COUNCILORS ABSENT: Randy MacDonald. The regular meeting of March 4, 1991, of the Eugene City Council was called to order by His Honor Mayor Jeff Miller. In light of the large number of items on the council's agenda, Mayor Miller asked those testifying at the public hearings to limit their comments to three minutes to ensure that everyone has the opportunity to speak. I. PUBLIC FORUM William J. Mason, 1803 West 34th Avenue, suggested that all written informa- tion that is presented to the public and council be marked with an issue date and be paginated to avoid confusion. II. CONSENT CALENDAR A. PUBLIC HEARING: HIGHWAY 99 NORTH ANNEXATION - City Manager Mike Gleason introduced the topic. Terry Smith, Deputy Public Works Director, gave the staff presentation. The council is considering MINUTES--Eugene City Council March 4, 1991 Page 4 e approval of agreements to regulate annexations and the prOV1Slon of urban services in the unincorporated portions of the Highway 99 North industrial area. He said that this agreement is intended to prevent the problems that would occur as a result of piecemeal annexations. Mr. Smith highlighted several important components of this agreement, includ- ing: e 1) A delay-of-effective-date provision which will allow the City to postpone the effectiveness of annexation for 10 years, while still requiring annexation prior to sewer installation; 2) a provision that upon annexation, property owners will pay a tax differential of 31 percent of the City's operating levy for nine years and would increase to 100 percent on the tenth year; 3) assures that the City that all Highway 99 North properties will be annexed by 2010; 4) requests that each property owner will be asked to sign an indi- vidual annexation agreement with the City when applying for a building permit; 5) calls for the development of a refinement plan for the Highway 99 North area; 6) delays, until annexation, the implementation of the paving and parking requirements in the City's parking lot code; and 7) clarifies a rule regarding the repair of septic tanks. Mr. Smith described how this proposal relates to the annexation agreement of River Road and Santa Clara. Whereas sewer hook-ups are mandated in the River Road/Santa Clara area, this agreement stipulates that both developed and undeveloped properties do have to annex to get sewer service. Both proposals include a tax-differential rate structure which although unequal, is equita- ble. However, in the Highway 99 North proposal the City will not be obligat- ed to provide additional services during the tax-differential period. Addressing questions which have been raised earlier, Mr. Smith said that this type of proposal could be applicable in other unincorporated portions of the urban growth boundary (UGB) area, but asked that staff have a few years to work with the proposal before extending its use elsewhere. Mr. Smith reminded the council that Ballot Measure 5 was passed since the council last dealt with this issue and said that the agreement will still be cash-neutral for the City. However, under this proposal the City would be assuming an obligation to complete a refinement plan in the Highway 99 North area, which has potential impacts on the General Fund. Property owners have indicated a willingness to increase their tax differential rate by approxi- mately half the cost of the refinement plan to recognize its impact on the General Fund; this would be approximately $250,0000 and would increase the tax differential by 2 percent. Responding to a question from Ms. Ehrman, Jan Childs, Planning and Develop- ment Department, said that if the council approves the plan, it is possible that the refinement planning process would begin early next fiscal year. - MINUTES--Eugene City Council March 4, 1991 Page 5 ~ Responding to questions from Mr. Boles, Mr. Smith said that 33 percent of the area in question is completely vacant, 22 percent is underdeveloped, and 8.2 percent is residential. Mr. Boles asked about the recognition status of the Industrial Corridor Com- munity Organization (ICCO). In response, Mr. Smith said that a proposal to provide limited recognition for the ICCO will come before the council in April . In response to a question from Ms. Bascom, Mr. Smith said that although the County has not yet adopted the Urbanizing Lands ordinance as a part of this agreement, staff is confident that this will still occur. Referring to page 2 of the Annexation and Urban Services Policy Agreement, Mr. Nicholson voiced concern that the County, by making some change in its policies, could nullify this agreement. Mr. Smith addressed this concern by saying that once a contractual obligation has been made between a property owner and the City, both parties are bound to uphold the terms of the agree- ment. e Mayor Miller opened the public hearing. John W. Peterson, mayor of Junction City, testified in favor of the agree- ment. The proposal is the result of a lot of hard work and negotiation and will ultimately enable property owners in the area the opportunity for order- ly annexation. He encouraged the council to approve the agreement. Louis Johnson, 345 Palomino Drive, testified as a property owner in the in- dustrial corridor area in favor of the agreement. He noted that as an indus- trial property owner, he does not need additional City services. While he is reluctant to annex to the City, he understands the need and supports this agreement as a mechanism for making annexation possible. Gail Overgard, Industrial Corridor, identified himself as chair of the ICCO and offered his support for the proposal. He commended Councilor Rutan and City staff for their efforts on the agreement, noting that the benefits of the proposal outweigh the costs. Doug McKay, Industrial Corridor, testified in support of the agreement. Similar to Mr. Johnson, he said that he also has no need for additional pub- lic services and said that the agreement represents a good compromise for all involved. Rodney Kempf, Industrial Corridor, speaking as a member of ICCO and as an industrial property owner, said that he is in support of the agreement, par- ticularly if it will make the sewer transitioning easier for property owners in that area. He urged the council to approve the agreement. Rick Re, Industrial Corridor, testified in support of the proposal. He thanked Councilor Rutan and Mr. Smith for their patience and persistence in e MINUTES--Eugene City Council March 4, 1991 Page 6 e developing a workable proposal and said that the process that was established during the deliberations has created the basis for a good relationship be- tween the City and property owners in the area. Jim Ramseyer, Industrial Corridor, urged the council to approve the agree- ment, which will provide a valuable planning tool for businesses and will encourage growth in the area. Dale Riddle, no address given, said that the proposal will benefit both par- ties involved and encouraged the council to support it. He noted that the agreement will hasten much-needed upgrades in an area that has been stagnant for some time. e Craig Koch, Industrial Corridor, spoke in favor of the agreement. He noted that he has no need for City services, but recognizes that the agreement will promote expansion and growth. Bud Brewer, Industrial Corridor, identified himself as a long-time resident of the Highway 99 North area and testified in favor of the agreement. He offered his appreciation to Councilor Rutan and City staff for their efforts and urged the council to approve the proposal. Mike Koza, 1900 Irving Road, testified on behalf of Georgia-Pacific Corpora- tion in favor of the proposal. He concurred with those who spoke before him about the tremendous staff effort that was involved in crafting the proposal and urged the council to approve it. There being no additional requests to speak, the public hearing was closed. Responding to a question from Mr. Boles regarding the provision of services at the time of annexation, Mr. Smith explained that when large areas annex to a city, it is often not pOSSible to deliver the full level of services at the time of annexation. Because property owners in the Industrial Corridor area {predominantly industrial development} have indicated that they do not need full service delivery as quickly as property owners in the River Road/Santa Clara area {predominantly residential}, this agreement is equitable. Mr. Boles asked whether the differential timetable is considered fair for resi- dential owners in the Industrial Corridor area. Mr. Smith responded that because property owners in that area are only paying for the services that will be delivered, this agreement is fair. Mr. Boles asked for rationale why the City-funded police patrol that was anticipated for the area prior to Ballot Measure 5 can no longer be provided. Mr. Smith responded that the City no longer has the capacity to fund the police patrol. In response to a question from Mr. Boles, Ms. Childs said that ICCO has sub- mitted an application for limited recognition, but the application has not yet been processed. - MINUTES--Eugene City Council March 4, 1991 Page 7 e Mr. Boles asked whether the proposed refinement plan discussions might result in changes to the urban growth boundary. In response, Ms. Childs said that it is possible, but not certain, that the refinement planning process would result in recommendations for changes to the urban growth boundary. Respond- ing to another question, Ms. Childs said that both the Metro Area Natural Resources Study and the Industrial Lands Replacement Study are evaluating the status of soils in that area; these studies should be available for public review in several weeks. Mr. Nicholson asked for clarification of wording on page 3 of the Annexation and Urban Services Policy agreement that "unless compelled by State or Feder- al law, the City may not impel connection of existing improvements." Mr. Smith explained that this language was intended to provide the City with the ability to compel a property owner to connect to a sewer system, if needed. It is stated explicitly in the agreement that all property owners in the area will be a party to this agreement and will annex by 2010. In response to a question from Mr. Nicholson regarding Systems Development Charges (SDCs), Mr. Smith said that each of the properties in the Highway 99 North area will pay SDCs for that portion of the infrastructure to which they connect. Sanitary sewer SDCs are collected when property owners connect to the sewer; transportation SDCs are collected following the effective date of annexation. e Mr. Nicholson commented that the proposal was crafted initially with the assumption that, under State law, Eugene would obtain a tax base increase equal to the assessed valuation of that property. Ballot Measure 5 has ren- dered that tax base increase no longer possible. Noting that this has a large financial impact on the agreement, he questioned whether it is still prudent to move forward at this time. Mr. Gleason acknowledged the impacts of Ballot Measure 5 on this proposal, but reminded the council of the EPA connection requirement that exists for the area. He also noted the General Plan designation of the Highway 99 North area as being located within the urban growth boundary. He stated that he is still recommending this agree- ment to the council as the most rational, equitable way to provide for annex- ation in the area. Mr. Nicholson expressed concern that at some point in the future, property owners might compel the City to provide additional services to the area with- out having already paid the necessary SDCs. Responding to a question from Mr. Green, Mr. Smith said that corresponding to City policy, the City would waive all annexation fees; such fees range from $900-$2000. In response to a question from Ms. Bascom, Mr. Smith explained that under the current law, a property owner is required to annex to the City before making minor septic system repairs, such as a broken septic tank lid or broken line. The City is seeking amendments to the rule to make a distinction between major and minor repairs. - MINUTES--Eugene City Council March 4, 1991 Page 8 e Mr. Boles asked whether annexation is required at the time of development. Mr. Smith explained that all new development will go through a delay-of- annexation. Sewering would be required at the time of development, and all remaining SDCs would be collected following the effective date of annexation, depending on development activity. He acknowledged that it is possible for development to occur prior to the effective date of annexation without paying SDC charges. This is justified on the grounds that the area already has an existing storm drainage and transportation system, and therefore has little need for additional services. Responding to further question, Mr. Smith said that the vacant and underutilized lands in the area would not put additional capacity demands on the City because these systems are operated by the Coun- ty. The County would be expected to meet additional service needs in the area. e In response to a question from Mr. Nicholson, Mr. Smith said all development in the Highway 99 North area would be regulated by the Urbanizing lands Ordi- nance, which was adopted directly from City Code. Mr. Rutan moved, seconded by Mr Boles, to direct the City Manager to execute the Highway 99 North policy and annexation agreements; and seek ordinance changes by lane County, rule changes by OEQ, and statutory changes by the legislature to implement these agreements. Mr. Rutan moved, seconded by Mr. Boles, to amend Section 4 of the Annexation and Urban Services Agreement to reflect a tax- differential rate that will cover approximately half the cost of a refinement plan. Responding to a question from Mr. Boles regarding the deferral of parking and paving requirements to the effective date of annexation, Mr. Smith explained that there are large costs associated with these requirements, which are largely aesthetic in nature. Mr. Boles voiced concern that property paving, which increases the capacity demand on the storm sewer, might occur prior to SDC collection. In response, Mr. Smith said that storm sewer SDCs would be collected at the point of sewer connection, which would not likely occur until annexation is effective. Roll call vote; the amendment carried unanimously, 7:0. Ms. Bascom extended her appreciation to Councilor Rutan, City staff, and all property owners involved in crafting this agreement. Mr. Nicholson said that while he supports the concept of phased-in annexa- tions, he is uncomfortable approving the agreement without further explora- tion of the fiscal impacts of the agreement and without some assurance that the City will be able to treat all residents with the equity. Mr. Nicholson moved, seconded by Mr. Boles, to table the ordi- nance until the April 8 City Council meeting. e MINUTES--Eugene City Council March 4, 1991 Page 9 e Responding to a question from Ms. Ehrman, City Attorney Bill Gary said that recognition of the ICCO as a neighborhood association is not necessary to make this ordinance legal, rather it is a policy question whether the City wishes to enter into this type of an agreement with an association that has not been officially recognized under the City's recognition policy. The motion to table the ordinance failed 2:5; with councilors Boles and Nicholson voting in favor, and councilors Rutan, Bascom, Ehrman, Robinette, and Green voting against. Mr. Boles said that he appreciates the hard work and effort of all parties involved in this agreement, but still has some concerns about the content and process by which this agreement was crafted. In particular, he voiced con- cern with the lack of opportunity the council has had to review and modify the ordinance and said that until he can be sure that this is a fair and equitable agreement, he cannot support the motion. Mr. Nicholson concurred with Mr. Boles and added that the community percep- tion about the equity of this agreement is very important. He is reluctantly voting against this agreement. Ms. Ehrman said that she supports the annexation agreement, particularly because it is equitable with respect to annexation agreements in other parts of the City. Mayor Miller concurred, noting that a resolution of this issue is in the public's interest. e Responding to question from Mr. Robinette, Mr. Gary said that the City Attor- ney's Office has reviewed these documents. It is his opinion that staff has represented them accurately. Mr. Green said he will support the motion, but shares concerns regarding the timing of the agreement. The mediation process that was used to create this agreement should not be used again in the future. Roll call vote; the motion carried 5:2; with councilors Rutan, Bascom, Green, Robinette, and Ehrman voting in favor, and councilors Boles and Nicholson voting opposed. PUBLIC HEARING: REVISION TO CHAPTER 8 OF THE CITY CODE Deputy Chief Dick Christensen, Department of Public Safety, gave the staff presentation. Department of Public Safety staff has completed proposed revi- sions to the City of Eugene Fire Prevention Code. The proposed revisions include adoption of the 1989 State of Oregon Uniform Fire Code and amendments - MINUTES--Eugene City Council March 4, 1991 Page 10 e to address local needs. The proposed changes have been reviewed with Build- ing and Permit Services staff and the Building Codes Advisory Committee, who have expressed an interest in enhanced communication regarding Code updates. Deputy Chief Christensen said that at the council work session on February 25, 1991, Councilor MacDonald raised a concern about the confusing language in regard to fireworks. In response to this concern, staff is proposing to amend the ordinance by deleting the word "allowed" on page 28, Section 78.102 (b), and on page 30, Section 78.107. The rest of the ordinance remains as proposed for adoption. An emergency clause is needed with this ordinance. Mayor Miller opened the public hearing. Roll call vote; the motion carried unanimously, 6:0. e Responding to a question from Mr. Boles, Mr. Lyle said that Hearings Official recommended several minor changes with respect to the distribution of costs in the ordinance; these changes have been reflected in the ordinance. With respect to Item C on the City Council Consent Calendar, Ms. Bascom noted that the plan does not call for striped bike lanes on sections of Bailey Lane and Bogart Lane. She commented that this area has high ridership potential, particularly by students of Monroe Junior High school, and requested that this issue be revisited. Mr. Lyle said that the Bike Master Plan reflects this area as an on-street facility without striped bike lanes. He said that he would review the possible addition of bicycle lanes during the design of the improvement project. Council Bill 4289 was read the second time by number only. ORDINANCE: TREE COMMISSION AMENDMENTS; APPROVAL OF BYLAWS City Manager Mike Gleason introduced the topic. Bob Hammitt, Public Works, gave the staff presentation. The action being considered is an amendment to the ordinance so that the Tree Commission is adVisory to the City Manager or designee instead of the "executive director of PARCS and to City staff." The ordinance also amends the selection of Tree Commission member to be "chosen from" instead of "representative of" various areas of expertise. The bylaws, which fall within the "internal organization and rules of procedure" language for which Section 2.251(3), also require council approval. Mr. Hammitt introduced Jan Staszewski, recently hired by the City in the position of Urban Forester. CB 4290--An ordinance concerning the Tree Commission; and amending section 2.245, 2.247, and 2.249 of the Eu- gene Code, 1971. Administrative Services Director Warren Wong gave the staff presentation for Agenda Items VIII and IX. The reports before the council were reviewed and audited by Coopers & Lybrand in compliance with State and Federal guidelines. He explained that the management letter included in the council's agenda packet is a review of the City's internal control systems. All items identified in the management letter have been addressed and approved by the auditors and by all affected external agencies. The resolutions before the council ask for council accep- tance and approval of the attached financial reports. Regarding a question raised during a previous council work session regarding the status of the Urban Renewal Agency's outstanding debt, Mr. Wong clarified that the agency has approximately $3.9 million in outstanding tax allocation bonds issued for the construction of the conference center parking garage and the Parcade, $7.3 million in outstanding intergovernmental agreements between the Eugene Renewal Agency and the City of Eugene, and $5.3 million in unre- stricted cash. It would be theoretically possible to payoff approximately one-half of the outstanding debt, with over $5 million debt remaining. Res.
