AMENDMENT OF ADMINISTRATIVE RULE R-3.696 TO ADD AND
REMOVE REPORTABLE CHEMICALS PURSUANT TO SECTION 54 OF
THE EUGENE CHARTER, 2002.
The City Manager of the City of Eugene finds that:
A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt rules
for the administration and implementation of any provisions of that Code. Section 3.696 of that
Code specifically authorizes the City Manager, after obtaining advice from the Toxics Board, to
adopt an administrative rule that adds chemicals to, or removes chemicals from, the list of
substances required to be reported under Section 54 (Amendment IV) of the Eugene Charter of
2002 ("the Amendment"). Section 3.696 also authorizes the City Manager to establish reporting
and materials balancing thresholds for added chemicals, and to establish a date when the additional
chemicals shall be subject to the reporting and materials accounting requirements.
B. On December 20, 2000, I issued Administrative Order No. 52-00-04-F adopting
Hazardous Substances Reporting Requirements Administrative Rule R-3.696. That Rule added
chemicals to the list of substances required to be reported under the Amendment, established
reporting thresholds and material accounting thresholds for each chemical added, and changed
previously established reporting thresholds and material accounting thresholds for certain
chemicals already subject to the reporting requirements.
C. On October 28, 2013, I issued Administrative Order No. 52-13-01-F which
amended Administrative Rule R-3.696 to add reportable chemicals to the list of chemicals required
to be reported under the Amendment.
D. The Toxics Board has recommended adding chemicals to, and removing chemicals
from, the list of reportable chemicals so that the City's list would be consistent Federal and State
law; and in order to add characteristic chemicals that have been identified by reporting businesses.
E. I concur with the Toxics Board's recommended modifications of the reportable
chemicals. Therefore, on September 21, 2017, Administrative Order 52-17-04 was issued
proposing to amend Administrative Rule R-3.696 by adding chemicals to, and removing chemicals
from, the list of reportable chemicals.
F. Notice of the proposed amendment was given by making copies of the Notice
attached as Exhibit A to Administrative Order 52-17-04 available to the Mayor and City
Councilors, to any person who had requested such notice, and by publication of the Notice in the
Register Guard Newspaper on October 2, 3, 4, 5 and 6, 2017. The Notice provided that comments

or objections to the proposed amendments must be submitted within 15 days of the first date of
publication of the Notice. No comments were received within the time or in the manner described
in the Notice.
Based on the above findings, and the authority of Sections 2.019 and 3.696 of the Eugene
Code, 1971, I order that Administrative Rule R-3.696 is amended as follows:
1. Effective January 1, 2018, the chemicals set out below are added to the list of
substances required to be reported under Section 54 (Amendment IV) of the Eugene Charter of
2002.
