Regular meeting of the Cornmon Council of the city of Eugene, Oregon was called to order by His Honor
Mayor Lester E, Anderson at 7:30p.m. on April 12, 1971 in the Council Chamber, with the following
Councilmen present: Messrs. Teague, Mohr, McDonald; Mrs., Beal; Mrs.. Campbell and Mr. Hershner, Mr.
Gribskovand Mr. Williams were absent.
I. Appointments - Mayor Anderson announced appointment of Councilman Tom Williams as chairman of
a committee to analyze and ,review the Black Community. Survey and ma~e recommendations for implemen-..
tation of the results to. the City Council. To serve with him, Mayor Anderson appointed Councilmen
Campbell and Hershner and the follo.wing members of the Human Rights Commission: Dean Owens,
Larry Carter, Erwin Juilfs and Ann Woeste, and former Commission member Bruce McKinlay, who
acted as supervisor of th~ Survey. He asked City Manager McKinley or a member of his staff
to sit with the Committee.

II. Legislation
A. S,B, 429, authorizing Governor to take emergency action to limit or prohibit an air pollution
source in case of serious. inversion. Councilwoman Beal read a statement in support of this
bill to the Senate Committee on Environmental Affairs. She said that periods of heavy
inversion could be dangerous to the health and safety of citizens, and that the Bill has
support of the Regional Air Pollutio.n Authority and Department of Environmental Quality,
Mrs. Beal felt it was a necessary bill.

After the statement was read Mr, Teague moved seconded by Mr. Mohr to approve the statement
and forward copies to the Environmental Affairs Committee. Motion carried.
B, S.B, 708, authorizes ~stablishment of regional correctional facilities for misdemeanants
operated by counties or cities or by corrections division, upon agreement with counties
or cities, and authorizes establishment of a 50/50 maximum matching fund agreem~rit between
the Division and counties and cities. Manager has discussed this bill with the:';C~unty
Administrator and it is felt this might present an alt~rnative to some of the operational
problems of the jail facility, and that such enabling legislation should be supported,
There was some Council discussion about the matching fund agreement. Mayor Anderson
suggested 'that the bill be supported.
Mr. Teague moved seconded by Mr.. Mohr that the Council authorize endorsement of S ,B, 708,

III.
Public Hearing, Appeal from Zoning Board of Appeals Decision re: Duplexes in Monta Vista Park
This problem arose from a request for Vacation pf a portion of City View from Shields Avenue
north to 28th Avenue which was denied. Mr. Shields requested and was issued building permits
to build duplexes on two corner 10,ts. Residents of the neighborhood appealed issuance of
building permits for duplexes on these lots to the Zoning Board of Appeals, asking that the
building permits be withdrawn on the basis that this was not toe purpose for which the lots
had been planned. An appeal has now been made by the. holders of the suspended buDding permits,
Mr, Shields and Mr, Scheid.

Mr. Larry Cooley, 140 South Park, said he represented Messrs, Sh~elds and Scheid. He presented
as reasons for the request for denial of the appeal the following:

1. The lots in question clearly are "corner lots" and thereby qualify under the Eugene
Zoning Ordinance for use as duplex dwelling lots and the decision of the building
department to issue building permits was correct,
2. That issuance of building permits by the building department .was not in violation
of the intention of good planning nor inconsistent with the intent of the zoning
ordinance.
3. That the decision of the zoning board of appeals is an exercise of power not
granted to the Board in Article 27 of the Zoning Ordinance,
Mr. Cooley said that the old Hovey Road is unquestionably a dedicated street, although there
may be some question who owns the &reet. He said that, because the lot complied with regulations
of the zoning ordinance, the building department felt obligated to issue a permit for construc-
tion of a duplex, He felt the basis used by the zoning board of appeals that duplexes on
these lots would not be good planning was not a correct basis and should not be a reason for
denying the permits.
Mr. Cooley stated that the zoning board of appeals power is limited to granting variances.
He said this was a unique situation, and there was no appeal from it, and that the effect
would be that the zoning ordinance could no longer be depended upon,

Mr, Robert Elfers, 2252 West 29th, said he owned property adjacent to one of the lots in question,
He distributed a memo from thirty property awners in and adjacent to. Monta Vista Park Subdivisian
setting forth the following:
A. Legally the lats do. not qualify as carner lots because a county raad was never
legally established in 1911 and 1912; no street in this area was surrendered by
the County or accepted by the City. '1<, !

The Planning Commission has never approved this street, but has recommended
against its creation.
B, Equitably, allowing duplexes would be a strict and literal interpretation
which would be inconsistent with the objectives of the zoning ordinance
C. Boih the legal and equitable basis can stand alone to support the action of
the Zoning Board of Appeals and the neighborhood is seeking collectively
relief from a harsh and inequitable result of a strict or literal interpretation
of the building inspector - relief from allowing a situation which was never cont-
emplated by the City Council, Planning Commisison, staff or the property owners
of Monta Vista Park - a situation. which certainly would be incon'sistent with
good' orderly pl,anning and inconsistent with the objectives of the Zoning Ordinance,

Mr, Elfers said ~he Zoning Board of Appeals had primarily granted relief to the neighborhood
on an equitable basis, that issuance of building permits would be contrary, to good planning
and interpretation of the zoning ordinance. He felt that the conditions could stand inde-
pendently on either basis and that the lots did not qualify as corner lots. He contended that
the street had never existed, and said he had done considerable research into old laws in
existence in 1911 and 1912. The procedure was not followed by Lane County to establish a
road in that area. It was found the last half mile of old Hovey Road was too steep, and no
further action was taken by the County Court to act upon a petition; therefore, no county road
exiSTed there.

If it was assumed that there was a road in exi~tence, no street in this area has been surrendered
by the County to the City and accepted by the City. Mr. Elfers pointed out the area on a
vicinity map and explained vacation of streets on each side of 28th, He read a section of
the zoning ordinance and stated that a corner lot had to be bounded entirely by streets which
had been officially approved by the Planning Commission and accepted by the city of Eugene,
which was not the case. Planning Commission has not approved this street, and to the contrary,
has recommended its vacation, and against its creation in actuality. He felt that, even
though the zoning ordinance', is new, i twould be retroactive in' a case of this nature.

Mr, Elfers s.aid if the Council upheld the zoning board of appeals, it would be following good
planning, but if it oyerruled the Board, it would be supporting nothing more than a technical-
ity and subterfuge for developing duplexes for commercial purposes.
Mr. James Whitall, 2280 West 28th, pointed out another lot owned by Mr. Shields, and suggested
that if they were successful in obtaining building permits for the two lots, they would also
want to build a duplex on the third lot, which was adjacent to hills property, He read a portion
of the restrictions on Monta Vista Park, and said those who platted it were being unfair to
those who bought properties, by allowing duplexes to be built there.
Mr. Ray Wiley, 2100 Shields, felt the fundamental thing involved'in the decision was whether
City View was a ,lega,l' street or a pedestrian way. Heci ted a portion of the zoning ordinance
which stated that the street had to be the principal means of egress to the abutting property,
and that it was his contention that this public way did,not conform to this description. Ori~.
several occasions the lianning Commission has recommended its vacation. Mr. Wiley reviewed
the various actions which had taken place regarding this street or pedestrian way in the past,
and maintained that, whether it was 10' wide or 30' wide, it was still a pedestrian way, and
would not qualify as a street.
Mr. Robert Miles, 2222 Shields, said he had appeared before the Council on a previous Vacation
request for this street, and the discussion then centered around whether this was or was not
a street, At that time Mr., Shields was requesting vacation of the street, and Mr. Roger
Chrysler objected, saying his property would be landlocked. Mr. Miles did not want the street
because it would increase traffic in the neighborhood, For the same reason, he objected to
duplexes being built. He and his neighbors were trying to protect their property values,

of the denial. Only two were in favor,

In answer to Mr. Mohr, Mr. Cooley said he had not seen the 1911 papers, but he was not sure
they had a bearing, He felt the County and City could not have been wrong all that time that
they had treated it as a street.
In answer to Councilman McDonald, Mr. Elfers said they were relying on both the legal question
and the equitable question. On other grounds it is a lite.ral interpretation which is unjlist
and contrary to good planni~g,
The City Attorney said the City took jurisdiction of City View because the County offered it,
and as far ashe was concerned, this was a valid county road until a court said it was not,
Therefore, it was considered a part of the City street system, and for that reason, the City
granted a building permit. The Attorney replied to Mr. Hershner that the zoning board of
appeals had acted with regard to the equities involved.

Mr. Mohr was concerned that the Council was in no position to make a decision, since it was
unsure of the authority of the zoning board of appeals. Mrs. Beal did not agree, and felt
there were two ways to look at the matter - the legal way and the common sense way.
Mr. Hershner felt if the street had been. va.cated iri bits and pieces., he could not agree more
with Mrs. Beal - he had seen the property and could not imagine a street in that gully,

Mr. Wallace Swanson, Chairman of the Garbage B'oard,Q,utlin~d the.r~port,aT1.d .explained
rates, He commented that there has been some increase in service due to the ban on
burning of clippings and leaves. Rates for apartment houses have not been increased
since 1965. Household rates were increased in 1969, and the increase requested is for
$2.35 per can over the previous rate of $2.10. There was no request for increase for
extra cans.
In answer to Mr. Mohr, Mr. Swanson said the Garbage ~oard did have a report regarding
\ a recycling proposal, but that he had been requested to withhold it untiil Dr. Car-
michael returned to the Ci ty.

There was discussion of charges for special hauling of solid waste. Mrs. Beal anq Mrs.
Campbell praised the garbage haulers for their services in this regard, and said they
felt their cooperation had contributed immensely to the success of the burning ban.
Action will be taken at the regular meeting.
City Manager express~d appreci'ation for work 'done by the Eugene Garbage Board and
its' chairman. He said complaints are readily accepted and disposed of, and that there
has been a very fine working relationship.
Res. No. 1910 - Establishing new, garbage rates for'the city of Eugene was submitted.
Mr. Teague moved seconded by Mr. Mohr that the resolution be adopted.
Councilmen were agreed that the garbage haulers had given excellent'service to residents since
initiation of the burning ban. .,
Councilwoman Campbell had forwarded.a letter to the Garbage Board from Mr. Richard Williams
which had suggestions.regarding increased rates and services. Mr. Swanson, Chairman of the
Garbage Board, said-the suggestions had been good, but with the increase in debris caused
by the burning ban, he did not feel it was a, judicious time to penalize residents for use of
an extra can, Perhaps the suggestions will be incorporated at a later time,

Mayor Anderson thanked the Garbage Board for its fine work, and said the ban on backyard
burning has been much more bearable because of the cooperation of the industry and the
Board cooperation.

Public Works Director'recommended that bids be award to lowest bidder in all. cases except
Number 3. He recommended that action be withheld on this bid and held for later consideration,
Mr, Teague moved seconded by Mr. Mohr that contracts be awarded on Items 1, 2 and 4 and that
action be withheld on Item 3.
Mr. Leigh Iverson, representing Breeden Bros. , circulated copies of Saratoga Plat to Council-
men and explained the 'problems which would be caused to their proposed Edgewood Addition Plat
by placement of the sewer line. He explained proposed streets in their plat, and how they
intended to make sewer connections. He did not feel their proposal would hold up development
of Saratoga Park.

Public Works Director said these changes could be made, and this pipe could be deleted, if
that was Breeden Bros, wish. His staff will check, and if it is feasible, the changes will be
made.
Mr, Teague added an amendment to his motion to authorize staff to delete a portion of construc-
tion in Street "A" if alternate methods of providing service on Street "B" can be worked out.
Mr. Mohr seconded. Rollcall vote. All councilmen present voting aye, the motion carried.

Coburg Road between Willakenzie Road and Bailey Lane.
This ordinance was tabled in 1969 for approval of a planned unit development. Planning
Commission now recommends adoption.
Mr. Teague moved seconded by Mr. Mohr that the bill be read tHe second time by council
bill number only, with unanimous consent of the Council, and that enactment be considered
at this time. Motion carried unanimously and the biil was read the second time.

B. Eugene-Springfield Mass Transit Study Report
Planning Commission recommended approval with the following comments:
1, The Transit Study Report represents a sound basis upon which to initiate a public
mass transit system. However, further studies are necessary to integrate transit
into the long-range, balanced transportation planning process and to develop more
precise transit system operational plans.
2, Economic self-sufficiency should not be a priority objective for the transit system.
3, The Transit Study Report should be referred to the E-SATS committee for review and
comment prior to adoption by Lane Council of Governments in the interest of furthering
the long-range, balanced transportation planning process.

The City Manager said that Councilman Williams had expressed some concern about the para-
graph relating to economic self-sufficiency.

Mayor Anderson felt this paragraph could be worded to infer that we should move toward
self-sufficiency, if possible.
Councilman Mohr suggested the wording might be turned around to stress public service. At.
a later time the need for economic self-sufficiency should be recognized.
Mrs. Campbell thought one of the points for leaving the paragraph as it is would be public
realization that transit systems are not self-supporting. They are subsidized throughout
the United States.

Mr. James Pearson, Planning Commission member, explained that this recommendation had
originated with the coordinating committee composed of members of the Eugene, Springfield
and Lane County Plannigg Commissions, and that he is a member of that committee. The
words were chosen with care. These recommendations were made to each Commission for
adoption by each of them. The Committee felt as a body that economic self-sufficiency was
an illusion, and if it was to be supportive, the purpose would be defeated. It is not
possible to strive for a successful, viable mass transit system and expect it to be
self-sufficient.

Mayor Anderson agreed, and said the Erie Pennsylvania system is self-sufficient
because of a unique siTIuatio~, The mills are located so that the buses can do double
duty in the city, He did feel, however, that the paragraph could say that economic
self-sufficiency should not be a priority, but it could be an objective, He
suggested that it be worded: "Recognizing that economic self-sufficiency should not
be a priority objective for a transit system, local government must be prepared to
meet costs of a transit system,"
Mr, Pearson said he could accept that change, and felt he could sell it ,to the Eugene
Commission and possibly to the coordinating committee,
Mrs. Beal said she could accept this amendment,
Mayor Anderson pointed out that this was a policy statement, and should be worded so
that it is perfectly understood by the public.
Councilman McDonald agreed, and said the San Diego system had been a combination
city and school system, and that it had run $750,000 in the red per year.
Mr. Teague said that the City should have a goal of trying to make the system
self-sufficient. He felt the Council agreed on this point.
Vote taken on motion to accept Mass Transit Study Report, as amended in Paragraph 2.
(First paragraph on this page, Mayor's statement). Motion carried unanimously,
V, Discussion, Budget Committee Members to be Freeholders

According't'o'state statute, a budget comini ttee member must be a freeholder; that
is, he must own property in the City in which he resides. Mr. Hodges does not own
property, and under this statute, does not qualify.
Mr. Mohr felt the Council should make its position clear, in that it disagreed
with such a qualification because it was discriminatory in nature. Discussion
followed to determdne what course of action should be taken.
Manager stated that work on the budget was the 'number one item of concern for
the City at this time, and that this should not be jeopardized.
Mr. Mohr moved seconded by Mr. Gribskov that, whereas the City Council found the
State Statute requirements for qualification for membership on a city budget
committee discrimdnatory in nature, the Council therefore, recinded the appoint-
ment of Brian Hodges to the budget commdttee and requests the City Attorney to
investigate the possibi1i ty of filing a declaratory judgment suit.
Mr, Mohr was asked to nomdnate another citizen to the budget committee in Mr.
Hodges' place.
At the last committee meeting the City Attorney advised City Councilmen that action
to rescind Mr, Hodges appointment would undermine its standing, if it wished to
test the state law requirement that a budget committee member must be a freeholder,
If the Council wishes to institute legal action, Mr. Hodges should continue, and if
it is not possible,to get a decision prior to final approval of the budget, another
appointment will be required to remain within the requirements of the law.
The City Attorney said he had checked with Mr, Hodges, and he is prepared, at Council
direction, to move into court with appropriate procedures. The City Attorney's
office has already prepared for the case so that it can move with haste, if this
is Council direction,
Councilman Mohr felt the Council's natural move would be to implement its stated policy.
The Council position was that they felt this was a discriminatory requirement.
There was Council discussion whether Mr. Hodges presence on the Committee might jeopardize
approval of the budget. It was pointed out that the requirement is only for a full
budget committee for final approval of the budget, Therefore, no. problems are anti-
cipated.
In answer to Mr. Hershner, the City Attorney said Mr. Hodges would be the party plaintiff
and the City the party defendant. The suit would be filed on an agreed statement of
controversy.
Mr, Mohr said that, based upon the stated policy of the Council, the Oregon law referring
to requirements of budget committee members was contrary to the policy of this City,
and he would move that the Council direct the City Attorney's office to file a suit of
controversy. Mrs. Campbell seconded the motion,

assured Councilmen that, should the suit fail, he had a substitute who could be appointed
immediately.

4/7/71 A. *Compensation Agreements, Employe Organizations - Eugene City Employe's Association,
AFSCME and the Police Benevolent Association have accepted administration recommendations
which are equivalent to the previously approved agreement with the Firefig{1ters. These'
will be before the Council for approval. Staff commented on its appreciation for the
,manner in which the groups worked with them on the agre~ments. approvel

30th Avenue from Hilyard to Kincaid and Amazon Parkway from 29th Avenue to Hilyard is ,I

Legislation
1, H.B.. .1229 - Relating to student scholarships in the State - The bill has deleted a: ' ~
portion relating to tuition remission for foreign students. This would affect approx-
imately 900 foreign students paying tuition at the University of Oregon.
Mr. Kenneth Ghent, foreign student advisor at the University of Oregon, outlined
the implications of this bill on foreign students, approximately 400 of which had
received "Scholarships" through reduced tuition, He explained the advantages of
foreign student enrollment, and how they enriched the campus. He said the bill will
be Defore. committee within. the next day, and reqqested the Council to send an express- '

Mayor Anderson felt the foreign student program at the University was a very vital
part of the. community and should be continued and strengthened. He recommended
the Council authorize staff to prepare a resolution seeking return of the fee remission ,I
plan.
After discussion with Mr. Ghent, Mr. Teague moved seconded by Mr. McDonald that a res-
olution be prepared as outlined above, and that it be sent to. the committee by wire.

2. S,B. 431 - Relating to alcoholism, and its treatment - Requires that alcoholism
will no longer be treated as a criminal offense and removes it from the criminal
law system. Senator Fadeley requested that the Council take a position on this bill.
Mayor Anderson said this seemed to be a topic for Council consideration, in view
of its recent action or interest in code revision.

There was d~scussion of treatment facilities in the City, and whether these would
be considered adequpte under the bill. Mrs. Vivien Hinton explained the existence
of a house for rehabilitation of women alcoholics, and how it is presently
utilized by the City.
Mrs. Beal moved seconded by Mr. Mohr that the Council express approval of S.B. 431.

E. Black Community Survey - Mr. Arthur Johnson, member of the Human Rights Commission,
reviewed the survey report end Commission responses to it. Since the Council previously
received copies of the report, he did not go into detail. He explained that. the
Commission has been charged with responsibility for ascertaining status and treatment
of minority groups ,regarding access to education, housing and employment. It is

primarilY problem-oriented, and they now know this approach is not adequate. Posi ti ve
suggestions have been made for employment of a minority relations specialist by the
City or an Executive Director for the Human Rights Commission,

successful in getting a response from the State Department of Employment to her

Mr. Larry Carter, member of the Human Rights' Corrunission, said blacks participate only
minimally in the corrununity, and few attempts have been made to encourage them to
participate. He explained the recommendation regarding police relations and that,
through better corrununication, they would be more trusted by blacks. He explained that
the recommendation for employment of a minority relatiqns specialist by the City was
made because the present position of community relations was created for investigation
and it mi ght find itself in confli ct wi th seeking employment for blacks. If it was found
impossible to employ two persons~ they were asking that the corrununity relations position
be retired. They felt the person employed should have the ability to relate to members
of minority groups. Nominations should be made from the local bJack community, and
should be screened by the Human Rights COnmllssion and the City Manager's staff, , \

Mayor Anderson :thanked members of the Human Rights Commission, past and present, who
participated in the survey. He said this survey was an evaluation of the City's efforts
so far, and that the City should not be satisfied with its progress. The survey itself
was remarkable in its objectivity, and those who worked out the mechanics should be
corrunended. It was comprehensive in scopel but went right to the heart of the problems.
It provided some very constructive approaches and set a number of suggested procedures.
The Mayor recommended appointment of a commi ttee of three Councilmen, members' of the
Human Rights Commission and a staff member to thoroughly analyze and review the survey,
and give recommendations for implementation of the results in a formal presentation to
the Council. He stressed that it was not his intention to delay this actionl and the
commi ttee should be directed to proceed immediately in acting upon. the survey's recom-
mendations. He suggested a public hearing, at which time the recorrunendations could be
presented in detail.
Mr. Williams moved seconded by Mr. Teague that the Council endorse the Mayor's suggestion
to appoint a commi ttee of three members of the Council, members of the Human Rights
Commission and a staff representative to, review the Black Survey Report in detail and make
specific recommendations which would be practical and feasible. Motion carried.

I. Deferred Assessment Request, Lilja - Mrs, Cambell had been contacted by Mr. Lilja,
111 Ingalls Way, who stated that he had petitioned the City Council to defer a sewer
assessment on unimproved real property which he owns. The petition was denied. Mr.
Lilja has spoken to the City Attorney. He informed Mrs, Campbell he feels this is a
double assessment because he has sewer line on both sides of his property.

City Manager said Mr, Lilja was' in his office this morning. and the Manager and Assistant
Public Works Director had met wmth him EO try to work out problems with his property.
Under terms of the ordinance, assessments may be. deferred only if it would be to city
benefi t. The situation with Mr, Lilja's property is no different than that of many
others. Mr. Gilman and Mr. Lilja later met with the Planning Department staff to
review the possibility of developing a lot with a panhandle access to allow development
of the rear. portion.. Another alternative w.ould be ,for the neighborhood, which has many

Mrs. Campbell explained that Mr. Lilja was not objecting to payment of the assessment,
but was requesting deferral. City Manager explained that this would set a precedent,
and that the City would be required to set up a fund to handle this sort of thing. The
contractor has to be paid when the work is completed. There was Council discussion of its
position in cases of this Mnd, and whether they shouild'work toward a state law change
so that this type decision would be administrative and could simply be challenged in court.
The City Attorney pointed out that the Council sits as a.quasi-judicial body, and that the
City position is enhanced in court cases by Council decisions. If these decisions were
administrative, there would be one hundred times as many court cases.
City Manager reiterated that, if the .Council found itself ih a position where it attempted
to adjudicate individual assessment complaints at its,meetings, the City would be required
to adopt a new process to protect itself financially. File

Mr. Barbarossa explained the inception o'f the program and the very real need for it. He
pointed out limitations to those elderly or low income persons for government subsidized,
housing, and how their group intended to encourage those in this segment to improve their
lot through "self-help." Individuals will actually help with the construction of their
own homes, thereby saving 30 to 45% of the actual cost of the home. It was possible to
work in conjunction with the government; but people had to solve, their own problems. Mr.
Barbarossa said they had received endorsement from many community agencies and organiza-
tions, and that they hoped to provide housing, using the self-help 'concept.'

Mr~~ Campbell thought the philosophy was excellent, but was unsure what the City's role
would be.
Mr, Barbarossa said they intended to be a non-profi t agency, and would have operating
costs wnLcfLwould have to be met, Their budget was $60,000 per year for the next three

he said they had contacted representati ves of labor and hoped they could overcome some of
their objections.

S.B. 277, Allowing Controlled Backyard Burning - The City Manager said it was his
understanding that, if this bill passed, it would supersede the City ordinance. He said
Mr. Vern Adkison, Lane Air Pollution Authority, would attend the hearing and had requested
Council direction regarding its position.

toward abatement of air pollution.

COUNCIL BILL NO. 9373 - Levying assessments for sanitary sewer between Gilham Road and Balfour
Street and between Holly Avenue and Terresa Avenue was submitted and read in full the first time
February 22, 1971, and held over to this meeting to allow proper notice of assessment to be given
owners of affected properties, and is brought back for consideration with no written protests on file.
Mr. Teague moved seconded by Mr.' Mohr that the bill be read the second time by council bill number
only, with unanimous .90nsen~ of the Council, and that enactment be considered at this time. Motion
carried unanimously and the bill was read. the second 'time by council bill number only.
Mr. Teague moved second~d by Mr. Mohr that the bill be approved and given final passage. Rollcall
vote. All councilmen present voting aye the bill was declared passed and numbered 16190.
COUNCIL BILL NO. 9352'- Amending zoning ordinance to set criteria for controlled income
and low rent housing was submitted and read the first' time on February 8, 1971 and was, at that
meeting, tabled indefinitely.
Councilman Williams had requested that this ordinance be removed from the table and given a second
reading. He has been in conference with Planning Commission members and staff and has suggested
a possible amendment to the ordinance which.would.allow densitv uu to 75fu of R-2 PD oensitv iu R-l
zone only, and also would el1m1nate the m1n1mum slte area prop~seu for PuD. Mr. W1II1ams~s 111,
but he called and indicated that he would have no objection to postponing action on taking the bill
from the table, or if the Council wished to proceed, he would be agreeable to that.

The Planning Director explained that Mr. Williams amendment would increase the density only in'the
lower densith zones. It was the feeling of the Planning Department that the Council could adopt
portions of the ordinance.without returning it. to the Planning Department.

Mayor Anderson felt the ordinance should go back tothe,PlanningCommissio~ for review, since there
did not appear to be an, eJTIergency.
Planning Director said there was no emergency~;that he was,-aKar,e"of,_and.the legislatimwould not
be needed for the next 15 or 20 days. ""-
Mr. Teague moved seconded by Mr. Mohr to take Council Bill No. 9352 off the table and refer it back
to the Plannigg Commission with suggestion for amendment.
Mr, Mohr explained that the bill, as it E now written, would allow extremely high density in the
R-4 area. The amendment would increase the size of units that could be considered under PUD, so
that rather than bringing a project in under a particular zone, ,it could .be brought in under the
PUD process and be more carefully controlled for density, access and other things.
Vote taken on motion as stated. Motion carried.

rezoning from RA to R-2 PD property located on the east side of Coburg Road between Willakenzie Road

able to just wade in it.
Manager explained that they were not designed for this purpose, and that there was a problem of

He did ltltrink bathing or swimming should be prohibited, but he was in favor of allowing wading. He
felt the subject should have public discussion, and that the issue should be identified.

Mayor Anderson thought that the issue was very well identified~ He explained that the Portland
fountain had been designed for bathing purposes, a fountain to be lived in, rather than loo~ed
at. ~ile a lot of people may not even like to look at ours, it was certainly not designed to be
utilized for bathing or wading. He could not see where the public iT).terest would be violated by
denial of privilege to bathe 0~ wade in the fountain. What the ordinance is trying to do is give
law enforcement people some backing which they heed to preserve the area for what it was intended.
