I. CONSENT CALENDAR A. Approval of City Council Minutes of May 13, 1991, Dinner Work Session; May 13, 1991, Meeting; and May 29, 1991, Lunch Work Ses- sion e B. Approval of Minutes, Findings, and Recommendations of Hearings Official and Adoption of Resolution Forming a Local Improvement District for Paving, Curbs, Sidewalks, Storm Drain, and Streetlights on Green Acres Road from Norkenzie Road to Delta Highway (Job No. 2647) Res. No. 4262--A resolution forming a local improvement dis- trict for paving, curbs, sidewalks, storm drain, and streetlights on Green Acres Road from Norkenzie Road to Delta Highway. Mr. Boles noted a spelling error in the minutes of May 13, 1991, dinner work session. He asked that "Major Defoe" be spelled consistently throughout. Referring to page 3, paragraph 3 of those minutes, regarding Blue Water Boats, Ms. Bascom also asked that the minutes be amended to reflect that "she concurred with the decisions of the three Planning Commissions and a site visit convinced her." Referring to the last sentence, last paragraph, on page 7, in the minutes of May 13, 1991, meeting, Mr. Boles asked that the minutes be corrected to state the following: "In that case, the full cost of the improvements would be credited up to the amount of the SDC." e MINUTES--Eugene City Council July 22, 1991 Page 1 e Mr. Rutan moved, seconded by Mr. Boles, to approve the items on the City Council consent calendar, as amended. Roll call vote; the motion carried unanimously, 7:0. II. PUBLIC HEARING: ANNEXATION/REZONING REQUEST FOR PROPERTY GENERALLY LOCATED IN THE RIVER ROAD AREA, BETWEEN THE NORTHWEST EXPRESSWAY AND GLORY DRIVE, SOUTH OF ELKAY DRIVE (AZ 91-7) City Manager Mike Gleason introduced the topic. Carol Heinkel, Planning and Development Department, summarized the code criteria necessary for annexation and zone change. She noted that these criteria apply to both annexation requests being considered this evening. Ms. Heinkel said that this property owner-initiated request was submitted by Green Valley Company of Oregon, which owns Tax Lots 1500 and 1600. The re- quest includes 4 parcels; Tax Lots 1502 and 1901 are owned by the City of Eugene and the Eugene & Water Electric Board (EWEB). These parcels are va- cant lots in the developed residential area of River Road. If approved, the applicant intends to develop the property for residential purposes. The Planning Commission held a public hearing on this request and recommended approval. It also recommended approval of zoning to low-density residential with site review criteria applied to Tax lots 1500, 1600, and 1502. Mr. Boles asked about the status of the parcels owned by the City of Eugene. In response, Pat Decker, Planning and Development Department, said that both e of the parcels are owned by EWEB and have transmission lines located along them. The City does not contemplate using them for other purposes. She explained further that it is the City's practice to annex publicly owned parcels when they are adjacent to properties being requested for annexation. Mr. Gleason added that technically the land in question is owned by the City of Eugene by and for the use of EWEB. Mayor Miller opened the public hearing. There being no requests to speak, the public hearing was closed. Res. No. 4260--A resolution furthering annexation to the city of Eugene and the Lane County Metropolitan Service District for property located in the River Road area, between the Northwest Express- way and Glory Drive, south of Elkay Drive. (Withdrawal from River Road Park and Recreation and Water Districts will be processed separate- ly if the annexation is approved.) Final Order AZ 91-7--A final order rezoning the property from County RA/UL to City R-1 with site review subdistrict to Tax Lots 1500, 1600, and 1502. e MINUTES--Eugene City Council July 22, 1991 Page 2 e Mr. Rutan moved, seconded by Mr. Boles, to adopt the resolu- tion and final order. PUBLIC HEARING: ANNEXATION/REZONING REQUEST FOR PROPERTY LOCATED IN THE SOUTH HILLS AREA, SOUTH AND EAST OF BAILEY HILL ROAD, WEST OF TIMBERLINE DRIVE (AZ 91-4) City Manager Mike Gleason introduced the topic. Carol Heinkel, Planning and Development Department, gave the staff report. She said that the code crite- ria summarized earlier applies to this request as well. This is a property owner-initiated request for a vacant parcel. The annexing area is contiguous to the main body of the city. The request includes about an eight-acre por- tion of a 200-plus-acre parcel, 73 acres of which was annexed to the City in 1980. The annexing area is part of a planned unit development (PUD) proposal before the city that includes the parcels already within the City. The Plan- ning Commission held a public hearing on the request and recommended approval and zoning to R-l/PD consistent with the portion of the tax lot already with- in the city. Mr. Boles asked staff to clarify the Planning Commission discussion with respect to the concerns about the impact of the development on adjacent for- est lands and the further reduction of agricultural land. In response, Ms. Heinkel said that the commissioners requested a map indicating the parcel's zoning in the county. Staff responded that the property in question is 10- e cated outside of the urban growth boundary and therefore not intended for urbanization. Responding to an inquiry from Mr. Green about opposition to this request, Ms. Decker explained that there is some discussion in the South Hills Study (the refinement plan for this area) about providing a buffer along the ridge1ine. In the past, the PARCS Department has attempted to acquire parcels along the ridge1ine between the area designated for urban development and the urban growth boundary for parkland. When property development occurs, the City will be working with the developer to provide open space within the develop- ment to address the relationship between urban densities inside the urban growth boundary and rural densities outside. The City has received no other opposition to the request. In response to a question from Mr. Boles, Ms. Heinkel said that all of the infrastructure needed to serve the planned unit development is currently in place or can be extended to serve the development site as part of the PUD process. Mr. Boles commented that the Systems Development Charge (SDC) should pick up the costs of extending the infrastructure up to the full cost of the SOC. Mayor Miller opened the public hearing. (Withdrawal from the Bailey-Spencer Rural Fire Protection District will occur automatically if the annex- ation is approved.) Final Order AZ 91-4--A final order rezoning the property from County AG/UL to City R-1/PD. Mr. Rutan moved, seconded by Mr. Boles, to adopt the resolu- tion and final order. Roll call vote; the motion carried unanimously, 7:0. IV. PUBLIC HEARING: UNIVERSITY OF OREGON LONG-RANGE CAMPUS DEVELOPMENT PLAN City Manager Mike Gleason introduced the topic. Christine Taylor, Planning and Development Department, gave the staff presentation. The University of Oregon has prepared a Long-Range Campus Development Plan as required by the Oregon State Board of Higher Education. In 1990, the State board amended its administrative rules and internal management directives to require review of campus plans by local jurisdictions for conformance with local comprehensive e plans. Ms. Taylor explained that in its review, the council should focus on those areas of the plan which relate to City policies and edge issues. The campus plan is intended to be a compilation of current campus planning poli- cies. Ms. Taylor stated that the Planning Commission held a public hearing on the plan and found it to be consistent with Eugene's general plan, applicable neighborhood refinement plans, and special area studies. The commission recommended approval with two minor modifications to the plan that: 1) it adopt by reference the Entrance Beautification Study; and 2) that it include an item in Appendix C that recognizes that various options in the Ferry Street Bridge proposal may offer an opportunity to coordinate with the City in transportation-related issues. In addition, the Campus Planning Commit- tee, University/Community Liaison Committee (U/CLC), and Planning and Devel- opment staff have reviewed the document and consider it to be consistent with local planning policies. Mayor Miller noted that at the request of several councilors, the council would not be taking action on this item at this meeting but would hold the public hearing, as scheduled. Mayor Miller opened the public hearing. Chris Ramey, 2063 Kincaid Street, University Architect for Planning, urged the council to pass a resolution supporting the Long-Range Campus Development - MINUTES--Eugene City Council July 22, 1991 Page 4 e Plan. He said that the material prepared by City staff accurately summarizes the intent of the plan. The suggestions made by the Planning Commission with regard to the plan are acceptable to the University. There being no additional requests to speak, the public hearing was closed. Ms. Ehrman inquired about the process that was used to receive student input on the plan. In response, Ms. Taylor said that the U/CLC was primarily in- volved in plan development. The U/CLC is composed of representatives from the Fairmont Neighborhood, South University Neighborhood, West University Neighborhood, and adjacent businesses. The Campus Planning Committee also reviewed the document and has a student representative on that committee. Ms. Bascom flagged for the council's Wednesday discussion that councilors pay particular attention to Appendix D which describes those policies arrived at as part of the Riverfront Research Park study and the treatment of the Willamette Greenway. She noted that this part of the plan accurately summa- rizes the long, involved process that was a part of creating the Riverfront Research Park study. Ms. Bascom noted that the plan identifies only a few trees as being signifi- cant and asked about the rationale for including those in the plan. In re- sponse, Mr. Ramey said that the trees that are mentioned in the plan have "recorded" significance within the University heritage. Additionally, there are many groups of trees on the campus that are not "recorded," but have some historic significance. In response to a question from Mayor Miller, Mr. e Ramey said that the Eugene Tree Ordinance has been interpreted to extend itself onto the campus. The University follows the guidelines of that ordi- nance. Mr. Boles said that because this is a land use planning document, there should be an opportunity for the larger community to be heard on these is- sues. He asked about the citizen involvement process that was followed for the plan, particularly non-university citizens. In response, Ms. Taylor reiterated that the U/CLC and the Campus Planning Committee were involved in plan development. She noted that the compilation of existing policies into a single document is only the first phase of future campus planning. In Phase 2, the University intends to take a look at new ideas which would result in suggested revisions to the plan. Ms. Taylor said that it will be more impor- tant to incorporate citizen input in Phase 2 of the process. Mr. Boles asked about the status of the U/CLC prior to developing this plan. In response, Ms. Taylor said that prior to undertaking the plan, there was some discussion about reconstituting the U/CLC in order to make it a more effective working group. This occurred and the first task for the reconsti- tuted committee was to assist with the preparation of the plan. Mr. Boles asked what certainty there is that Phase 2 of the plan would ever occur. In response, Mr. Ramey said that there are several items in Appendix C that are meant to be addressed in Phase 2. In addition, there is ongoing academic planning in progress at the University which will reach conclusion e MINUTES--Eugene City Council July 22, 1991 Page 5 e next year and should be incorporated into the plan. It is likely that Phase 2 will occur next year and continue as revisions are necessary to enable the University to bring its physical facilities in line with its new mission. Responding to another question from Mr. Boles, Mr. Ramey said that he feels the plan is consistent with the letter and spirit of The Oregon Experiment. Mr. Boles commented that the breadth of the user group and the lack of public review violate the spirit of the The Oregon Experiment. Mr. Boles noted that the plan seems to indicate that the Riverfront Research Park is under the control of the University. However, the development is also part of an urban renewal district. He asked staff to be prepared to discuss the fiduciary relationship that exists between the Riverfront Re- search Park development and the City as the Urban Renewal Authority at the Wednesday meeting. Mr. Nicholson asked whether any effort was made to bring together a public symposium on the plan. Ms. Taylor responded that no such effort was made.
