The adjourned meeting of December 8, 1986, of the City Council of Eugene,
Oregon, was called to order by His Honor Mayor Brian B. Obie.

A. Proclamation of November 4 Election Results
Mayor Obie read the following proclamation:
At a special City election duly and regularly held within the territorial
limits and boundaries of the City of Eugene concurrently with the general
election conducted by the Lane County Election Department on November 4, 1986,
e the electors of the City of Eugene voted on the following measures and city
offices to be filled:
Measure 51: "Prohibits Specified Nuclear Weapons and Nuclear
Power Activities in Eugene."
Measure 52: "Route Approval for West Eugene Parkway."

The City Council of the City of Eugene, Oregon, and I, on the 10th day of
December, 1986, have canvassed the election returns for said special election
tit conducted by the Lane County Election Department submitted in the abstract of
the election, the date of the abstract being November 12, 1986, and certified
by John E. Faw, County Clerk for Lane County, Oregon, and the abstract shows
the results of the City election as follows:

I hereby proclaim and declare as follows:
That Measure No. 51, Prohibits Specified Nuclear Weapons and Nuclear Power
Activities in Eugene, was passed.
That Measure No. 52, Route Approval for West Eugene Parkway, was passed.
That Emily Schue, Robert D. Bennett, Freeman Holmer~ and Jeffrey R. Miller
were elected as City Councilors representing Wards 1 ~ 4, 5, and 6
respectively.
That Dennis L. Solin was elected as a member of the Eugene Water & Electric
Board representing Wards 4 and 5, and Randall E. Thwing was elected as a
member of the Eugene Water & Electric Board representing the City at large.

B. IIBe a Brickll Campaign and Hult Center Newsletter
Ms. Bascom distributed Seasons Greetings cards for the IIBe a Brickll Campaign
for the Hult Center for the Performing Arts. She also distributed copies of a
Hult Center newsletter.
e C. Zoning Violations
Ms. Ehrman said she attended a meeting of the West University Neighborhood
Association recently at which there were numerous complaints about zoning
violations and the City's failure to respond to them. She encouraged other
councilors to find out if there are zoning violations in other parts of the
city.
D. National League of Cities Conference
Ms. Schue said several councilors recently attended a National League of
Cities Conference in San Antonio~ Texas. She said cities are st i 11 not
receiving revenue-sharing funds from the Federa 1 government but the
atmosphere at the conference was more positive than it has been in the past.
She said city officials indicated they can do things themselves and they
exchanged information about how things can be done.
Mayor Obie suggested the councilors or the staff who attended the conference
write a report to share their experiences with others.

E. Time Limits in the Overpark
e Mr. Hansen said a constituent is confused because the constituent received a
ticket for parking more than one hour in the Overpark.
Mr. Holmer said signs on the Overpark should indicate on which floors and for
what time periods free parking is available.
F. Population Statistics
Mayor Obie said he is concerned about an article in The Register-Guard this
morning that indicated Eugene is losing population.
City Manager Micheal Gleason responded that he bel ieves the statistics
compiled by Portland State University are wrong. He said last year the City
proved that the population statistics compiled by Portland State University
were wrong by referring to such things as water connections, U.S. Post Office
statistics, and sewer connections. This year Portland State University
employees again used a new method to compute populations in the state. He
said they have changed the assumptions and methods they use often and that
makes comparisons difficult.
Mr. Gleason said he will pursue the issue and report to the council soon. He
said he expects to prove the statistics reported by Portland State are wrong
but it wi 11 take time. He said maybe the University of Oregon Bureau of
Governmental Research should compute population statistics for the state.
Mayor Obie said the issue is serious because the Portland State University
e statistics may damage the City financially.
II. PUBLIC HEARING: CITY OF EUGENE SUPPLEMENTAL BUDGET NO. 2 FY87
City Manager Micheal Gleason introduced consideration of Supplemental Budget
No. 2. Fi nance Di rector Warren Wong gave the staff report. He said
Supplement Budget No. 2 was approved by the Budget Committee on November 18,
1986.
Mayor Obie opened the public hearing.
There being no requests to testify, Mayor Obie closed the public hearing.
CB 2932--An ordinance adopting a supplemental budget; making
appropriations for the City of Eugene for the fiscal
year beginning July 1, 1986, and ending June 30, 1987;
and declaring an emergency.
Mr. Hansen moved, seconded by Ms. Ehrman, that the bill be read
the second time by council bill number only, with unanimous
consent of the council, and that enactment be considered at
this time. Roll call vote; the motion carried unanimously, 7:0.

Council Bill 2932 was read the second time by council bill number only.
e Mr. Hansen moved, seconded by Ms. Ehrman, that the bill be
approved and given final passage. Roll call vote; all
councilors present voting aye, the bill was declared passed
(and became Ordinance No. 19435).
Mayor Obie recessed the meeting of the Eugene City Council and convened a
meeting of the Eugene Urban Renewal Agency.
III. PUBLIC HEARING: EUGENE RENEWAL AGENCY SUPPLEMENTAL BUDGET NO. 1 FY87

City Manager Micheal Gleason introduced consideration of the Eugene Renewal
Agency Supplemental Budget No.1.
Mayor Obie opened the public hearing.
There being no requests to testify, Mayor Obie closed the public hearing.
Referring to a Beginning Working Capital adjustment of $195,426 for the
Broadway Corridor Project and 8th/High Landscape and Overpark Improvements on
pages 2 and 3 of the budget, Ms. Bascom said she raised questions about the
item at the Budget Committee meeting. She said the council wanted a unified
1 andscapi ng plan for the downtown and the fifth Street Corri dor but the
council's wish has not been implemented very well. She said she will continue
e to work on the project and hopes to organize an inter-departmental team to
coordinate such things as tree planting and unifying tree wells.
Res. No. 924--A resolution adopting a supplemental budget;

Mr. Hansen moved, seconded by Ms. Ehrman, to adopt the
resolution. Roll call vote; the motion carried unanimously,

Mayor Obi e adjourned the meeting of the Eugene Urban Renewal Agency and
reconvened the meeting of the Eugene City Council.
IV. TRANSFER OF RESERVE FOR ENCUMBRANCES TO DEPARTMENTS
City Manager Micheal Gleason introduced the item.

Res. No. 4014--A resolution authorizing the transfer of the
balance of the Reserve for Encumbrances to
e departments.
Mr. Hansen moved, seconded by Ms. Ehrman, to adopt the
resolution. Roll call vote; the motion carried unanimously,
7:0.
V. TRANSFER OF RESERVE FOR ENCUMBRANCES TO NON-DEPARTMENTAL
City Manager Micheal Gleason introduced the item.
Res. No. 4015--A resolution authorizing the transfer of the
balance of the Reserve for Encumbrances to
Reserves, Contingency, or Balance Available.
Mr. Hansen moved, seconded by Ms. Ehrman, to adopt the
resolution. Roll call vote; the motion carried unanimously,
7:0.
VI. CONSIDERATION OF A WHISTLE-FREE ZONE
City Manager Micheal Gleason introduced the item. Dave Reinhard of the Public
Works Department gave the staff report. He said the City received a letter
from John Humbert, administrator of Ya-Po-Ah Terrace, and a petition signed by
120 residents of Ya-Po-Ah requesting consideration of a whistle-free zone in
e downtown Eugene from 9 p.m. to 7 a.m. because the train whistles disturb
people sleeping at Ya-Po-Ah Terrace.
Mr. Reinhard said State law permits whistle-free zones at at-grade railroad
crossings protected by gates and lights. He said the EWEB at-grade crossing
at Mill Street is the only crossing in downtown Eugene that is not protected
by gates and lights.
Mr. Reinhard said there is much bicycle, pedestrian, and vehicle traffic at
the Pearl Street and High Street crossings and, occasionally people cross the
tracks when the gates are down and a train is arriving. He said the whistles
provide some extra protection. He did not recommend establ i shment of a
whistle-free zone.
Answering questions from Ms. Ehrman and Mr. Holmer, Mr. Reinhard said he does
not know how often whistles are blown at night or if they have changed
recently. He said train engineers usually sound the whistle before each
crossing. He has not discussed the matter with Southern Pacific Railroad
officials.
Mr. Hansen said he does not favor stopping the whistles because of the safety
they provide and the activity they indicate.

Ms. Schue agreed with Mr. Hansen but she suggested the City staff discuss a
compromise with Southern Pacific Railroad officials. She said perhaps the
e whistles could be blown for a shorter time.
Answering questions from Mayor Obie. Mr. Reinhard said Salem has a whistle-
free zone but it is not in the downtown. He said the Public Utility Commission
(PUC) staff does not favor whistle-free zones. He emphasized the severity of
. train accidents. He said there have been five accidents at the High Street
railroad crossing and three accidents at the Pearl Street railroad crossing in
the last five years. He said the PUC has limited train speed in downtown
Eugene.
John Humbert. administrator of Ya-Po-Ah Terrace. said it is hard to sleep when
trains blow whistles about every hour. He said the design of Ya-Po-Ah Terrace
increases the noise. He suggested information about accidents be requested
from cities that have whistle-free zones.
Ms. Ehrman said she would like to know how many trains go through Eugene.
Mr. Gleason suggested the staff investigate ways to mitigate the problem and
the councilors agreed by consensus with his suggestion.

Mr. Hanson moved, seconded by Ms. Ehrman. that the council

Ms. Schue pointed out that several people just appointed by the council now

IX. MAYOR NOTIFICATION OF APPOINTMENT TO THE TREE AND BEAUTIFICATION
COMMITTEE
Mayor Obie announced his appointment of Mary Bensten, 950 West 16th Avenues,
to the Tree and Beautification Commission for a term of undetermined length.
He said Ms. Bensten will replace Don McCloud as a representative of the
neighborhood groups.
XI. MINUTES OF LEGISLATIVE SUBCOMMITTEE MEETING OF DECEMBER 5, 1986
Mr. Hansen moved, seconded by Ms. Ehrman, that the council
approve the minutes of the Legislative Subcommittee meeting of
December 5, 1986. Roll call vote; the motion carried
unanimously, 7:0.

XII. APPROVAL OF CITY COUNCIL MINUTES OF SEPTEMBER 10, SEPTEMBER 24, AND
OCTOBER 27, 1986
Mr. Hansen moved, seconded by Ms. Ehrman, that the council
~ approve the minutes of the City Council meetings of September 10,
1986, September 24, 1986, and Octoper 27, 1986. Roll call vote;
the motion carried unanimously. The minutes of September 24
and October 27 were approved 7:0. The minutes of September 10
were approved 6:0:1 with Councilor Holmer abstaining because
he was not at the meeting.
XIII. APPLICATION FOR STATE OF OREGON PUBLIC WORKS INFRASTRUCTURE
GRANT/LOAN
City Manager Micheal Gleason introduced the item. Lee Beyer of the
Development Department gave the staff report. He said Major Properties, a
local developer, is interested in developing a motel, restaurant, and winery
complex off Interstate 5 near the Glenwood exit. He said a State program of
loans and grants would finance the public improvements necessary for the
complex and the City must apply for the funding. He said the City Manager
would apply for a 25 percent gran~ and a 75 percent loan if the council
approves the application. The amount of the grant, loan, and any additional
City costs would be passed on to the developer who could delay repayment for
two or three years. The interest on the loan would be about 5 percent. Mr.
Beyer discussed the process for considerating applications and said the City
may back out of the application process at any time.
Mr. Beyer said the City designed the proposed public improvements and asked
for bids in 1984. The project did not progress because there was no demand for
~ the improvements.
Mr. Beyer said the developer's ability to repay the loan will be evaluated
with the same process used for the Eugene Business Development Loan Program.
Mr. Holmer said support of existing businesses is very important and he
wondered if the motel/restaurant industry had been asked to comment on the
proposal. Mr. Beyer responded that the developer presented the project to the
Board of Directors of the Convention and Visitors Bureau which indicated the
project is a good one. He said the winery would be a unique asset.
Mr. Hansen said he has been told Oregon wines are going to gain in popularity
and the proposed development offers an economic opportunity.
Mr. Hansen moved, seconded by Ms. Ehrman, that the council
authorize the City Manager to submit an application for a
loan/grant to the State of Oregon. Roll call vote; the
motion carried unanimously, 7:0.
Mayor Obie adjourned the meeting at 1:07 p.m. to December 15, 1986.
