COUNCILORS ABSENT: Emily Schue, Freeman Holmer, Roger Rutan. The regular Eugene City Council meeting was called to order by His Honor Mayor Jeff Miller. I. PUBLIC FORUM Mayor Miller announced that the council had appointed John VanLandingham to meet with citizens to discuss concerns relating to the issue of homelessness in order to work toward developing a more effective way of addressing the e housing needs of children and their attending adults. Councilor Green introduced Willamette High School students representing Students United for Responsible Fun (SURF). Adam Bercol explained that the SURF Club opposes gangs and gang violence and provides youth with positive activities as alternatives to drug use. The club is open to all young people. Dan Bjerke described SURF as a fun experience that involves challenging outdoor activities. Joyce Owens, 2830 Emerald Street, spoke as the chair of the Lane County Chapter of the American Lung Association. She asked the council to consider adopting an ordinance to ban the sale of tobacco products from vending machines or restrict vending machines selling such products to locations where minors are prohibited. She also asked for consideration of an ordinance requiring that the sale of tobacco products be a licensed activity, with the license being revocable should a retailer be found guilty of selling to minors. Ms. Owens distributed sample ordinances to staff. Kirsten Frohnmayer, 2875 Baker Boulevard, identified herself as a volunteer for the Lung Association. She described a recent survey conducted by a group of young people that demonstrated the ease with which minors can purchase tobacco from convenience stores, vending machines, and grocery stores. Approval of City Council Minutes of April 25 and May 23, 1990, Lunch/Work Session B. Assessment Segregation Orders Segregation of Assessment for Property Located on the South Side of Willakenzie Road Between Coburg Road and Bogart Lane (Tax Lot 04100--Assessor's Map 17-03-21-2 4) (90-04) (90-05) Mr. Bennett moved, seconded by Ms. Ehrman, to approve the items on the City Council Consent Calendar. Roll call vote; the motion carried unanimously, 5:0. III. PUBLIC HEARING: PROPOSED WITHDRAWAL OF RECENTLY ANNEXED PROPERTIES FROM WATER AND PARK DISTRICTS City Manager Mike Gleason introduced the topic. Cathy Czerniak, Planning and Development Department staff, was available to answer questions. e Mayor Miller opened the public hearing. There being no requests to speak, the public hearing was closed. CB 4230--An ordinance providing for withdrawal of 26 acres of residential property and 16 acres of publicly owned property from the River Road Water District and the River Road Park and Recreation District (EC EU 90-6. River Road Church of Christ) (effective date of annexation: May 21, 1990) CB 4231--An ordinance providing for withdrawal of .26 acres of residential property from the River Road Water District and the River Road Park and Recreation District (EC EU 90-9, Tuski) (effective date of annexation: May 16, 1990) CB 4232--An ordinance providing for withdrawal of 2.5 acres of residential property from the Santa Clara Water district (EC EU 90-7, Henson) (effective date of annexation: May 21, 1990) CB 4233--An ordinance providing for withdrawal of .68 acres of commercial property from the Santa Clara Water District (EC EU 90-4, Klemp) (effective date of annexation: May 21, 1990) e MINUTES--Eugene City Council July 9, 1990 Page 2 e Mr. Bennett moved, seconded by Ms. Ehrman, that the bills, with unanimous consent of the council, be read the second time by council bill number only, and that enactment be considered at this time. Roll call vote, the motion carried unanimously, 5:0. Council bills 4230, 4231, 4232, and 4233 were read the second time by number only. Mr. Bennett moved, seconded by Ms. Ehrman, that the bills be approved and given final passage. Roll call vote; all councilors present voting aye, the bills were declared passed (and became Ordinance Nos. 19700, 19701, 19702, and 19703). IV. PUBLIC HEARING: ORDINANCE CONCERNING THE VACATION OF A PORTION OF THE EAST-WEST ALLEY KNOWN AS 12TH AVENUE BETWEEN WILLAMETTE AND OLIVE STREETS (EUGENE CLINIC) (AV 90-2) City Manager Mike Gleason introduced the topic. Jim Croteau, Planning and Development, reported that the proposed vacation of between five and seven feet of the western half of the east-west alley known as 12th Avenue is directly south and adjacent to the Eugene Clinic. The vacation would allow the clinic to add an elevator tower and covered entry. The clinic has submitted a revised parking plan and additional right-of-way dedication to continue to facilitate vehicular access in this area. e Ms. Bascom urged caution in order not to compromise the east-west bicycle corridor in the area. Mr. Croteau responded that the area to be vacated is part of the existing accessway, but continued ease of access for bicyclists and pedestrians has been considered carefully. He added that the slight jog in the bikeway's alignment proposed by the vacation request would in fact move bicyclists away from the side entrance to the clinic and would allow improved maneuverability. Mayor Miller opened the public hearing. Jim Saul, III West 7th Avenue, spoke on behalf of the applicant. He noted that the request is for vacation of the space immediately adjacent to the bUilding and the clinic is proposing dedication of an additional 27 feet as right-of-way in exchange. Mr. Saul assured councilors that no compromise of east-west bicycle movement would occur. By shifting the traveled area slightly to the south, bicycle crossover from the existing bicycle lane on 12th Avenue will be more direct. There being no further requests to speak, Mayor Miller closed the public hearing. CB 4234--An ordinance vacating between five and seven feet of the western half of the east-west alley known as 12th Avenue, for a distance of 177.96 feet. e MINUTES--Eugene City Council July 9, 1990 Page 3 e Mr. Bennett moved, seconded by Ms. Ehrman, that the bill, with unanimous consent of the council, be read the second time by council bill number only, and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 5:0. Council Bill 4234 was read the second time by number only. Mr. Bennett moved, seconded by Ms. Ehrman, that the bill be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance No. 19704). V. PUBLIC HEARING: ORDINANCE CONCERNING THE VACATION OF STREET AND ALLEY RIGHT-OF-WAY WITHIN THE AREA OF THE RIVER EDGE PUBLIC PLAZA City Manager Mike Gleason introduced the topic. Jim Croteau, Planning and Development Department, reported that the proposed street and alley right-of-way vacation is for the area of the River Edge Public Plaza located adjacent to the EWEB headquarters building and the Willamette River. The project completes a joint planning effort to provide a destination point and access to the river and bike trail. The proposed vacation would return the property to public uses such as bicycling, walking, and other plaza-related activities. EWEB has agreed to assume responsibility for maintenance of the plaza and liability within the plaza area will be shared by the City and e EWEB. Answering a question from Ms. Ehrman, Mr. Croteau said the small bollards would remain to prevent cars from entering the plaza area. Ms. Bascom asked EWEB representative Anthony Lum about the use of the plaza area by food vendors and other community organizations. Mr. Lum referred to EWEB's existing public plaza policy, a pushcart vendor policy, and a permit use policy and said that the area would be monitored to assure enjoyable, nonconflicting use of the facility. Ms. Bascom encouraged EWEB to work with PARCS to actively encourage the use of the area. Responding to Ms. Ehrman's inquiry about a smaller alley space described as parcel 2, Mr. Croteau said that area provides access to the delivery area at the rear of the north building (cafeteria) and its use will not be encouraged. Mayor Miller opened the public hearing. There being no requests to speak, the public hearing was closed. Mr. Gleason commented that the master plan agreement of which this project is a part, represents a positive effort at intergovernmental cooperation that benefits the community. e MINUTES--Eugene City Council July 9, 1990 Page 4 e CB 4235--An ordinance vacating street and alley right-of-way within the area of the River Edge Public Plaza located east of the Ferry Street Overpass and west of the Willamette River. Mr. Bennett moved, seconded by Ms. Ehrman, that the bill, with unanimous consent of the council, be read the second time by council bill number only, and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 5:0. Council Bill 4235 was read the second time by number only. Mr. Bennett moved, seconded by Ms. Ehrman, that the bill be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance No. 19705). VI. BALLOTING TO DETERMINE INTERVIEWEES FOR OPENING ON THE PLANNING COMMISSION Councilors cast ballots for individuals they wished to interview for the opening on the Planning Commission. Five applicants received two or three votes. e Ms. Ehrman moved, seconded by Ms. Bascom, to interview Donna Turring, Monte Marshall, Alan Zelenka, Stephens Harter, and Greg Evans for the opening on the Planning Commission. Roll call vote; the motion carried unanimously, 5:0. Interviews were scheduled for July 18 at 5:30 p.m. Ms. Ehrman informed the council that she would arrive late at the July 11 council meeting.
