Hamel, Mark Lindberg, Brian Obie, Emily Schue, Betty Smith. ABSENT: Mayor Gus Keller and Councilors Gretchen Miller and Cynthia Wooten. Regular meeting of the City Council of the City of Eugene, Oregon, was called to order by Acting Mayor, City Council President, Brian Obie. r. CONSIDERATION OF SALARY ADJUSTMENT FOR CITY MANAGER Councilor Obie said that, before his departure for Japan, Mayor Keller had asked Mr. Obie and Ms. Schue to consider and make a recommendation on a salary adjustment for City Manager Micheal Gleason. Mr. Obie read a memorandum from him and Ms. Schue, summarizing the results of Mr. Gleason's annual performance evaluation and expressing the praise of the council for Mr. Gleason's work and the concern of the council for the large number of working hours and the amount of stress Mr. Gleason incurs in the position. Mr. Obie said he and Ms. Schue recommended e that the council consider a 4.6 percent adjustment in Mr. Gleason's salary for 1982-83, retroactive to July 1, 1982, with an additional $2,250 a year in deferred retirement benefits. Mr. Obie said that the 4.6 percent adjustment was in line with salary adjustments recently made for both union and exempt City employees. He said that the adjustment would result in a monthly salary increase from the current $4,300 to $4,500, with an additional $2,250 in retirement benefits. Ms. Schue moved, seconded by Mr. Hamel, to approve the recommendation. Responding to a question from Councilor Ball, Mr. Obie said that the recommended adjustment was consistent with salary adjustments for other City employees. Mr. Ball asked if figures on recent adjustments for union and exempt employees were available. Mr. Gleason said he did not have those figures but that last year's union settlement, as well as adjustments for exempt employees, were approximately eight percent. He said that adjustments for the executive management staff for 1982-83 were at an annualized rate of six percent. Mr. Ball asked when Mr. Gleason's salary had last been adjusted. Mr. Gleason responded that his salary had been adjusted one year ago and that adjustment had also been consistent with bargaining agreement adjustments. Ro 11 call vote. ANNOUNCEMENT: CITIZEN PARTICIPATION MONTH e Mr. Obie announced that October is Citizen Participation Month for the City of Eugene, providing recognition for the more than 200 Eugene citizens currently serving on City boards, commissions, and advisory groups, and also providing a recruitment program for current and future openings on those bodies. III. PUBLIC HEARING: MU-R WHITEAKER RESIDENTIAL MIXED-USE DISTRICT (CA 82-5) (memo, map, background information distributed) Recommended approval by Planning Commission August 9, 1982. Vote--4: 1 Mr. Gleason introduced Susan Smernoff, Planning. Ms. Smernoff said that the Land Use Diagram in the Whiteaker Refinement Plan, adopted by the council in December 1978, had designated three areas for mixed-use development. She sai d that the ordinance before the council would be one way of implementing that designation. She said that the ordinance would have the effect of supporting commercial development and emphasizing residential development. She said that existing industrial uses would be allowed to continue and could expand onto property they currently owned. She emphasized that the MU-R zoning designation would only be applied if requested by the property owner. She said that all property owners in the designated areas would be notified and given a one-time opportunity to have their property rezoned to MU-R without paying the standard zone change fee. She noted that property owners who did not take advantage of this initial round of MU-R zone changes could later apply for MU-R zoning but e would need to pay the standard fee. No ex parte contacts or conflicts of interest were decla~ed by councilors. Staff notes and minutes were entered into the record. Public hearing was opened. There was no public testimony in support of the ordinance. Those speaking in opposition were: Emerson Hamilton, 2159 Escalante Street, said he was one of the owners of Hamilton Electric. He noted that his firm owned property in one of the areas being considered for application of MU-R zoning and said he opposed this rezoning. Mr. Hamilton reviewed the background of the proposal. He cited goals 2 and 3 and related policies of the Whiteaker Refinement Plan, and noted that at the time of adoption he had expressed concern about these goals, which emphasize reducing reliance on the automobile and minimizing the negative impact of regional facilities in the Whiteaker area. He said his firm was a regional facility, serving much of Western Oregon, and that the firm relied heavily on automobiles to serve its customers and to bring customers to the business. He said that the MU-R proposal, circulated to property owners in the affected areas on February 22, 1982, was of great concern to him for the above reasons as well as for its attempts to eliminate medium-intensity industrial uses such as Hamilton Electric in the Whiteaker area. e MINUTES--Eugene City Council October 11, 1982 Page 2 Mr. Hamilton said that he had voiced his concerns at the Planning Commission - hearing on this matter. He said he could see no benefit for his business in the ordinance. He said that electrical contracting and retailing were not included in the list of acceptable businesses or in the alternative matrix. Mr. Hamilton said that his business was established in 1937 and that it had operated for 40 years at its present location, which was ideally suited to the needs of the firm, since it has easy access to the freeways and is near the firm's three primary distributors and suppliers. He said that the business had paid a significant amount of property taxes to the City and had tried to maintain its properties well and be a good neighbor. He said the firm hoped to grow and expand on properties it owns in the area, but he noted that the firm had been unsuccessful in acquiring adjoining properties and so would be expanding onto non-contiguous property. He said he had received no answer to inquiries made of the Planning Department staff regarding the effect of the proposed ordinance on expansion of his firm onto non-contiguous properties. He said that the proposed MU-R zoning was an experiment and that he did not want to be a part of an experi- ment. He felt that the rezoning would have an adverse effect on property values in the area. He said the ordinance was in direct opposition to the City's economic diversification efforts. Mr. Hamilton did not want to have to move his business elsewhere as a result of the rezoning. He said salaries from his firm supported 35 families in the area. He asked that the zoning in the block between Lincoln and Charnelton streets be left as is and that businesses such as his be allowed to expand in the area. Robert Booth, 10518 SW Hood Avenue, Portland, said he owned the property across the street from Hamilton Elect~ic. He said that the property had been owned by the Booth family for 35 to 40 years. He said that the industrial building on e the property was ideally sited within one block of the railroad, with a connecting spur. He was concerned that wholesaling and distributing firms had been excluded from the matrix in the ordinance. He said that he agreed with Mr. Hamilton's comments and felt that the MU-R designation would lower market values and possibly taxable values of properties in the area. He said the City said it was interested in increasing the stock of industrial land in the area, but he felt that the proposed designation would have the opposite effect. Ms. Smernoff said that no property would be rezoned to MU-R unless requested by the property owner. She said that the round of City-initiated rezonings would only be for properties that had requested such rezoning. Ms. Smernoff referred to the matrix appended to the ordinance as Exhibit A and said that under the ordinance, industrial uses could expand on properties they currently owned. She added that the conditional use permit would be required for future changes in the type of industrial use. Jim Croteau, Planning, reiterated that the Planning Commission had been concerned and had specifically provided that any rezonings to MU-R be completely voluntary. There being no further public testimony, public hearing was closed. Responding to questions from Councilor Hamel, Mr. Croteau and Ms. Smernoff said that properties that were zoned for industrial use but currently used for resi- dences could be changed to industrial use in the future. Mr. Croteau, Ms. Smernoff, and Mr. Gleason said there was, however, little possibility under the adopted Whiteaker Refinement Plan that existing residentially zoned properties e in the area would be rezoned for industrial use. Mr. Gleason said that the MINUTES--Eugene City Council October 11, 1982 Page 3 e proposed ordinance would expand the use option for industrially zoned land in the area. Ms. Smernoff said that the Whiteaker Community Council was supportive of the ordinance and was supportive of the continued existence and expansion of industrial uses in the neighborhood. Responding to a question from Councilor Schue, Ms. Smernoff said that the ordinance would not affect Mr. Hamilton's firm's ability to expand onto industri- ally zoned properties he currently owns. She said that the ordinance would not allow new industrial development on property not previously developed industrially. She said, specifically, that the lot Mr. Hamilton had expressed an interest in expanding onto, while it was currently used for a residential duplex, was zoned M-2 and therefore could be used for expansion of the firm. Councilor Smith said that Mr. Hamilton had suggested an amendment to the proposed ordinance, but that, in view of staff comments, this did not appear to be necessary, since the ordinance would favorably address Mr. Hamilton's concerns. Councilor Ball was concerned that Mr. Hamilton had never received the letter he had requested 'from the Planning Department explaining his options for expansion under the proposed ordinance. Ms. Smernoff said that Planning staff members had met with Mr. Hamilton several times. She noted that changes in the proposed matrix of uses had been made after the Planning Commission hearing. Councilor Lindberg requested that staff send Mr. Hamilton and Mr. Booth copies of the minutes of this meeting and letters summarizing the effect of the ordinance on their areas of concern. Mr. Lindberg said he felt that the proposed ordinance e was consistent with the City's economic development and comprehensive planning efforts, particularly in the matter of cQre area revital~zation. Mr. Hamel felt it was important for businesses, not just neighborhood residents, to be included in area planning efforts. Acting Mayor Obie said he felt that the council had addressed the concerns of the businesses in the area and that this could be confirmed in writing to Mr. Hamilton and Mr. Booth, as suggested by Mr. Lindberg. CB 2527--An ordinance concerning MU-R Whiteaker Residential Mixed-use District for properties located in the Whiteaker community; and declaring an emergency. Ms. Schue moved, seconded by Ms. Smith, that the bill be read the second time by council bill number only, with unanimous consent of the council, and that enactment be considered at this time. Roll call vote; motion carried unanimously. Council Bill 2527 was read the second time by council bill number only. Ms. Schue moved, seconded by Ms. Smith, that the bill be approved and given final passage. Roll call vote.
