The adjourned meeting of October 21, 1987, of the City Counci 1 of Eugene,
Oregon, was called to order by His Honor Mayor Brian B. Obie.
1. PUBLIC HEARING: ANNEXATION/REZONING REQUEST FOR PROPERTY LOCATED ON
BOTH SIDES OF RIVER ROAD, SOUTH OF CROCKER LANE AND NORTH OF THE
EXISTING CITY LIMITS (TWELFTH STREET DEVELOPMENT CORPORATION, ET AL)
(AZ 87-8)
Assistant City Manager Dave Whitlow introduced the item. Cathy Czerniak of
the Planning Department gave the staff report. She said the annexation
proposal is for 17 tax lots totaling 13.5 acres. No nonconsenting property
owners are included in the proposal. Eleven of the properties are privately
e owned and six tax lots are Lane County rights-of-way. Ms. Czerniak said River
Road is being widened and the Chambers Connector is being constructed in the
area of the annexation proposal. Annexation at this time will permit property
owners to connect to sewers during construction.
Ms. Czerniak said the Planning Commission received testimony about
notification to the River Road Community Organization. A change in the
executive board membership of the organization resulted in some members not
being notified of the proposal. She said the Planning Commissioners noted
that their decision was made without benefit of testimony from the
organization but the commission noted that community organization
representatives will be able to testify before the Ci ty Council and the
Boundary Commission. The Planning Commission unanimously recommended
approval of the proposal. If it is approved, the Tax Differential Plan for
the River Road area will be applied.
Ms. Czerniak discussed concerns expressed to the Planning Commission about the
recommended rezoning of Tax Lot 200 which is currently zoned for residential
use. The staff recommended Tax Lot 200 be rezoned for commercial use. She
said Tax Lot 100 north of Tax Lot 200 is zoned for commercial use but it is not
known when Tax Lot 100 was zoned for commercial use. It is possible the
rezoning was a transcription error; however, the Lane County Board of
Commissioners legislatively adopted the commercial zoning during the urban
transition.

Ms. Czerniak said the Planning Commission recommended Tax Lot 200 be rezoned
for commercial use because the surrounding zoning is commercial and because of
e the effects of the road improvements. She said the commission recommended the
attachment of Site Review Procedures to all commercial zoning in the area to
address concerns about access from River Road. She said the River Road/Santa
Clara Urban Facilities Plan indicates that the effects of the Chambers
Connector and other road improvements in the River Road/Railroad Avenue
Subarea should be studied. The Planning Commission will consider scheduling
the study when it considers its work program. In the meantime, the commission
recommended that no properties north of the existing commercial properties in
the River Road/Railroad Avenue subarea be rezoned for commercial use until the
study is complete.
Answering questions from Mr. Holmer, Ms. Czerniak said approval of the
annexation proposal wi 11 result in an is 1 and of about 30 residential
properties east of River Road. State law would allow annexation of those
properties without the consent of the property owners.
No conflicts of interest or ex parte contacts were declared.
Mayor Obie opened the public hearing. He entered the staff notes and minutes
into the record.
Bruce Tait, 465 Hunsaker Lane, said he owns Tax Lot 200 and would like the
property to be annexed. He said he would like access to City sewers. He said
the properties north and across the street from Tax Lot 200 are zoned for
commercial use. He said the widening of River Road will result in the loss of
about one foot of the porch of the residence on Tax Lot 200.
e Harold Chapman, 51 Chapman Drive, sa i d he attended most meetings of the
Citizen Advisory Committee (CAT) during development of the River Road/Santa
Clara Urban Facil it i es Plan. He displayed a diagram of the River
Road/Railroad Avenue Subarea. He said CAT members did not recommend changes
to the diagram which indicates Tax Lot 200 should be zoned residentially.
Mr. Chapman distributed copies of a ten-page packet of maps, pages from the
River Road/Santa Clara Urban Facilities Plan, and letters. He emphasized that
CAT members considered the plan diagram and policies to be consistent and that
both Tax Lot 100 and 200 were zoned for residential use when the Urban
Facilities Plan was developed. He said the owner of Tax Lot 200 requested
commercial zoning but the CAT denied the request and stated that the existing
land use patterns should be maintained until the area is studied. He said a
clerical mistake apparently rezoned Tax Lot 100 to commercial use. He said
CAT members did not want strip commercial development in the River
Road/Railroad Avenue subarea.
Vora Heintz, 1038 Jayne Drive, said she is chairperson of the River Road
Community Organization. She said she was not provided information about the
annexation proposals in time to comment on them. The organization's next
meeting will be November 9, 1987. She said Eugene has a policy of illogical
extensions and creeping annexations that do not address cost effectiveness,
law enforcement, or the right of citizens to vote on annexations.

Ms. Heintz said citizens also were not permitted to vote on sewers in the
River Road area. She said development of the River Road/Santa Clara Urban
e Facilities Plan by the CAT excluded participation of the River Road Community
Organization. She said the community organization opposes the annexation
proposals within and without the organization's boundaries recognized by the
Lane County Board of Commissioners. She specifically opposed the annexation
of Beltline Road. She di scussed State legislation concerning annexation
procedures.
Ms. Heintz said the River Road Community Organization opposes all annexation
proposals in the area. She requested that her testimony be included in the
record of each proposal.
There being no more requests to testify, Mayor Obie closed the public hearing.
Ms. Brody said the zoning on Tax Lot 100 may have been changed by error but the
current zoning is commercial. The staff considered that and the impact of the
River Road widening when evaluating zoning for Tax Lot 200 and decided that
commercial zoning would be appropriate. She said the owner of Tax Lot 200
does not want the property annexed if it is not rezoned for commercial use.
Ms. Brody said both the previous offi cers of the River Road Community
Organization and those represented by Ms. Hei ntz were notified of the
council's public hearing. Abutting property owners were also notified of the
hearing and the staff held an informational meeting in the neighborhood before
the Planning Commission hearing.
Mr. Holmer read from minutes of an April 1986 council meeting in which
e Mr. Miller urged council officials to bring the streets in the River Road area
up to City standards so property owners would not be assessed for upgrading
the streets after annexation. Answering questions from Mr. Holmer, City
Engineer Les Lyle said Lane County officials will pay for improving River Road
and neither abutting property owners nor the City will pay for it. The City i s
still negotiating with County officials about what condition the streets will
be left in after the sewer construction. The roads probably wi 11 not be
brought up to City standards but the City will take over their maintenance.
Mr. Whitlow said streets that are annexed will be included in future urban
transition payments to the City from the County.
Replying to questions from Ms. Wooten, Ms. Brody said Mr. Chapman referred to
the planning process for the River Road Urban Facilities Plan and indicated
that rezoning Tax Lot 200 would not be legal because it would not conform to
the policy in the plan that indicates existing land use patterns should be
maintained until the River Road/Railroad Avenue subarea is studied. Ms. Brody
said the recommendation to rezone Tax Lot 200 is the result of an evaluation
of the impact of the River Road widening and the Chambers Connector and,
therefore, complies with the plan.
Answering a question from Ms. Bascom, Mr. Lyle said sanitary sewers have been
constructed in the area.

Ms. Ehrman asked about annexation and rezoning procedures. Ms. Brody said the
owner of Tax Lot 200 can withdraw from the proposal before it is heard by the
e Boundary Commission if the council does not approve the rezoning.
Mr. Holmer noted that Tax Lots 5400, 7200, and 7500 could be annexed in
separate proposals. Therefore, he suggested that River Road from Fir to
Briarcliff be excluded from this proposal to eliminate the creation of an
island to the east that could be annexed without the consent of the property
owners. He said the creation of the island is disconcerting. Ms. Czerniak
responded that this proposal will connect parts of River Road that are within
the city limits now. Ms. Brody pointed out that none of the property owners in
the island testified against the proposal. She said the annexation of the
island may be appropriate in the future for the delivery of services.
Res. No. 4063--A resolution furthering annexation to the City
of Eugene and the Lane County Metropolitan
Service District for property located on both
sides of River Road, south of Crocker Lane and
north of the existing city limits.
Ms. Ehrman moved, seconded by Mr. Holmer, to adopt the
resolution.
Answering questions from Ms. Wooten, Ms. Heintz said she received a packet of
information about the annexation proposals after the Planning Commission
hearing. She said she did not receive the staff notes. She said the other
executive board members of the River Road Community Organization have not seen
the staff notes although someone spoke about the annexation proposals at a
e board meeting.
Mr. Holmer said he believes all of the River Road area and much of the Santa
Clara area should be annexed to Eugene. However, this proposal is aggressive
and arbitrary and indicates Eugene will use whatever methods are available to
annex the area. He said such actions will poison attitudes and the City
should show compassion to River Road residents.
Ms. Ehrman noted that all the property owners in this proposal consented to
the annexation.
Mr. Miller said people should not be surprised by the annexation of River Road
properties. Urban services are being provided by Eugene and it is logical to
annex the area. He said River Road residents should be represented on the
council after annexation and they should take action to obtain representation.
He said the status quo cannot be maintained in the area.
Ms. Bascom urged the staff to not ify all interested parties of future
annexation proposals. She said she appreciated the careful consideration
given the proposals by the Planning Commission.

Roll call vote; the motion carried 6:1 with Councilors Ehrman,
Wooten, Bascom, Rutan, Miller, and Bennett voting aye and
e Councilor Holmer voting nay.
Mayor Obie said he favors additional evaluation of the zoning for Tax Lot 200.
Ms. Brody said a study of the River Road/Railroad Avenue subarea probably
could not be completed until the spring of 1988. She said no public hearing
was held when Tax Lot 100 was rezoned to commercial use.
Answering questions from Mr. Bennett, Ms. Brody said the rezoning of Tax Lot
200 for commercial use seems to conform to the Urban Facilities Plan but
Mr. Sercombe could analyze the conformance further. She said commercial use
was unanimously recommended by the Planning Commission. Mr. Sercombe added
that he has not analyzed the necessity of the council acting on the Planning
Commission's recommendation for rezoning.
Ms. Bascom said the Chambers Connector is almost complete. Therefore, the
rezoning conforms to the policy in the Urban Facilities Plan that indicates
zoning in the area shaul d be evaluated upon completion of the Chambers
Connector.
Ms. Ehrman said she participated in CAT discussions and strip commercial
development along River Road was an important issue. CAT members decided
against a request to designate Tax Lot 200 for commercial use. She said she
wi 11 oppose a change now but will reconsider the change when River Road is
widened.
Mr. Bennett said residential use of Tax Lot 200 does not seem reasonable and
e that will not change. Therefore, he concurs with the Planning Commission
recommendation.
Mayor Obie noted that some businesses along River Road are designated Highway-
Oriented Sign District but the Outlying Commercial Sign District is
recommended for the properties in the proposal. He requested a report later
on the criteri a used for the Outlying Commercial Sign District and the
Planning Commission discussion of it for these properties.
Responding to comments from Mr. Holmer and Mayor Obie, Mr. Sercombe said the
diagram on page 2-20 of the Urban Facilities Plan indicates Tax Lot 200 should
be residential. He said additional analysis of the controlling effect of the
diagram is needed.
Ms. Bascom and Ms. Wooten asked that the subarea study be completed as soon as
possible. Responding to thei r comments, Ms. Brody recommended against
delaying action on the zoni ng because the council must act on both the
annexation and zoning before the proposal can be heard by the Boundary
Commission. She recommended Tax Lot 200 not be rezoned until Mr. Sercombe can
analyze whether the diagram or maps in the Urban Facilities Plan control the
land use designations.

Ms. Ehrman moved, seconded by Mr. Holmer, to adopt a final
order rezoning property located on both sides of River Road,
e south of Crocker Lane and north of the existing city limits
from County C-2/UL and County C-1/UL to City C-2, and from
County RA/UL to City R-1 and designation of commercial and
residential sign districts.
Mr. Bennett said he would like an answer to the proper zoning of Tax Lot 200 as
soon as possible. Mr. Sercombe said a legal opinion can be ready next week.
Mayor Obie said he would like the subarea study expedited.
The motion carried unanimously, 7:0.
II. PUBLIC HEARING: ANNEXATION/REZONING REQUEST FOR PROPERTY LOCATED ON
THE EAST AND WEST SIDES OF PRAIRIE ROAD BETWEEN BELTLINE ROAD AND
LEGHORN AVENUE; ON THE SOUTH SIDE OF FEDERAL LANE BETWEEN GENT ROAD
AND PRAIRIE ROAD; ON THE NORTH AND SOUTH SIDES OF IVING ROAD BETWEEN
GENT ROAD AND THE SOUTHERN PACIFIC RAILROAD; NORTH AND SOUTH OF
BELTLINE ROAD EAST OF THE NORTHWEST EXPRESSWAY; AND BELTLINE ROAD
RIGHT-OF-WAY WITH ASSOCIATED UTILITY CORRIDORS (MARXEN, KEMPF, ET AL)
(AZ 87-9)
Assistant City Manager Dave Whitlow introduced the item. Alan Lowe of the
Planning Department gave the staff report. He revi ewed the background
material which indicated the proposal involved 135 acres. Mr. Lowe sa i d a
recent legal description indicated the proposal includes 122 acres. He said
e approva 1 of the proposal will not create islands. The properties of both
consenting and nonconsenting owners are included in the proposal. All the
privately owned properties are designated and zoned for industrial use. All
the properties are developed except Tax Lots 1806, 2602, and 4305 (Assessor1s
Map 17-04-10-0 0).
Mr. Lowe said the proposal includes rights-of-way of parts of Beltline,
Prairie, and Irving roads because sanitary sewers will be constructed in
Prairie and Irving roads. Annexation of Beltline Road will provide continuity
to the city.s main boundary and for a noncontiguous industrial parcel annexed
in 1983. The proposal includes the EWEB reservoir, pump station, and
transmission and water facilities, and two sanitary sewer pressure mains and
one pump station. He said the State will retain jurisdiction of Beltline Road
if the proposal is approved.
Mr. Lowe said the proposal is consistent with the Metro Plan and the Eugene
Code and the properties are contiguous to existing city limits at two places
on Beltline Road. A minimum level of key urban facilities can be provided. He
reviewed written testimony in the background material and the organizations to
which written notification of the proposal was sent. He said the applicants
requested the ten-year tax differential plan.
Answering a question from Ms. Ehrman about Amended Attachment A, Mr. Lowe said
Johnson, Smith, Pacific Northwest Bell, Dunn, and the Univerisity of

California oppose the annexation, Peterson has not commented, and the opinion
of Aratex is unknown.
e Mayor Obie wondered why the Highway-Oriented Sign District was not recommended
for properties along Beltline Road. Mr. Lowe responded that the industrial
and residential sign districts are more appropriate because the Highway-
Oriented Sign District is a commercial district and there are no commercially
zoned properties in the proposal.
Mayor Obie said he owns property adjacent to properties in the proposal but
that will not affect his decision. He said he will neither request nor oppose
annexation of his property.
No conflicts of interest or ex parte contacts were declared.
Mayor Obie opened the public hearing.
Doug McKay, 2300 Oakmont Way, sa i d he represented McKay Land Development
Company which owns Tax Lot 2800. He said the number of employees on the
property has increased and City sewers are needed.
Robert L. Smith, P.O. Box 5463, said he owns 3.8 acres in three tax lots on
Prairie Road. He bought the M-3 property in 1972 for a auto salvage
operation. In 1982, the property was rezoned to M-2 without his knowledge and
the salvage operation became a nonconforming use. He said annexation or
rezoning which is contrary to reasons for investment disregards ownersl
rights. He said he opposes annexation of his property.
e Bruce Johnson, 2124 Silver Lea Court, said he represented JLB Industries, the
tenant on Tax Lot 100 owned by Louis and Ann Johnson. He said JLB Industries
competes nationally for business and, when costs increase, the firm is less
competitive. He said the existing septic system is more than adequate for
present employees. He said obtaining Lane County permits to expand has been
difficult and he understands such permits are more difficult to obtain from
the City. He said the company will not benefit from annexation and Tax Lot 100
would not have to be included in the proposal. He asked the councilors to
delete Tax Lot 100 from the proposal.
Harold Chapman, 51 Chapman Drive, read the following statement from the
Planning Commission motion on October 13, 1987, recommending approval of the
Beltline Road East (AZ 87-10) annexation proposal:
Based on the oral. . . with a request to the City Council
for a statement that approval of this annexation is not a
step toward encircling the River Road area. . .
Mr. Chapman said the matter should be addressed by the council now. He
distributed copies of a article and an editorial from the Gresham Outlook,
read from the editorial, and discussed it. He sa i d the editorial could
describe the proposal before the Eugene council.

Mr. Chapman said the next State Legislature will probably review annexation
laws and annexation laws are a ma i n issue in the replacement of State
Representative Ron Eachus. He said Eugene should be very careful about
e creating islands that can be annexed without residents' consent and River Road
residents have reason to be apprehensive about annexation proposals.
Mr. Chapman suggested Beltline Road east of Highway 99 be deleted from the
proposal because there is no reason to annex the EWEB reservoir. He sa i d
approval of the proposal as presented will damage relations between River Road
residents and the City.
During consideration of another annexation proposal, Vora Heintz, said her
testimony during consideration of the Twelfth Street Development Corporation,
et al (AZ 87-8) applies to this proposal also. Her testimony was:

information about the annexation proposals in time to comment on
them. The organization's next meeting will be November 9, 1987.

There being no additional requests to testify, Mayor Obie closed the public
hearing.
Mr. Lowe said Lane County rezoned many properties, including Mr. Smith's, in
1982 when the Metro Plan was adopted. Discussing the configuration of this
proposal, he said nonconsenting property owners, such as the Johnsons, were
included in the proposal to create the most effi ci ent serv ice de 1 i very
boundary possible. Residential properties were excluded because residents
might remonstrate. Part of Beltline Road was excluded to avoid encircling the
River Road Area. Some nonconsenting property owners east of Prairie Road were
included in the proposal because a fairly large area is needed to justify the
construction of sanitary sewers.

east and west sides of Prairie Road between
Beltline Road and Leghorn Avenue; on the south
side of Federal Lane between Gent Road and
Prairie Road; on the north and south sides of
Irving Road between Gent Road and the Southern
Pacific Railroad; north and south of Beltline
Road east of the Northwest Expressway; and
Beltline Road right-of-way with associated
utility corridors.
Ms. Ehrman moved, seconded by Mr. Holmer, to adopt the
resolution.
Mayor Obie said approval of the proposal will indicate the council IS intent to
annex the River Road area and he urges approval. He said he respects the
opinion of people who do not want to pay for services they do not need but the
City is providing urban services and residents should help pay for them. He
said the City does not always annex islands. Some islands created decades ago
in the Chase Gardens area have not been annexed.
Ms. Ehrman said written testimony indicates the Guenthers oppose the
annexation.
Mr. Rutan said the proposal meets the annexation criteria and conforms to the
City's plans and policies.
e Ms. Bascom said some septic tanks in the area are failing and it is important
to consider the health of residents.
Mr. Holmer reiterated the Planning Commission recommendation that the council
state it does not intend to encircle the River Road area. He said he does not
want to approve the proposal without such a statement.
Answering a question from Mayor Obie, Mr. Lowe said approval of Mr. Johnsonls
request to delete Tax Lot 100 from the proposal could result in requests from
other property owners for removal of their property and, therefore, could
result in the City not being able to provide services to those owners who want
annexation.
The motion carried 6:1 with Councilors Ehrman, Wooten, Bascom,
Rutan, Miller, and Bennett voting aye and Councilor Holmer
voting nay.
Ms. Ehrman moved, seconded by Mr. Holmer, to adopt a final
order rezoning property within the area to be annexed from
County 1-2/UL to City 1-2, from County PL/UL to City PL, from
County RA/UL to City RA, and from County R-l/UL to City R-1
and designation of industrial and residential sign districts.

The motion carried unanimously, 7:0.
e I I 1. WORK SESSION: NO CRUISING ORDINANCE
Mayor Obie announced that the council will consider the no cruising ordinance
at another time because consideration of the annexation proposals has taken
longer than anticipated.
Mr. Whitlow said he apologized to people in the audience who were interested
in the ordinance and assured them it will be the first item on a future agenda.
IV. PUBLIC HEARING: ANNEXATION REQUEST FOR PROPERTY LOCATED ON AND ALONG
BELTLINE ROAD FROM ROSS LANE TO RIVER AVENUE (CITY OF EUGENE:
BELTLINE ROAD EAST) (AZ 87-10)
City Manager Micheal Gleason introduced the item. Neil Bjorkland of the
Planning Department gave the staff report. He said the annexation proposal
involves 11.35 acres of Beltline Road and Division Avenue rights-of-way and an
adjacent EWEB transmission line. He sa i d the propo sa 1 is continguous to
existing city limits on the east and west ends and along parts of the northern
and southern boundaries. He said approval of the proposal wi 11 clarify
responsibility for road maintenance and police service.
Mr. Bjorkland said the part of Beltline Road included in this proposal was
part of the Wastewater Treatment Plant annexation (AZ 83-2) approved by the
City Council in 1983. The Boundary Commission deleted Beltline Road from that
e proposal because the Boundary Commissioners felt it was not necessary for
Eugene to provide emergency services in the right-of-way at that time. Since
then, five annexations in the area have been approved and the need for Eugene
to provide services has increased substantially.
Mr. Bjorkland said the Planning Commission recommended approval of the request

Ms. Heintz said the River Road Community Organization existed in 1976 and was
recognized by the Lane County Board of Commissioners. She emphasized that she
did not receive information about the annexation proposals before the Planning
Commission considered them and members of the River Road Community
Organization did not receive the information in time to evaluate it before the
council considered the proposals. She said the Executive Board opposes the
proposals but members did not get full background information on them. She
said 80 percent of the people in the River Road area opposed annexation in
1978/1979.
Harold Chapman, 51 Chapman Drive, asked that his comments about i s 1 and
annexations during consideration of the Marxen, Kempf, et a 1 (AZ 87-9)
proposal be included in the record of this proposal. The comments were:

from the Planning Commission motion on October 13, 1987, recommending
approval of the Beltline Road East (AZ 87-10) annexation proposal:
Based on the oral. . . with a request to the City Council
for a statement that approval of this annexation is not a
step toward encircling the River Road area. . .
"Mr. Chapman said the matter shoul d be addressed by the council now.
He distributed copies of an article and an editorial from the
Gresham Outlook, read from the editorial, and discussed it. He
said the editorial could describe the proposal before the Eugene
counci 1.
"Mr. Chapman said the next State Legislature will probably review
annexation laws and annexation laws are a main issue in the
replacement of State Representative Ron Eachus. He said Eugene
should be very careful about creating islands that can be annexed
without residents. consent and River Road residents have reason to
be apprehensive about annexation proposals.
"Mr. Chapman suggested Be 1t 1 i ne Road east of Hi ghway 99 be deleted
from the proposal because there is no reason to annex the EWEB

reservoir. He said approval of the proposal as presented will
damage relations between River Road residents and the City.1I
e Mr. Chapman said this proposal will make an island of 20 tax lots and the
Marxen, Kempf, et al proposal will make an island of over 30 tax lots. He
emphasized that the property rights of those owners should not be abused.
There being no additional requests to testify, Mayor Obie closed the public
hearing.
Res. No. 4065--A resolution furthering annexation to the City
of Eugene and the Lane County Metropolitan
Service District for road and electrical
rights-of-way located on and along Beltline
Road from Ross Lane to River Avenue.
Ms. Ehrman moved, seconded by Mr. Holmer, to adopt the
resolution.
Mr. Holmer said the proposal will create regular city boundaries but he cannot
vote for a proposal that will create additional islands that can be annexed
without residents' approval.
The motion carried 6:1 with Councilors Ehrman, Wooten, Bascom,
Miller, Rutan, and Bennett voting aye and Councilor Holmer
voting nay.
e v. RESOLUTION REGARDING HISTORIC LANDMARKS
Mr. Bennett declared a conflict of interest because of his ownership of the Ax
Billy Building. He did not participate in the discussion or vote.
Assistant City Manager Dave Whitlow introduced the item. Planning Director
Susan Brody gave the staff report. She said the Quackenbush Building, Ax
Billy Building, the McDonald Theater Building, the Eugene Hotel Building, the
U.S. Post Offi ce Buil di ng, and Johnson Ha 11 and the Museum of Art on the
University of Oregon campus are National Historic Landmarks but they are not
City Historic Landmarks. The resolution before the council will initiate the
City1s National Historic Landmark process for the properties.

Ms. Ehrman moved, seconded by Mr. Holmer, to adopt the
resolution. Roll call vote; the motion carried unanimously,
6:0:1 with Councilor Bennett abstaining.

VI. ORDINANCE CONCERNING LIQUOR LICENSE REVIEWS
e Assistant City Manager Dave Whitlow introduced the item.
Mr. Holmer said the proposed ordi nance is not adequate and he woul d 1 i ke
additional information about the City's policies when liquor licenses are
reviewed.
Mayor Obie said the ordinance will be "held over."
VII. FINDINGS OF HEARINGS OFFICIAL/ORDINANCES LEVYING ASSESSMENTS:
CONTRACTS 86-06, 86-09, AND 86-11
Assistant City Manager Dave Whitlow said no objections to the ordinances have
been fil ed.
CB 2994--An ordinance levying assessments for sanitary sewer to
serve Goodpasture Island Road from 750 feet to 1,700
feet north of Valley River Drive (Contract 86-08).
CB 2995--An ordinance levying assessments for storm sewer 300
feet east of Glenwood Boulevard from 22nd Avenue to
Interstate 5 (1-5) Freeway (Pape Bros.)
(Contract 86-09).
CB 2996--An ordinance levying assessments for paving and storm
and sanitary sewers to serve Pitchford Avenue from
e Willow Creek Road to 2,300 feet west (Contract 86-11).
Ms. Ehrman moved, seconded by Mr. Holmer, to adopt the
findings of the Hearings Official, to read the bills the
second time by council bill number only with unanimous
consent of the council, and to consider enactment at this time.
Roll call vote; the motion carried unanimously 7:0.
Ms. Ehrman moved, seconded by Mr. Holmer, that the bills be
approved and given final passage. Roll call vote; all
councilors present voting aye, the bills were declared passed
(and became Ordinance No. 19508 (CB 2994), Ordinance No. 19509
(CB 2995), and Ordinance No. 19510 (CB 2996).
VIII. BALLOT AND DETERMINE INTERVIEWEES FOR DOWNTOWN COMMISSION, PLANNING
COMMISSION, AND EUGENE-SPRINGFIELD METROPOLITAN PARTNERSHIP OPENINGS/
ESTABLISH INTERVIEW TIMES
Mr. Holmer moved, seconded by Mr. Rutan, to appoint Gerry
Gaydos, 2820 Emerald Street, to a second term (ending
December 31, 1991) on the Planning Commission and to
interview candidates for the other vacant position.

Ms. Bascom said she prefers to interview all candidates for vacant positions.
Ms. Wooten and Ms. Ehrman agreed with her.
e The motion carried 4:3 with Councilors Holmer, Rutan, Miller,
and Bennett voting aye and Councilors Ehrman, Wooten, and
Bascom voting nay.
The councilors submi tted ba 11 ots for interviewees for a vacancy on the
Downtown Commission, a vacancy on the Planning Commission, and three Eugene
positions on the Eugene/Springfield Metropolitan Partnership Board of
Directors.
Ms. Bascom suggested that Mayor Obie ask the Metropolitan Partnership Board of
Directors to change the length of terms for board members so that the terms of
Eugene representatives can be staggered. The other councilors agreed with her
suggestion.
Ms. Ehrman said the current members of the Partnership Board of Directors
received more votes than any other candidates.
Ms. Ehrman moved, seconded by Mr. Holmer, to re-appoint
Bob Fenstermacher, Tom Hoyt, and Jeanne Wagenknecht to
the Metropolitan Partnership Board of Directors for terms
ending December 31, 1988.
Ms. Wooten said she would like to interview Mr. Fenstermacher, Mr. Hoyt, and
Ms. Wagenknecht about their contributions to the Partnership, their future
plans for the Partnership, and what the Partnership has accomplished.
e Mr. Rutan said it would not be necessary to interview the three since they
received more votes than other candidates.
Ms. Bascom suggested the three be re-appointed and then invited to meet with
the council to discuss the Partnership.
The motion carried 6:1 with Councilors Ehrman, Holmer,
Bascom, Rutan, Miller, and Bennett voting aye and
Councilor Wooten voting nay.
Ms. Ehrman moved, seconded by Mr. Holmer, that the council
interview all three candidates, Marcia Chambers, Ann Kahanek,
and Joy Morrow for a vacancy on the Downtown Commission. The
motion carried unanimously, 7:0.
Ms. Ehrman said Mr. Stephens received five votes, Mr. Evans received four
votes, and Mr. Davi sand Mr. Tollenaar each received three votes for the
Planning Commission vacancy.
