HomeMy WebLinkAbout11/09/1983 Meeting e M I NUT E S Eugene City Council City Council Chamber November 9, 1983 11: 45 a.m. COUNCILORS PRESENT: Emily Schue, Brian Obie, John Ball, Dick Hansen, Freeman Holmer, Mark Lindberg, Betty Smith, and Cynthia Wooten. Adjourned meeting of the City Council of the City of Eugene, Oregon, was called to order by His Honor Mayor Gus Keller. 1. ITEMS FROM MAYOR & COUNCIL, APPOINTMENTS, ANNOUNCEMENTS, AND AGENDA ADJUSTMENTS A. All-American Cities Competition Councilor Schue said she would be leaving on November 12 for Baltimore with Cathy Briner and Don Mason to attend the All-American Cities Competition. She said that a run-through of the presentation would be held in the McNutt Room at 3:30 p.m. on November 10. She said that comments and suggestions would be apprec i ated. Mayor Keller thanked Ms. Schue for representing the City at the e competi tion. The other councilors expressed their appreciation to Ms. Schue and their wishes for a successful presentation. B. Adjustment to Agenda Mayor Keller requested that item III on the agenda, the Olympic Scientific Congress, be held over to November 16. He explained that more information was needed on the item before presenting the entire package to the council. Since no Objections were voiced by the Council, the item was rescheduled to November 16. C. Advisory Committee for the Business Development Fund Mayor Keller asked for additional names of those to be considered for the Advisory Committee. He said that Ms. Wooten was the only councilor who had given him some names. In response to a question, Ms. Wooten reviewed the goals and the proposed composition of the adVisory committee. She said it had been recommended that the committee review the loan packages submitted for financing through the Business Development fund. Mayor Keller requested staff to distribute information on the membership requirements to the councilors. He said that it was necessary to have the committee members selected next week. D. Presentation by Girl Scouts Two Girl Scouts from Troop 396, representing the Western Rivers Girl Scout Council, expressed their enjoyment of the Eugene Celebration and their desire to e enter a float in next year's Celebration. They also stated that their troop was willing to perform community service activities for any group or individual who MINUTES--Eugene City Council November 9, 1983 Page 1 required assistance. They presented Mayor Keller with a 1984 Girl Scouts e calendar and pocket planner. Mayor Keller thanked the scouts for the calendar and Councilor Schue thanked them for their participation in the celebration. E. WUN Parking Pricing Program City Manager Micheal Gleason said'that this item had been rescheduled for the November 16, 1983, council meeting. F. League of Oregon Cities Conference City Manager Micheal Gleason announced that any councilors needing a ride to the conference on November 13, 1983, should contact Pat Lynch. G. Council Meeting Attendance Councilor Wooten announced that she would be in Portland on November 16, 1983, and therefore would not be able to attend the council meeting on that date. II. ROUTINE ITEMS FOR COUNCIL APPROVAL A. Consideration of City Council minutes of September 21, 1983, and Joint City Council/Planning Commission minutes of October 19, 1983, and Legislative Subcommittee minutes of November 2, 1983 (minutes distributed) e Ms. Schue moved, seconded by Mr. Obie, to approve the City Council minutes of September 21 and October 19, and the Legislative Subcommittee minutes of November 2, 1983. Roll call vote; the motion carried unanimously, 8:0. B. Finance Resolutions (memo and exhibits distributed) City Manager Micheal Gleason introduced the agenda item. Finance Director Warren Wong presented the staff report, stating that the two resolutions were the first step to close out last year's financial records. He said the Appro- priation Act passed for FY84 had included a Reserve for Encumbrances to carry forward outstanding purchase orders on June 30, 1983, into the present fiscal year. He said the purchase orders were for goods and services ordered last year but not received until this year. Res. No. 3809--A resolution authorizing the transfer of funds from the reserve for encumbrances to departments. Res. No. 3810--A resolution authorizing the transfer of the balance of the reserve for encumbrances to reserves, contin- gency, and balance available. Ms. Schue moved, seconded by Mr. Obie, to adopt the resolutions. Roll call vote; the motion carried unanimously, 8:0. e MINUTES--Eugene City Council November 9, 1983 Page 2 C. Call for Public Hearings for December 14, 1983, to Consider Withdrawals e from Water Districts (memo distributed) City Manager Micheal Gleason introduced the agenda item. He said the five resolutions calling for public hearings regarding withdrawals from water districts resulted from recent annexations. Res. No. 3811--A resolution calling for a public hearing for December 14, 1983, to consider withdrawal of property from the River Road Water District (Petitti A/I 83-1). Res. No. 3812--A resolution calling for a public hearing for December 14, 1983, to consider withdrawal of property from the Santa Clara Water District (City of Eugene/MWMC A/I 83-2). Res. No. 3813--A resolution calling for a public hearing for December 14, 1983, to consider withdrawal of property from the River Road Water District (City of Eugene/MWMC A/I 83-2). Res. No. 3814--A resolution calling for a public hearing for December 14, 1983, to consider withdrawal of property from the Santa Clara Water District (Hamilton, Hood et al. A/I 83-5). e Res. No. 3815--A resolution calling for a public hearing for December 14, 1983, to consider withdrawal of property from the Santa Clara Water District (Hutchinson, et al. A/I 83-6). Ms. Schue moved, seconded by Mr. Obie, to adopt the resolutions. Roll call vote; the motion carried unanimously, 8:0. D. Street Vacation for River's Edge PUD (Riverside Realty) (SV 80-2) (memo distributed) City Manager Micheal Gleason said the original hearing on the item was held two years ago. He said that four of the current councilors were not present at that hearing and staff had to ensure that the remaining four councilors were actually present at the hearing to ensure a quorum. He recommended that the item be removed from the agenda until staff could make that determination. In response to a question, City Attorney Tim Sercombe said the item would be held over to the next council meeting. He said that staff would present a transcript or record of the hearing to those councilors who had not been present so that the vacation could be considered next week. IV. REVISIONS TO BUSINESS LICENSE TABLE (memo, ordinance distributed) City Manager Micheal Gleason introduced the agenda item. He reviewed the e October 31, 1983, memorandum from the City Recorder which addressed this issue. MINUTES--Eugene City Council November 9, 1983 Page 3 Councilor Wooten said she was unaware that so many business license requirements e existed. She said an across-the-board business license program had been discussed at a recent Financial Planning Committee meeting. She asked if council had requested staff to study that proposal. Mayor Keller said Mr. Obie had volunteered to study the issue. Mr. Gleason said that most of the licenses in question had some regulatory effect and had been reviewed by the Coordinated Permit Counter Task Team. He said he had not interpreted the discussion as linking that request to these licenses involved in this revision. Councilor Obie said he would meet with the Finance staff who had made projections on past business licenses and would present that information and a proposal to the council. CB 2695--An ordinance concerning licensed businesses; amending Section 3.010 of the Eugene Code, 1971; and declaring an emergency. Ms. Schue moved, seconded by Mr. Obie, that the bill be read the second time by council bill number only, with unanimous consent of the Council, and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 8:0. Council Bill 2695 was read the second time by council bill number only. Ms. Schue moved, seconded by Mr. Obie, that the bill be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance No. 19196). e V. PARKS AND PUBLIC LAND POLICIES (memo, report distributed) City Manager Micheal Gleason introduced the agenda item. Parks and Recreation Director Ernie Drapela presented the staff report, stating that the council had identified this item at the 1982-83 City Council Goals Session. He thanked the council for the opportunity to review the issue and said that the review had many positive benefits. Mr. Drapela said that the City had two to three dozen major use facilities managed by the Parks and Recreation Department and that inquiries were received by various levels within the department. He said the continuity of the programs and the inquiries, along with potential attrition rates in the department, required that the department reexamine and consolidate many of its policies within one document. He said the document had been reviewed by the Joint Parks Committee (JPC). Roger Rutan, Chair of the Joint Parks Committee, said the document had been submitted to the JPC on September 21 and the committee decided at its October 19 meeting that the document accurately reflected the policies in place and that the policies and rules were fair and practical. He said the thrust of the committee's review was to determine if the rules reflected the community.s interest that park lands and facilities were available to the community on a reasonable basis. Mr. Rutan said the JPC felt the document reflected that objective on the part of the Parks Department. e MINUTES--Eugene City Council November 9, 1983 Page 4 e Ms. Schue moved that the City Council adopt the Parks and Public Land Policies as presented. Councilor Obie, clarifying the situation, said that this item was scheduled as an informational item only and therefore did not require a motion.
