Home My WebLink AboutAdmin Order 58-17-17ADMINISTRATIVE ORDER NO. 58-17-17 of the City Manager of the City of Eugene AMENDMENT OF FAIRMOUNT NEIGHBORS EVENT PARKING DISTRICT AND REPEAL OF ADMINISTRATIVE ORDER NO. 58-17-01. The City Manager of the City of Eugene finds that: A. EC 5.040 authorizes the City Manager or the Manager's designee to take administrative action establishing parking area time limitations, including the form of permissible parking and imposing conditions upon which the streets and other public property may be used for parking. B. On October 17, 2008, the City of Eugene, University of Oregon and Fairmount Neighbors Association entered into an Arena Impact Mitigation Agreement ("AIM Agreement") to implement certain permanent mitigations measures to lessen the impacts of traffic, parking and pedestrians associated with sports arena events on the campus area and nearby residential neighborhoods. C. Paragraph 5 of the AIM Agreement sets forth mitigation measures for arena event parking. Paragraph 5(b) of the AIM Agreement requires the City to establish a Fairmount Neighbors Event Parking District (Parking District) and it sets forth the parking restrictions to be applied in the Parking District. The AIM Agreement states that the Parking District restrictions are in addition to existing parking restrictions that apply within the Parking District's boundaries. D. Pursuant to the AIM Agreement, on August 24, 2010, the City Manager issued Administrative Order No. 58-10-15 establishing the Fairmount Neighbors Event Parking District. Due to AIM Agreement amendments since that time, the boundaries and parking limitations established by Administrative Order No. 58-10-15 have been amended, most recently by Administrative Order No. 58-17-01 issued on February 1, 2017. E. A recent amendment to the AIM Agreement necessitates amending the Parking District boundaries established by Administrative Order No. 58-17-01 so that the Parking District boundaries and regulations established by Administrative Order of the City Manager are consistent with those in the AIM Agreement and its amendments. On the basis of these findings, I order that: 1. Notwithstanding any other Administrative Order to the contrary, the area depicted on the map attached to this Order and incorporated herein as Exhibit A, and described specifically below, is established as the Fairmount Neighbors Event Parking District ("Parking District"). Administrative Order -- Page 1 of 3 Boundaries of Parking District: The area bounded by and including the intersection of 15th Ave. and Villard St., then east along 15 Ave. to 15th Ave. and Fairmount Blvd., then south and west along Fairmount Blvd. to 21st Ave. and Agate St., then north along Agate St. to 19th Ave. and Agate St., then east along 19th Ave. to Villard St. and 19th Ave., then north on Villard St. to 15th Ave. and Villard St.; and also including Birch Ln. from Fairmount Blvd. up to and including 2293 Birch Lane, Sunset Dr. from Fairmount Blvd. up to but not including 85 Sunset Dr., and 15th Ave. east of Fairmount Blvd. (The commercially zoned property on 19th Ave. between Agate St. and Columbia Aly. is not in the Parking District. The high density residential zoned properties at 15th Ave. and Walnut St. and at 15th Ave. and Orchard St. are not in the Parking District. The Walnut Station Special Area zoned properties at 15th Ave. between Villard St. and Orchard St. are not in the Parking District.) 2. For residential parking permit purposes, the Parking District shall be designated as Zone J. 3. The Parking District shall allow the following parking limitations: a. In the area shaded light green on Exhibit A, and described specifically below, 1 -hour public parking between 7:00 a.m. and 11:00 p.m., Monday through Sunday (7 days per week, including legal holidays), except for arena event permitted vehicles and Zone J permitted vehicles. Boundaries of Public Parking Described in Paragraph 3.a. above: The area bounded by and including the intersection of 15th Ave. and Villard St., then east along 15 Ave. to 15th Ave. and Fairmount Blvd., then south along Fairmount Blvd. to south side of 17th Ave., then west to the west side of Villard, and then north to 15th and Villard. Also including Birch Lane up to and including 2293 Birch Lane and 15th Ave. East of Fairmount Blvd. (Except the high density residential zoned properties at 15'h Ave. and Walnut St. and at 15th Ave. and Orchard St.) b. In the area shown as blue cross hatching on Exhibit A abutting Maude Kerns Art center, 30 -minute public parking between 7:00 a.m. and 11:00 p.m., Monday through Sunday (7 days per week, including legal holidays), except for arena event permitted vehicles. C. In the area shown as orange cross hatching on Exhibit A abutting Fairmount Park, 1 -hour public parking between 7:00 a.m. and 11:00 p.m., Monday through Sunday (7 days per week, including legal holidays), except for arena event permitted vehicles. d. In the area shaded dark green on Exhibit A, 2 -hour public parking between 7:00 a.m. and 11:00 p.m., Monday through Sunday (7 days per week, including legal Administrative Order -- Page 2 of 3 holidays), except for arena event permitted vehicles and Zone J permitted vehicles. These boundaries are as described in paragraph 1 of this Order excluding the boundaries described in paragraph 3. subsections a., b. and c. of this Order. 4. The University of Oregon may issue up to 500 arena event parking permits ("Event Permit") to allow vehicular parking in the Parking District in excess of the 2 -hour limitation set forth in paragraph 3, above. Event Permit parking privileges shall be limited to University of Oregon men's basketball games and collegiate level men's and women's post - season basketball games, totaling no more than 22 events per year. 5. The Maude Kerns Art Center may issue event permits for art center events to allow vehicular parking in the Parking District in excess of the time limitations set forth in paragraph 3, above. Maude Kerns Event Parking permits may not be used for volunteer or employee parking. 6. Persons residing in or owning residential property within the Parking District designated in this Order may apply for a permit entitling the permit holder to preferential long- term parking within the designated Parking District. Upon application, each residential location within the Parking District may receive up to two free residential parking permits. The cost of providing the free parking permits to the residential locations within the Parking District shall be included in the City's annual operational costs paid by the University of Oregon. Permit fees shall be established in accordance with Section 2.020 and Chapter 5 of the Eugene Code, 1971. 7. A holder of a Parking District residential parking permit may apply to the Parking Services Manager for an individual, or packet of ten (10), temporary guest parking permit(s). 8. Except when this administrative order provides a conflicting provision, the area designated as the Parking District shall continue to be governed by applicable administrative orders. Order. 9.
