The adjourned meeting of the Eugene City Council was called to order by His Honor Mayor Jeff Miller. Mayor Miller welcomed Boy Scout Troop 25 in attendance. I. CONSENT CALENDAR A. Approval of City Council Minutes of September 11, 1991, Lunch Work Session; September 18, 1991, Lunch Work Session; and September 23, 1991, Dinner Work Session e Mr. Rutan moved, seconded by Mr. Boles, to approve the item on the consent calendar. Mr. Nicholson asked that the minutes of September 23, 1991, dinner work ses- sion, be withdrawn from the consent calendar. Mr. Nicholson agreed to work with staff on his amendment to those minutes. Roll call vote; the motion passed unanimously. II. PUBLIC HEARING: ANNEXATION/REZONING REQUEST FOR PROPERTY GENERALLY LOCATED IN THE RIVER ROAD AREA ON THE NORTH SIDE OF ELKAY DRIVE, EAST OF FAIRWAY DRIVE, SOUTH OF MARION LANE (AZ 91-9) City Manager Mike Gleason introduced the topic. Carol Heinkel, Planning and Development Department, summarized the code criteria applicable to annexation and zone change. This is a property owner-initiated request involving a 1/2-acre parcel in the River Road area. If the annexation request is ap- proved, the property owners plan to build a single-family dwelling unit on the lot. The Planning Commission held a public hearing on the request and recommended approval and rezoning to RA Suburban Residential. Mayor Miller opened the public hearing. There being no requests to speak, the public hearing was closed. e MINUTES--Eugene City Council October 28, 1991 Page 1 e Res. No. 4276--A resolution furthering annexation to the city of Eugene and the Lane County Metropolitan Service District for property located in the River Road area, on the north side of Elkay Drive, east of Fairway Drive, west of Hoover Lane, and south of Marion Lane. (Withdrawal from the River Road Park and Water districts will be processed separately if the annexation is approved.) Final Order AZ 91-9--A final order rezoning the property from County RA/UL to City RA. Mr. Rutan moved, seconded by Mr. Boles, to adopt the resolu- tion and final order. Mr. Robinette noted that he has done some legal work for the applicant but that he has not worked with the applicant on this request and was not aware of the request until he received his council packet. Roll call vote; the motion passed 6:1, with Mr. Nicholson voting nay. III. PUBLIC HEARING: ANNEXATION/REZONING REQUEST FOR PROPERTY GENERALLY LOCATED IN THE BETHEL-DANEBO AREA ON THE CORNER OF BARGER DRIVE AND e TERRY STREET IN WEST EUGENE (AZ 91-10) Carol Heinkel, Planning and Development, said the code criteria read earlier was applicable to this request. This is a property owner-initiated request involving an approximately 60-acre parcel in the Bethel-Danebo area in west Eugene. If the annexation request is approved, the property owners plan to develop the property with a 250-unit, manufactured home clustered subdivi- sion. The Planning Commission held a public hearing on the request and rec- ommended approval. At the public hearing, neutral testimony included con- cerns about traffic safety issues along Barger Drive; staff responded that the City would extend Terry Street to connect Barger Drive with Royal Avenue to the south. She said Public Works staff was present to answer questions. The Planning Commission also recommended approval for rezoning to R-1 Low Density Residential. Mr. Green asked about the portion of Terry Street owned by Lane County. Ms. Heinkel explained that a small stretch of what would be Terry Street, if it were extended, has not been annexed to the city. She said she understood that Public Works staff had not had conversations with Lane County about extending Terry Street. Responding to a question from Ms. Bascom, Dave Reinhard, Public Works, said that the existing portions of Terry Street have been designed so that bike lanes could be added. He said the existing Terry Street is half of an even- tual 46-foot-wide minor arterial street, including three lanes (one traveling e MINUTES--Eugene City Council October 28, 1991 Page 2 e each direction and a center turn lane), on-street bike lanes (five to six feet wide), and sidewalks. Half of the existing 80-foot right-of-way would be dedicated. Mr. Reinhard said staff will work with Lane County on the section that has not been annexed to the city. He explained that Lane County's road plans include developing Terry Street as a minor arterial from West 11th Avenue, but that renewed concerns about wetlands may keep this from occurring. He said that Terry Street is also planned to eventually extend from Barger Drive to Roosevelt Boulevard. Ms. Bascom felt development of the Terry Street arterial was important be- cause Bethel-Danebo's relatively flat neighborhood had significant potential for generating bike traffic. Responding to a question from Mr. Boles, Ms. Heinkel said the estimated $81,000 which would be generated from parks systems development revenue was based on the standard systems development charges (SDCs) rate schedule ap- plied to 250 units. Mr. MacDonald reminded councilors of concerns regarding the SDC's parks systems development charge and exclusion of regional facili- ties. He suggested that the council revisit the parks systems development charges at a future meeting. Mr. Boles asked staff for a follow-up to deter- mine if the revenue generated from the SDCs was adequate to cover the acqui- sition cost of the park. Mayor Miller opened the public hearing. e Al Johnson, 767 Willamette Street, representing the applicant, expressed support for the request. Using an aerial photograph taken April 1991, he pointed out the property under consideration. He indicated that the State is considering barring access to Beltline Road from Royal Avenue. Responding to a question from Mr. MacDonald, Mr. Johnson said the residential lands inventory recently completed identifies 10 percent of the property as having hydric soils but that soil maps indicate that 40 percent of the prop- erty contains hydric soils. He said there have been substantial changes in the hydrology due to development and that wetlands consultants and soil con- servationists have surveyed the land. He noted that soil conservationists have recently been directed to discontinue wetlands delineations because of changes in regulations. He said The Capital Press, a statewide agricultural newspaper, indicated in this week's publication that definitional issues may not be resolved for another 18 months. He said there would be potential to preserve open area on the property, as it can provide up to 350 units. Responding to questions, Mr. Johnson said the projection of Terry Street as an arterial presumes that it will be accessed via West 11th Avenue. He de- scribed potential traffic patterns if this occurred. Mayor Miller closed the public hearing. e MINUTES--Eugene City Council October 28, 1991 Page 3 -- Res. BALLOTING TO DETERMINE INTERVIEWEES FOR OPENINGS FOR THE BUDGET COMMITTEE, DOWNTOWN COMMISSION, EUGENE-SPRINGFIELD METROPOLITAN PARTNERSHIP, HUMAN RIGHTS COMMISSION, AND PLANNING COMMISSION City Manager Mike Gleason introduced the topic. Nancy Young, City Manager's Office, said that results of the preliminary ballots had been distributed to councilors prior to the meeting. She noted that incumbents had not been included with those results. e A. Budget Committee Mr. Rutan moved, seconded by Mr. Boles, that the council con- sider the incumbents' applications for reappointment and that the council interview the following top five candidates for the three openings on the Budget Committee: Tim Laue, Leslie Hendrickson, Ken Boettcher, Janet Anderson, and Laurie Schultz. Mr. MacDonald thought that the council wanted to reconsider reappointing incumbents to the Budget Committee. Responding to a question from Ms. Bascom, Mr. Boles said that Janet Anderson has indicated that she would resign from the Citizen Involvement Committee if she were appointed to the Budget Committee. Mr. Nicholson moved to amend the above motion to interview Howard Bonnett, in addition to the top five applicants named in the above motion, for the three openings on the Budget Committee. The motion died due to a lack of a second. Ms. Ehrman moved, seconded by Mr. Boles, to amend Mr. Rutan's motion to interview the top three applicants, rather than the top five, for the three openings on the Budget Committee. Mr. Nicholson suggested that if there was already a majority of the council that supported reappointing the incumbents, then the council should not in- terview the applicants. Mr. MacDonald concurred. Roll call vote; the amendment passed 6:2, with councilors Green, Ehrman, Rutan, Boles, Robinette, and Bascom voting in favor and councilors Nicholson and MacDonald voting opposed. Roll call vote; the main motion passed as amended 5:3, with councilors Green, Ehrman, Rutan, Boles, and Robinette voting in favor and councilors Nicholson, Bascom, and MacDonald vot- ing opposed. B. Downtown Commission Mr. Rutan moved, seconded by Mr. Boles, to interview the three candidates, with the assumption that all three have been confirmed as qualified, for the one opening on the Downtown Commission. The three candidates are Jerry Grotzinger, John Gage, and John Stromberg. Roll call vote; the motion carried unanimously, 7:0. C. Eugene-Springfield Metropolitan Partnership e Mr. Rutan moved, seconded by Mr. Boles, to interview the top three candidates for the one opening on the Eugene-Springfield Metropolitan Partnership. The top three candidates are Jane Scheidecker, Patrick Malone, and Pennie Hopkins. Roll call vote; the motion carried unanimously, 7:0. D. Planning Commission Mr. Rutan moved, seconded by Mr. Boles, to interview the top three candidates for one of two openings on the Planning Com- mission and that the council reappoint Ken Tollenaar to his position. The top three candidates are Julie Aspinwall-Lam- berts, Tim Laue, and Adell McMillan. Roll call vote; the motion carried unanimously, 7:0. E. Human Rights Commission Mr. Rutan moved, seconded by Mr. Boles, that the council reap- point the three incumbents seeking reappointment and that the council interview the top five candidates for the two remain- ing openings. The top five candidates are Brian Knowles, Leroy Dickens, John Moniz, Martin Acker, and George Russell.
