COUNCILORS ABSENT: Cynthia Wooten, Freeman Holmer. { The adjourned meeting of September 15, 1986, of the City Council of the City of Eugene, Oregon, was called to order by His Honor Mayor Brian B. Obie. 1. ITEMS FROM MAYOR, COUNCIL, AND CITY MANAGER A. Certificate of Achievement Mayor Obie presented a Certificate of Achievement for Excellence in Financial Reporting to Dee Ann Raile, Eugene Reporting/Control Manager. The cert ifi cate e was awarded by the Government Finance Officers Association of the United States and Canada for the City's Comprehensive Annual Financial Report for the Fiscal Year which ended June 30, 1985, Mayor Obie said the award is an honor and he congratulated Ms. Raile and the staff. B. Recognition of Councilor Wooten's Leadership Although Ms. Wooten was not present, Mayor Obie said he and the community want to thank her for her excellent leadership. He said the rodeo which was in town during the past weekend was spectacular and Ms. Wooten arranged for it. He asked the staff to prepare an appropriate recogn it ion of Ms. Wooten1s contributions to the community which will be awarded during the inaugural ceremony in January. Mayor Obie also thanked City Manager Micheal Gleason and the City staff for their help in planning the rodeo. Ms. Ehrman, who ;s chairperson of the Eugene Celebration, sa i d 25 peop 1 e served on a committee which planned the rodeo. C. Parks and Recreation Programs Mr. Rutan said he and Mr, Miller met with Parks Department Director Ernie Drapela and discussed City programs which might infringe on activities e MINUTES--Eugene City Council September 17, 1986 Page 1 provided by private entrepreneurs. They will report to the council in a few weeks. e D. "Be a Brick" Campaign Ms. Bascom said the "Be a Brick" campaign to benefit the Hult Center has begun. She encouraged the other councilors to buy bricks. E. Rededication of George Owens Rose Garden Ms. Schue said the George Owens Rose Garden wi 11 be rededicated Sunday, September 21, at 1:30 p.m. She wi 11 attend and she invited the other councilors to join her. F. Discussion of Tests for Drugs Mr. Miller said a citizen speaking during the council's Public Forum recently suggested that councilors take one of the tests that may indicate the use or non-use of illegal drugs. Mr, Miller suggested the matter be placed on a council agenda. He said he does not support the suggestion because he does not think the tests are accurate and because requiring such tests may not be constitutional. He said he prefers efforts to curb drug abuse that are effective. Mayor Obie and the other councilors decided to discuss the issue during the November Council Goal Session. Mr. Hansen said drug abuse is a serious issue in the community. He asked the e City Manager to give the councilors some suggestions for appropriate action. He said he supports the use of tests and will be glad to take one. G. Urban Renewal Area Expansion Mr. Hansen asked the staff to provide a Profit and Loss Statement to him from the Eugene Urban Renewal Agency as soon as possible. He said the council will be discussing expansion of the urban renewal area and he would like to know how much is pledged against the properties, what the pay-off schedule is, what the projection for increased property taxes is, what the income stream is, and what the income stream for other areas is before discussing the expansion. Ms. Ehrman said she will attend several of the public meetings at which the proposed expansion is discussed before the council considers the matter. H. Mayor's Invitational Fine Arts Exhibit Mayor Obie said a ceremony to open the Mayor's Invitational Fine Arts Exhibit will be held Friday, September 19. CITY COUNCIL MINUTES OF AUGUST 11 AND AUGUST 13, 1986 e Mr. Hansen moved, seconded by Ms. Ehrman, to approve the City Council minutes of August 11, 1986, and August 13, 1986. Roll call vote; the motion carried unanimously, 6:0. II!. ORDINANCE CONCERNING THE BICYCLE COMMITTEE City Manager Micheal Gleason said the council subcommittee that reviewed the advisory groups recommended that three-year terms be established for members of the Bicycle Committee. C.B. 2901--An ordinance concerning the Bicycle Committee amending Section 2.013 of the Eugene Code, 1971. Mr. Hansen moved, seconded by Ms. Ehrman, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 6:0. Council Bill 2901 was read the second time by council bill number only. Mr. Hansen moved, seconded by Ms. Ehrman, that the bill be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared e passed (and became Ordinance No. 19404). IV, ORDINANCE CONCERNING CITY BOARDS, COMMISSIONS, AND COMMITTEES City Manager Micheal Gleason introduced the item. Cathy Freedman gave the staff report. She said terms of office for a few of the City's advisory groups do not end on December 31, The proposed ordinance would change those terms so that they terminate on December 31 and coincide with other advisory groups. C.B. 2902--An ordinance concerning City boards, commissions, and committees; amending Section 2.013 of the Eugene Code, 1971; and declaring an emergency, Mr. Hansen moved, seconded by Ms. Ehrman, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time, Answering a question from Mr. Hansen, Ms, Freedman said the proposed ordinance provides for an incumbent member of a board, committee, or commission to continue to serve if another person has not been appointed by December 31. It continues a practice the council has followed in the past, Mr. Gleason added that quorum problems may develop if a position becomes vacant. e MINUTES--Eugene City Council September 17, 1986 Page 3 Replying to a question from Ms. Bascom, Ms. Freedman said the recruitment and publicizing process begins in August for all positions that will be vacant on e December 31. Roll call vote; the motion carried unanimously, 6:0. Council Bill 2902 was read the second time by council bill number only. Mr. Hansen moved, seconded by Ms, Ehrman, that the bill be approved and given final passage. Ro 11 ca 11 vote; all councilors present voting aye, the bill was declared passed (and became Ordinance No. 19405). Mayor Obie said he notified current board, committee, and commission members that the council decided to limit to two the number of terms a person serves on anyone board, committee, or commission. V. ORDINANCE CONCERNING INDUSTRIAL PRETREATMENT PROGRAM City Manager Micheal Gleason introduced discussion of the City's industrial pretreatment program. Public Works Director Chris Andersen introduced James Ollerenshaw, Wastewater Treatment Plant Laboratory Supervisor. Mr. Ollerenshaw said the proposed ordinance will regulate industrial discharges into the treatment system to protect the workers, sewage system, and treatment plant from damage due to toxic or corrosive substances and to ensure that environmental damage is kept to a minimum. e Mr. Ollerenshaw said the pH and oil and grease discharge limits have been studied since 1984. The proposed changes raise the limit for pH discharge from 9.5 to 12.0, but no problems are anticipated from the increase, He said the City may reduce the limit if problems arise, pH discharges above 12.5 are identified as hazardous wastes in Federal regulations and are prohibited. He said animal and vegetable oil and grease are bio-degradable but hydrocarbon oil and grease are not bio-degradable. He said the proposed change will raise the total oil and grease limit to 300 milligrams per liter and create a limit of 100 milligrams per liter for hydrocarbon oil and grease. He sa i d the Springfield City Council and the Metropolitan Wastewater Management Commission have approved the proposed changes. Answering questions from Mr, Rutan, Mr. Ollerenshaw said the City will not permit pH discharges that are classified as hazardous wastes. Mr. Gleason said a local company recently lost control of caustic soda and discharged a large amount of it into the sewage system. The discharge could have resulted in damage to the treatment plant and the Willamette River and fines for the City. However, the employees at the treatment plant quickly i dent i fi ed the problem and put emergency procedures into effect. Their actions contained the problem and saved the City major expenses. Answering questions from Mayor Obie and Ms, Bascom, Mr, Gleason said the proposed changes have been in effect for some time and the City will work with the affected industries. He said the plant releases a higher quality of effluent than is required by Federal standards. e C,B, 2903--An ordinance concerning the Industrial Pretreatment Program; amending Section 6.410 of the Eugene Code, 1971; and declaring an emergency. RESOLUTION CONCERNING ANNEXATION GUIDELINES City Manager Micheal Gleason introduced the discussion. Planning Director Susan Brody gave the staff report. She said the council directed the Planning Commission to develop administrative guidelines for proposed annexations when the counci 1 adopted the Annexation Program in April 1986. She sa i d the e Annexation Program primarily responds to annexation requests from property owners, The guidelines will assist the Planning Commission, the council, and the Boundary Commission in considering annexation requests. She said members of the Boundary Commission are interested in adopting guidelines consistent with the City's. She said the guidelines will help in assessing non- contiguous annexation proposals and will help determine which properties of non-consenting owners should be included in annexation proposals. She said Mr. Holmer expressed some concerns about the guidelines and the staff prepared changes which respond to his concerns. She introduced Jim Carlson of the Planning staff. Mr, Carlson distributed a page titled "Example 1" and .. Examp 1 e 2" to the councilors, He reviewed each of the objectives and guidelines in Exhibit A attached to the agenda, He said the first objective recognizes that the City will eventually extend to the urban growth boundary. Responding to Mr, Holmer's concerns, Mr, Carlson recommended the following change (Material in parentheses should be deleted and underlined material should be added.): To annex outward to the acknowledged Metropolitan Plan urban growth boundary in a (timely) manner responsive to the service needs of property owners. Mr. Carlson said the word "timely" is appropriate in the second objective, Answering a question from Mr. Hansen, Mr. Carlson said all properties are not e equally benefitted by an annexation. However, properties do benefit from a new sanitary sewer or street improvements. MINUTES--Eugene City Council September 17, 1986 Page 5 -- - Mr. Carlson said Mr. Holmer was concerned about the first guideline because a strange shape might result from including all possible properties of e consenting owners. Consequently, Mr. Carlson suggested the following addit ion: Maximize the size of each annexation by including all possible consenting owners within a reasonable service area. Replying to questions from Ms. Schue, Mr. Carlson said the City's Annexation Program indicates that property owners who might benefit or to whose property infrastructure improvements could be extended will be contacted and asked if they want to be included in the annexation proposal. Answering questions from Mr. Miller, Mr. Carlson said each annexation is different. Usually, extending a sanitary sewer a short distance is more costly per foot than extending a sewer a long distance because large projects are most cost-effective, Property owners must bear the expense of extending sewers later if they choose not to be included in large projects. Mr, Rutan said the seventh guideline indicates that the City will encourage the formation of islands when annexation proposals are prepared. He suggested the wording be changed to: Consider, but do not encourage, the formation of islands. Mayor Obie suggested the guideline indicate that the necessity of forming islands will be recognized. e Answering questions from Mr. Hansen, Mr. Carlson said some properties will be excluded from proposals because a triple majority proposal would not result if they are included. He said it would be best to include all the properties in a specific area in an annexation proposal but it is not always possible, Mr, Hansen said the City seemed to gerrymander boundaries in the past to obtain a triple majority proposal. The guidelines seem to support that action and result in the City continuing to work with property owners who want annexation to the detriment of property owners who oppose it. Mr. Carlson said the City helps assemble a triple majority proposal and initiates the request, The guidelines indicate that the City will try to assemble a proposal for property owners who want their properties annexed. Mr, Gleason said the notification procedures result in people deciding whether they want to be included or excluded from annexation proposals and the City staff must decide on a boundary, Then the Planning Commission and the City Council must decide if the boundary is reasonable, Mr. Hansen suggested, in that case, that the objectives state that the City will aggressively annex properties. Mr. Gleason responded that the guidelines balance competing interests, Ms. Schue said that sometimes forming an island is preferable to telling owners their properties cannot be annexed. e MINUTES--Eugene City Council September 17, 1986 Page 6 Mr. Rutan said he would have to leave the meeting but he supported the work of the Planning Commission, the changes which meet Mr. Holmer's concerns, and the _ change to the seventh gui de 1 i ne he suggested. Res. No. 4002--A resolution adopting guidelines for annexation proposals. Mr. Hansen moved, seconded by Ms. Ehrman, to adopt the resolution subject to the changes to the first objective, the first guideline, and the seventh guideline which respond to Mr. Holmer's and Mr. Rutan's concerns. Roll call vote; the motion carried unanimously, 6:0. VIII. RESOLUTION AUTHORIZING ADMINISTRATIVE APPROVAL OF WARRANTS City Manager Micheal Gleason said the proposed resolution would change the amount of warrants the City can issue. Answering questions from Mr. Hansen and Ms. Ehrman, Mike Albrich of the Finance Division said the resolution would reduce the number of times the council must approve the sale of warrants. However, the council would continue to approve the projects and contracts prior to the sale of the warrants, Mr. Gleason said the warrants are for Bancroft loans which are backed by the value of the property. Mr. Albrich said the sale of warrants finances improvements to properties. ... When the improvements have been completed, Bancroft bonds are sold and the ~ warrants are paid. Res. 4003--A resolution authorizing the City Manager to administratively approve and issue local Improvement Warrants in an amount not to exceed $6,000,000 in the aggregate. Mr. Hansen moved, seconded by Ms, Ehrman, to adopt the resolution. Mr, Rutan and Mr. Hansen left the meeting. Mayor Obie announced that there was no longer a quorum of the council. He continued consideration of the resolution to another council meeting.
