M I NUT E S EUGENE CITY COUNCIL Council Chamber March 25; 1974 Adjourned meeting of the Common Council of ' the city of Eugene, Oregon - adjourned from the meeting on March 11, 1974 - was called to order by His Honor Mayor Lester E. Anderson at 7:30 p.m. on March 25, 1974 in the Council Chamber with the following council'members present: Mr. Williams, Mr. Hershner, Mr. McDonald, Mrs. Beal, Mrs. Campbell, Mr. Murr.a:y,and Mr. Wood. Councilman Keller was absent. Vacation of easement at southeast corner of Gilham Road and Salley Way (City EV 74-1) Recommended by the Planning Commission January 14, 1974. Easement through Jeppeson property no longer needed since utilities were already located in other areas. . 0187 .-= Public hearing was held with no testimony presented. Council Bill No. 470 - Vacating easement at southeast corner of Gilham Road and Salley Way was read by council bill number and title only, there being no councilman present requesting that it be read in full. Mr. Williams moved seconded by Mr. Hershner that the bill be read the second time by council bill number only, with unanimous consent of the Council, .and that enactment be considered at this time. Motion carried unanimously and the bill was read the second time by council bill number only. Mr. Williams moved, seconded by Mr. Hershner that the bill be approved and given final passage. Rollcall vote. All councilmen present voting aye, the bill was declared passed and numbered 16998. B. Bids - I.parks Department (Opened March 21, 1974) For Shasta ballfield backfield fences, concrete aprons, and players' benches. Wildish Construction Company Concrete Unlimited, Inc. Devereaux and Pratt $ 20,791. 77 22,233.15 23,261.20 $ 21,752.14 Estimate Staff recommended award to low bidder. Public hearing was held with no testimony presented. Mr. Williams moved seconded by Mr. Hershner to award contract to the low bidder, Wildish Construction Company, on bid price of $20,791.77. Rollcall vote. All councilmen present voting aye, motion carried. 82 3/25/74 - 1 III - Consent Calendar Items acted upon with one motion after discussion of individual items if requested. Previously discussed in committee meetings on March 13 (Present: Mayor Anderson; Councilmen Williams, Hershner, Beal, Campbell, Keller, Murray, and Wood) and March 20 (Present: Mayor Anderson; Councilmen Hershner, McDonald, Beal, Campbell, Murray, and Wood). Minutes of those meetings appear below printed in italics. 02~. ---- - --'-'-~.-..__.--_..-- ,-. ~ .-..\~ "I' ,... . . ,',- A.Request for vacation of alley between Monroe and Madison, 25th to 26th (Blackstone - AV 73-3) - Planning Commission on February 11, 1974 recommended denial of the vaca- tion. The Commission further recommended that the applicant be referred to the Zoning Board of Appeals for assistance. The recommendation resulted because of ,objections from neighbors using the, alley for access. Some Council members viewed the site on tour. Manager explained that an addition to Mr. Blackstone's house 'at the corner of the alley and 25th resulted in encroachment upon the setback area. When building permit for the addition was issued it was not discovered that the falleywas a ded.:J.c:ated right-of-way.. Mapac;er.:, said tJ:a t the zoning Board had the authority to waive the five-foot setback requirement. If' any portion of the hous~ actually encroached upon the right-of-way and did not hinder any public uS,e, a revocable permit could be granted. Stanley Blackstone, 4125 Jessen Drive, explained that a survey received since con- struction of the addition showed the original structure about six inches from the 'property line. After construction of the addition, the violation of the sethack area was discovered. Mr. Blackstone said he would accept either vacation of the alley or an irrevocable permit. He noted that the original structure had been in existence for 25 years without objection to its proximity to the property line, and that a permanent easement would still provide access for other properties abutting the alley. --"'" " -, .' Councilman Williams fe1 tit would not be proper to vacate the alley in view of opposition in the neighborhood. And he was 'hesitant about granting an irrevocable permit which he felt would be setting precedent, placing the City in the position of granting permission for building in public rights-of-way, either by accident or design, after the fact. However, he could see no reason why the building should be removed and suggested a revocable permit might be appropriate. Manager said staff recommendation would be to refer to the zoning Board of Appeals , for consideration of setback variance and for overhang over the alley right-of- way, granting a revocable permit. In answer to Mr. Blackstone, Manager said that such a permit would appear on the title but similar situations have presented no problems. M~~ger ex- Iplained that an administrative process had been followed for some ti~e ~hereby any irequest for water main extension, either within the city or outside: areas not being served, was referred to the Eugene Water & Electric Board, Lane County, and LCOG for [feedback before EWEB decided whether to extend the main. That proc~ss~ he said, was [similar to the policy proposed by LCOG. Staff had no recommendatio~s with regard to 'wordin~ changes. Manager noted that the 1973 Legislature gave to the Boundary Com- Imission review authority for extension of water and sewer lines o~tside .city or special district boundaries, so the Commission had need for a policy statement for guidance also. .... Gary Chenkin, planning department, represented the city on a committee of LCOG agency members which prepared the proposed policy. He said the present..process for extending service within the urban service boundary but outside city'or special dis- 'trict limits probably would not be affected by the policy. It was aimed basically :at extension of service beyond the urbans~rvice boundary entirely. ,_.-~,. -, " - 'Councilman Williams asked whether adoption of this policy would preclude service to the River Road area bya metropolitan area sewer service distric:t wjthout requiring :annexation "to the City. Manager answered that there was no cqnfl,ic;t.; 'it would be a !question of city policy on annexation. Councilwoman Cq,mpbell favpred the policy 'and said she would endorse it. ' , &3 3/25/74 - 2 . Councilwoman Beal asked for clarification of Item 2(b) in the resolution which would permit extension to planned urban areas outside established urba~ s.ervice areas. Mr. Chenkin explained that this provision would allow extension of service to an urban area for which there was a recognized plan 11ut which had need for outside ,source of w~ter. It would prohibit tap of that service between tb~ source and the urban area. Councilman Wood said that an established residence ~tween the source and the urban area however could be served for health hazard reasOns ~pOn approval. ;He added that without the prohibition for tapping a service line there would be no :way to determine the service available to any particular area. rhis Policy would ;provide a plan for the available service and the need as a basis for making decisions 'Comm with regard to extension of lines. ,,_3./13/74 , -Approve Mrs. Beal moved seconded by Mr. Williams to inform LCOG that the Eugen~ City Council had no suggestions, changes, or recommendations with regard to the proposed policy. (Bike Easement, 12th between WiLlamette and Oak - Councilman Murray wondered Iwhether it would be appropriate for staff to investigate the possibility of ac- iquiring an easement through the property where ,12th Averme would run if dedicated I between Willamette and Oak Streets. He said it was his understanding the property : was being considered for development and he wanted to explore whether ,the current :;~ike route through that location, created by popular use, could be retained. [Bill Sugaya, comprehensive planning, said he had seen plans in the building de- !partment for a high-rise condominium type structure at that location. JMI'. Murray moved seconded by Mr. Wood that staff explore the possibility of the leity's acquiring a bike easement through the property. I I I ! Appointment, Citizen Represen61tive, Regional Sewer Commission - Managerre- ported that Mark Westling of the Bureau of Governmental Research and Service 'was willing, if appointed, to serve as the City's citizen representative on the 'recently created Regional Sewer Comm,ission. Manager reviewed Mr. Westling's j'qualifications and his tenure with the. Bureau 'during which he was concerned [primarily with public works and planning activities in the Bureau's advisory I j role toci ties throughout ~the State. Comm 3/20/74 Approve i ---' a. 3/25/74 - 3 F. Traffic Diverters, Westside Neighborhood Quality Project - Copies of memo from ,Traffic Engineer were previously distributed to Council members. A sketch attached showed location of temporary traffic diverters proposed by the Westside Neighborhood Quality Project at intersections of Broadway and Madison, lOth and Adams, and 12th and Tyler for the purpose of discouraging use of the six streets as arterials. The proposal included the provision for traffic count before and after the installations to determine whether permanent diverters would be installed. -- Adrian St.Clair, 652 West ~roadway, chairman of the Neighborhood Project's traffic ,committee, pointed o~a picture displaying the type of diverter proposed. She said that a questionn~ire mailed throughout the neighborhood resulted in overwhelm- jing support of the proposed diverters as the best possible solution to traffic iproblems on the neighborhood streets. She added that bike routes were provided in connection with each of the diverters. ~Gordon Elliott, 1287 Irvington Drive, said he planned to eventually live in that neighborhood and he objected to the installations. He,expressed concerns about their! effect upon west-to-east traffic movements, saying they'would effectively block every route except 11 th and 13th, 6th and 7th, and make i t:-even_ more di!ficuTCror people to get to the downtown mall. He felt the installations would be too co~tly .and that the cost would be lost if the diverters were removed after a period of time. Also, .-that_t:hose...p;r:esent. at the meetings and proposing the diverters were not ~.,-," representative of Eheentire neighborhood. He thought the diverters would be con--/ ducive to speeding in the blocks closed off. Mr. Elliott suggested instead revers- ing the one-way traffic on 11th Avenue with a tie-in at about City View. He also suggested lower speed limits or stop sign on the streets in question. He expressed 'concern that such neighborhood proposals would cut off access to certain areas of ,the City and that any proposal should be shown to benefit the City as a whole before (installation proceeds. !. ~.~. ,Bill Turner, 1165 Taylor Street, member of the Land Use Committee of the westside .Neighborhood Project, said the purpose of the group was to maintain the "old Eugene quality" of that neighborhood, and they felt the inconvenience of traveling two or 'three blocks out of the way rather than having arterials through the area would (help to retain the single-family residential character. He added that traffic ,analysis data on the temporary installations would indicate whether there would be : permanent diverters put in. If they proved to be a detriment to the neighborhood or to the City as a whole they would not be installed. '". .~.- . 'Mr. Elliott said that the bus routes would also be affected~b~<the installations. He felt it more convenient for the busses to travel Broadway, [Othh and 12th because the heavier traffic on 11th and 13th would hinder loading and unl()adingof passengers. He added that the extra travel to get around the streets blocked off would also add i to the air pollution problem. ~ -- 'Councilman Murray noted that the busses travel 8th Avenue. Councilman McDonald referred to the votes recorded at the westside Neighborhood ~eet- ing on..the issue and said it seemed a small number of people were involved.' Councilman Hershner asked ~ent on the abili ty of people not familiar w~ :neighborhood to find addresses when confronted with a blocked street. Al Williams, " traffic engineer, felt there would be no problem in that regard. He wondered whether numbering blocks at intersections on arterials had 'eTTer been considered. Councilman McDonald noted the numbering systems in newer :areas of the ci ty and complimented the public works department for that achievement. I . ~ ~~, Mr. Murray moved seconded by Mr. Wood to place the proposal on the March 25 Council :agenda for public hearing. ;Councilwoman Campbell asked Mr. Elliott if he didn't think the inconvenience of itravel;ng two or three blocks out of the way would be worth adding to the liveability lof the ne~ghbOrhood. Mr. Elliott answered that he was concerned with the liveability I.of the ne~ghborhood but he hadn't found any neighbors on Madison Street in favor of lthe diverters. He said any fair reading of the questionnaire mailed would give the ~s 3/25/74 - 4, impression the city was in favor of the installations, and a lot of the people there hand't considered the implications. He said there was no objection to present : traffic on those streets. ,,",,",".~-." .- Further Council discussion resulted in Councilman Murray's changing his motion, 'with Councilman Wood's second, to approve the temporary installations as recommended 'and to place the item on thecqnsent calendar for the March 25 Council meeting with ~the idea that it could be segregated for discussion if requested. I l Comm ~120/74 Approve Traffic Engineer said that because people opposed to the diverters had accused him of instigating the proposal he wanted to make it pe.rfectly clear that his role in working wi th the neighborhood groups was that of staff support and source of informa- tion. He hoped those people would understand that his was a neutral stand. :In answer t~ Councilman Wood, Traffic Engineer said there would be emergency vehicle .access to the streets on which the diverters were ~roposed. .-- IVote was taken on the motion as changed. [Third-level (Commuter) Air Carrier Service - Copies of Airport Commission recommenda- !tion ~ere previously furnished to Council members w.ith regard to information re- ~q.ue-sted from airport operators by the Public utili ty Commissioner. The Commission irecommended as essential the requirement for performance and/or surety bonding for :third-level air carriers of at least three months' jrevenue, in no case less than I .$1000, to the airport; that a study be made of the need for bringing traffic to and 'from the coastal areas for connections at Eugene; and that no State subsidy be granted third-level air carriers at this time, instE~ad each community seeking that type service evaluate means of easing the financial load of newly initiated com- muter service until traffic loads make the operation financially feasible. c.. h,..' Manager explained the desirability of having a third-level air carrier service to !serve the Eugene market because of reduction in air carrier service to smaller :cities in the State and because present schedules do not allow for convenient con- :nections to other areas. Because efforts to have that type of service have failed in the past it was felt the bonding requirement wou.ld tend to assure that a third- 'level service would be well enough funded to have some opportunity for success. Staff recommended transmittal of the Airport Commission recommendation to the PUC. Council consensus was that anything developed to assist in making connections to other areas and to upgrade service to other ci ties ;in the State would be desirable. Councilwoman Campbell asked 'if the City answered that that was not the intent. ;be involved in that manner, he said. would have to subsidize the service. I H. ,Class A Dispenser License Application - Excelsior Cafe, 754 East 13th Avenue (Greater 'Privilege - Manager explained that when the original certificate of occupancy for ,the Cafe was issued a variance was granted by the Zoning Board to allow eight off- : street parking spaces for the use of the ground fl~)r partially by the cafe and par- 'tially for a retail operation with living quarters ~[n the upper floor. The retail operation has since muved uut and the cafe operation has expanded into that space. At the time of original occupancy a variance was also granted permitting smoke de- tection system rather than sprinklering system for fire protection. The business operation has been good, well respected, and very popular from the standpoint of food service. However, the expansion into the retaJ[] area for restaurant purposes is at variance with the certificate of occupancy and staff feels the problem of fire ;protection and additional code requirements should be resolved if the operation is 'to continue on its expanded basis. Zoning Board has again granted a variance to alio~'the expanded use without additional parking spaces. Manager said both would be responsible, assuming the building was leased. Mayor Anderson fel t the question was not one of getting compliance .but rather a means of bringing it about. The bonding application would be signed at (time of assessment, then upon transfer of property the assessment could be placed ~on a lO-year installment program with the same interest charges as any other in- ;stallment assessment. Manager confirmed :Mr. Hershner's understanding that the City would retain funds from sale of bonds, ~.carrying the interest in cases of deferred collection of assessment. Finance Director [pointed out staff recommendation in the study for paying construction warrants [from the deferred assessment fund and holding the bonding applications until the Ideferral was no longer applicable, at which time it could be paid in cash or put ion installment payments. At Councilman McDonald's request, Manager explained payments to American Legion Post #3, Veterans of Foreign Wars, and World War I Barracks. The State law also provides that 60% of the Commission's percentage of gate receipts from those exhibitions must be distributed to veterans organizations and 40% to charitable uses. The payments listed are the disbursement of the statutory share for veterans groups. He added that prior to receipt of revenue sharing funds the other 40% went into a fund to help indigents and more recently was allocated to Buckley House, a privately operated home for alcoholics. Fordon Elliott, 1287 Irvington Drive, asked to speak with regard to installation of traffic diverters recommended by the Westside Neighborhood Quality Project (Item III-F). He said he had taken a survey and had additional information for Council consideration. Mayor Anderson explained that the item had been acted upon and any new information should be brought to a committee-of-the-whole meeting at which time the Council would consider whether to re- consider its action approving installation of the temporary diverters.
