent of'the Council. Mr. Mohr declined to second, saying he wished to present
a substitute motion. There was no second to,the motion.

*NO formal action was taken on this item at the meeting of February 3, 1971, since a
public hearing was scheduled for this meeting.
At its meeting of January 18 the Planning Commission recommended approval of an amendment
to the zoning ordinance to set out the general description and purpose of conditional-~
use permits, and to set out more specific procedures and criteria for controlled income
and rent housing projects to encourage construction of more housing for families who
cannot get decent, safe and sanitary shelter in the open market for 25% of gross family
income. A copy of ,the proposal was ,distributed to the City Council. The amendment would
provide that controlled income and rent housing could be built to a higher density than
normally permitted in a particular zone. It sets better buidelines for the Planning Commis-
sion to establish density in excess of the parent zone.

Mrs. Betty Niven of the Planning Commission explained that the ordinance was very mue'It-
needed to enable the city to meet its housing commitments. She outlined the number of
units now available in this area, and the humber in the plannigg stages. She explained
FHA regulations and how they affect builders and financing.
Mr. Al Tussing, resident of Laurel Hill, felt this was an effort to by-pass the
zoning ordinance in matters of density. He suggested a zone change would be better
so that there would be a public hearing to decide the merits of each case.
Mrs. Niven explained that this amendment would not eliminate the public hearing. She
pointed out that rezoning could increase the value of the property, thus restricting its
use for non-profit sponsors of low income housing.

Mrs. Shirley Hulegard, 1710 West 28th, was of the opinion that this amendment was not in
the best interests of the citizens of the City. She felt their investment in property
should be protected. She said she spoke for others in her neighborhood who could not be
present.

Mr. Mohr moved, seconded by Mr. Teague, to table this motion, and said this implied that
there would be a definite time to take .the bill off the table. He asked for a report
setting guidelines or criteria for a housing plan or policy of the city with respect to
density. He wanted to make it clear that members of the Council supported housing for
the elderly and low income of the community. He reiterated Council faith in the Planning
Commission and the zoning ordinance, but said he was concerned about density, and that
he felt the proper tools for implementation of an increase were not at hand. He suggested
a committee be generated by the Planning Commission to study this problem and provide
guidelines and standards as tools for controlling density.

Mrs. Niven felt this study would be possible, but she explianed that the federal government
sets up guidelines which must be followed for federal financing. Unless these are followed,
the city simply will not have any housing for low income people.
Councilman Mohr explained that his proposal was made in the hope of accomplishing increased
density with some felicity and elegance. He explained the manner in which increased
density is accomplished in foreigh countries, and that he felt this could be somewhat
attained here.
Mrs. Niven suggested that only the first sept of the proposal be followed, since a committee
would probably take at .:.:least a year to complete the study requested. She felt there
were some problems, and that a committee would be helpful.
Mr. Williams explained the housing situation in large cities in the east, and his fears
that something of that nature might happen here. He felt this was an extremely dangerous
area of urban planning. He had consulted with urbanologists, and now felt study by a
committee would be a prudent use of time.

Councilman McDonald felt the Planning Commission had studied this amendment before
referring it to the Council, and that the Council should concur with its recommendation.

Mrs. Beal asked exactly what sections of town were foreseen for such developments. Mrs.

Niven explained the policy ,of scatteration, and.that the planning staff encouraged
developers to select areas which were not already developed in this manner. There
are two considerations - one whether facilities are available, and the other, where
the End is available.

Mayor Anderson said this discussion did point out that a review of the housing policy,
particularly with relation to controlled. income housing, was certainly in order for
the Council. He suggested that a committee meeting in the near future be set aside
for this purposer He 'suggested 'a joint meeting with the Planning Commission might
be beneficial.
In answer to Councilman Hershner, Mrs. Niven explained the problem with rezoning the
land, and its immediate increase in valuation.

Mr. Mohr was concerned with Council reaction, and suggested the:,~,motion be separated into
two parts - one part with regard to formation ofa special commlttee to deal directly
with the problem of density. The other part would concern the tabling of the ordinance.
Mayor Anderson suggested the Council review the zoning ordinance as it exists today, re-
view the housing policy, and possibly go into several case histories to find how the
Planning Commission arrives at the proper density on the basis of present zoning policy.

Mr. Williams suggested the Council go one step further and invite some of the people
in the City who are knowledgeaflle about the subject.
Mr. Robert Suess, builder, told the Council of some' of his'properties, and their
locations, and invited them to look at them. He explained the density and steps taken
to insure that they were developments to be proud of.
The Planning Director pointed out that the 1990 Plan considers this issue, and suggested
that discussion of some of its facets might be included'in.the committee report.
Mr. Williams felt this was a good suggestion, and agreed that an analysis of the 1990
Plan would be very helpful to the Council.
Mr. Mohr moved seconded by Mr. Teague that the Council table indefinitely consideration
of this amendment to the zoning ordinance. Motion carried.
Mr. Mohr moved seconded by Mr. Teague that the Council request the Planning Commission
to report on density, as it would be related to the 1990 Plan. Motion carried.

The Public Works Director asked that the Council withhold action on Item No.1. The property
owner has not decided whether to accept the bid.
On Items 2 through 5, staff recommends award to lowest bidder in all cases.
Mr. Teague moved seconded by Mr. Mohr to award the contract to the lowest bidder in all cases
except No.1, which should be held for action at a later date. Rollcall vote. All councilmen
voting aye, the motion carried.

III. Bid, Opened by Parks Department
Second state of irrigation for Campbell Center
Of three plan holders the bids were as follows:

Office Estimate $9,830.00 Recommend accept Ramsey Waite bid
Three sets of plans were taken out but only one bid was returned. One bidder forgot to meet
the deadline and the other was not able to provide a bond. The office estimate was higher
than the bid received, and in view of that fact, and the good experience the City has had with
Ramsey Waite Company, the staff recommends award to Ramsey Waite.
Mr. Teague was concerned that there was only one bidder. The Manager explained that there
are only a limited number of companies in the city able to do this work.
Mr. Teague moved seconded by Mr. Mohr to award the bid to the Ramsey Waite Company, as
outlined above. Rollcall vote. All councilmen present voting aye, the motion carried.
IV. Reconsideration of Ban on Backyard Burning - Mr. Harold Moell, 36 Grandview, told of a
2/3/7bomnrrttee formed of citizens from all parts of the city who are petitioning the City Council
to reconsider its total ban on backyard burning. He explained problems wi th removal of
shrub clippings and leaves, and the hardship it presented for those with fixed incomes.
He said brush piles were infested with rodents, and were a fire hazard.
Mrs. Margaret patoine, said she was a member of a number of organizations which supported
the burning ban, and that she felt it had been most successful. She suggested that those
persons with rodent problems contact city and county agencies for control.

Mr. Leslie Erb, 610 East 39th, said the comnrrttee did not wish to argue the merits of the
burning ban, but were requesting the Council to reconsider this matter.
Mrs. Beal suggested that the law had not been in effect long enough to really evaluate,
and that it should remain in force at least through another summer.

Fire Marshal Wendell Wick said he had been concerned about the build-up of brush, but that
his last check revealed that all accumulations of trash had been eliminated. He felt the
fire hazard had lessened, and that people had accepted the fact that they could not burn.
He had checked with the County and found that there was no problem with disposal at the
land fill si tes .
Mr. Williams asked the Fire Marshal if there was any way to ascertain how much yard
debris was now being burned in fireplaces. Mr. Wick said this practice had undoubtedly
increased, but there was no way to qhbek it.
Mr. Mohr was not convinced the Council should reconsider this legislation. He congratulated
the people of Eugene on the way they had accepted the ban in terms of compliance with the
ordinance. The citizens of the City have been willing to take this small step to do their
part toward solution of the pollution problem.

Mr. McDonald suggested that the Council should consider noise, pollution as well as air
pollution, and in particular, look again at the matter of Balboa Park. He has ~ad many
complaints regarding excessive noise in that area. He asked that this be placed on an
early agenda.
It was the Council consensus that they had taken a stand regarding pollution, and that
they did not feel the ordinance banning outdoor burning should be reconsidered at this
time.

Councilwoman Beal felt very strongly about the importance of, continuing the ban in effect.
She felt it had been most successful, .and that the citizens had been very cooperative.
Mr. Cliff Everett, Eugene Board of Realtors, offered the opinion that the small amount of
pollution caused from backyard burning caused no harm, and that burning could be done
only on days of good dispersal.
It was the Council consensus that .no action should be taken on this matter.

'Revocable Permit, Mall Location for Brownie Stand - Mr. David Hunt of the Eugene Renewal
Agency said the Council, at a previous comnrrttee meeting, had directed the Agency to
review other sites on the mall for location of a small displaced business. He outlined
the proposal regarding the building and payment for the revocable permi t.

Councilman Mohr said he thought the Council had previously approved location of the
stand in the mall, and he did not understand why it was not before the Council. The
City Attorney explained that the Council must now approve a revocable permit to allow
it to be located in the Mall.

Mr. Ed Stone, representing Mr. and Mrs. Gerald Fields, said they are the owners of a
sandwich shop directly across the street from the proposed location. He explained that
plac~~~~bf the stand at this site would harm his business, and possibly put him out
of business, since Mr. Brown would be selling some of the same items he has for sale. He
felt this was mfair competition.
The Council discussed the location of the stand and the amount paid for the permit.
They concluded that the amount was fair, and that, rather than harm the Fields' business,
this location might in fact enhance their business by bringing more people to that portion
of the Mall.
Mrs. Beal moved seconded by Mr. Mohr that the Council approve Mr. Hunt's report, and
grant a revocable permit to Mr. Borwn for his stand in the mall. Motion carried.
Mr. Teague moved seconded by Mr. Mohr to approve granting of a revocable permit to Mr.
Brown for q>eration of a portable stand in the Mall.
The City Attorney pointed out that it would be appropriate to include in the motion
authorization for the City Manager to sign the permit. Mr. Teague and Mr. Mohr added
this to the motion.
Vote taken on motion, as amended. Motion carried.
VI. Items to be considered with one motion, after discussion of individual items, if
requested. These items were discussed at Committee meetings of January 27 and
and February 3.

Meter Hood Rentals, Schedule - Since the cha~ge for rental of parking meter hoods
to contractors was increased, local contractors have met with city staff to discuss
possibility of return to old rate, or at least a reduction. Staff believes the
present rates should stay in force, since rental of hoods is strictly a benefit
to construction or maintenance companies.

Mr. John Boyer of the Associated General Contractors, read letters from many
contractors protesting the increase and outlining the number of times they used
meters, and the inconvenience to them and their. customers if they;must use a
parking lot. They felt the increase was unreasonable, and that s~me adjustment
should be made. Mayor Anderson suggested that this problem might be difficult
to solve in a public hearing, and suggested a comnrrttee be appointed, headed
by Mr. Gribskov, with Mr~ Hershner and Mrs. Campbell, to meet with representatives
of the contractors and return with a recommendation.
Mr. Teague moved seconded by Mr. Mohr that the Mayor appoint a comnrrttee to meet
with representatives of the contractors and return a recommendation to the Council.

EWEB Board Members Terms, Change from Five Years to Four Years - As a res ul t of an
inquiry by Council members on terms of Board members, Eugene Water & Electric Board
replied that they had been aware of the variance in terms resulting from even year
elections, but that it had seemed to present no problem. Following discusston,
the Board agreed that the term of office for EWEB Commissioners should be reduced to
four years. This would conform to the.State law requiring that city officials.be
elected at the time of Statewide elections.

Regarding representatiennby Wards, the Board recommended that the present method
be continued. It was felt this would insure against election of all Commissioners
from one section, and would keep the cost of campaigns to a minimum.

The City Manager suggested that the Council change the prov~s~ons for EWEB terms
in the Code, so that recodification could be completed, and consider the question
of ward boundaries at a later time.

Councilwoman Beal was concerned that EWEB served a large area' 'Outside the city limits,
and that those people were not represented.
Councilman Hershner pointed out that there was no residency requirement for candidates,
and he felt this could be improved.
Mr. Freeman said he felt the Board membership could be increased with a member at large
to cover the service areas outside the City. It would require ,legislation to accomplish
this.
Mr. Gribskov moved seconded by ~s. Beal that the staff be directed to prepare an
ment to the ordinance to change the term of office of EWEB rp~mbers to four years.

C. Fiei'd Burning, Experimentation - Councilwoman Beal commented that the seed growers are
2/3/71 experimenting with a mobile field incinerator which is greatly improved, and may be a
practical solution to part of the field burning problem. $75,000 is required for con-
tinuation of research. She asked that a letter be forwarded to the Governor, with
a copy to Kessler Cannon, requesting his support of the request for funds to continue
that research.

Support for Reconsideration of Closure of Hanford Plant - Councilman Williams suggested
that the Council join with others in the Northwest protesting closure of the Hanford
Nuclear Power Plant. Since the northwest is concerned about the supply of power,
closure would increase pressure on existing generating systems and force sooner cons-
truction of other plants.
Mr. williams moved seconded by Mr. Mohr that a resolution be drafted urging the Pres-
ident to reconsider closure of the Hanford Plant.
Councilwoman Beal reported that testimony at the Legislature had shown that the
Columbia River was badly contaminated from waste from the Hanford Plant, and ~he felt
the Council should look into this matter carefully before taking action concerning it.
Councilman williams explained that his suggestion had been based upon the matter of
closure due to budgetary reasons, and in view of a projected power shortage, this
would be rather foolhardy. It should be made clear that the Council has not done
this on the basis of environmental consideration .:',

Councilman Mohr suggested that the staff be directed to prepare a resolution framed in
language which speaks only to the effect of the possible closure because of budgetary
concerns. Councilman Williams concurred and suggested that a statement be included
that the Council has not assessed the environmental question.

Joint Housing Committee Recommendation - Mrs. Betty Niven explained the Joint Housing
Committee recommendation that the Lane County Housing Authority raise income eligi-
bility limits to limits comparable to tho~e currently in effect in Linn and Benton
Counties. Since 235 subsidy limits are established at 135% of public housing limits,
this action is necessary to increase the 235 limits.

Councilman williams expla~ned that this would tend to add to already long waiting
lists of the Housing Authority, but this was the only manner in which the 235 limits
may be increased, and it seems desirable at this time to increase them.
Mr. Williams moved seconded by Mr. Mohr that the Council approve and forward to the
Lane County Housing Authority the recommendations as drafted by the Joint Housing
Commi ttee. Motion carried. approve ,:

Library Board Recommendation - A limited number of dollars are available on a matching
basis, which would allow development of a special arts department at th~ ,library
whi~h would encompass areas of arts and crafts, the dance, and music. The Library is
proposing in its budget the sum of $21,054.00 to remodel an area, equip and staff the
art and music department. They requdsted Council to approve an application for one-
hatf this amount.

The Assistant City Manager pointed out that action taken by the Council should be subject
to budget committee review. An application could be submitted to the Trustees of the
Oregon State Library to see if funds are available.
Mrs. Campbell moved seconded by Mr. Mohr that the Council authorize submission of an

Printing. of City Government Booklet '- Councilwoman Campbell suggested that the Council
encourage staff to proceed with printing a pamphlet describing the City and'its gov-
ernment, and that the Ci ty should pay for it~' Mrs. Campbell also suggested that a
small brochure, or something similar, be provided as a handout to young people
attending Council meetings. She showed the League of Women Voters leaflet, and said
it contained many interesting facts concerning the City and its officials. She
felt this could be used as a model.
Mayor Anderson agreed with Mrs. Campbell. He felt Council attendance had increased
considerably, and that perhaps such a handout could incorporate arguide and explana-
tion of Council procedures,
Mrs. Mary Briscoe, President of the League of Women voters, supported these suggestions.

The Ci ty Mmager cormnented that money had not been budgeted for Ci ty Government Book-
let, and alternatives may have to be found if it is to be printed in this budget year.
Councilman Mohr reminded the Council of his s'uggestion to print an article in the
local newspaper, informing peqple of public events, hearings and meetings, and a
directory of city services.

Mrs. Beal thought Mr. Mohr's suggestion was a good one, but that it would be exceed~,

Mrs. Beal was concerned that the action suggested for this item was to file. She
suggested that other action was indicated and that the indica~ion be to affirm. This
was considered a good suggestion and the change was made.
Cancellation of Special Meeting"~ The City Manager announced that a special meeting
called for January 28'between the City Council, Planning Commis$ion and Eugene
Renewal Agency had been cancelled until more input can be recei ved from the Downtown
Association. file
Resolution, Mass Transit - The Council recently directed a resolution to the
Congressional Delegation concerning a proposed rail passenger system, and its
concern about the lack of connection on the west coast. RespoDses have been
received from several legislators with expressions of support for the Council
position. Copies of therecormnendation have been forwarded to the Interstate
Corrmdssion, which also supports this concept of transportation.

Invitation to Attend Meeting of B.R.I.N.G. - Councilwoman Beal expressed the hope
that Councilmen would attend the meeting of the group attempting to organize a
corrmdttee to find a means to solve the solid waste problem. This meeting is at
7:30 p.m., January 28 in the First presbyterian Church.

Lane Community College Board, Discussion of Long Range Plans - Lane Community College
Board members requested a meeting wi.t.'1 the Ci ty Council to discuss future develop-
ment of the College area.
Mr. Robert Ackerman, Board member, explained the unexpected rise in enrollment qt
the College, and said that a sewage disposal problenLis anticipated, since the
lagoon-type facility they are utilizing is almost at capacity. It was felt annex-
ation would be the logical solution, ,vut sipce the college is not contiguous to
the City, this presents a problem.

Mr. Marsten Morgan, in answer to the Mayor, said the 1990 Plan does not provide
for a sewage disposal facility in this area in the irmnediate future, because of
other priorities in the City. There is rothing planned for 8 to 10 years. Unless
something is done before that time, the College will have to expand in other areas.
The Public Works Director outlined various studies made of this area, and
conclusions regarding costs for 'temporary or permanent facilities. He explained
the problems with financing of an east bank trunk line, and the city expense
that would be involved for construction pf a sewage disposal facility to serve
this area.
Councilmen and College Board members discussed the various plans and the costs
they would entail. They expressed concern with any annexation, since the position
of the 1990 Plan is to limit urban services, contain city boundaries and prevent
sprawl.

In answer to Mr. Schafer, the Mayor said the city policy has been never to seek
territory, but provide services to contiguous territory, if possible.
There was some discussion about the possibility of the City providing other services
to the College. The Manager explained that the City provides no services to out-
lying areas except fire service, which is done under a fire service contract.

Bicycle Routes, San Francisco - Councilwoman Campbell quoted an article regarding
such an increase in use of bicycles in San Francisco that the City has considered'
designation of certain streets,as bicycle routes.

that members of the Council may attend the Congressional-City Conference,
and asked that they be considering it and report whether they wish to attend.

Oregon Problem Drinkers - Mr. Stan Allen, Community Educator, Oregon Problem
Drinker-Traffic Fatality Proj~ct, announced the beginning of their program in
Eugene.

Councilman Mohr asked if the ,City Council could provide any service other than
endorsement. He offered support in use of city facilities, such as municipal court.
The Councilmen had further questions, and Mr. Allen indicated he could prepare a
written statement of the full program for consideration by the Council at another

T. Request for waiver, Mobile Home Site - Mr. Ron Hilton, 519 Shire Court, requested a
waiver of the building code requirement so that a mobile home could be located on
his proptery. He hopes to develop a mobile home park on the site, and has
requested a waiver so that he could live on the site.
The City Attorney explained the City Code prohibition on s~ngle mobile homes on
an individual lot. The only way the City Council could grant this request would be
to amend Section 41.23 of the Ci~y Code.
In answer to Councilman williams question, Mrs. Niven of the Planning Commissio~
said the Co~ssion has discussed the desirability of uniform codes .which would'
be applicable to mobile homes, as well as to other dwellings. In this case,
mobile homes would be equivalent in standing with other dwellings, and eligible
for placement on single lots. no action

U. Legislation, Request for Council position - Mr. Andy Jordan asked for a Council
position regaEding revenue sharing, and said that legislators should be notified
of Eugene's position in this regard. Councilman Williams reminded the Council
that a resolution had been passed previously setting forth the Council's position
on this matter. Mr. Jordan distributed copies of the ICMA proposal regarding
revenue sharing, and asked the Council to study it and discuss the proposal at its
next meeting.

Regarding Pollution, Councilwoman Beal reported on related bills suppo;ted by the
Cipy. She said those written and proposed by lay groups and the coordinating
council of the pollution authority are now ready to be introduced. The Speaker
of the House will introduce the bills from theco~ttee on environment.
Mr. Jordan outlined a number of bills which need Council discussion, and said
he will bring them up at the next meeting, since time was now short.

ORDINANCES
COUNCIL BILL NO. 9228 - Vacation of 13th Avenue from east margin of Kincaid Street to the
west margin of University Street, reserving easement for emergency vehicles was submitted and read
in full the first time on June 29, 1970, given 2nd and 3rd readings, and held for final passage,
pending agreement with the university of Oregon. At the meeting of Augusut31, 1970 the ordinance
was tabled. It is brought back at this time for further consideration, since an agreement has
been signed by both parties.
If this ordinance is passed this will be the final act vacating 13th Avenue within these perimeters.
Mr. Teague asked that another Gouncilman make the motion in this instance.
Mrs. Campbell moved seconded by Mr. Mohr that the bill be approved and given final passage.

Mr. Mohr felt consideration of this ordinance was premature. City Mangger pointed out that an
agreement had been approved by the Council and signed by representatives of both the State and the
City, and that the vacation had been contingent upon this agreement.
Mrs. Niven expressed concern that some terms of the agreement hinged on future vacations. Manager
assured her that the contract provided that these vacations would be handled through normal pro-
cedures, with public hearings before the Planning Commission and City Council. A letter has been
written which will supplement the agreement, so that there will be no misunderstanding.

Rollcall vote. All councilmen voted aye except Mr. Teague, who voted no. The motion carried,
