Regular meeting of the City Council of the City of Eugene, Oregon, was called to
order by Councilor Betty Smith in the absence of His Honor Mayor Gus Keller.
I. ANNOUNCEMENTS
City Manager Micheal Gleason informed the council and the public of the following
meetings:
A. The City Budget Committee meeting scheduled for September 13, 1983,
has been cancelled.
B. In lieu of the regular Wednesday meeting of the City Council, the
Annual Focus on Economic Diversification Luncheon will be held at
noon on September 14, 1983, in the Williams Room at the Conference
e Center.
C. The City Council will host a joint meeting with the 4-J School
District at 7:00 p.m. on September 14, 1983, in Studio A, at the
Conference Center.
Councilor Ball stated that the by-laws set down requirements for attendance at
the meetings of the City Council and the Budget Committee. He said that he does
not wish to proceed in this manner with councilors continuing to be absent at
scheduled meetings. He requested that some determination be made as to who is
causing the problem and to seek some remedy. Mr. Gleason responded that unfor-
tunately the meetings coincided with the vacations of some of the councilors.
II. PUBLIC HEARINGS
A. Vagrancy Task Force Final Recommendations (summary memo, final report
distributed)
Mr. Gleason introduced Chris Hotmann who presented the staff report. She said
that the council had authorized the Vagrancy Task Force in December 1982 to
look at the issue of vagrancy in Eugene and the problems of homeless people.
She said the task force presented recommendations for policy to the City Council
in June 1983, which the council approved. Ms. Hotmann said the task force then
worked on implementation strategies with social service and City agencies. ~e
said the final report reflects the work of the previous several months, and
includes recommendations and strategies to help alleviate the problems of
- vagrancy and homeless families in the future.

Public hearing was opened.
e Jill Heimans 1628 East 19th Avenues Eugene, said that she is a board member of
the Lane County ACLU. She said that the final report is thorough and sensitive
to the needs of the community. Ms. Heiman asked the City Council to support the
expansion of shelter facilties and the funding of the alchohol treatment
programs as well to support the alcohol detoxification program through Jobs Bill
funding. She asked that the City Council recommend increased shelter facilities
for the homelesss urging the council to investigate the homesteading program as
an alternatives as well as supporting the establishment of public and private
camping facilties. In regard to the ACLU's concern about drinking in public
placess Ms. Heiman said she supports the recommendation by the task force to
have proper notice of the ordinance posted and similar posting of the anti-camping
ordinance. Referring to the task force's June reports she said the ACLU is
concerned with the City's apparent policy of arresting transients rather than
issuing a citation. She said the City should have equal treatment of transients
and residents and requested that the City abandon making arrests if Citations
in Lieu of Custody could be issued. Ms. Heiman commended the task force on its
work and recommended that the City Council adopt the report.
Richard Guskes 278 North Grands Eugenes said that he agreed with the previous
testlmony. He said he is speaking with the concerns of a resident on the
problems involved with vagrancy in Eugene. Mr. Guske said that he seconds the
recommendation that CDBG funds be used to support the Buckley House alcohol
detoxification program.

Councilor Lindbergs responding to the statements of Ms. Heimans stated that
IIselective enforcementll was a poor choice of \\Ords. He expl ai ned that the
intent is to deal with predatorss the approximately 15 percent of the transient
population that causes the majority of the problems. He added that it is the
intent of the CLC policy to arrest those transients who are committing the
serious crimes. Mr. Lindberg said that the City of Eugene has undergone an
education through the Vagrancy Task Fon:e. He said that the residents of Eugene
had been split into two opposing factionss each having an inaccurate idea of the
purpose of the task force. He explained that the task force attempted to look
at all the people in Eugene as one communitys lOOking at those with serious
needs, as well as trying to minimize the effects of the homeless on the resi-
dents of Eugene, thereby mi nimi zi ng confl ict. Mr. Lindberg thanked the City
Council for its support and encouragement and thanked the task force and those
others involved for their work.
Councilor Wooten thanked the members of the task force and Mr. Lindberg for
the i r wo rk . She stated that she hopes it is not the intent of the City
Council, by its adoption of the report, to direct the reprogramming of the
Jobs Bill Community Development Block Grant funds for alcohol detoxification.
She said she would rather the City Council wait to see what processes are
developed by the Community Development Committee for those funds.
Councilor Hansen asked, as a matter of procedure, if the council is adopting or
accepting the report. He said that the report ;s a great effort, but he is not
e sure if the council is ready to accept the guidelines of the report without
further study. Mr. Lindberg explained that the attached summary is divided

into three sections. He said one section includes those items already accomp-
e lished and the second section is an attempt by the task force to move the
efforts of dealing with homeless people from the task force itself to other
agencies and departments. The third section outlines the action requested of
the council. Mr. Lindberg said he hopes the recommendations will be adopted as
a policy with the understanding that the implementation is a transitional
process that the task force hopes to have refined by others. Ms. Smith said
that she understands the recommendation as stated in the report summary is to
have the City Council approve the report and direct the City Manager and advisory
groups to pursue the recommendations. She added that the council will not be
locked into any of the recommendations, but that it is giving direction to staff
to pursue the recommendations.
Ms. Wooten moved, seconded by Mr. Hansen, that the City Council
accept the Vagrancy Task Force fi nal recommendati ons wi th di rec-
tion to the Ci ty Manager and the staff to pursue impl ementation
strategies in the future. The motion passed unanimously, 5:0.
Ms. Wooten stated that she would appreciate the staff maintaining contact with
the ACLU as the strategies are pursued so as not to preempt or to act inappro-
pri ately. Ms. Smith thanked the members of the task force on behalf of the
mayo r. Mr. Lindberg stated that he also wished to thank the members of the
subcommittees and other contributors for their work.
B. Rezoning Requests
e 1. Property Located on the Northeast Corner of Greenacres Road and
Del ta Hi ghway from C-1/PD Neighborhood Commerci al Di strict wi th
Planned Unit Development procedures and R-2/20/PD Limited Multiple-
Family Residential District with 20 units per acre density with
Planned Unit Development procedures, to C-2/SR Community Commercial
District with Site Review procedures; and a Sign District Boundary
Change for Tax Lot 1300 from Residential to Integrated Shopping

Mr. Gleason introduced the item and Mr. Jacobson, Planning, presented the staff
report. He said the rezoning request concerns approximately 12 acres of vacant
property located at the northeast corner of Greenacres Road and Delta Highway.
He said the surrounding property includes the Eugene Sand and Gravel operation
to the west across Delta Highway, the Delta Pines Mobile Home Subdivision to the
north, vacant property zoned R-2/PD to the east, and the Delta Oaks Shopping
Center developed with Jafco and GI Joe's. Mr. Jacobson said the Planning
Commission unanimously recommended approval on July 19, 1983, with a site review
suffix to address noi se reducti on from the sand and gravel operation and to
address the issue of access points from Delta Highway and Greenacres Road. He
said that Ms. Mulder of the Planning Commission was available to answer any
questions.

Jim Saul, 44 Club Road, Eugene, stated that he is representing the owners of
the property. He said that his comments will be brief since the council has
e already been presented with extensive material and the recommendation of the
Planning Commission. He indicated that the present action presents an unusual
opportunity to both fulfill the objectives of the General Plan, with respect to
commercial allocations in this area, and to resolve the noise problems on the
residential property involved in this request. He stated that he would answer
any of the council.s questions.

CB 2676--An ordinance authorizing rezoning from C-l/PD Neighborhood
Commercial District with Planned Unit Development proce-
dures and R-2/20/PD Limited Multiple-Family Residential
District with 20 units per acre density with Planned Unit

District with Site Review procedures; and a Sign District
Boundary Change for Tax Lot 1300 from Residential to

Ms. Wooten moved, seconded by Mr. Lindberg, that findings support-
ing the rezoning as set forth in Planning Commission staff notes
and minutes of July 19, 1983, be adopted by reference thereto;
that the bill be read the second time by council bill number only,
with unanimous consent of the council; and that enactment be
considered at this time. Roll call vote; motion passed unanimously,
5:0.

2. Property Located at the Southwest Corner of 7th Place and Garfield
Street from 1-2 Light-Medium Industrial District to C-2 Community
Commercial District (Amino, Inc.) (Z 83-7) (map, background

Mr. Gleason introduced the agenda item. Mr. Jacobson, Planning, presented the
staff report, stating that the property presently contains a vacant structure
used previously for commercial purposes. Mr. Jacobson said the surrounding
property consists of 1-2 Light-Medium Industrial District property containing
the American Steel Building to the south, the 7th Avenue right-of-way to the
north, the Lane Transit District garages to the east, and the AAMCO Transmission
shop to the northeast. Mr. Jacobson said the Planning Commission voted unani-
mously on July 19, 1983, to recommend that the City Council rezone the subject
property containing approximately 11,700 square feet.

notes and minutes of July 19, 1983, be adopted by reference
thereto; that the bill be read the second time by council bill
number only, with unanimous consent of the council; and that
enactment be considered at this time. Roll call vote; the motion
passed unanimously, 5:0.

3. Property Located at the Northwest Corner of 4th Avenue and
Jefferson Street from 1-2 Light-Medium Industrial District
to R-3 Multiple-Family Residential District (John and Bess
Brandt) (Z 83-8) (map, background information distributed)
e Mr. Gleason introduced the agenda item. Mr. Croteau, Planning, presented the
staff report, stating that the request for rezoning from 1-2 Light-Medium
Industrial District to R-3 Multiple-Family Residential District is for property
located on the northwest corner of 4th Avenue and Jefferson Street. He stated
the property contains a vacant building which was previously used for commercial
purposes. Mr. Croteau said that the letter distributed to the council was
received that day from Ronald Burke. He explained that the letter is requesting
a postponement of the agenda item until the council meeting on October 24, 1983.
He said that the request is apparently based on a change in plans for the
future use of the building. Mr. Croteau said that staff would support a post-
ponement to the date specified so that renotification of the applicants would
not be necessary.
Ms. Wooten moved, seconded by Mr. Lindberg, that item I,B,3 be
postponed until October 24, 1983. The motion passed unanimously,
5:0.
4. Property Located on the South Side of 7th Avenue, East of Garfield
Street from 1-2 Light-Medium Industrial District to C-2 Community
Commercial District (Peter Murphy) (Z 83-9) (map, background

Mr. Gleason introduced the agenda item. Mr. Croteau presented the staff report,
stating that the rezoning request is for property of approximately .7 acres
e containing a vacant office building previously used to house a governmental

agency. He said the surrounding property consists of the 1-2 zoned Lane Transit
e District bus operations to the south, a paint store and a variety of commercial
and industrial uses zoned 1-2 to the east, and a mixture of 1-2 and C-2 zoned
properties to the west and north. Mr. Croteau mentioned that the property
located to the west on the corner of 7th Avenue and Garfield is the property
just rezoned to C-2 Community Commercial District in item I,B,2. He sta ted the
Planning Commercial voted 3:1 on July 19, 1983, to recommend approval of the
request.
Ms. Wooten raised the question of the possible increase in traffic on West 8th
Avenue as a result of the change in use of the building on the property as
discussed by Mr. Bauske, the staff, and the applicant. She asked if any data
had been presented which could make a distinction between the traffic generated
from the prior use and that proposed by the zone change. Mr. Croteau said the
original zone change submitted to the Planning Commission was for a change of
the entire two parcels of land that run and front onto 8th Avenue. He sa i d
that the application was revised (after staff discussion and a concern over
traffic generation) so that the zone change did not extend to 8th Avenue. He
said the office building which extends from 7th Avenue almost to 8th Avenue has
its main access and parking lot on 7th Avenue; therefore, the commercial develop-
ment of the property will be oriented more to 7th Avenue. Mr. Croteau said he
does not want to discount Mr. Bauske's comments since he was apparently concerned
about commercial encroachment on 8th Avenue and eventual traffi c increase. He
said that Ms. Mulder was present to answer any questions.
Ms. Wooten asked if any thought had been given by the Planning Commission to the
e amount of traffic which wi11 be generated in relation to the Chambers Connector
and the traffic patterns of vehicles exiting from that section of the thoroughfare.
Mr. Croteau said that he does not believe there was any specific discussion on
the connector and the impact of the traffic generated on that area. He sa i d
that the area has been developed wi th a mixture of commercial and industri al
uses. He said that a change from predaninantly industrial zoning to commercial
was started two years ago due to the newly formed 1-2 zoning district which did
away with many of the commercial uses in the industrial district. He added that
the strip commercial on 6th and 7th Avenue has occurred over the past 20 years
under industrial zoning. Mr. Croteau said that the area will be undergoing a
change in the zoning rather than any actual change in the uses of the properties.

George Mayer, 1065 High Street, Eugene, said that the Jefferson/Far West Refine-
ment Plan included the subject area as a C-2 area. He said that it also falls
within the guidelines of the Metropolitan General Plan. He said the first pl an
mentioned goes further south according to the map. Mr. Mayer said the building
on the property has 16,600 square feet with a 7-foot, 6-inch ceiling. He said
that it would be difficult to use the building for industry or manufacturing.
He said it is the intent of the owner to upgrade another building to keep it
from becomi ng 1 i ke the fl eet of empty office bui 1 dings found in the downtown
area. Mr. Mayer said the building was used by the State Welfare agency, so the

traffic generated by any new use of the building would not be significantly
e more, if any. He said there is no idea what type of business will use the
building, stating that a gymnastics operation and a printing plant have expressed
interest in the property. He referred to the letter submitted to the council,
stating that he could add nothing to the statements presented in the letter, and
expressed his willingness to answer any questions of the council.

thereto; that the bill be read the second time by council bill
number only, with unanimous consent of the council; and that
enactment be considered at this time. Roll call vote; the motion

5. Property Located on the North Side of West 11th Avenue, extending
from McKinley Street west past Conger Street from 1-2 Light-
Medium Industrial District to C-2 Community Commercial District
(JB2 Properties) (Z 83-12) (map attached; background infonnation

Mr. Gleason introduced the agenda item. Ms. Jones, Planning, presented the
staff report. She said that the application for rezoning involves 11 tax lots
under four ownerships, adding that all of the parcels are presently developed
with four restaurants, a paint store, small offices, an automobile repair shop,
and a sign shop. She explained that the parcels were developed at a time when
the 1-2 zoning allowed more commercial uses. She said the property is bordered
on the north by 1-3 Heavy Industrial property and on the south of West 11th
Avenue by a mixture of commercial and industrial uses. Ms. Jones said that the
council will later be hearing an appeal of a zoning request for property owned
by R. A. Chambers and located to the west of the subject property. She sai d
that the Planning Commission voted unanimously on August 2, 1983, to recommend
approval of the zone change.

e Jim Saul, 44 Club Road, Eugene, said he is representing the owners of the
property. He stated that since the council had the recommendation of the
Planning Commission and the written materials he would simply respond to any
questions from the members of the council. He said that the property owners had
hoped for an emergency clause on the rezoning because one of the leasors of the
property on the corner of 11th Avenue and Conger Street had ~ready entered into
certain binding arrangements for the redevelopment of that property. He sa i d
that this person has been waiting since the application was filed in June in
order to proceed with the redevelopment and the delay has created some personal
hardship. He said that without the six councilors necessary, the council could
not take action on the emergency clause, but he did encourage the council to
approve the rezoning as submitted and recommended by the Planning Commission.
There being no further testimony, the public hearing was closed.
Mr. Lindberg asked if it would be procedurally better to delay one week and then
have a vote which would include the emergency clause. Mr. Saul responded tha t
it would be helpful, but since it cannot be predicted if six councilors will be
present, he felt that it would be better to have the council vote on the item at
thi s time.
Mr. Gleason suggested that the council approve the item at this meeting and then
the council could vote on the emergency clause at the next meeting. He st res sed
that the councilors present would also have to be present at the next meeting
along with one councilor who had studied the material and had listened to
the tapes of the discussion so that the council would be ready to vote on the
e emergency clause.
Mr. Hansen asked if Mr. Saul would be willing to wait another week. Ms. Smi th
restated the suggestion that the council could vote on the rezoning tonight
and then consider the emergency clause at the meeting on September 21, 1983.
Mr. Hansen again stressed his concern on having all five of the councilors
present at the next meeting. Mr. Gleason clarified that six councilors who are
well-advised on the rezoning application must be in attendance to vote on the
request.

Mr. Gleason stated that the item will be added to the agenda of the
September 21, 1983, council meeting for consideration of the emergency
clause amendment.
C. Appeal of Planning Commission's Denial of Rezoning Request for Property
Located on the North Side of West 11th Avenue, extending from Seneca
Street East Past Tyinn Street from 1-2 Light-Medium Industrial District
to C-2 Community Commercial District (R. A. Chambers and Associates)

Mr. Gleason introduced the a~enda item. Ms. Jones, Planning, presented the
staff report, stating that t is issue is an appeal of a Planning Commission
decision. She said that the property is very close to the property just con-
sidered by the council. Ms. Jones said the property of approximately five acres
is vacant except for a gasoline service station on the northeast corner of 11th
Avenue and Seneca Street. She said the property to the north of the subject
property is zoned 1-3 Heavy Industrial and is vacant except for the area along
Seneca Street which is developed by the Monsanto Chemical Company. She stated
that the south side of West 11th Avenue is zoned 1-2 Light-Medium Industrial and
contains a mixture of commercial and industrial uses. She said that the Planning
Commission voted 2:2 on August 2, 1983, to approve the request, but a tie vote
is considered a denial; therefore, the applicant appealed the decision. Ms.
Jones said that some of the concerns expressed by the Planning Comnission are
e the loss of industrial lands to commercial uses in the West Eugene area and
limiting the expanse of strip commercial property along West 11th Avenue to uses
that are already developed. Ms. Jones said that Ms. Mulder was present to
discuss any Planning Commission decisions.

Jim Saul, 44 Club Road, Eugene, said he was representing the owner of the
property and R. A. Chambers, who has a long-term land lease on the property. He
said that this is a difficult issue to bring to the council since it involves a
split vote by the Planning Commission and, therefore, contains no actual decision.
He said the best that can be done is to glean the basis of the vote from the
record and then ask the council to make a judgment based on the issues involved.
He said that in reviewing the draft of the minutes of the Planning Commission,
he felt the recitation of the discussion to be limited. He said that, according
to his personal notes on the discussion, there were four issues raised. Of the
first, he said the commissioners were split on whether the request conformed
with the Metropolitan Plan; he therefore asked the council to consider the
following: a) the four vacant parcels of land involved in the request were
included in the allocation of property designated in the Metropolitan Plan for
commercial use; b) the rezoning would be consistent with the planned text and
policies; and c) in a series of prior actions, the City has consistently recog-
e nized the appropriateness of commercial zoning on the north side of 11th
Avenue and east of Seneca Street.

He said that with these considerations in mind, the request is consistent with
the Metropolitan Plan and fulfills the allocatlon of that plan. Of the second
e issue, that of retaining industrial land, Mr. Saul said that the plan expresses
the need to provide both commercial and industrial properties and does not
give priority to one or the other. He said the third issue discussed was
whether only the rezoning of developed property should be considered. He
said that the only pertinent policy in the Metropolitan Plan sfeaks to the need
to increase the supply of undeveloped commercial and industria properties;
therefore, there is no basis on which to assert that vacant property should not
be rezoned to a commercial designation based on whether the property is currently
in commercial use or vacant. Mr. Saul said the fourth issue addressed the
question of whether the property was designated on the plan diagram as being
suitable for commercial. He said that the commercial designation on the east
side of Seneca Street extends some distance east of that street on the north
side of 11th Avenue and that the definition of the plan diagrOOl indicates lIit is
the graphic depiction of the allocation of projected land use needs.1I Mr. Saul
said that this property is clearly allocated for commercial use as based on the
Metropolitan Plan, background papers, and visual observation. He sa i d tha t he
believes this to be an appropriate zone change and the owner and the developer
have consented to site review procedures in order to achieve the design objective
of the plan. Mr. Saul urged the council to approve the request and said that he
would be willing to answer any questions of the council.

Ms. Wooten asked Ms. Mulder to clarify the split vote of the Planning Commission.
Ms. Mulder stated that it is difficult to represent the split vote. She sai d
e the dilemma of the Planning Commission was in weighing what to give emphasis to
in the various goals of the Metropolitan Plan. She sai d her personal emphasi s
was to listen to limiting strip commercial use, stating that this issue goes
back to when the definition of 1-2 zoning was changed. She said that many of
the rezonings have been cleaning up the problems that were caused by limiting
commercial uses. Ms. Mulder said the other two commissioners looked at the

Mr. Lindberg asked staff for some explanation of their recommendation for
approval of the request. Ms. Jones said that the lines are not clearly delin-
eated between commercial and industrial usage in the area. She said that staff
had determined that commercial usage should stop at West 11th Avenue and Seneca
Street, where the Fred Meyer store is presently located. He said that one must
look at either no development at the shopping center or a strip along the
frontage along We st 11th Avenue. Mr. Croteau added that in previous cases the
council considered the extent of commercial development to the west of the Fred
Meyer development; however, this request deals with a zone change to the east.
He said these previous cases never discussed the property to the east of the
Fred Meyer property.
Mr. Saul said that there two items on which he wished to comment. In regard to
strip commercial usage, he said the view is that the Metropolitan Plan enunciates
it to be an 00 sol ute evi 1 to be avoided it at all costs. Mr. Saul says that the
plan, while not encouraging the use, recognizes areas that are characterized by

e this use and identifies the West 11th Avenue area as being such an area. He
said that the site review mechanism is present to ensure compliance with the
design pl an objectives and that the review has been accepted by the appl icants.
Secondly, he said that this property is distinguishable from the general run of
strip commercial development in that most strip commercial areas were not
allocated for commercial use. He said that the properties in questi on have been
definitively allocated for commercial use and to change the meaning of the plan
would be to undermine the basic planning process that went on. Mr. Sa u 1 sa i d
that, while the Metropolitan Plan does contain some emphasis on the importance
of industrial land, it also includes within the same sentences or paragraphs
the importance of commercial properties. He said that the councilors must be
aware that the current inventory of property within the city limits with available
services and zoned for industrial use overshadows any inventory of commercially
designated property.
Mr. Lindberg moved, seconded by Mr. Hansen, to approve the appeal.
The motion passed 4:1; Councilors Ball, Hansen, Lindberg, and Smith
voting aye; Councilor Wooten voting nay.
Mr. Gleason said that policy requires the council to set a joint meeting with
the Planning Commission when it takes an action in conflict to the commission.
Mr. Gleason said that a date for the meeting would be set.
II I. RESOLUTION CONCERNING THE LANE COUNTY LIBRARY LEVY (memo, resol ution
attached)
e Mr. Gleason introduced the agenda item. He said that Ms. Wooten would be
addressing the issue and that Mr. Meeks, Library, was present to answer any
questions from the council.
Ms. Wooten said that she is concerned with the library levy that will be before
the Lane County, Eugene, and Springfield voters on September 20, 1983. She sai d
that she feels it would be appropriate for the council to adopt a resolution
addressing the seriousness of the matter and the implication of the services for
the City of Eugene and the services for Lane County residents. Ms. Woo ten the n
read the resolution which urges all citizens of the City of Eugene to vote in
support of the levy. She said the Friends of the Library and the Library Board
have passed similar resolutions. She said that the passage of the levy would
maintain, and possibly improve, the Bookmobile program, as well as increase
library hours and restore some of the positions cut by the Eugene Budget Committee
during the last fiscal year.

Ms. Wooten moved, seconded by Mr. Lindberg, to adopt the resolution.
Roll call vote; the motion passed unanimously, 5:0.
Ms. Wooten asked that Ms. Bellamy make the resolution available to those members
of the media who were not in attendance at the meeting.
