COUNCILORS ABSENT: Debra Ehrman, Ruth Bascom. The regular meeting of the City Council of Eugene, Oregon, was called to order by Hi s Honor Mayor Bri an B. Obi e. 1. PUBLIC FORUM Mayor Obie said the Public Forum is an opportunity for people to express opinions and provide information to the council about issues that are not scheduled for council consideration. He said the council will not respond immediately to the concerns expressed in the public forum. Mike Helm, 1147 East 26th Avenue, said he lives next to the Masonic Cemetery and Hope Abbey which are located at 26th Avenue and University Street. He e showed slides of the cemetery and abbey. He said the cemetery contains the graves of Eugene Skinner, Thomas Condon, Maude Kerns, George Whiteaker, the Kincaid, Harlow, Hendricks, and Patterson families and many other people who were important in the development of Eugene. He said the cemetery is still used. Thomas McChesney was buried there in 1986. Mr. Helm sa i d the cemetery is a historic resource but it is not well maintained. Many of the graves have been vandalized and the vandalism is increasing. Almost none of the old tombstones is complete and, when tombstones are broken, they are not restored. The slides displayed graffiti on the mausoleum, damaged tombstones, and an open grave. Mr. Helm said a person with a tractor and a gang mower is hired to cut the grass in the cemetery about twice a year. The mower hits and cuts the cement curbs around family plots and ripped an iron fence that surrounds a plot. Mr. Helm said the cemetery is a historic resource that is vanishing because it is not maintained. It needs regular care and restoration and the Masons do not seem interested in maintaining it. He said signs that would identify the historic features would be helpful. He said police presence in the cemetery ; s very effect i ve. If police officers arrive during a party in the cemetery, the parties decrease for several weeks. He suggested the council direct that police officers walk around the cemetery to indicate that the community cares about the cemetery. e MINUTES--Eugene City Council October 12, 1987 Page 1 At the end of the meeting, Ms. Wooten said she would like information about appropriate City actions concerning the cemetery and abbey. She said the graves of founders of the community should be well maintained. She wondered e how many recent burials there were. Ms. Schue said she agreed with Ms. Wooten and would like information about the plans of the Masons. Mr. Holmer asked for information about a regular police presence in the cemetery. II. PUBLIC HEARING: AMENDMENT TO THE METROPOLITAN PLAN REGARDING NONCONTIGUOUS ANNEXATIONS (MA 87-1) City Manager Micheal Gleason introduced the item. Gary Chenkin of the Planning Department gave the staff report. He said the proposed amendment to the Metropolitan Area General Plan would permit annexation of undeveloped, noncontiguous properties and delete references to the triple-majority annexation process. He said some owners of properties that are not contiguous to the city limits cannot develop their land until they receive City services and, therefore, the owners have requested annexation. Mr. Chenkin said Metro Plan amendments must be approved by the three jurisdictions. The Eugene and Springfield city councils approved an amendment similar to this one but the Lane County Board of Commissioners inserted a requirement that annexation proposals for noncontiguous undeveloped land be supported by the owners of at least half the land area. The amendment before e the council now includes that provision. Mayor Obie opened the public hearing. There being no requests to testify, Mayor Obie closed the public hearing. Answering questions from Ms. Wooten and Mr. Holmer, Mr. Chenkin said the amendment would not apply to land outside the urban growth boundary. Adoption of the amendment would not imply that every recommended annexation proposal would be approved by the council. Proposals would have to meet the criteria in the City Code and conform to applicable Metro Plan policies. Most annexation proposals would be reviewed by the Planning Commission before being considered by the council. CB 2988--An ordinance adopting amendments to the Eugene- Springfield Metropolitan Area General Plan pertaining to noncontiguous annexations, and repealing Ordinance No. 19450. Mr. Holmer moved, seconded by Ms. Schue, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance No. 19506). III. PUBLIC HEARING: ORDINANCE REGULATING PUBLIC CONTRACTS City Manager Micheal Gleason said Mr. Holmer requested the item be "held over." Responding to Mayor Obiels question, Mr. Holmer said he has numerous questions about the adequacy of the proposed ordinance to describe appropriate City policy. He said he would like to work with the staff to make the ordinance stronger and to make it clear that the Cityls policy is consistent with State law. He sa i d the ordinance mod1fi es the City I s Charter policy which authorizes the City Manager to review contracts. The change is a consequence of the State law that requires the council to become a contract review body and, therefore, establish rules. IV. PUBLIC HEARING: REVISIONS TO ANIMAL CONTROL ORDINANCE City Manager Micheal Gleason introduced the item. Assistant City Manager Dave Whitlow gave the staff report. He said the council revised the Cityls animal control ordinance in April 1987. The revision established classifications for e potentially dangerous dogs and regulations for dogs classified as dangerous. He said the ordinance before the council now will refine the regulations. It wi 11 make them conform to State laws, easier to administer, and more understandable to the public. Mr. Whitlow introduced Laurel Fetsch, Animal Control Director for Lane County. Mr. Whitlow said the animal control program is working well. Mayor Obie opened the public hearing. There being no request to testify, Mayor Obie closed the public hearing. Mr. Miller asked if a person must see a dog barking before a complaint can be processed. Mr. Whitlow said he is investigating the matter. Mayor Obie said he has received two calls about the animal control program this year. CB 2990--An ordinance concerning animal control regulations amending Sections 4.330, 4.335, 4.340, 4.350, 4.353, 4.370, 4.375, 4.385, 4.390, 4.395, 4.435, 4.440, and 4.990 of the Eugene Code, 1971; repealing Section 4.335 of the code; and declaring an emergency. e MINUTES--Eugene City Council October 12, 1987 Page 3 Mr. Holmer moved, seconded by Ms. Schue, that the bill be read the second time by council bill number only, with e unanimous consent of the council, and that enactment be considered at this time. PUBLIC HEARING: CITY OF EUGENE SUPPLEMENTAL BUDGET NO. 1 City Manager Micheal Gleason introduced the item. Finance Director Warren Wong gave the staff report. He said Supplemental Budget No. 1 makes the City's budget and accounting system comply with Government Accounting Standards Board (GASB) Pronouncement #6, implements the Urban Services Agreement of the City and Lane County, and recognizes unanticipated revenues. GASB Pronouncement #6 concerns the City's special assessment (Bancrofting) program. Answering a question from Mr. Holmer, Mr. Wong said one member of the Budget Committee voted against recommending approval of Supplemental Budget No.1. Mayor Obie opened the public hearing. e There being no requests to testify, Mayor Obie closed the public hearing. CB 2991--An ordinance adopting a supplemental budget; making appropriations for the City of Eugene for the fiscal year beginning July 1, 1987, and ending June 30, 1988; and declaring an emergency. Mr. Holmer moved, seconded by Ms. Schue, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. The motion carried unanimously, 6:0. Council Bill 2991 was read the second time by council bill number only. Mr. Holmer moved, seconded by Ms. Schue, that the bill be approved and given final passage. Roll call vote; the motion carried 5:1 with Councilors Schue, Wooten, Rutan, Miller, and Bennett voting aye and Councilor Holmer voting nay. RESOLUTIONS ESTABLISHING FUNDS City Manager Micheal Gleason introduced the item. Finance Director Warren e Wong gave the staff report. He sa i d the resolutions before the council establish new funds for the City's special assessment program. The existing funds will be terminated at the end of the fiscal year. Res. No. 4054--A resolution establishing a Special Assessment Capital Projects Fund Res. No. 4055--A resolution establishing a Bancroft Bond Fund Res. No. 4056--A resolution establishing a Short-Term Warrants Fund Res. No. 4057--A resolution establishing an Assessment Management Fund Res. No. 4058--A resolution establishing a Local Improvement Assistance Fund Mr. Holmer moved, seconded by Ms. Schue, to adopt the five resolutions. Roll call vote; the motion carried unanimously, 6:0. VII. ORDINANCE POSTPONING SOLAR SETBACK REGULATIONS e City Manager Micheal Gleason introduced the item. Jim Croteau of the Planning Department gave the staff report. He said the council decided to hold a public hearing on proposed changes to the solar setback regulations for new buildings and additions to buildings. The hearing will be in November. He said the solar setback regulations in the existing ordinance were to become effective October 1, 1987. The ordinance before the council would postpone imp 1 ementat i on of those regulations. Other parts of the solar access ordinance have been implemented. CB 2992--An ordinance regarding enforcement of the solar access regulations; amending Ordinances Nos. 19400, 19401 and 19402; repealing Ordinance No. 19490; and declaring an emergency. Mr. Holmer moved, seconded by Ms. Schue, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. EUGENE/SPRINGFIELD CONVENTION AND VISITORS BUREAU QUARTERLY REPORT City Manager Micheal Gleason introduced Ed Smith, Director of the Parks, Recreation and Cul tura 1 Services Department. Mr. Smith said the City's contract with the Eugene/Springfield Convention and Visitors Bureau requires a quarterly report to the council. He said a reporting format for statistics of bureau activity is being developed. In addition, the council will receive an evaluation in January or February of the Lane County Tourism Plan and its effect on the Cityls plans. Mr. Smith introduced Scott Lieuallen, Executive Vice President of the bureau. Mr. Lieuallen said Transient Room Taxes increased 4.8 percent in FY86/87 and July and August 1987 Transient Room Taxes are ten percent more than last year. He discussed several events held in Eugene this summer amd said the community benefited from Expo 186 return traffic. He said the community will host about 90,000 meeting delegates in 1987. That is an average annual growth of nine percent since 1982. Discussing bureau convention activities, Mr. Lieuallen said the bureau often assists local people in promoting attendance and publicizing meetings to be held here. He said the World Wide Church of God Assembly brings 35,000 e delegates here for eight days. He compared the benefits of that meeting to other meetings that last only two or three days. He said bids for conventions usually must be submitted several years before a convention is held. Discussing visitor activities, Mr. Lieuallen said bureau activities and Lane County Tourism Plan activities will complement each other and the area can become a valid vacation destination. For example, the number of visitors this July, August, and September increased 72 percent over last summer and an Italian travel magazine recently published an article about Oregon. Discussing bureau finances, Mr. Lieuallen said the number of bureau members is increasing but the increase in business has necessitated the hiring of several additional interns. He said the bureau staff is developing a Five-Year Plan for the community's visitor industry. During the process of developing the plan, the community must decide if it wants to become an amateur sports center. Mayor Obie said the bureau's activities have had a positive impact on the community. He said Hayward Field at the University of Oregon would not have been renovated without Mr. Lieuallenls efforts. Mayor Obie said the bureau's activities produce jobs in the community. Responding to a question from Mayor Obie, Linda Weston, Director of Sales for the Convention and Visitors Bureau, said she has worked with the Oregon Track - MINUTES--Eugene City Council October 12, 1987 Page 6 Club Masters Division and the World Association of Veteran Athletes to bring the International World Games here in 1989. A decision will be made this e fall . She said 9,000 people will come for about two weeks if the games are held here. She said the games will have a $10 million impact on the community. IX. SEGREGATION OF ASSESSMENT FOR PROPERTY LOCATED AT 1715 FRANKLIN BOULEVARD (LANE ELECTRIC COOPERATIVE) (SV 87-1) City Manager Micheal Gleason introduced the item. Mr. Holmer moved, seconded by Ms. Schue, to approve the segregation of assessment as noted. Mayor Obie asked if the property is for sale, Mr. Gleason said he will present a report to the council soon. Roll call vote; the motion carried unanimously, 6:0. X. APPOINTMENTS: COUNCILOR NOMINATION TO THE BUDGET COMMITTEE Mr. Holmer moved, seconded by Ms. Schue, to appoint John Rodda to the Eugene Budget Committee for a term ending December 31, 1990. Roll call vote; the motion carried unanimously, 6:0. e XI. APPOINTMENTS: MAYOR'S NOMINATION FOR A SOUTHERN WILLAMETTE PRIVATE INDUSTRY COUNCIL REPRESENTATIVE ON THE COMMUNITY DEVELOPMENT COMMITTEE Mr. Holmer moved, seconded by Ms. Schue, to appoint Jim Stephenson to complete an unexpired term representing the Southern Willamette Private Industry Council on the Community Development Committee for a term ending December 31, 1988. Mayor Obie said Mr. Stephenson's name was submitted by representatives of the Southern Willamette Private Industry Council. Roll call vote; the motion carried unanimously, 6:0. XII. APPOINTMENTS: MAYORIS NOMINATION TO THE AIRPORT COMMISSION Mr. Holmer moved, seconded by Ms. Schue, to appoint Mary Hudzikiewicz to the Airport Commission to complete an unexpired term ending December 31, 1989. Mayor Obie said Ms. Hudzikiewicz has served on several City committees and he is delighted to nominate her for the Airport Commission. e MINUTES--Eugene City Council October 12, 1987 Page 7 Roll call vote; the motion carried unanimously, 6:0. . Mayor Obie suggested two additional members be appointed to the Airport Commission. Ms. Schue and Mr. Holmer agreed with his suggestion. No one objected to it. XII 1.
