ABSENT: Debra Ehrman. The regular meeting of the City Council of the City of Eugene, Oregon, was called to order by His Honor Mayor Brian B. Obie. 1. PUBLIC FORUM Mayor Obie gave an opportunity to those who wished to address the council about subjects that are not scheduled for council consideration. Paul Engelking, 32 N. Alder, Lowell, told the council he was crossing the intersection of Franklin and Agate streets on October 29, 1987, when he was e struck by a vehicle making a left turn. He said a traffic sign allowing only a 1 eft or ri ght turn from Agate Street makes it dangerous for pedestrians crossing in the crosswalk. In addition, he said the sign is an inducement for left-turning traffic to violate ORS 811.350, which stipulates the conditions for a dangerous left turn. Mr. Engelking said he has been informed by the City's Transportation Division that a plan is available that would make the intersection more safe. He asked the council to allocate enough money so that such a project could be completed. Mr. Engelking submitted a written copy of hi s comments. II. PUBLIC HEARINGS A. Annexation/Rezoning Request For Properties Located On Both Sides Of Prairie Road, North Of Irving Road And South Of Kaiser Avenue (HERBERT, UNITED PIPE, SHERMAN, ET AL) (AZ 87-12) City Manager Mike Gleason introduced the item. Cathy Czerniak, Planning Department, presented the staff report. She said the annexation consists of nine tax lots currently industrially zoned and designated, and portions of Prairie Road and Leghorn rights-of-way. The properties are within the urban growth boundry and located on both sides of Prairie Road between Irving Road and Kaiser Avenue. - MINUTES--Eugene City Council December 7, 1987 Page 1 , The requested annexation is adjacent to a previous annexation, AZ 87-9. The Boundary Commission, which was scheduled to make a decision regarding AZ 87-9 e at its December 3 meeting, was forced to delay a public hearing and any action due to a lack of a quorum. Ms. Czerniak said the request includes both consenting and nonconsenting property owners. Approval of AZ 87-9 and the annexation before the council tonight will enable a large sewer project to be completed during one construction phase. This annexation and subsequent sewer connection will be helpful in meeting the Environmental Protection Agency and Oregon Department of Envi ronmenta 1 Quality sewer hook-up deadl i ne schedule. She said the Planning Commission voted unanimously to approve the annexation requests. She added the ten-year tax differential plan will apply to the properties included in the annexation. Mr. Rutan asked what portion of the 21.66 acres involved are represented by the nonconsent i ng land owners. Ms. Czerniak said nonconsenting owners comprise four properties or about half of the acreage. Mayor Obie opened the public hearing. Hearing no requests to testify, he closed the public hearing. Res. No. 4067--A resolution furthering annexation to the City of Eugene and the Lane County Metropolitan Service District for properties located on both sides of Prairie Road, north of Irving Road and south of Kaiser Avenue. e Mr. Holmer moved, seconded by Ms. Schue, to adopt the resolution. Roll call vote; the motion carried 6:1 with Councilors Bascom, Bennett, Miller, Rutan, Schue, and Wooten voting aye and Councilor Holmer voting nay. AZ 87-12--A final order rezoning property located on both sides of Prairie Road, north of Irving Road and south of Kaiser Avenue from County I-2/UL to City 1-2 and designation of Industrial Sign District. Mr. Holmer moved, seconded by Ms. Schue, to approve final order AZ 87-12. Roll call vote; the motion carried unanimously, 7:0 B. Annexation/Rezoning Request For Property Located On The West Side Of River Road, Between Bauer And Hansen Lanes (Looking Glass) (AZ 87-11) City Manager Mike Gleason introduced the item. Cathy Czerniak presented the staff report. The annexation/zone change request consists of a single tax lot located adjacent to the existing city limits on the west side of River Road between Hansen and Bauer lanes. Sewers are already in place along River Road to serve the property and police currently travel in front of the property on their way to serving the east side of River Road. e MINUTES--Eugene City Council December 7, 1987 Page 2 --., ~----~ ------ Ms. Czerniak reported the Planning Commission unanimously adopted findings that the proposal is consistent with Eugene1s annexation criteria. The five- e year tax differential plan will apply to the annexed property. In response to a question from Mr. Holmer, Ms. Czerniak said the current occupants are paying property tax. Mayor Obie opened the public hearing. Hearing no requests to testify, Mayor Obie closed the public hearing. Res. No. 4068--A resolution furthering annexation to the City of the Eugene and the Lane County Metropolitan Service District for the property located on the west side of River Road, between Bauer Lane and Hansen Lane. Mr. Holmer moved, seconded by Ms. Schue, to adopt the resolution. Roll call vote; the motion carried 6:1 with Councilors Bascom, Bennett, Miller, Rutan, Schue, and Wooten voting aye, and Councilor Holmer voting nay. AZ 87-11--A final order rezoning property located on the west side of River Road, between Bauer Lane and Hansen Lane from County RA/UL to City R-1 and designation of Residential Sign District. Mr. Holmer moved, seconded by Ms. Schue, to approve final order AZ 87-11. Roll call vote; the motion carried unanimously e 7:0. Mr. Bennett asked Mr. Holmer why he is voting against the annexations. Mr. Holmer said he is opposed to the "spot annexation" method being taken by the council. C. City Of Eugene Supplemental Budget No.2 City Manager Mike Gleason introduced the item. He said Warren Wong, Finance Director, is available to answer council questions. Mayor Obie opened the public hearing. Hearing no requests to testify, Mayor Obie closed the public hearing. CB No. 3009--An ordinance adopting a Supplemental Budget; making appropriations for the City of Eugene for the Fiscal Year beginning July 1, 1987, and ending June 30, 1988; and declaring an emergency. Mr. Holmer moved, seconded by Ms. Schue, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Roll call vote; the motion carried unanimously 7:0. The bill was declared passed (and became Ordinance No. 19522). Mayor Obie recessed the meeting of the Eugene City Council and convened a meeting of the Eugene Renewal Agency. D. Eugene Renewal Agency Supplemental Budget No. 1 City Manager Mike Gleason introduced the item. Mayor Obie opened the public hearing. Hearing no requests to testify, Mayor Obie closed the public hearing. Res. No. 931--A resolution adopting a Supplemental Budget; making appropriations for the Eugene Renewal Agency for the Fiscal Year beginning July 1, 1987, and ending June 30, 1988. Mr. Holmer moved, seconded by Ms. Schue, to adopt the resolution. Roll call vote; the motion carried unanimously, 7:0. Mayor Obie adjourned the meeting of the Eugene Renewal Agency and reconvened e the meeting of the Eugene City Council. III. SOUTH WILLAMETTE SUBAREA STUDY City Manager Mi ke Gleason introduced the item. A 11 en Lowe, Planning Department, presented the staff report. He said the area under discussion runs from 19th Avenue to 24th Place on the west side of Willamette Street. He reviewed the Planning Commission's original recommendation that the west side of Willamette between 19th and 22nd avenues be rezoned to R-2/10A units per acre and the blocks between 22nd Avenue and 24th Place retain R-3 zoning. Mr. Lowe presented a brief slide show of the area in question. He said the Planning Commission, at a September 21 work session, discussed three issues pertaining to land use and densities. The first issue was the Metro Plan designation, which, for the west side of Willamette, is low-density residential. The existing zoning on the west side is R-3 and inconsistent with the Metro Plan designation. The second issue discussed was automobile trip generation. There are currently 14 tax lots and 20 dwelling units in the area that generate approximately 200 trips per day. About 616 per day would be generated under an R-3 zoning. The third issue was topography and alley access. Mr. Lowe said the topography is relatively steep except for portions of the area that flatten out between 19th and 20th avenues and 22nd Avenue and 24th Place. All but two of the properties use the alley for access. e MINUTES--Eugene City Council December 7, 1987 Page 4 '~ - Staff drafted three alternatives for the Planning Commission to consider. Option A) maintain the commission's original recommendation that the west side e of Wi 1 lamette Street between 19th and 22nd avenues be rezoned to R-2/10A units per acre and retain R-3 zoning between 22nd Avenue and 24th Place. Option B) retain R-3 zoning in its existing configuration from 19th Avenue to 24th Place. Option C) rezone the seven tax lots south of Grandview Street to R-2/10A and retain R-3 zoning on the remaining tax lots between 19th Avenue and 24th Place. The Planning Commission unanimously approved Option C, according to Mr. Lowe. Mr. Lowe responded to an earlier question from Mr. Bennett about the feasibility of the seven property owners affected by Option C to dedicate addit i ona 1 ri ght-of-way to wi den the alley. He said the existing alley running between Grandview Street and 22nd Avenue is 16 feet wide. The alley would have to be increased 34 feet for an acceptable width of 50 feet. The needed width would have to come from the seven private parcels on the west side of the alley. Those properties are currently 100 feet deep. Ms. Wooten asked what kind of communication has been heard from the property owners, in particular the seven property owners affected by an alley expansion. Mr. Lowe said he has had no communication from any of the seven property owners, and one letter from a resident who owns property between 19th and 20th avenues. Ms. Bascom said she appreciated the tour of the subarea she and Mr. Bennett took to further explore the proposed downzoning. She said it was interesting e to discover the seven parcels would make R-3 zoning difficult for primarily topographical reasons. She said the issue of widening the alley was raised to explore the possibility of providing access from the alley instead of the steep slope at Willamette. Ms. Bascom said she appreci ates Mr. Bennett raising the issue of downzoning because the council has made it a practice to decrease the number of downzoned parcels except in the most important of cases. Mr. Holmer asked if the property owners on the seven parcels can install R-2/10A residences. Mr. Lowe replied they could, although the council should keep in mind the first three lots south of Grandview Street have been developed in the last 10 years. He clarified for Mr. Holmer that R-3 zoning allows for single or multi- families within limits of housing. Mr. Bennett said he has a philosophical problem with downzoning properties unless there is a significant health and safety threat. He said he is not persuaded that 50 feet would have to be taken off the private property to accommodate reasonable access from the alley. Mr. Miller said he concurs with Mr. Bennett and supports his opposition to the change. e MINUTES--Eugene City Council December 7, 1987 Page 5 CB No. 2974--An ordinance adopting the South Willamette Subarea Plan. . Mr. Holmer moved, seconded by Ms. Schue, that the bill be read the second time by council bill only, with unanimous consent of the council, and that enactment be considered at this time. Ms. Bascom noted that the Planning Commission unanimously approved the South Wi11amette Subarea Plan. She also pointed out the Plan is an effort to recognize a discrepancy between the Metro Plan that designates the area a single-family zone, and the City zoning as R-3. Mr. Bennett moved, seconded by Mr. Rutan, to amend the motion by substituting Option B for Option C. Ro 11 ca 11 vote; the motion carried 5:2 with Councilors Holmer, Bennett, Miller, Rutan, and Wooten voting aye, and Councilors Bascom and Schue voting nay. Roll call vote that the main motion as amended be read a second time by council bill only; the motion carried 7:0. Council Bill 2974 was read the second time by council bill number only. Mr. Holmer moved, seconded by Ms. Schue, that the bill be approved and given final passage. Roll call vote; the motion carried 5:2 with Councilors Holmer, Bennett, Miller, e Rutan, and Wooten voting aye, and Councilors Bascom and Schue voting nay. The bill was declared passed (and became Ordinance No. 19523). VII. Roll call vote; the motion carried unanimously, 7:0.
