COUNCILOR ABSENT: Mark Lindberg. Adjourned meeting of the City Council of the City of Eugene, Oregon, was called to order by His Honor Mayor Gus Keller. I. AGENDA ADJUSTMENT FOR APRIL 27, 1983, COUNCIL MEETING Councilor Obie said that he would be absent from the April 27,1983, council meeting and noted that the Buy Oregon First program was scheduled for council discussion at that meeting. He asked if councilors would be willing to hold over action on this item until a future meeting when he could be present, since he would like to participate in the decision. Councilor Holmer suggested that all discussion of this item be delayed until the May 11, 1983, council meeting. Councilors concurred with this suggestion. II. PUBLIC HEARINGS A. Annexation/Rezoning Request for Property Located West of Terry Street between West 11th Avenue and the Coos Bay Branch of the Southern Pacific Railroad from County ICU Industrial/Commercial Urbanizing District to City of Eugene 1-1 Special Industrial District and Appli- cation of City Industrial Sign District (Cone/Net Investments) (A/Z 83-3) (map, background information distributed) Recommended approval by Planning Commission April 5, 1983 Vote--5:0 City Manager Micheal Gleason introduced Bill French, Planning Department. Mr. French said that the request involved approximately 200 acres at the southwest corner of West 11th Avenue and Terry Street. He said that the property was primarily flat. Mr. French noted that a portion of the property was developed with an older farm house. He said that the Amazon Channel crossed the northeast corner of the property. Mr. French noted that this parcel was one of the Special Light Industrial Sites identified in the Metropolitan Area General Plan. He said that the property was well within the urban growth boundary. No ex parte contacts or conflicts of interest were declared by councilors. Staff notes and minutes were entered into the record. Public hearing was opened. There being no testimony, public hearing was closed. Res. No. 3771--A resolution authorizing forwarding a recommenda- tion to the Boundary Commission for annexation of property located west of Terry Street between West 11th Avenue and the Coos Bay Branch of the Southern Pacific Railroad to the City of Eugene and the Lane County Metropolitan Wastewater Service District. Ms. Schue moved, seconded by Mr. Obie, that findings supporting the annexation as set forth in Planning Commission staff notes and minutes of April 5, 1983, be adopted by reference thereto; and that the resolution be adopted. Roll call vote; motion carried unanimously. ' CB 2633--An ordinance authorizing rezoning from County ICU Indus- trial/Commercial Urbanizing District to City of Eugene I-I Special Industrial District and application of City Industrial Sign District for property located west of Terry Street between West 11th Avenue and the Coos Bay Branch of the Southern Pacific Railroad. Ms. Schue moved, seconded by Mr. Obie, that findings supporting the rezoning as set forth in Planning Commission staff notes and minutes of April 5, 1983, be adopted by reference thereto; that the bill be read the second time by council bill number only, with unanimous consent of the council; and that enactment be considered at this time. Roll call vote; motion carried unanimously. Council Bill 2633 was read the second time by council bill number only. Ms. Schue moved, seconded by Mr. Obie, that the bill be approved and given final passage. Roll call vote. All councilors present voting aye, the bill was declared passed and numbered 19134. B. Rezoning Request for Property Located East of Danebo Street, North of West 11th Avenue, from PL Public Land to RA Low-Density Residential District (City of Eugene: West Lawn Memorial Park) (Z 83-1) (map, background information distributed) Mr. Gleason introduced Jim Croteau, Planning Department. Mr. Croteau said that this rezoning had been initiated by the City for 37 acres on Danebo Street. He noted that the land was presently zoned PL Public Land and that under the provisions of the revised PL district, it was incumbent upon the City to initiate changes in PL designations for properties not in public ownership. Mr. Croteau said that the Planning Commission had voted unanimously to recommend approval of the request. He noted that land surrounding the subject property was developed with industrial uses. He said that Planning Commission President Eleanor Mulder was not present, but he was available to answer questions on the Planning Commission discussion of this item. Ms. Schue moved, seconded by Mr. Obie, that findings supporting the rezoning as set forth in Planning Commission staff notes and minutes of March 15, 1983, be adopted by reference thereto; that the bill be read the second time by council bill number only, with unanimous consent of the council; and that enactment be considered at this time. Roll call vote; motion carried unanimously. - Council Bill 2634 was read the second time by council bill number only. Ms. Schue moved, seconded by Mr. Obie, that the bill be approved and given final passage. Roll call vote. All councilors present voting aye, the bill was declared passed and numbered 19135. C. Council-Initiated Improvements for Paving of Sam R Street, 12th Avenue, and Wallis Street (1962) (memo, resolution distributed) Mr. Gleason introduced Bert Teitzel, City Engineer. Mr. Teitzel said that the City Council had initiated consideration of paving for Sam R and Wallis Streets and portions of 12th Avenue as a result of citizen requests at the February 12, 1983, council meeting. He said that staff had met with property owners and that one owner had expressed concern with the cost of the project, given the current economy. Responding to questions from Councilor Wooten, Mr. Teitzel said that all affected property owners were notified of the staff hearing and of this council hearing. He said five owners were represented at the staff hearing. Public hearing was opened. Ray Janisse, 84700 Arbie Lane, said that he owns the Janisse Street subdivision. He noted that it was not just area property owners but also owners of buildings on nearby streets that wanted the improvements. He said that he had done a phone poll of all those affected and that all those surveyed wanted the improve- ments. There being no further testimony, public hearing was closed. Res. No. 3772--A resolution authorizing paving and storm sewer on Sam R Street from 11th Avenue to 12th Avenue; on 12th Avenue from Sam R Street to Wallis Street; and on Wallis Street from 12th Avenue to 900 feet south. - MINUTES--Eugene City Council April 25, 1983 Page 3 e Ms. Schue moved, seconded by Mr. Obie, to adopt the resolution. Roll call vote; motion carried unanimously. D. Changes in Public Improvement Hearing Process (memo, charts distributed) Mr. Gleason introduced Bert Teitzel, City Engineer. Mr. Teitzel said that over a period of several months the public improvement process had been reviewed by City staff and such groups as the Planning Commission, Citizen Involvement Committee, and neighborhood associations. He said that a new process was proposed, which would provide for a hearings officer to conduct the initial hearing and the assessment hearing on improvements and to make a report to the council for adoption. The council would make this adoption without holding a public hearing, except in cases where there was a remonstrance of over 50 percent. Mr. Teitzel noted that the council had previously approved an ordinance that would allow this move to a hearings officer process. He said that, as per the City Charter, there would be a six-month delay before implementation of this revised assessment process. Responding to questions from Councilor Obie, Mr. Teitzel said that a remonstrance is an appeal petition against an assessment. He said that under the proposed process if owners of more than 50 percent of the frontage remonstrate, the council must consider the matter and hold a public hearing. Approval in these cases would require at least a two-thirds vote of the council. e Councilor Wooten asked what effect this would have on situations in which a public agency, such as the State of Oregon, owned a majority of the frontage involved. Mr. Teitzel said that the City would continue to follow its existing policy of considering publicly owned property as neutral. Public hearing was opened. There being no testimony, public hearing was closed. Ms. Schue moved, seconded by Mr. Obie, to adopt the new process. Roll call vote on the motion. Motion carried unanimously. Councilor Wooten, council IS representative on the Citizen Involvement Committee, requested a report be brought back to the Citizen Involvement Committee on the effectiveness of the new process and its impact on citizen involvement. She asked that this report be made six months after initiation of the new process. Mr. Gleason indicated staff would follow up with this report. II. IMPROVEMENTS TO SPRING BOULEVARD A. Contract Award for Paving, Sanitary Sewer, Storm Sewer, and Sidewalk in Spring Boulevard from 30th Avenue to Dogwood Street (Job #2019) (memo distributed; tabulation attached) e MINUTES--Eugene City Council April 25, 1983 Page 4 - Mr. Gleason introduced Bert Teitzel, City Engineer. Mr. Teitzel noted that this item had been heard by the council on February 28, 1983, and that the council had referred the matter back to the Hearings Panel for reconsideration. He said that the Hearings Panel minutes and recommendations had been distributed to councilors. Mr. Teitzel said staff recommended awarding the contract. He noted that, because of the remonstrance, a two-thirds affirmative vote of the council was needed to award the contract. Ms. Schue moved, seconded by Mr. Obie, to award the contract to Egge Sand & Gravel. Roll call vote; motion carried unanimously. B. Approval of Hearing Panel Minutes of April 13, 1983, and Adoption of Findings of Fact (findings, minutes, additional information distributed) Ms. Schue moved, seconded by Mr. Obie, to approve the Hearing Panel minutes of April 13, 1983, and adopt the Findings of Fact. Roll call vote; motion carried unanimously. C. Ordinance for Second Reading--Levying Assessments CB 2599--An ordinance levying assessments for paving, sanitary sewer, storm sewer, and sidewalk in Spring Boulevard on 30th Avenue to Dogwood Street; and declaring an emergency (#83-04). e Council Bill 2599 was read the second time by council bill number only. Ms. Schue moved, seconded by Mr. Obie, that the bill be approved and given final passage. Roll call vote. All councilors present voting aye, the bill was declared passed and numbered 19136. III. APPOINTMENT TO CITIZEN INVOLVEMENT COMMITTEE Ms. Schue noted that prior to this evening's meeting the council had held a special meeting and conducted interviews for the vacancy on the Citizen Involve- ment Committee. Ms. Schue moved, seconded by Mr. Obie, that Richard Guske, 278 North Grand, be appointed to the Citizen Involvement Committee to fill the unexpired term of Darcy Marentette with the term to expire December 31, 1983. Roll call vote; motion carried unanimously. The meeting was adjourned to April 27,1983.
