COUNCILORS ABSENT: Bobby Green. The adjourned meeting of September 18, "1991, of the Eugene City Council was called to order by His Honor Mayor Jeff Miller. Councilor Bascom introduced visitors from Irkutsk, Eugene's sister city, in attendance at this meeting. I. CONSENT CALENDAR A. Approval of City Council Minutes of June 24, 1991, Dinner Work Session; July 10, 1991, Lunch Work Session; and August 7, 1991, Lunch Work Session e B. Resolutions Concerning Reserve for Capital Projects Res. No. 4269--A resolution authorizing the transfer of funds from the Reserve for Capital Projects accounts to department's capital project accounts. Res. No. 4270--A resolution authorizing the transfer of bal- ance of the Reserve for Capital Projects ac- counts to Balance Available accounts. C. Resolutions Concerning Reserve for Encumbrances Res. No. 4271--A resolution authorizing the transfer of funds from the Reserve for Encumbrances accounts to department's operating accounts. Res. No. 4272--A resolution authorizing the transfer of the unused portions of the Reserve for Encumbrances accounts to Contingency or Balance Available accounts. D. No. 4273--A resolution forming a local improvement dis- trict for sanitary sewer within and adjacent to Woodbine between 24th Avenue and Cleveland Street and Terrace View Drive and City View Street. Mr. Rutan moved, seconded by Mr. Boles, to approve the items on the City Council consent calendar. Roll call vote; the motion carried unanimously, 7:0. II. ORDINANCE CONCERNING DOG LICENSING FEES Acting Assistant City Manager Linda Norris introduced the topic. She said that the ordinance would remove dog licensing fees from the code and provide that they be established by administrative order of the City Manager. Darcy Marentette, City Manager's Office, was available to answer Questions. Mr. Nicholson said that he is disturbed by the recent trend of designating more administrative functions to the City Manager. He felt that it is appro- priate for the council to periodically review fees of this magnitude, partic- ularly in light of the number of citizens whom the ordinance will affect. e Mr. Boles asked that this issue be flagged for discussion at the next process session. CB 4332--An ordinance concerning dog license fees; amending Section 4.395 of the Eugene Code, 1971; and declaring an emergency. Mr. Rutan moved, seconded by Mr. Boles, that the bill, with unanimous consent of the council, be read the second time by council bill number only, and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 7:0. Council Bill 4332 was read the second time by number only. Mr. Rutan moved, seconded by Mr. Boles, that the bill be ap- proved and given final passage. Responding to a question from Mr. MacDonald, Ms. Norris said that the ration- ale behind increasing the dog licensing fees was to encourage citizens to have their dogs spayed or neutered by levying a higher fee to license unspayed or unneutered dogs. e MINUTES--Eugene City Council September 23, 1991 Page 2 , ~ . - Ms. Ehrman indicated her support for this ordinance and expressed hope that e the rate differential would encourage citizens to have their dogs spayed or neutered. Responding to a question from Mr. Boles, Ms. Norris said that she does not know why the City licenses potentially dangerous dogs. Mr. Boles asked that this issue be flagged for further discussion the next time the council con- siders its rate structure for dog licensing. Mr. Nicholson observed that the City recently advised a constituent that litigation is a citizen's only recourse action if bitten by a potentially dangerous dog. He asked whether there were other code regulations governing potentially dangerous dogs. In response, Bill Gary, City Attorney's Office, said that the code does contain other provisions governing potentially dan- gerous dogs specifically targeted at repeat offender dogs. Responding to another question, Mr. Gary said that the City learns of repeat offender dogs on a citizen complaint basis. Mr. Nicholson said that he believes the ordinance is inadequate with respect to repeat offender dogs. Staff agreed to reexamine the code and provide the council with a response. Mr. MacDonald observed that some "potentially dangerous" dogs never cause any problems. He said that it is legitimate for the City to license potentially dangerous dogs as long as the dog owner complies with restrictions set forth in the code. e Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance 19799). Mayor Miller adjourned the meeting of the Eugene City Council and convened a meeting of the Urban Renewal Agency. III. RESOLUTION CONCERNING RESERVE FOR CAPITAL PROJECTS Acting Assistant City Manager Linda Norris introduced the topic and said that Administrative Services Director Warren Wong was available to answer Ques- tions. Res. No. 957--A resolution authorizing the transfer of funds from the Reserve for Capital Projects to the Planning and Development Department. Mr. Rutan moved, seconded by Mr. Boles, to adopt the resolu- tion. Roll call vote; the motion carried unanimously, 7:0. Mayor Miller adjourned the meeting of the Urban Renewal Agency and reconvened the meeting of the Eugene City Council. e MINUTES--Eugene City Council September 23, 1991 Page 3 ,- . ~ . IV. ORDINANCE CONCERNING 1991 STATE TRAFFIC LAWS e Acting Assistant City Manager Linda Norris introduced the topic and said that Dick Loveall, Department of Public Safety, was available to answer questions. CB 4333--An ordinance concerning traffic regulations; readopting Section 5.005 of the Eugene Code, 1971; and declaring an emergency. Mr. Rutan moved, seconded by Mr. Boles, that the bill, with unanimous consent of the council, be read the second time by council bill number only, and that enactment be considered at this time. Roll call vote; the motion carried unanimously, 7:0. Council Bill 4333 was read the second time by number only. Mr. Rutan moved" seconded by Mr. Boles, that the bill be ap- proved and given final passage. Recognizing that this is a routine item, Mr. Boles asked whether there might be a way for the council to automate this procedure. He suggested tacit council approval with a veto ability. In response, Mr. Gary said that this is an exercise of the City's home rule power to adopt ordinances that mirror the State code. The council must adopt this by affirmative vote. e Roll call vote; all councilors present voting aye, the bill was declared passed (and became Ordinance 19800).
