COUNCILORS ABSENT: Ruth Bascom; Mayor Jeff Miller. The regular meeting of January 13, 1992, of the Eugene City Council was called to order by Council President Shawn Boles. I. PUBLIC FORUM There were no requests from the public to speak. II. CONSENT CALENDAR A. Approval of City Council Meeting Minutes of October 14, 1991, Meeting; October 16, 1991, Lunch Work Session; October 21, 1991, Dinner Work Session; October 23, 1991, Lunch Work Session; October 28, 1991, Dinner Work Session; October 28, 1991, Meeting; November 4, 1991, Meeting; November 7, 1991, Dinner Work Session; and No- vember 18, 1991, Special Meeting. B. Approval of Minutes, Findings, and Recommendations of Hearings Official; Authorization of Design, Acquisition, and Bidding; and Adoption of Resolution for Designating Marshall Avenue as a Col- lector Street. Res. No. 4295--A resolution designating Marshall Avenue from 200 feet east of Hughes Street to Echo Hollow Road as a collector street. C. Resolution Concerning the Multiple-Unit Property Tax Exemption for Property Located at 15th Avenue and Olive Street. Res. No. 4296--A resolution concerning the multiple-unit prop- erty tax exemption for property located at 15th Avenue and Olive Street (Krumdieck), and amend- ing Resolution No. 4130. Roll call vote; the motion passed unanimously, 7:0. III. PUBLIC HEARING: ANNEXATION/REZONING REQUEST FOR PROPERTY LOCATED IN THE WILLAKENZIE AREA ON THE NORTH SIDE OF AYRES ROAD, BETWEEN DELTA HIGHWAY AND GILHAM ROAD (AZ 91-13 CAMPBELL/SAUNDERS) e City Manager Mike Gleason introduced the topic. Cathy Czerniak, Planning and Development Department, summarized code criteria necessary for zone change and annexation. The property owner has requested annexation and rezoning of the 42-acre parcel as a first step toward developing the property for low- density residential uses. The property is located within the urban growth boundary in the Willakenzie area, and key urban services can be provided to serve development on the site. The Planning Commission held a public hearing on this request and voted unanimously to recommend approval of the request. Responding to a question from Mr. Nicholson, Ms. Czerniak explained that there are no provisions in the Eugene Code requiring annexation/rezoning requests to meet criteria of land use plans that have not yet been adopted by the council. She said the Planning Commission discussed concerns about this request in the context of the draft Willakenzie Refinement Plan. Mr. Boles opened the public hearing. Marguerite Saunders Campbell, property owner, expressed support for the re- quest and offered to answer Questions concerning the property. There being no other requests to speak, the public hearing was closed. Res. No. 4297--A resolution furthering annexation to the city of Eugene and Lane County Metropolitan Service District for property located on the north side of Ayres road, between Delta Highway and Gilham Road. The Boundary Commission's expedited process is requested. Withdrawal from the Willakenzie Rural Fire Protection District will occur if the annexation becomes effective. Final Order AZ 91-13--A final order rezoning the property from County AG/UL to City R-l/SR. Mr. Green moved, seconded by Ms. Ehrman, to adopt the resolu- tion and final order. Responding to a question from Ms. Ehrman, Ms. Czerniak said that concerns expressed in correspondence were related to increased traffic on Ayres Road resulting from development of the area. She said that Ayres Road has been scheduled for improvements in the Capital Improvement Plan (CIP). Mr. e MINUTES--Eugene City Council January 13, 1992 Page 2 e Nicholson felt it was illogical to aprove this annexation/zone change request outside the context of the Wi'lakenzie Refinement Plan. Mr. MacDonald felt that the issue of postponing land use requests due to pending refinement plans merited further discussion at a future council meet- ing. Mr. Robinette concurred but objected to delaying action on this re- quest. Mr. Gleason said that statutory requirements require that the council act on land use requests based on adopted plans and policies. Ms. Ehrman supported proceeding with the request, pointing out that there was little input from the neighborhood association in the minutes of the Planning Commission's public hearing. Mr. Nicholson read provisions of Policy 7 in support of his argument for delaying action on this request until the Willakenzie Refinement Plan is adopted. Jan Childs, Planning and Development Department, said that the Willakenzie Refinement Plan may not be presented to the council for final adoption until April. Responding to a question from Mr. MacDonald, Ms. Czerniak explained that the Willakenzie Refinement Plan identifies several "opportunity areas" and en- courages consideration of mixed uses for those areas. She said that the area of this request comprises approximately 30 percent of an identified opportu- nity area. She said that if development of the area does not occur before final adoption of the Willakenzie Refinement Plan, and if the Willakenzie Plan calls for rezoning of the area to something other than low density, the e City could then initiate a rezoning of the area as specified by the plan. Mr. Green moved to call the question. Roll call vote; the motion passed 6:1, with councilor Nicholson voting against. PUBLIC HEARING: PROPOSED WITHDRAWAL OF RECENTLY ANNEXED PROPERTIES FROM SPECIAL DISTRICTS City Manager Mike Gleason introduced the topic and said staff was present to answer questions. Mr. Boles opened the public hearing. Wanda Simmons, 1183 Skipper Avenue, testified neither in support nor in favor of the proposed withdrawal of the Walnut Grove property. She noted that she recently saw a proposal on the news for developing housing in the area. She expressed concern about the potential safety hazard for children who would play near the pond if multiple-unit housing were developed there. She asked if the City would consider developing housing for senior citizens adjacent to the pond instead and suggested developing the multiple-unit housing next to e MINUTES--Eugene City Council January 13, 1992 Page 3 e the park. She described the litter problems around the pond and asked if the City would consider prohibiting automobile access to the site. Ethel Martinson, 1520 Elkay Drive, said she shared some of Ms. Simmons' sug- gestions and concerns. Tom Heintz, 1038 Jayne Street, Chair of the River Road Community Organiza- tion, requested an additional seven days to review material he received con- cerning the proposed withdrawal of the properties located in the River Road district. He said that he wanted to call a meeting of the organization to discuss the information. There being no other requests to speak on this item, the public hearing was closed. Ms. Czerniak clarified that the annexations of the properties have already been approved by the Lane County Local Government Boundary Commission and that a separate process was required to withdraw the properties from their water and park districts. Mr. Nicholson asked if not withdrawing the properties could result in in- creasing the property owners' taxes. Ms. Czerniak confirmed this. Referring to Mr. Heintz's testimony, Ms. Ehrman said that notices regarding the proposed withdrawals had been posted for approximately two weeks prior to this public hearing. e Mr. MacDonald requested a follow-up report on the safety concerns expressed by Ms. Simmons and on her suggestion to prohibit automobile access to the Walnut Grove site. Mr. Green supported Ms. Simmon's suggestion. Mr. Boles noted that when he served on the Council Social Goals Committee, a neighbor- hood effort was undertaken to clean up around the pond. He felt it was im- portant to maintain the effort. CB 4349--An ordinance providing for withdrawal from the Junc- tion City Water Control District that part of the district annexed to the city of Eugene by the Lane County Local Government Boundary Commission on May 21, 1990 (River Road Church of Christ, EC EU 90-06). Mr. Green moved, seconded by Ms. Ehrman, that the bill, with unanimous consent of the council, be read the second time by council bill number only and that enactment be considered at this time. Roll call vote; the motion passed unanimously, 7:0. Council Bill 4349 was read the second time by number only. Mr. Green moved, seconded by Ms. Ehrman, that the bill be approved and given final passage. Mr. Green moved, seconded by Ms. Ehrman, that the bill, with unanimous consent of the council, be read the second time by council bill number only and that enactment be considered at this time. Mr. Green moved, seconded by Ms. Ehrman, that the bill, with unanimous consent of the council, be read the second time by council bill number only and that enactment be considered at this time. Mr. Green moved, seconded by Ms. Ehrman, that the bill be approved and given final passage. Roll call vote; the motion passed unanimously, 7:0, and became Ordinance No. 19825. V. APPOINTMENTS: CONSIDERATION OF MAYOR MILLER'S NOMINATION TO THE SOLID WASTE AND RECYCLING BOARD At the request of Councilor Nicholson, this item was postponed until a future council meeting. APPOINTMENTS: NOTIFICATION OF MAYOR MILLER'S APPOINTMENTS TO THE EUGENE CELEBRATION STEERING COMMITTEE AND THE PUBLIC SAFETY ADVISORY COMMITTEE Mr. Boles said that notification of Mayor Miller's appointments were included in the council packets.
