Regular meeting of the Common Council of the city of Eugene, Oregon was ca~led to order by
His Honor Mayo~ Lester E. Anderson with the following councilmen present: Councilwomen Beal,
Councilmen Williams, Hershner, Councilwoman Campbell, and Councilmen Keller, Murray and Wood.
Councilman McDonald was absent.
I - Council Officers, 1973 - Mayor Anderson announced the election of Councilwoman Wickes Beal
as president and Councilman Tom Williams as vice president of the Council for the year
1973. At the same time he welcomed new Council members Gus Keller, Neil Murray, and
Robert E. Wood.
II - Presentation of Plaques, Retiring Councilmen - Mayor Anderson presented engraved plaques
in recognition of service as Council members to Charles Teague (August 12, 1968 to
January 2, 1973) and Ray Bradshaw (March 22, 1972 to January 2, 1973).
111- Mayor I s Message - Mr>. Anderson read the annual Mayor I s Message, copy of which is on file
in the Finance Department.
IV - Public Hearings
A. Liquor> License Application - Ilkley Moor, 365 Coburg Road - New location for RMBC
(Retail Malt:_Beverage Class "C") submitted by St. Nizaire, Inc. OLCC report indicates
18 of 28 contacted in the vicnity of the proposed location objected.
John Morris, one of the applicants, said he has talked with people in, the neighborhood
to ascertain what the objections were and found their main concern to be about noise,
traffic, and dr>unks. He described constr>uction and operation proposed for the building
which he felt would take car>e of objections listed. He didn It think drunks would be
a pr>oblem since the oper>ation will be a restaurant rather than a tavern. In answer to
Mr. Mur>ray, Mr. Morris described the parking area in relation to adjacent residential
properties. He said he felt any objections were resolved in his conversations with
neighbors except in cases where the people tho~~ht drinking immoral.
Mrs. Beal moved seconded by Mr. Williams to recommen~ approval of the applica-
tion. Motion carried unanimously.
B. i Unauthorized Parking. of Motor Vehicles - Copies of memorandum (November 22, 1972)
I were previously distributed to Council members explaining problem of unauthorized
; vehicles parked on private property and unmetered public property and with abandoned
lor junk vehicles left on private property. Copies of a proposed ordinance which
would authorize immobilization and towing of autos for which parking fees on City's
; unmetered lots have not been paid were distributed to Council members.

: Assistant Manager asked the Council for general direction on whether the City should
become involved in enforcement on private parking lots where the owner now has the
:burden of regulating use. Staff feels use of the "boot" (mechanical immobilizing
: device) would be desirable on City's unmetered lots as something less harsh than
,towing vehicles which have a number of outstanding citations or on which parking
; fees have n~t been paid. However, it would shift the burden from the private
'property owner to the Ci ty if the same enforcement is used on pri vately-owned parking
I lots.
Councilman McDonald said there should be some consideration for owners of pri vate
'properties on which cars are abandoned, that the entire cost of removing them should
)not be at the expense of the private property owner. He asked if there is any possi-
Ibility of the towing companies' renoving the cars. Assistant Manager said there is
1 a question of use of public money for removing vehicles abandoned on private prop-
:erty. Personnel costs would amount to about $30,000 in addition to towing costs,
and expense of sale of junk cars which usually will exceed salvage value. He said
towing companies now remove such cars from th~ public right-of-way in co-operation
wi th the ci ty and cancei vably an arrangement could be worked out forpri vate properties'l
Councilman Williams asked whether owners of abandoned vehicles can be determined, and
c1 ted, thereby making them bear the cost of abandonment. He said the owner should
be liable for abandoning an auto on pri vate property or unauthorized parking on a
private lot. Assistant Manager said there would be the problem of the City's being
able to ci te _~:mly those people li ving wi.thin the c~ty_..
(councilwoman Beal suggested consideratio;'~;Uld be given also to regulations
:governing parking of cars on streets for long periods of time, that the overall
iproblem of abandoned autos, parking without payment of fees, parking in the public
right-of-way for extended periods of time, etc., should be reviewed.

'Councilman Hershner noted that the ordinance under consideration deals only with
non-payment of fees. Assistant Manager verified Mr. Hershner's question with re-
gard to the estimate in staff memorandum of three man years per year to remove
; abandoned cars .from pri vate property. There followed discussion between staff and
Council members with regard to definition of abandoned vehicles, cost to City if
, engaged in removal of vehicles from pri vate properties, problems of setting up a
, program of removal and storage, consideration of value by towing companies before
. they will remove autos, problems of determining ownership, etc.
Assistant Manager said Diamond Parking would like to have the authority to "boot"
vehicles parked contrary to their regulations. In answer to Councilman Williams,
Assistant Manager said that it is not known whether it would have to be a City
function if that authority were granted. Staff would want to explore the situation
before action is considered in that regard.
Jim Anderson, speaking for Diamond Parking, said the request originated because of
, problems with the lOth and Oak Overpark, owned by the City but managed by Diamond
,Parking. He said it is the same situation as the City's unmetered lot at 8th and
Pearl, so they were asking for the same type of enforcement tool. The ordinance
under consideration, he continued, doesn't address the same problem encountered
on other Diamond lots, but they would be interested in seeing one adopted which
would allow them to immobilize vehicles until parking fees are paid.
Councilman Williams suggested ,that Diamond should determine the legalities in-
volved in use of the "boot" on their own lots. Manager said Diamond does have the
right to have vehicles towed away for non-payment of parking fees, but that authority.
would not include i11l1TObilization.
'Ed Kenyon, Register-Guard, referred to wording on a Diamond lot "This vehicle will
be impounded..." and barrels used as a type of immobilization, and asked whether
. that was actually enforced. .7im Anderson replied that he was not familiar wi th
:the situation and doesn't know whether it is legal.
'Mrs. Campbell asked what authori ty the Uni versi ty of Oregon uses in towing un-
;authorized cars from their parking lots, and the number of cars per week towed from
'unmetered lots in the Ci ty. Assistant Manager replied that the Uni versi ty operates
under the state law as well as the trespass ordinance. He said the towing com- ;
ipanies indicate that they take away about 35 vehicles a week in addition to respondingl
,to an average of six calls a week where cars are gone when they arrive. From 9 to
12 vehicles a week they refuse to tow because their value is not sufficient to pay
,the costs of towing. No figures are available on the number of those which are
towed from parking lots.
Councilman Hershner said he would like to see a breakdown between truly abandoned
vehicles and those evading payment of fees on parking lots. Also, some information
'with regard to whether the private parking lot owner has the right to impound or
. "boot" autos. He felt this would help to determine whether the Ci ty could enact
legislation to give that right in Eugene. He said he feels it should be the property
,owners' problem in no legislative tools can be provided them.
Mr. Hershner moved seconded by Mr. Williams to schedule a public hearing on the
proposed ordinance. Motion carried unanimoUSly.

Councilman Williams wondered whether it would be the responsibility of the City's
legal department to research the option on private parking lots, perhaps it should
1lr}re appropriately be done at the property owner's expense.
Councilwoman Campbell asked what authori ty the County uses in similar instances.
Assistant Manager said the County's procedure has not been explored. Direction from
the Council was felt desirable at this point to see whether 1lr}Ie time and effort
j:should be put into the study to see if the City should become involved in enforce-
lment on private ]Xoperties. He said the memorandum from the city Attorney's office
~ (copies of which were distributed to Council) reviewed some of the legal remedies
available now, but it entails a major policy decision. Manager said in the past
the Ci ty has limi ted its invol vement to acting as catalyst between property owners
and towing companies. The Ci ty does not have staff for a program of rerrcwing
abandoned vehicles.

Council Bill No. 151 - Amending Section 5.990 of City Code and adding Section 5.285
re: Off-s~reet Parking of Motor Vehicles, was submitted and read the first time by council
bill number and title only, there being no councilman present requesting that. it be read in full.
Assistant Manager reviewed purpose for the proposed ordinance and advised that City Attorney
gave the opinion that the ordinance would apply on any City operated parking lot where an agent
is placed for management such as Diamond Parking. It applies to all City-controlled unmetered
parking lots and would extend the remedy of the "boot."
Councilman Hershner said he did not foresee its application to the 10th and Oak Overpark and
wondered wh~ther the "boot" would be used for "overtime" violations. Assistant Manager re-
plied that it is felt use of the "boot" would be less expensive to the violator then towing
expense. Its use will be controlled; unpaid fees or unpaid parking tickets will be verified
to show there is in fact a violation of ordinances. Primary need for use of the "boot" is in
those instances where permit fees for parR:ing on City lots have not been paid for an extended
period of time: In answer to Mrs. Beal, Assistant Manager said there is legislation already
in existence to allow use of the "boot" on metered lots.
Councilwoman Campbell asked if the ordinance spells out length of time a car is parked before
it can be booted. Assistant Manager replied that this ordinance provides only that a car can
be booted if there are unpaid permit charges, outstanding citations, or unpaid fines.
Mrs. Beal moved seconded by ,M~. W,illiams that the, bill be re.adthe. .second time by
council bill number only', with unanimous consent of the Council, and that enact-
ment be considered at this time. Motion carried unanimously and the bill was read
the second time by council bill number only.

C ..RezQning Recommended by, Planning Commission December 12, 1972
1. Rezone from R-l to RG area on northwest corner ofl7th 'and Chambers (Cedar Lane
Company) - Applicant originally requested RP ZOnilJg on properties now zoned RG
and R-l. Planning Commission recommended rezoning the R-l portion to RG and
leaving all as Garden Apartment Residential District.
Planning Director noted history of controversy in this area when the existing
clinic was allowed. Commission was concerned about spread of commercially-zoned
property and the fact that the RP zone would allow many types of professional
offices and certain commercial uses not compatible with the neighborhood. The I Comm

recommended RG zone would allow expansion of the clinic desired by the applicant.l/3/73

Councilman Murray asked the.staff's feeling with regard to R-l and R-2 zones in this
general area. Planning Director said the Commission feels C-2 on 11th to R-2 on 12th
to lesser density farther south are appropriate uses for this area for some time.
There is no specific plan to rezone additional property in that area. The R-2 zone
for these properties on the '-S-outh side of 12th is deemed appropriate transitional
use and compatible with. the surrounding R-l
Council Bill No. 152 - Rezoning to RG the area located at northwest COrner of
17th and Chambers was submitted and read the first time by council bill number and
title only, there being no councilman present requesting that it be read in full.

2 ,'Rezone from R-l to R-2 area on south s.ideof 12th between Grant and north/so~th
alley between Grant and Hayes (Hurst) - Planning Commission reconunended approval
of R-2 zoning as appropriate for the area. It is anticipated that RG zoning to
the north will be phased out. A triplex development is proposed for the property
which is now vacant.
Planning Director, in answer to Mrs. Beal's question as to whether R-2 is better
for the area than RG, said the Commission felt the R-2 zone would be in the best
'interests of the City because of its consistency with the 1990 General Plan and
the desire to upgrade the housing in that area.
'In answer to Councilwoman Campbell's question as to amount of control the Com-
mission has over location of parking areas for apartment houses, Planning Director
said regulations adppted with the new zoning ordinance require setback for parking,
area, and that unless property is developed under oondi tional use, si te review,
or PUD, the parking can be located in front with the property setback. Prior to
adoption of the new ordinance parking could be located to the property line.

.Councilman Murray asked whether there has been a change with regard to R-l prop-
:erties in the West Eugene area or whether this recommendation applies only to the
jimmediate vicinity of this zone change request. Planning Director said they are
jtrying to maintain single-family density and do not want to increase beyond an
:R-2 density in that area.

the projects was recommended.
With regard to 43rd Avenue sewer east of East Amazon Drive
said the cost per square foot was high because of terrain.

Councilman Williams asked if there is possibility of bids being withdrawn on the 2nd
Avenue sewer (Item 2) in view of the differential between the low bid and the others sub-
mitted. Public Works Director said there has been no indication of withdrawal.
Councilman Keller asked about the difference between budgeted cost ($3,500.00) and
estimated cost ($22,200.00) and cost to City ($11,301.69) on the Echo Hollow storm sewer.
Public Works Director explained that it was planned to do only a part of the p~oject
when funds were budgeted. Since passage of bond issue for public works improvements, it
was decided to combine, storm sewer and paving for Echo Hollow Road rather than accom-
plishing the work under two separate jobs. Balance of the funds will be budgeted
next year. Counciman He:r>shner questioned the total cost shown on the tabulation in
relation to the bid price - some $2000 more than bid. There was ,no explanation.
Mrs. Beal moved seconded by Mr. Williams to award contracts to low bidders
on each project as recommended. Rollcall vote. All councilmen present
voting aye, motion carried.

In making the appointments and recommendations, Mr. Anderson explained his policy

,Mrs. Keever because of a study in progress which will likely continue for another

:previous1y recommended construction of a cul-de-sac on Portland between 29th and
129th Place, cost to be assessed against benefiting properties, as a condition of

!rezoning to RG certain properties on the east side of Portland Street. Since that
i time a barricade has been erected at Crest Drive to prohibit through traffic. No
agreement has been reached among residents in the area with regard to further barri-
cading for diverting traffic or for noise control, and there is still considerable
disagreement in the neighborhood with regard to closure of the street with or without
the requested rezoning.
Jack OUConnor is now requesting reconsideration of conditions of rezoning. Planning
Commission feels it inappropriate to consider unless referred back by the Council.

members would meet at 7:00 p.m. on January 8, 1973 in the Mayor's office for
the purpose of electing a president and vice president for the new year.
J. Ad Hoc Council Corruni ttee, Ordina:nce Study- Councilmen Hershner (chairman),
Bea1, and Murray were appointed as members of an ad hoc comndttee to study and
make recommendations to the Council on the ordinances having to do wi th dis-
orderly conduct,public indecency, and resisting arrest. which were tabled at
the December 18, 1972 Council meeting. It was understood Mr. Hershner would
call a meeting of the conmrittee.
K. Swearing-In, Mayor and Councilmen - Mayor Lester E. Anderson and Councilwoman
Wickes Bea1, re-e1ected in November 1972, and newly elected councilmen Gus
Keller, Neil Murray, and Robert Wood received the oath of office from City
Recorder Flogstad.
L. Budget Meeting - Manager announced Budget Committee meeting scheduled for
ThurSday, January 4, 1973, 7:30 p.m., in the McNutt Room.
M. Appointment, Jim Luce, Legislative Liaison - Manager announced appointment of
Jim Luce, law student at the University of Oregon, to work part time as legisla-
tive liaison in the Manager's office during the 1973 session of the Oregon
Legislature.
