COUNCILORS ABSENT: Randy MacDonald, Roger Rutan, Ruth Bascom, Kaye Robinette. The adjourned meeting of the Eugene City Council of August 19, 1992, was called to order by His Honor Mayor Jeff Miller. Due to a lack of a quorum, items II, IV, V and IX were postponed until August 26, 1992, and all other items, except items I and III, will be rescheduled for a future meeting. The public hearing for Item III will be held tonight and continued until September 14, at which time the council will act on the item. 1. PUBLIC FORUM e Referring to the person who indicated that he would like to testify regarding a local income tax, Mayor Miller explained that a council subcommittee was exploring a local personal income tax, business tax, or some combination of both, and will report back to the council in late September. Irvin Moore expressed support for a one-percent sales tax on all retail sales in Eugene. He said that based on figures provided by the U.S. Department of Commerce, Bureau of Census, a one-percent sales tax instituted in Eugene would generate $12.7 million annually. He expressed concern about taxing one particular industry, adding that a sales tax would be the most fair and less costly to administer. Dave Sweet said he understood that the council made a promise in the "Let's Get To The Point" Eugene Decisions tabloid regarding the section which described the potential impact of a $170,000 reduction in the Development Division's budget. He said the tabloid indicated that if such a cut were made, one of the results would be to eliminate the regulation of street musicians in Eugene. He added that a majority of the public has expressed support for such a reduction in the Development Division's budget. He stated that Eagle Park Slim, who was recently featured in The Reqister-Guard as Eugene's only full-time street musician, has moved to Seattle because of Eugene's regulations. e MINUTES--Eugene City Council August 24, 1992 Page 1 7:30 p.m. e II. PUBLIC HEARING: ANNEXATION/REZONING REQUEST FOR PROPERTY LOCATED IN THE SANTA CLARA AREA (AZ 92-7), BREEDEN LAND COMPANY) City Manager Mike Gleason introduced the topic. Cathy Czerniak, Planning and Development Department, summarized the code criteria necessary for annexation and rezoning. She said that due to the lack of a quorum, the public hearing tonight will remain open until September 14, and additional testimony will be taken then before council discussion and action. This request includes 54 undeveloped tax lots and portions of road rights-of- way in the immediate area. This request was initiated by the property owners, Breeden Land Company, in preparation for the next phase of development in the Lynnbrook II subdivision. The Metropolitan Area General Plan requires that undeveloped property be annexed before new urban development occurs and urban services are extended. As allowed by an amendment to the Metro Plan, existing development in the Lynnbrook subdivisions will be permitted to connect to the City sewer system without annexing to the city. Subdivision of this area for low-density residential development was approved by Lane County in the early 1970s. At that time, Lane County and the State Department of Environmental Quality (DEQ), approved on-site sewage lagoons as an interim means of providing sewer service to this area until a public sewer system was available. The DEQ permit for the sewage lagoons expires in January 1993, and the City is currently working with Lynnbrook property owners and the Breeden Land Company on the transition to the public sewer system which is in place adjacent to the e area. Before the end of the year, the lagoons will be decommissioned, and the Lynnbrook sewer system will be connected to the metropolitan sanitary system. Responding to a question from Mr. Boles, Ms Czerniak said the Lynnbrook I subdivision is fully developed and that approximately one-third of the Lynnbrook II subdivision is developed. Mayor Miller opened the public hearing. There being no requests to speak, the public hearing was continued until September 14.
