Adjourned meeting of the Common Council of the city of Eugene, Oregon - adjourned from the meeting held May 14, 1973. - was called to order by His Honor Mayor Lester E. Anderson at 7:30 p.m. on May 29, 1973 in the Council Chamber with the following councilmen present: Mrs. Beal, Messrs. Williams, McDonald, Mrs. Campbell, Messrs. Keller, Murray, and Wood. Councilman Hershner was absent. Councilwoman Beal read a statement 'of apology with regard to meeting of the Council she called on May 21 without notifying the news media. She said there is no provision in the Council by- laws for informal meetings of the members, which was the type of meeting held. She recognized that without the news media in attendance there was no way the public could know that it was an informal meeting, and said meetings of that nature would not be called in the future. At the conclusion of other business, Councilman Murray expressed appreciation for Mrs.Beal's statement. He said it did not seem appropriate for her to take the entire blame since any one of the Council members could have left the meeting, and none did. Mrs. Beal: moved seconded by Mr;Williams to accept the proclamation as presented. Motion carried unanimously. II - Public Hearings A. Abatements 1. 1955 West 23rd Avenue, Burgoyne Building Department has been unsuccessful in attempting to have the property owner remove debris from a partially demolished structure west of her property. Letter from Virginia Burgoyne, owner of the property, was read stating building was removed. However, Manager reported that building materials and other de- bris remain on the lot in a less than satisfactory condition from staff's viewpoint. Public hearing was held with no testimony presented. - Resolution No. 2183 - Authorizing abatement at 1955 West 23rd Avenue was submitted. Mrs. Beal moved seconded by Mr. Williams to adopt the resolution. Motion carried, all councilmen present voting aye, except Councilman McDonald abstaining. 2. 4291 East Amazon Drive, Rogers John F. Rogers, owner of the property offers no protest to City's efforts to remove debris left by contractor in demolition of building on the property. Public hearing was held with no testimony presented. Resolution No. 218~ -' Authorizing abatement at 4291 East Amazon Drive was submitted. Mrs. Beal moved seconded by Mr. Williams to adopt the resolution. Motion carried unanimously. I . B. Rezoning 1. Area on east side of Portland between 29th and 30th (Pohll, O'Conner, Melevin) Council had previously approved multiple-family zoning subject to construction of a cul-de-sac on Portland between 29th and 29th Place and development of prop- erty under planned unit development procedure. Subsequent to that action, barricade was placed at the south end of Portland at Crest Drive thereby eliminat- ing thr~ugh traffic. Petitioner asked reconsideration of the rezoning request because of the change in traffic pattern. Planning Commission on April 23, 1973 recommended R-2-4 SR (Multiple-family with minimum of 4000 square feet per unit under site review conditlons). Now zoned RA. Public. hearing w~s opened. \CcA 5/29/73 - 1 E. M. .Matthews, 2935 Portland Street, objected to the multiple-family zoning, saying apartment housing would lower property values. It was his understanding that cost for construction of a cul-de-sac would be charged to abutting properties. Manager explained that cul-de-sac construction was not required as a part of the present recommendation. Mr.. Matthews requested construction of a fence between his property and that on which rezoning is requested if apartment houses are built. He felt that ,would prevent anticipated vandalism on his property. .: Harold Wald, 2973 Portland Street, also expressed opposition to the rezoning and presented letters from other residents of the area objecting to apartment construction on the basis that it would add traffic and there is ample multiple- family housing in the area now. Public hearing was closed. Council Bill No. 262 - Rezoning to R-2-4 SR area located on east side of Portland Street between 29th/Avenue and 30th Avenue was submitted and read by council bill .number and title only, -there being- no councilman present requesting that it be read in full. Councilwoman Campbell and Councilman Murray expressed a desire to view the property in question. Jim Saul, planner, explained in answer to Mr. Murray that under the R-2-4 zoning approximately nine units would be permitted on four contiguous parcels, this in comparison to about 20 which,would have been allowed under the RG recom- mended when the matter was previously before the Council. .,; Mrs. Wald requested that their property be fenced also, if the Matthews property was to be fenced. Manager explained that the Council does have authority to re- quire fences under the site review conditions if they are needed and desirable. It was understood that C.B.262 would be held to give opportunity for Council members to view the area under consideration. 2. Area at 1381 Bailey Hill Road (Cascade Steel Fabricators) RA to M~2 SR -Rezonliui fromRA toH''M".;.2 SR areaOiocated at-13-STBidleyHili 'Roacf;-cascade--si:e~l - Planning commission on December 27, 1971 reconunended approval, pending completion i of contract with petitioner. That contract was completed May 1, 1973. It provides . that proposed use of the property will be discontinued by December 31,1990 at which time the use will revert to whatever is appropriate in accordance with the then adopted General Plan. Proposed use at this time is to expand Steel Fabricators building eastward. Commission felt there would be conflict between this heavy in-.' dustrial use and adjacent R-2 and RA zones, but the heavy industrial use is in "'_, existence and it seemed that an amortization period would best resolve the conflict. Mr. Wood moved seconded by Mr. Williams that public hearing be scheduled on the . request at the May 29,1973 meeting., Motion carried unanimously. Council Bill No. 263 - Rezoning to M-2 SR area located at 1381 Bailey Hill Road was submitted and. read by council bill number and title only, there being no councilman present requesting that it be read in full. Mrs.. Beal moved seconded by Mr. Williams tbat the bill be read the second time by council bill' number only, with unanimous' consent of the Council, and that enact- ment be consider~d at this time. Motion carried unanimously and the bill was read the second time by council bill number only. Mrs. Beal moved seconded by Mr. Williams that the bill be approved and given final passage. Rollcall vote. All councilmen present voting aye,ihebill was declared passed and numbered 16795. C. Plan Checking Fee Copies of the proposed fee schedule for plan checking were previously distributed to~ Council members. The fee is designed to cover the majority of City cost for reviewing plans for conformance to building codes prior to granting building permits. . Council Bill No. 264 - Repealing Section 8.025(5) of City Code re: Plan Checking Fee was read by council bill number and title only, there being no councilman present requesting that it be read in full. Councilman McDonald asked for explanation of the procedure for initiating the plan checking fee. Assistant Manager explained that terms of the Uniform Building Code \CoS 5/29/73 - 2 .' cover use of a plan checking fee. However, the City Code holds that section of the Uniform Code inoperative, and removal of that language from the City Code has the effect of putting the fee into operation. Manager explained that the proposed change would not change the status of single-family or duplex fees, only commercial, in- dustrial, or multiple-family housing larger than a duplex. Mrs. Beal moved seconded by Mr. Williams that the bill be read the second time by council bill number only, with una~imous consent of the Council. Motion carried unanimously and the bill was read the second time by council bill number only. Mrs. Beal moved seconded by Mr. Williams that the bill, be approved and given final passage. Rollcall vote. All councilmen present voting aye, the bill was declared passed and numbered 16796. D. Truck Routes Maps of proposed truck routes were previously distributed to Council members. Planning Commission on April 23, 1973 recommended adoption of the plan as submitted by the Transportation Planning Committee. Favorable Council action would entail recommenda- tion for establishment of the proposed routes to the State Highway Commission, 'thereby requiring heavy trucks mo bypass other than designated streets in traversing the City. Public hearing was opened. e Mike Helquist, 2456 Madison Street, speaking for Citizens for Noise Control, recom- mended adoption of the plan. He said various neighborhood or'ganizations in the City also favored its adoption. ," ' Nick Maskal, 4652 Briars, principal of Lincoln School, favored the plan also. He noted the significant. portion of heavy truck traffic around Lincoln School and said he felt designation of other streets for trucks wouid contribute to the safety of children going to and from school. Public hearing was closed. Councilman McDonald thought motorcycles should be included because of the noise factor. He favored designated truck routes to promote safety and lessen congestion, but felt noise control also was extremely important. Councilman Wood wondered whether the proposed routes ,~ould be required for local de- livery travel, thereby eliminating use of residential streets. He thought load limits might have a bearing upon which streets could be used. Manager said there was no attempt to establish load limits, the limit in the State law was the only authority. Councilman Murray supported the plan, saying it would be a meaningful step in protect- ing neighborhoods west of the downtown area. . Mrs. Beal moved seconded by Mr. Williams to adopt the plan and transmit recommendation to the State Highway Commission. Motion carried unanimously. E. Motion carried unanimously. c.:purchase, Mathers Property - Councilman Hershner said he had reviewed the two , \ memos from the City Attorney's office with regard to personal liability of Council members and right of acquisition in view of the Freeway Charter amend- ment of the Mathers property. He said he would not want to change his vote which was in favor of purchasing the property. Councilman williams agreed. It was understood staff was authorized to proceed with the purchase (see Council May 14,1973). D. Liquor License, Back Door, 1046 Oak Street - Request for greater privilege (RB to DB) by Back Door, and adding Henry Falkenstein to list of stockholders. ;OLCC report lists no objections. Staff has no objections. Mr. Williams moved seconded by Mr. Wood to recommend approval. Motion carried , unanimously. E.,Agreement with State re: Resurfacing Washington and Jefferson from 1st to 6th - Staff requested aut:horization to send letter of agreement to State on sharing 50/50 the cost of overlay paving to upgrade Washington and Jefferson between : 1st and 6th. The Commission recommended endorsement of I the 'proposed zoning (scheduled for hearing May 22, 1973) with the following IChanges: (1) Amend the Rural Residential District to assure minimum lot size of five acres; (2) delete certain airport uses from t:he Airport District; and (3) , creat:e a new dist:rict - Airport Operat:ions District - to include those uses de- l '; leted from the AP District. Councilwoman Beal asked the reason for strict limitation on numbers of animals per acre. Mr. A1ltucker explained that the limitations are set by the C::'unty 'zoning code. In answer to Councilwoman Campbell, Manager explained that the districts constitute land use control areas. Airport Commission recommenda-\: Commission. Motion carried, f . -.; ~ ! "Comm 5/16/73 Approve . John Alltucker, Airport Commission chairman, presented copies of letter addre$sed to the Council listing changes in the Commission's recommendations since consideration of the zoning by the County Planning Commission. The recommendations were that (1) north quarter approach facilities and lights should be designated within Airport area uses; (2) area within Airport boundaries itself should be distinguished from that outside; (3) AGT zone accepted for the City-owned 80 acres, although there was some discussion as to its eventual use; (4) recom- mendations other than zoning be taken into consideration; i.e., that consideration be given to acquiring title to properties close to the Airport, or to air rights, because unlimited growth in that area could eventually detract from airport use or even close it; and that action be started to prevent development of adjacent farm lands to a higher use. With regard to the latter and in answer to Councilwoman Beal, Assistant Manager explained that the Airport Commission was concerned with ensuring protection for the Airport facility and at the same time provide a favorable economic climate for adjacent agricultural uses. Mr. Alltucker added that the Commission had not adequately researched studies with regard to adj acent land uses in other states so is not prepared to make a::recdmmendation at this time. Councilwoman Campbell asked whether favorable action taken at this meeting would be to approve an unknown figure for land acquisition. Manager explained that approval of Airport Commission recommendations were policy matters only. The Commission sees acquisition of the land as a resolution of anticipated problems in operation of the Airport and is asking that Council and Commlssion work toward the solution without any commitment at this time which will actually achieve acquisition. In answer to Councilman Wood, Mr. Alltucker explained that in some cases acquisition of air rights is more costly than actual purchase of the land, in other instances the reverse is true. Councilman Williams felt political pressures would build if development of p~operties near the Airport is allowed to ~ontinue without control. He said he would abstain from voting because of conflict of interest. It G. :.z:owntown Free Parking Program - Council was invited to hearing (May 16,1973) ;before the Downtown Development Board on its free parking proposal on which a !recommendation will be brought to the Council after this hearing. One problem iencountered in the creation of the free parking district and acceptance of the planl 'by those businessmen and operators in the affected district is the overlying obli- gation of assessment for the 10th and Oak Overpark. It was hoped that the free parking program would be sufficiently well funded to assume the 10th and Oak assessments, thereby making equal assessment to all in the new district. However, it appears the cost would be greater than can be absorbed. Manager explained the ,formula proposed that those peop~e paying assessment for the Overpark will not Ibe obligated to pay into the free parking district if their,free parking district assessment is less than or equal to what they are paying, on' the Overpark. Use of tax increment money from the dowrit:own renewal project was suggested a.s a way of relieving the double Obligation. Staff recommends that the Council declare las its future intention that after obligations of the renewal project are met, !tax increment funding might be used to relieve the Overpark assessment obligation. Staff would like to be in pOsition at the hearing before the Downtown Development Board to say the Council would be ,willing to consider use of tax increment funds as a means of financing free down- I town parking. .; Manager reviewed formation of the 10th and Oak Overpark district and assessment procedure. Councilman Murray wondered what effect the proposed free parking would have on use of the OVerpark facility. Traffic Engineer williams said that it is anticipated use 9f the facility, to be included in the program, will be increased ,if free parking is provided. He said it is very likely the Development Board would guarantee $2080 monthly (included in the proposed district's operating budget) ; toward payment for the OVerpark, with that amount to be reviewed annualiy with the , potential of being increased 10% each year on a compound basis. David Hunt, ERA 'director, noted a study proposed on parking facility planning in the downtown area and said he felt that study would develop further information on the overall impact. Councilwoman Campbell wondered what effect the proposed financing of the free ,parking would have on repayment of the Overparf bonds, and whether people in the :proposed district realized they would still have an assessment to pay. Manager 'explained use of tax increment funds would result in earlier payment of the Over- jPark bonds. Mr. Hunt added that pledging of the tax increment monies would have ,the effect of phasing out assessment payments for the Overpark. Comm 5/16/73 Approve "Councilwoman Beal said that in the consideration of new construction and adding :to parking facilities the increased use of mass transit and possible limitation on ; the use of private cars should be taken into account. She asked whether Mass Transit ,District had been consulted with regard to bus service. It was pointed out that al- : though other means of transportation are important considerations, at this time it J would cause serious delay for a group of people trying to receive some indication : of the Council's intention on what appears to be a logical method of financing : a free parking program. Concerns of this nature will be covered by the study on ;parking facilities planning. Mr. Hunt said the Agency is working with the Mass :Transit District on central transfer point in parking garage basements to enhance ,bus servi ce. Vote was taken on the motion as stated. Air Rights over' Pedestrian Alley, east' from Willamette between 8th arid Broadway The Eugene Renewal Agency requested an indication,of the Council's feeling toward 'private use of air rights over the pedestrian walkway running east from Willamette Street between the present Del Rey building and Latham's. Developers of adjacent : properties would like to know before design work is started whether that use would ibe allowed. Mr. Hunt said there are several alternatives for briding or building ,over the alley with retail shops on the ground floor. He displayed a map of the area and noted that the alley is owned by the City in fee simple. ~~J:::'. Comm 5/16/73 Approve "Mr. williams commented on the desirability of covering as many walkways :mall as possible to minimize exposure to wet weather. I. LeglsTatl.on; iiJR 7,' iiii 2276, 8B 396 - Use of Gas Tax Funds for Mass-Transit - ,'Councilman Williams read letters prepared at the direction of the Legislative Subcommittee and addressed to chairmen of the House and Senate Transportation Committees stating the City's position in support of HJR 7 and HB 2276, and of ,SB 396 if, and only if, HJR 7 and HB 2276 are passed. SB 396 would authorize ; $150 million bond issue for highway purposes, and the subcommittee felt commit- ment of those funds should not be made unless voters are permitted to decide :whether gas tax funds should be used for mass transit purposes. I Councilwoman Beal, in answer to Mr. Murray, explained that although the Council has previously taken a position favoring use of gas tax funds for mass transit, '. She suggested a copy be sent to House Speaker Richard Eymann and that the letter be signed by the Mayor, and herself as Council President. -. ,Mrs. Beal moved seconded by Mr. Williams to authorize the City's position as :stated in the letters. Comm 5/23/73 Approve ;Mrs. Beal said the subcommittee did not study effect this legislation would 1have on the city'of Eugene but would work on it if, that ,is wanted by the Council. I Councilwoman Campbell wondered what effect th~ leg~slat~on would have on the present method of funding transit districts through payroll tax. It was ex- :plained that local transit districts determine the method of funding their districts. Vote was taken on the motion as stated. The events are scheduled i for June 15 and 16 and include a fashion show with IIOdels from several stores, ! an art show in which artists may be selling Paintings, a boat show which may in- clude representatives from boat dealers. Underground Wiring, EWEB Inquiry - Inquiry was received from Eugene Water and' Electric Board with regard to oonversion of overhead electric system to under- ground on Franklin Boulevard from Onyx Street to east of Garden Avenue. The in- quiry went to all property owners in that area asking whether they would be will- , ing to participate in the cost and responsibilities of oonversion; if so, to what extent. There was no indication of costs. City owns a strip of property fronting on Franklin Boulevard in that area which EWEB is considering possibili ty of improv- ing as a major entrance to the Ci ty. Present transmission lines are on the north . side of Franklin, there is no indication whether properties on both sides or only , one side cf the street would be assessed for the work. Individual neighborhoods then could be encouraged to assume the cost of underground wiring on residential streets. He suggested meeting with EWEB to see whether a policy could be developed. Councilman Williams said he felt it would be better to meet with EWEB and agree on an overall program for the community rather than agreeing to participate in the Franklin Boulevard project. Councilwoman Beaithought it would be well for city and EWEB staffs to develop costs and a proper way to establish some way of paying for underground wiring other than being absorbed by property owners. Beal moved seconded by Mrs. Campbell that staff arrange a meeting between the Council and Eugene Water and Electric Board at an appropriate time to discuss ways in which underground wiring could be accomplished. He said drainage for tanks in the plat is as good as any in the area. Councilman Hershner expressed concern about overloading open storm channels across private property with water from newly paved subdivisions. Councilwoman Beal thought owners of properties outside the plat should be notified of the project before the petition is accepted and befo,re any expense incurred in engineering and design work. She felt that Council was more'or less pressured into going ahead with a project after the engineering work has been completed and bids called. Manager suggested if property owners are notified at time of initiation of a project it would result in two public hearings before the Council. Mayor Anderson thought petitions should be considered from the view- point of whether the Council decides a project is needed. Then when the design and cost estimates are presented at,time of bid award, there is something definite upon which to base a decision. Public Works Director reminded the Council of procedure previously followed of holding public hearings when adoption of improvement ordinances was considered. This resul ted in two public hearings, the second at the time df bid award, and the Director felt the present method of notifying property owners of public hearing when bids are considered is much better. He said the Council should in no way feel pressured because of time spent on engineering and design work. It is not wasted because plans on those projects which are not carried forward are saved with the knowledge that at some future time the project will be constructed and those plans used. Councilman Williams noted that the petition carried 60% of the property to. be assessed and felt it would be another matter were it not a majority in favor of the improvements. Public Works Director also discouraged the Council from relying on petition percentages when considering installation of sewers, because there is an obligation to initiate sewer construction where there may be health hazard situation. Manager add~d.that the $55,912.50 item to Emery and Mildred Pruitt was the City's last payment on a 50/50 t>asis with the Federal gover~ment for acreage in SpencersButte Park. Mrs. Beal moved seconded by Mr. Williams to adopt the resolution. Rollcall vote. Motion car- ried, all councilmen present voting aye. Manager announced Budget Committee meeting scpeduled for, Thursday, May' 31, to review and make.recommendations with regard to revenue sharing funds t9.be used for social,services, t?ose recommendations to be presented at a joint City/County Budget,meeting on Thur~day, June 7.
