Hamel, Gretchen Miller, Brian Obie, Emily Schue, Betty Smith, Cynthia Wooten. COUNCILOR ABSENT: Mark Lindberg. Adjourned meeting of the City Council of the City of Eugene, Oregon, was called to order by Council President Brian Obie. 1. ITEMS FROM MAYOR AND COUNCIL, APPOINTMENTS, ANNOUNCEMENTS, AGENDA ADJUSTMENTS A. Request for Update on Bonneville Power Administration Transmission Line Councilor Wooten asked for an update on the BPA transmission line that had been proposed to run through South Eugene. Mr. Whitlow said staff would provide this information on the first available council agenda. B. Appointments - Mr. Obie said that the council would be considering Mayor Keller1s nomination of John Gregor to the Performing Arts Commission. Ms. Schue moved, seconded by Ms. Smith, to appoint John Gregor, 975 Oak, to the Performing Arts Commission for a term to expire January 1, 1986. Roll call vote; motion carried unanimously. C. Status Report from Eugene Arts Foundation Assistant City Manager David Whitlow introduced Benson Snyder, director of the Eugene Arts Foundation. Mr. Snyder said that the foundation had made commitments of $1,809,845 to the Performing Arts Center, including $389,00 for operating support. He said that the broad-scale community fundraising effort had been postponed until after the opening of the center. Mr. Snyder said that gifts raised to date totaled $4.92 million, with $3.4 million contributed toward the $5.5 million goal for capital enhancement and operating support and $1.5 million committed to an endowment for support of major local performing arts groups. Mayor Keller arrived at the meeting. Mr. Snyder said this $1.5 million endowment had been given by Carolyn Silva- Chambers in memory of her parents, Julio W. and Elizabeth M. Silva. He said that the foundation had passed a resolution requesting the council to name the large concert hall Silva Hall to ~ommemorate this gift. - MINUTES--Eugene City Council September 8, 1982 Page 1 .~ Councilor Schue expressed her delight at Ms. Chambers' gift and at the support for local arts organizations. She said she was pleased at the request to have - the council honor the Silvas by naming the concert hall Silva Hall. Counc i lor Smith added that this was a most fitting tribute to the Silva family and a great benefit to local arts groups. Councilors Hamel and Obie added their appreciation. Mayor Keller expressed the appreciation of the council and of the citizens of Eugene for this generous gift. Res. No. 3715--A resolution naming the concert hall in the Eugene Performing Arts Center. Ms. Schue moved, seconded by Mr. Hamel, to adopt the resolution. Roll call vote; motion carried unanimously. Mayor Keller took over the chairing of the meeting. D. Announcements 1. Financial Planning Committee meeting date Mr. Whitlow said that the Council Financial Planning Committee would meet at 5 p.m. on Monday, September 13, 1982. 2. Contract with International Alliance of Theatrical and Stage Employees and Motion Picture Operators (IATSE) Mr. Whitlow introduced Bruce Mulligan, Employee Relations Manager. Mr. Mulligan - saia that, as a result of the opening of the Performing Arts Center, the City had entered into relations with a new bargaining group, the International Alliance of Theatrical and Stage Employees and Motion Picture Operators (IATSE). He said that relations had gotten off to a good start, with a contract agreement that will carry the City through June 30, 1983. He said that the contract was a flexible one that should permit innovative operations. Mr. Mulligan introduced IATSE representative Marvin Ramsay. Mr. Ramsay said that he was pleased with the contract settlement and that the City had been a pleasant group to bargain with. He noted, however, that IATSE local members have yet to ratify the agreement. 3. West University Neighbors Community Street Fair Mayor Keller said that Councilor Lindberg had asked him to announce that on Saturday, September 18, 1982, the West University Neighbors, the University Small Business Association, and the Eugene Department of Parks and Recreation will hold a community street fair. Mr. Lindberg invited councilors to attend this event. Mr. Whitlow said that the City would have a booth at the fair and that Mr. Lindberg would be contacting councilors for help in staffing that booth. e MINUTES--Eugene City Council September 8, 1982 Page 2 'J~ II. Consideration of Council Minutes of July 12, 19H2; Regular and Work Session meetings of July 21, 1982; Regular Meeting of July 26, 1982, and July 28, 1982, and August 9, 1982; and Regular and Work Session meetings of August 11, 1982 (minutes distributed) Mr. Obie moved, seconded by Ms. Schue, to approve the City Council minutes of July 12, 1982; regular and work session meetings of July 21, 1982; regular meetings of July 26, July 28, and August 9, 1982; and regular and work session meetings of August 11, 1982. Roll call vote; motion carried unanimously. B. Improvement Petitions Mr. Whitlow said that these were routine improvement petitions and noted that this was only the first step in the assessment process and that staff would return to the council to set dates for public hearings on the improvements and to award the contracts. 1. Street paving, sanitary sewer, and storm sewer in 7th Avenue (affected property on petition--assessable costs: paving, 100 percent; sewers, 100 percent; City cost, none) Res. No. 3711--A resolution authorizing street paving, sanitary sewer, and storm sewer construction in 7th Avenue cul-de-sac on the south side of West 7th Avenue, e 600 feet east of Bailey Hill Road (1977). Mr. Obie moved, seconded by Ms. Schue, to adopt the resolution. Roll call vote; motion carried unanimously. 2. Intersection reconstruction at 13th Avenue (affected property on petition--assessable costs: paving--total front footage/front footage petitioned, 162 feet, 100 percent; City cost, none) Res. No. 3712--A resolution authorizing intersection reconstruction at 13th Avenue, Franklin Boulevard, and Villard Street, to serve tax lots 17-03-33-32-05800 and -05900 (2070). Mr. Obie moved, seconded by Ms. Schue, to adopt the resolution. Roll call vote; motion carried unanimously. 3. Mr. Obi e moved, seconded by Ms. Schue, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Roll call vote; motion carried unanimously. Council Bill 2512 was read the second time by council bill number only. Mr. Obie moved, seconded by Ms. Schue, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Traffic diverters located on Potter Street, 5th Avenue, e Onyx Street, 26th Avenue, and 25th Avenue (memo, administrative order, background information distributed) Mr. Obie moved, seconded by Ms. Schue, to call a public hearing for September 27, 1982, to consider traffic diverters located on Potter Street, 5th Avenue, Onyx Street, 26th Avenue, and 25th Avenue. Ms. Wooten said that she had been told that the hearing on tne 5th Avenue diverter would be held on September 13. She said that the newsletter of the Whiteaker neighborhood group had also reported that date. Councilor Wooten said that she would support the motion but requested that pUblic notification of the change in date be made. Mr. Whitlow said that staff would give special attention to publicizing the change in date and that if the new date could not receive adequate publicity, the item would be postponed until such time as adequate publicity could be provided. Councilor Hamel said he would oppose the motion due to his longstanding belief that traffic diverters were not a solution to traffic problems. Roll call vote. Motion carried 6:1, with Councilors Ball, Miller, Obie, Schue, Smith, and Wooten voting in favor, and Councilor Hamel voting in opposition. III. PUBLIC HEARINGS e A. Street Vacation Located between South Shasta Loop and Sweetbriar Lane (Dennis Hartley) (SV 82-1) (map, background distributed) Recommended approval by Planning Commission June 7, 1982 Vote--6:0 Mr. Whitlow said that staff was available to respond to questions. Public hearing was opened. There being no public testimony, public hearing was closed. CB 2514--An ordinance authorizing vacation of a 20-foot-wide public street easement located between South Shasta Loop and Sweetbriar Lane. Mr. Obie moved, seconded by Ms. Schue, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Roll call vote; motion carried unanimously. Council Bill 2514 was read the second time by council bill number only. Mr. Obie moved, seconded by Ms. Schue, that the bill be approved and given final passage. Roll call vote. In-Custody Jail Hearings (memo, ordinance, background information e distributed) Mr. Whitlow introduced Sandra Franklin, Court Administrator. Ms. Franklin said that the proposed ordinance would allow Municipal Court sessions to be held at the Lane County Corrections Facility. She said that it currently takes three or four Police officers to provide transportation and security to bring those in custody from the corrections facility to City Hall for each session and tnat this ordinance would free up these Police officers for other duty. She said that the security risk of transporting those in custody would also be reduced. Ms. Franklin said that the weekend population at the jail could be decreased under the proposed change, since hearings could be held on Friday afternoons. She said that a status report on the new procedure would be made in 90 days. Ms. Franklin said that Deputy Police Chief Pat Larion was available to respond to questions. Responding to a question from Councilor Wooten, Ms. Franklin said that court proceedings will continue to be open to the public when sessions are held in the corrections facility. Responding to a question from Councilor Miller, Ms. Franklin said that in-custody hearings are held for approximately 100 to 125 people per month. Ms. Franklin felt that staff would be able to process paper- work for cases and get the necessary papers to the corrections facility in a timely manner for hearings. Councilor Miller asked whether the fact that arraignments were held in the corrections facility could be used in allegations that the setting was coercive. Tim Sercombe of the City Attorney's Office said that the defendant is in custody e no matter whether hearings are held at City Hall or at the Lane County Corrections Facility and that defendants would have the same rights to dress in street clothing at the corrections facility as at City Hall. Councilor Miller said that the proposed change seemed worth trying and that she would be interested in receiving the report on the first 90 days of the new process. She commented that the new process could save the City some money. Mr. Whitlow said that the new process might actually cost tne City more than the present system but that it would allow more Police officers to work on the street, since they would no longer be needed to transport those in custody and only one officer would be needed to provide security at the corrections facility during court sessions. Public hearing was opened. There being no public testimony, public hearing was closed. CB 2515--An ordinance concerning Municipal Court; adding a new section 2.772 to the Eugene Code, 1971; and declaring an emergency. Amendments to the Sign Code Allowing Banners and Searchlights for the Grand Opening of the Eugene Performing Arts Center (CA 82-6) (memo, ordinance, background information distributed) Mr. Whitlow introduced Jerry Jacobson, Planning. Mr. Jacobson said that the proposed amendments would allow the use of banners and searchlights during events of September 19, 1982, through November 14, 1982, surrounding the Grand Opening of the Eugene Performing Arts Center (EPAC). Mr. Jacobson said that other amendments to the Pedestrian Sign District had been presented to the Planning Commission along with the items under consideration by the council at this time, but that the Planning Commission had decided to separate the items due to the imminence of the EPAC grand opening and to allow more time for consideration of the Pedestrian District. Mr. Jacobson said that the Planning Commission felt that the amendments should be granted for EPAC on a one-time basis for the grand opening and that any future uses should be considered along with the remaining amendments to the Pedestrian District. Mr. Jacobson noted that the Planning Commission had voted 4:1 to recommend approval. Responding to a question from Councilor Wooten, Performing Arts Center Director Dick Reynolds said that he did not yet know how frequently searchlights would be used during the September 19-November 14 period. e Public hearing was opened. AUTHORIZATION OF GENERAL OBLIGATION BANCROFT BOND SERI ES II I II BOND SALE . (memo distributed) Mr. Whitlow introduced Warren Wong, Financial Services Director. Mr. Wong said that the resolution before the council would authorize the notice of sale of $4,555,000 in Series 11111 General Obligation Bancroft Improvement Bonds and that the ordinance would authorize the issuance and sale of the bonds. Mr. Wong said that sealed bids would be opened on September 29, 1982, and would be returned to the council for the award. He estimated that the rate would be approximately ten percent. Mr. Wong said it was important to take this action now 1} because the City has $4.4 million in warrants coming due in December and January; 2} because interest rates are favorable at this time; and 3} because passage of Ballot Measure 3 would preclude the issuance of Bancroft bonds, and the City must therefore act to cover its outstanding warrants before the general election. Mr. Wong then addressed the subject of delinquent payments on assessments. He said that approximately 5,800 accounts totaling $15.9 million are currently outstanding and that of that amount $3.5 million is delinquent. He said de 1 i n- quent accounts include 826 accounts with developers, totaling $3.2 million, and 85 accounts with private homeowners, totaling $263,000. He said the Budget Committee would be asked to take funds from the Bancroft funds ana put them in the operating budget to provide staffing for collection efforts. He sai d that collections staff would work with delinquent accounts to make arrangements for payments and would proceed with foreclosures if necessary. e Mr. Wong noted that, in light of Ballot Measure 3, the Public Works Department had agreed to put off all new Bancroft-eligible projects until after the election and to finish current projects by that time. Councilor Wooten said she felt that the solutions proposed by staff were good ones but that she was concerned that the City not foreclose on any owner-occupied dwellings. She wondered whether a long-term deferral program could be worked out for delinquent homeowners. Mr. Wong responded that foreclosure was only used as a last resort, that arrangements for at least token monthly payments could usually be made, and that the City did not have a record of foreclosing on private residential property. After some discussion, councilors indicated that while they shared Ms. Wooten's concern, they did not feel the need for action at this time, since the City was presently being extremely flexible in arrangements with delinquent accounts. STAFF MEMORANDUM REGARDING BUILDING PERMIT FEES Councilor Obie said that he appreciated having the comments from staff on building permit fees and that the Financial Planning Committee would be con- sidering the suggestions.
