COUNCILORS PRESENT: Debra Ehrman, Emily Schue, Cynthia Wooten, Ruth Bascom, Roger Rutan, Jeff Miller. COUNCILORS ABSENT: Richard Hansen, Freeman Holmer. The adjourned meeting of September 17, 1986, of the City Council of the City of Eugene, Oregon, was called to order by City Council Vice President Debra Ehrman in the absence of Council President Richard Hansen and His Honor Mayor Brian B. Obie. 1. PUBLIC HEARING--CODE AMENDMENT CONCERNING FLOOD HAZARD AREAS City Manager Micheal Gleason introduced consideration of a code amendment concerning flood hazard areas. City Engineer Bert Teitzel gave the staff report. He said the proposed ordinance contains flood plain regulations which are required by the Federal Emergency Management Agency (FEMA) . The regulations must be adopted before Eugene properties can be included in the e regular flood insurance program. He said the City has used the requirements in these regulations in subdivisions, conditional use permits, and planned unit developments in the flood plain for 12 years. He said the difference is that the City now has official maps of the floodways and special flood hazard areas. Answering questions from Mr. Rutan, Mr. Teitzel said the new maps do not indicate that any new areas are in the floodway because the floodway has not changed in the last four years. He said the West Eugene Parkway will cross the Amazon floodway. The design of the pa rkway wi 11 have to recogn i ze the floodway, but the FEMA regulations will not prevent the parkway. Mr. Gleason said the FEMA maps received by the City four years ago substantially increased the floodways along the Amazon Channel. He said the proposed ordinance will not have a negative impact on development in any area. He said the City may have to construct drainage facilities and storm sewers in the Amazon channel area to reduce the floodway. Replying to a question from Ms. Bascom about a letter from William Loy of the University of Oregon Geography Department, Mr. Teitze 1 said the Willamette River floodway splits near the Delta Ponds. Most of the land in the floodway area is publicly owned and Mr. Loy.s proposed improvements would increase the water flow through the area which would be a benefit. Mr. Teitzel said the regulations in the ordinance would not prohibit the improvements proposed by Mr. Loy. e MINUTES--Eugene City Council September 22, 1986 Page 1 Ms. Ehrman opened the public hearing. e There being no requests to testify, Ms. Ehrman closed the public hearing. CB 2904--An ordinance concerning flood plain regulations; amending sections 9.015, 9.268, 9.604, 9.606, and 9.607 of the Eugene Code, 1971; adding sections 9.602 and 9.603 to that code; and declaring an emergency. Ms. Schue moved, seconded by Ms. Wooten, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 6:0. Council Bill 2904 was read the second time by council bill number only. Ms. Schue moved, seconded by Ms. Wooten, that the bill be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance No. 19407). II. PUBLIC HEARING--VACATION OF THE NORTH PORTION OF EDISON STREET (City of Eugene: Parks and Recreation Department (SV 86-2) City Manager Michea1 Gleason introduced consideration of the proposed e vacation. Bill French of the Planning Department gave the staff report. He said right-of-way to be vacated is 60 feet wide and about 560 feet long. It is in the Bethel Triangle. The land will be incorporated into Trainsong Park. The only public comment received concerning the vacation expressed opposition to the design of Trainsong Park. It did not directly concern the vacation. Replying to a question from Ms. Wooten, John Etter of the Parks and Recreation Department said the improvements to Trainsong Park will begin in the morning and will continue for three or four weeks. The neighbors have been informed of the progress. Answering a question from Ms. Bascom, Mr. Etter sa i d the land parcels designated "City of Eugene" on the map in the staff notes are part of Trainsong Park. He pointed out the staff recommended approval of the vacation subject to the retention of a public utility easement over the entire area to serve the properties to the north. The vacation involves about 3.5 acres. Ms. Ehrman opened the public hearing. There being no requests to testify, Ms. Ehrman closed the public hearing. e MINUTES--Eugene City Council September 22, 1986 Page 2 CB 2905--An ordinance vacating the north/south section of Edison Street located west of Bethel Drive. e Ms. Schue moved, seconded by Ms. Wooten, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 6:0. Council Bill 2905 was read the second time by council bill number only. Ms. Schue moved, seconded by Ms. Wooten, that the bill be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance No. 19408). III. ORDINANCES AMENDING SPECIAL ASSESSMENTS City Manager Micheal Gleason said the proposed ordinances amend pre- assessments that were made some time ago. He said the improvements have now been completed and the actual costs were less than the pre-assessments. Answering a question from Ms. Bascom, City Engineer Bert Teitzel said the property owners have been paying assessments made when the contracts were awarded. The assessments were estimates of the cost of the projects. The actual cost was less than the estimates and so payments will be reduced. People who paid the entire pre-assessment will receive cash refunds. Mr. e Gleason added that the pre-assessing system was approved by the council several years ago to maintain funds in the City's Bancroft account. CB 2906--An ordinance concerning assessments for paving, sanitary sewers, storm sewers, and sidewalks on Spring Boulevard from 38th Avenue to Dogwood Street; amending Ordinance No. 19136; and declaring an emergency. CB 2907--An ordinance concerning assessments for paving and storm sewers on Hawthorne Street from 500 feet west of Berntzen Road to Berntzen Road; amending Ordinance No. 19157; and declaring an emergency. CB 2908--An ordinance concerning assessments for paving 6th Avenue from 1,100 feet west of Garfield Street to 600 feet west of Garfield Street; amending Ordinance No. 19289; and declaring an emergency. e MINUTES--Eugene City Council September 22, 1986 Page 3 CB 2909--An ordinance concerning assessments for sanitary sewers on Country Club Road from Sand Avenue to e Willagillespie Road; amending Ordinance No. 19281; and declaring an emergency. Ms. Schue moved, seconded by Ms. Wooten, that the bills be read the second time by council bill number onlYt with unanimous consent of the council t and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 6:0. Council Bills 2906, 2907t 2908t and 2909 were read the second time by council bill numbers only. Ms. Schue moved, seconded by Ms. Wooten, that the bills be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance Nos. 19409 (CB 2906); 19410 (CB 2907); 19411 (CB 2908); and 19412 (CB 2909). IV. RESOLUTION AUTHORIZING ADMINISTRATIVE APPROVAL OF WARRANTS Ci ty Manager Mi chea 1 Gleason introduced consideration of the resolution authorizing administrative approval of warrants. He said the councilors di scussed the reso 1 ut i on on September 17 but not enough council ors were present to pass a motion. He said the resolution will permit the City to sell warrants for the Bancroft account before the bonds are sold. The wa rrants e will be used to pay contractors. Res. No. 4003--A resolution authorizing the City Manager to administratively approve and issue Local Improvement Warrants in an amount not to exceed $6,000,000 in the aggregate. Ms. Schue moved, seconded by Ms. Wooten, to adopt the resolution. Roll call vote; the motion carried unanimously, 6:0.
