Adjourned meeting of the City Council of the City of Eugene, Oregon, was called
to order by President Emily Schue.
1. PUBLIC HEARINGS
A. Annexation/Rezoning Request for Property Located North of Division
Avenue, East and West of Ross Lane from County RA Suburban Residential
to City RA Suburban Residential District for Approximately 49 Acres with
application of City Residential Sign District; Remaining Approximately
Five Acres to Retain Existing County Zoning (Hutchinson et al.) (A/Z
83-6)
Mr. Gleason introduced Tom Hayes, Planning Department, who reviewed the staff
e memorandum of July 25, 1983. He observed that the Planning Commission had
unanimously recommended approval, and that six tax lots had been added to the
request at the time of the Planning Commission public hearing at the request of
the property owners, together with the Green Lane right-of-way. Mr. Hayes noted
that three letters of comment had been received which were not in the council
package: from Michael Wells, in support, and from Clarence Greer and Bonnie
Lindsay, in opposition. He indicated that the staff recommendation was to
approve the annexation/rezoning request, including the five non-petitioners
since this would make the extension of services more logical and orderly.
In response to a question from Councilor Wooten, Mr. Hayes explained that the
petition for the incorporation of the proposed City of Santa Clara had gone to
the Lane County Elections Office and would be considered by the Lane County
Commissioners at their next meeting. He said that this request would, if
approved by the council, be received by the Boundary Commission before the Santa
Clara petition, and would therefore be considered by them in the normal way.
Councilor Hansen asked whether the petitioners or the City had set the boundaries
for the proposed annexation. Mr. Hayes replied that the area of the original
request had been set by the petitioners, and that staff had added properties in
order to make the boundaries more logical.

No ex parte contacts or conflicts of interest were declared.
- In response to a question from Councilor Wooten, Mr. Hayes noted that this
annexation would not affect the minimum density figures for the proposed City of
Santa Clara, since it was a sparsely developed area.
Public hearing was opened.
Speaking in favor of the request:
Bill Furtick, 334 Lone Oak Avenue, said that property owners in the area had no
water or sewer services or police protection. He said that he wanted city
services, and was willing to pay for them, and wished to be a part of the City
of Eugene. He noted that the annexation would be in line with land use plans
for the area, and asked the council to approve the request.
Charles Gudger, 59 East 11th Avenue, Suite 4, said that he represented the Lee
family trust, the owner of a mobile home park with 69 mobile homes occupied
mainly by elderly persons. He expressed his clients' concern at the situation
which would arise if the septic system failed and these longtime residents were
forced to leave their homes. He therefore asked that the area be annexed to the
City of Eugene and provided with city services. He added that it was his
opinion that the proponents of the proposed City of Santa Clara merely wished to
keep the area to help their tax base.
Doug DuPriest, 777 High Street, indicated that he represented the Hutchinsons,
and urged approval of the request. He said that residents of the area needed
e city services and that only Eugene could provide them. Noting that not all the
residents of the area were in agreement with the annexation, he said that
nevertheless the Triple Majority requirement had been more than adequately met.
Speaking in opposition to the request:
Clarence L. Greer, 405 Lone Oak Avenue, asked why his property had been added to
the annexation area in order to avoid an island, while, in a previous annexation
request considered by Council, a series of tax lots along Beltline Road, which
also appeared to form an island, had been left out.
John Mehringer, 165 West Hilliard, asked when the council had last turned down
an annexation request which had been approved by the Planning Commission. He
stated his opinion that there was a footrace going on between the incorporation
of the City of Santa Clara and the approval of annexations in the area. Pointing
out that there had been at least a month between the Planning Commission's
recommendation and the City Council's consideration of the previous six annexation
requests, he asked why this request had come to the council less than two weeks
after its consideration by the Planning Commission.
Mr. Mehringer went on to ask whether any followup was ever done on annexations,
and wondered whether any leases had been signed with the Hayden Island group.

Mr. Mehringer noted that a joint policy committee on the River Road/Santa Clara
e area was researching alternatives to traditional gravity sewers, and stated that
the provision of gravity sewers by the City of Eugene was not the only answer.
He indicated that Director of Public Works Don Allen had acknowledged at the
Planning Commission's public hearing that it would take two to five years from
the time of annexation for the City of Eugene to provide sewer service, and
claimed that the City of Santa Clara could do as well. He stated his opinion
that this annexation request was illogical and untimely.
Alan Wagner, 4502 River Road, asked for specific timetables for the provision of
services through the City of Eugene and the proposed City of Santa Clara, so
that residents of the area could make an informed choice, and asked the council
to table the annexation request until after the Boundary Commission had given a
ballot title to Santa Clara.
Responding to testimony, Mr. Hayes observed that Ms. Mulder of the Planning
Commission was available to answer questions. He explained that the six lots to
which Mr. Greer had referred were not an island and were not critical to the
annexation. Responding to Mr. Mehringer's question as to whether leases had
been signed in the Hayden Island development, he said that approval had been
given in good faith, and that development potential was not one of the fbur
criteria which the council was required to consider.
There being no further testimony, the public hearing was closed.
Res. 3792--A resolution forwarding a recommendation to the Boundary
Commission for annexation of property located north of
e Division Avenue, east and west of Ross Lane to the City
of Eugene and the Lane County Metropolitan Wastewater
Service District.
Councilor Obie moved, seconded by Councilor Smith, that findings
supporting the annexation as set forth in Planning Commission
staff notes and minutes of July 12, 1983 be adopted by reference
thereto; and that the resolution be adopted.
Councilor Wooten asked staff for details on the level and timing of improvements,
noting that the applicants were clearly expecting immediate services. Mr.
Gleason replied that residents had control over the timing through the Bancroft
system, and that the sewer trunk line would be in place within two years.
Councilor Lindberg asked what the rationale was for including the non-petitioners.
Mr. Hayes replied that Boundary Commission staff had suggested the inclusion to
avoid the creation of islands and to permit the logical and orderly provision of
services. In response to a question from Councilor Hansen, he stated that the
City's policy was incremental voluntary annexation. The inclusion of the six
properties on Beltline, considered in a previous annexation request, would not
have made the boundary more logical; while, in this situation, the inclusion of
the five non-petitioning properties did make the boundary more logical.

Councilor Ball congratulated Mr. Mehringer on the success of the Santa Clara
- petition. However, he said that annexation was clearly the will of the majority
in thi sease, and that he wou1 d therefore support the motion.
Roll call vote. The motion carried unanimously.
CB 2668--An ordinance authorizing rezoning from County RA
Suburban Residential District to City RA Suburban
Residential District and application of City Residential
Sign District for property located north of Division
Avenue, east and west of Ross Lane.
Councilor Obie moved, seconded by Councilor Smith, that findings
supporting the rezoning as set forth in Planning Commission staff
notes and minutes of July 12, 1983 be adopted by reference thereto;
that the bill be read the second time by council bill number only,
with unanimous consent of the council; and that enactment be
considered at this time. Roll call vote. The motion carried
unanimous1 y.
Council Bill 2668 was read the second time by council bill number only.
Councilor Obie moved, seconded by Councilor Smith, that the bill
be approved and given final passage. Roll call vote. All council ors
present voting aye, the bill was declared passed and numbered 19166
B. Public Works Contract Awards (tabulations attached):
e 1. Paving Sam R, 12th and Wallis Street (1962);
2. Paving sanitary sewer and storm sewer in G1enwood Boulevard (2071);
3. Paving Roosevelt Boulevard from Garfield to Highway 99 North (845)
Mr. Gleason introduced Bert Teitze1 , Public Works Department, who reviewed the
staff memorandum of July 19, 1983.
Councilor Lindberg asked whether this would be an appropriate time to consider the
process for the allocation of the remainder of the Jobs Bill funds. Mr. G1 eason
responded that staff was not ready to make a presentation on this issue. Thi s will
be brought back as a separate item, to council, in the future. Councilor Lindberg
said that there was concern in the community that decisions regarding the Jobs Bill
funds were being made by staff with too little additional input, and suggested that
the Community Development Committee be part of the decision-making process.
Mr. Gleason agreed that the CDC and Eugene Private Industry Counc~l should be
involved; Councilor Lindberg suggested adding the Vagrancy Task Force. Councilor
Obie declared the discussion out of order, noting that information on the Jobs
Bill would be brought back later, and requested discussion of the bids occur.
In response to a question from Councilor Wooten, Mr. Teitze1 said that the State
of Oregon would be contributing $10,000 towards the traffic signal.

Councilor Obie moved, seconded by Councilor Smith, to award the
contracts to the low bidders as outlined in the staff memo of
J u 1 Y 19, 1983. Roll call vote. The motion carried unanimously.
C. 1982/83 Restoration Loan Applications Funded with City Monies:
1. Walton House (Moreno's Restaurant), located at 433 East Broadway
(R 83-2);
2. Ankeny House, located at 212 Pearl Street (R 83-3).
Mr. Gleason introduced Pat Decker, Eugene Development Department, who said that
Ellen Miller-Wolfe of the EDO would give the staff presentation. Ms. Miller-Wolfe
reviewed the staff notes on the two proposals. She said that the original
application for the Walton House had been for painting, but that staff had
discovered that the building was also in need of work on the roof, gutters and
gables, and exterior carpentry work. The Historic Review Board's recommendation
was that a loan of $12,982 be made at 6 percent over 20 years. Ms. Miller-Wolfe
went on to indicate that the recommendation on the Ankeny House was for a
$11,500 loan at 9 percent over ten years for roof replacement. She added that
the reference in the staff notes to encumbrances on the deed was based on
incorrect material received from the title company.
In response to a question from Councilor Holmer, Ms. Miller-Wolfe said that the
e low bid for the painting for the Walton House was $2,337.
Councilor Hansen asked how the interest rates had been determined. Ms. Mi 11 er-
Wolfe replied that the guidelines called for 9 percent on income-producing
property, but that this had been reduced in the case of the Walton House on the
basis of hardship.
Councilor Holmer expressed concern that a 20 year loan was being made for an
improvement with a life less than 20 years, for painting the Walton House. Ms.
Decker said that if the council wished to delete funding for this item they
could do so without taking the issue back to the Historic Review Board.
In response to a question from Councilor Ball, Ms. Miller-Wolfe stated that all
loans through the program were due on sale of the property. He asked about the
nature of the security for the loan for the Ankeny House. Mr. Gleason said
staff would need to work on this item and would bring a report back to the
council on the security issue.
Councilor Hansen asked whether matching funds were being asked for from the
applicants. Ms. Miller-Wolfe said that they were not. Councilor Hansen then
asked whether the Walton House would stand for the 20 years of the loan term.
Ms. Miller-Wolfe replied that without the repairs to the roof the life of the
building would be seriously shortened.

Councilor Lindberg sug~ested dela,ing action on this item until staff responds
to the questions raise by Counci or Ball. Ms. Decker noted the desire to
campl ete the projects prior to the end of the construction season.

Speaking in support of the application:
Bonnie Marineau, 380 Ventura Avenue, the manager of Moreno's Restaurant, said
that she thought of it as an oasis among the fast food restaurants and motels
located on Franklin Boulevard. She said that the restaurant paid its bills, and
could afford the repayments at 6 percent, though 3 percent would be even better.
She urged the council to approve the loan.
There being no further testimony, the public hearing was closed.
Councilor Wooten stated her support for both loan applications noting that the
security issue would be addressed by the attorneys. Councilor Ball indicated
that despi te the good work of staff on these appl ications he coul d not support
them while his fire station was still closed for lack of funds. Council or
Wooten reminded Councilor Ball that the loan funds were in a revolving fund and
therefore had nothing to do with fire station funding. In response to a question
from Councilor Lindberg, Ms. Decker assured the council that staff would not
proceed with the Ankeny House loan without adequate security. Mr. Gleason said
that a report will be given to the council on the nature of the security.

Councilor Obie moved, seconded by Councilor Smith, to adopt the
resolutions. Roll call vote. The motion carried 7:1, with
Councilor Ball voting no.
II. ORDINANCES FOR SECOND READING
A. Findings of Fact
Councilor Obie moved, seconded by Councilor Smith, to adopt the
Findings of Fact prepared by staff and outlined in the memo of
July 19, 1983. Roll call vote. The motion carried unanimously.
B. Levying Assessments
CB 2663--An ordinance levying assessments for paving and storm
sewer on Sam R Street from 11th Avenue to 12th Avenue;
and on 12th Avenue from Sam R Street to Wallis Street;
and on Wallis Street from 12th Avenue to 900 feet
south (83-15).

Councilor Obie moved, seconded by Councilor Smith, that the bill
e be approved and given final passage. Roll call vote. All coun-
cilors present voting aye, the bill was declared passed and
numbered 19167
CB 2664--An ordinance levying assessments for paving, sanitary
sewer and storm sewer in Glenwood Boulevard from Glenwood
Drive to 1,100 feet south, and in Moon Mountain Drive
from Glenwood Boulevard to Laurel Hill Drive; and
sanitary sewer to serve Tax Lots 18-03-03-02-01100,
01200, 01300, and 01302 (83-16).
Councilor Obie moved, seconded by Councilor Smith, to postpone
second reading until August 8, 1983. Roll call vote. The moti on
carried unanimously.
III. AMENDMENT TO RIVER ROAD-SANTA CLARA URBAN FACILITIES PLAN, JOINT
RESOLUTION 3773
Mr. Gleason introduced Tom Hayes, Planning Department, who explained that the
River Road-Santa Clara Urban Facilities Plan Policy Committee, of which Councilors
Holmer and Ball were members, had decided that it would like to add a sixth
voting member, from the fifteen-member Citizen Advisory Team. He noted that the
City of Springfield had passed a similar resolution.
e Res. 3795--A resolution concerning the River Road-Santa Clara Urban
Facilities Plan Policy Committee increasing the size
of that committee from five to six voting members.
Councilor Holmer moved, seconded by Councilor Ball, to adopt the
resolution.
Councilor Ball remarked that the participation of area residents was essential.
Roll call vote. The motion carried unanimously.
IV. APPOINTMENTS: MAYOR'S NOMINATIONS TO THE FINANCIAL PLANNING COMMITTEE
Councilor Obie moved, seconded by Councilor Holmer, to approve the
Mayor's nomination to reappoint Councilors Cynthia Wooten and
Betty Smith to the Financial Planning Committee for terms to
expire July 1, 1985.
Councilor Hansen, noting that this was an important committee, said that the
council should receive regular reports. Councilor Schue remarked that there
were staff reports available and that all councilors were welcome to attend the
meetings.
