COUNCILORS PRESENT: Betty Smith, Freeman Holmer, Emily Schue, Dick Hansen,
Mark Lindberg, John Ball (from 12:15 p.m.).
COUNCILORS ABSENT: Brian Obie, Cynthia Wooten.
Adjourned meeting of the City Council of the City of Eugene, Oregon, was
called to order by His Honor Mayor Gus Keller.
I. ITEMS FROM MAYOR AND COUNCIL: ANNOUNCEMENTS
Mayor Keller announced that this was the last meeting for Francis Lynch, Public
Service Officer, and thanked her for her service. He then introduced Jane
Holloway who would be taking her place for the next six months.
Mr. Gleason introduced Andrea Hulnick the new intern in the City Manager's
office.
e Mr. Gleason announced that Don Allen, Public Works Director, would be retiring
in January after 34 years of service to the city, during which time the
population of Eugene had tripled. He paid tribute to the work done by Mr.
Allen in this time.
Mr. Gleason announced that the City Council goal-setting session would be held
October 28 and 29.
Mr. Gleason announced that due to light agendas, the City Council meetings
scheduled for July 20 and 27 had been canceled.
Mr. Gleason noted that an item VIII would be added to the end of the agenda,
Resolution 379l.
Mr. Gleason noted that item VI, resolution initiating the Glenwood Jurisdictional
Study, would be held over to a future meeting.
II. ROUTINE ITEM FOR COUNCIL APPROVAL: APPROVAL OF CITY COUNCIL MINUTES
Ms. Schue moved, seconded by Ms. Smith, to approve the regular
City Council meeting minutes of June 13, 1983, and June 15, 1983,
and the dinner/work session minutes of June 13, 1983.
Councilor Holmer asked that the dinner/work session minutes of June 13, 1983, be
amended to show that Mr. Obie had been present.

III. PUBLIC HEARINGS
A. Amendment to the Transient Room Tax Ordinance
e Mr. Gleason introduced Timothy Sercombe, City Attorney's Office. Mr. Sercombe,
referring to his memorandum dated July 5, 1983, stated that this change was
proposed to amend the Transient Room Tax Ordinance to include bed-and-breakfast
facilities.
Public hearing was opened.
There being no public testimony, public hearing was closed.
CB 2666--An ordinance concerning the Transient Room Tax; amending
Section 3.778 of the Eugene Code, 1971.
Ms. Schue moved, seconded by Ms. Smith, that the bill be read
the second time by council bill number only, with unanimous
consent of the council, and that enactment be considered at
this time. Roll call vote; motion carried unanimously. Councilor
Ball was absent for this vote.
Ms. Schue moved, seconded by Ms. Smith, that the bill be approved
and given final passage. Ro 11 call vo te . Councilor Ball was
absent for thi s vote. All councilors present voted aye; the bill
was declared passed and numbered 19164.
e B. Street Vacation Requests
1. Located west of Jacobs Street, south of Concord Avenue (Solvang
Associates) (SV 81-3)
Mr. Gleason introduced Jim Croteau, Planning Department, who reviewed staff
notes, indicating that thi s request had been made in response to vandal i sm and
trespass problems. He commented that the state requirements for street vacation
were cumbersome, but that this request met the requirements. He noted that the
Planning Commission had voted unanimously to recommend approval.
In response to a question from Councilor Schue, Mr. Croteau said that an
alternative bikeway connector had been provided by the applicants, which had
been approved by the Eugene Bicycle Committee. The Bicycle Committee is in
support of the request for vacation.
Public hearing was opened.
Speaking in favor of the request:
Glen Pederson, 1189 Fairfield Avenue, said that he represented the owners of the
Solvang housing development and the 250 elderly residents. He introduced the
next two speakers.

Verdi Powell, 1202 Jacobs Drive, introduced herself as the manager of the
Solvang housing development and reviewed the vandalism which had occurred there
e since March, 1982. She urged the council to approve the request and make the
place safe for elderly residents.
Lulu Lane, 1202 Jacobs Drive, Apt. #149, said she was a retired Los Angeles
police officer and a resident of the Solvang housing development, and listed
acts of vandalism which she had experienced and heard about.
Councilor Ball arrived at the meeting.
Glen Pederson, 1189 Fairfield Avenue, continued indicating that construction of
an alternative connector had been completed. He denied the allegation that this
vacation would simply move the problem from Solvang to the Village Square.
Noting that the overwhelming majority of neighborhood residents had approved the
request, together with the Eugene Bicycle Committee, the police and fire depart-
ments, and the Bethel citizens group, he requested approval of the request.
There being no further testimony, the public hearing was closed.
CB 2667--An ordinance authorizing vacation of a 46-foot-radius
cul-de-sac on Marshall Avenue and a 12-foot-wide
pedestrian-bikeway easement linking the Marshall
Avenue cul-de-sac and Jacobs Street.
Ms. Schue moved, seconded by Ms. Smith, that the bill be read
the second time by council bill number only, with unanimous
consent of the council, and that enactment be considered at
e this time.
In response to a question from Councilor Schue, Mr. Croteau confirmed that
the land in question had been dedicated to the City by Solvang, and that no
money had changed hands or would at this time. In response to questions from
Councilor Hansen, Mr. Croteau said that fire access would be maintained, but
that there would be no need for turnaround space for stray vehicles.
Roll call vote; motion carried unanimously.
Ms. Schue moved, seconded by Ms. Smith, that the bill be approved
and given final passage. Roll call vote. All councilors present
voting aye; the bill was declared passed and numbered 19165.
2. Located on the east side of River, between Green Lane and
Division Avenue (Miller et al.) (SV 83-1)
Mr. Gleason introduced Jerry Jacobson, Planning Department, who reviewed
a memorandum dated July 6, 1983, noting that the Planning Commission had
recommended approval of the request subject to the three conditions listed. He
said that the applicants were in the final stages of meeting these conditions
and, therefore, asked that consideration of the item be postponed to the City
Council's meeting of August 17, 1983.

Ms. Schue moved, seconded by Ms. Smith, to postpone the public
hearing and council consideration of a street vacation request
e located on the east side of River Road, between Green Lane and
Division Avenue to August 17, 1983. Roll call vote; motion
carried unanimously.
IV. REPORT ON ENERGY CONSERVATION PROGRAMS BY EWEB STAFF
Ms. Reeder of Eugene Water & Electric Board reminded the council that an
ordinance had been enacted in February of 1981 establishing mandatory weatheriza-
tion standards to become a part of the City's Housing Code on January 1,
1985, and requiring a review of certain implementation issues by January 1,
1984. She said that her report had been prepared in anticipation of this
review.
Ms. Reeder noted that three areas had been identified at the time the ordinance
had been adopted: the cost and availability of energy; the success of voluntary
weatherization under existing programs; and the availability of financing.
The Cost and Availability of Energy. Ms. Reeder indicated that there were a
number of unanswered questlons ln this area, including the future of the
WWPPS plants. She said that the cost of energy would be directly related to
demand. She noted that the Regional Energy Council's goal was to buy only
resources that were needed and to buy the cheapest resource first. She added
that conservation was currently the cheapest resource.

Availabilita of Financing. Ms. Reeder observed that BPA funding for EWEB had
been reduce by more than half in the current year, and would be cut again in
FY84. She said that FY85 projections were for less than half the current
financing. In addition, she noted that BPA was requiring utilities to sign long
term conservation contracts with provision for unilateral amendment by BPA
and payment of a conservation contract charge. As a result of concern over
these issues, EWEB was, she indicated, pursuing alternative financing methods
of conservation efforts through the sale of EWEB revenue bonds guaranteed by
BPA.
Ms. Reeder closed her presentation by asking the City Council to support
EWEB's efforts for continued financing and local control of conservation
efforts.

Mr. Gleason concurred with Ms. Reeder's remarks. He noted that conservation was
e not as popular an issue as it had been several years ago, but that the City
should continue its conservation efforts in anticipation of a new cycle of
energy shortages. He commented that Councilors Smith and Schue and two repre-
sentatives from EWEB were meeting to coordinate these efforts.
Councilor Smith agreed that this issue was of vital importance. She noted that
the present working relationship with EWEB should be maintained and reinforced.
She asked Ms. Reeder what the City Council could do at this stage to support
EWEB's struggle for continued local control of the conservation program. Ms.
Reeder replied that a letter to BPA would be helpful. Council agreed that
staff should draft a letter and, if time permitted, a resolution to BPA on the
proposed contract amendment.
Councilor Schue also spoke in favor of continued cooperation with EWEB. She
expressed a need for more information concerning revenue bonding. Councilors
Holmer and Lindberg concurred that the momentum should be maintained.
Councilor Ball asked for more details concerning the conservation contract
charge.
Ms. Reeder distributed copies of her report.
Mr. Gleason said that staff would bring back more information on the issue of
revenue bonds and staff will continue to work with EWEB on their conservation
efforts.
e V. CITIZEN INVOLVEMENT COMMITTEE ANNUAL REPORT
Carol Cogswell, chairperson of the CIC, reviewed the committee's report,
noting that the committee had been established to insure citizen involvement in
land use planning decisions. She indicated that the CIC's major role was in
decisions as to who should be involved and at what stage. She added that during
the past year the committee had established guidelines on citizen involvement,
reviewed specific documents, such as the proposed new land use planning flow
charts, and participated in reviewing the involvement of neighborhood groups.
She concluded by showing the council copies of pamphlets on citizen involvement
which the committee had produced.
Councilor Schue thanked Ms. Cogswell and the CIC for its work during the past
year noting that this committee is a group of creative citizens. Ms. Cogswell
introduced Pat Valerand, next year's chairperson.
VI. REPORT ON IN-CUSTODY HEARINGS PILOT PROJECT
Mr. Gleason introduced Ernie Mazorol, Eugene Municipal Court, who reviewed
highlights from the memorandum on this subject dated July 1, 1983. He noted
that the project had been introduced in order to increase courtroom security,
reduce jail costs, and reduce the number of officers involved in transporting
inmates. He indicated the advantages and disadvantages of the program. He
e recommended continuation of the project.

Mr. Gleason endorsed Mr. Mazorol's recommendation. Mr. Gleason noted that staff
would return to the council with a funding proposal.
e Ms. Schue moved, seconded by Ms. Smith, to endorse the report
as presented and to request a staff financial proposal be
prepared to support it. Roll call vote; motion carried
5:1, Councilor Holmer voting in opposition.
VI I. RESOLUTION CONCERNING OREGON BUSINESS DEVELOPMENT FUND
Mr. Gleason introduced Bill Sloat, Business Assistance Team, who explained that
in order for a business to apply to the Oregon Business Development Fund for a
loan it was necessary for the local jurisdiction -- in this case the City of
Eugene -- to approve a resolution acknowledging the appropriateness of the
transaction between the State of Oregon and the local business.
Mr. Gleason said that staff recommends adoption of the resolution.
Res. No. 3791--A resolution approving the Oregon Business Development
Fund project proposal of Color and Herbal Works, I nc.
Ms. Schue moved, seconded by Ms. Smith, to approve the resolution.
Councilor Holmer stated his intention of voting against the resolution, because
of insufficient notice of this item and the lack of information.
Roll call vote. Motion carried 4:2, with Councilors Lindberg,
e Schue, Smith and Hansen voting in favor, and Councilors Holmer
and Ball voting in opposition.
Counci 1 or Li ndberg stated hi s understandi ng that approval of the resol ution
had merely indicated acknowledgement of the City Council's approval of the
loan program, and not an endorsement of a particular applicant.
Mr. Gleason said that staff would bring back a report as follow up to the
council's concerns which would provide additional information on the program.
The meeting was adjourned to July 20, 1983.
