Eugene City Council Council Chamber--C;ty Hall November 9, 1992 7:30 p.m. COUNCILORS PRESENT: Shawn Boles, Bobby Green, Ruth Bascom, Debra Ehrman, Randy MacDonald, Paul Nicholson, Kaye Robinette. ABSENT: Roger Rutan. The regular meeting of the Eugene City Council of November 9, 1992, was called to order by His Honor Mayor Jeff Hiller. I. PUBLIC FORUM Dave Sweet, 1237 Ferry Street, said he hopes that the new City Council will be more responsive to public input than the current council. He stated that the City's integrity has been compromised by what he felt were unfair regulations concerning musicians who perform in public places. He urged the council to uphold the constitutional rights of these citizens and eliminate such regula- tions. . II. CONSENT CALENDAR A. Approval of City Council Minutes of August 26, 1992, Lunch Work Session and September 9, 1992, Lunch Work Session B. Community Development Block Grant (CDBG) Funding for Acquisition of AIDS Hospi ce Hr. Boles moved, seconded by Ms. Ehrman, to approve the items on the City Council Consent Calendar. Roll call vote; The motion carried 6:0:1, (Councilor Green was momentarily out of the room when the vote was taken). III. PUBLIC HEARING: ANNEXATION/REZONING REQUEST FOR PROPERTY LOCATED IN THE SANTA CLARA AREA (AZ 92-10. CLEMENS/MARQUESS PROPERTIES LTD.)___ City Manager Hike Gleason introduced the item. Cathy Czerniak, Planning and Development Department, summarized the code criteria for annexations and zone changes. This property owner-initiated request includes two tax lots totaling approxi- . Annexation and rezoning of the properties will allow infill development to occur consis- . tent with the Metro Plan. The Planning Commission unanimously recommended approval of the request. Responding to a question from Ms. Ehrman regarding concerns expressed in written testimony related to the request, Ms. Czerniak explained that Tax Lot 1300 will require some right-of-way dedication to provide for the full width of Quince Street, to be determin~d through the subdivision process. Mayor Miller opened the public hearing. There being no requests to speak, the public hearing was closed. Res. No. 4351--A resolution furthering annexation to the city of Eugene and the lane County Metropolitan Service District for property located in the Santa Clara area on the north side of Santa Clara Avenue, west of River Road. Final Order AZ 92-10--A final order rezoning the property from County R-ljUl to City R-l. Mr. Boles moved, seconded by Mr. Green, to adopt the resolution and final order. Roll call vote; the motion passed unanimously, 7:0. IV. AMENDMENT TO ALTON BAKER PARK MASTER PLAN . City Manager Mike Gleason said the council requested that this item be returned after the November election. Ms. Bascom did not feel it was appropriate to have this item on the agenda in light of the passage of Ballot Measure 20-01, an initiative limiting the development of Alton Baker Park. Glen Klein, City Attorney's Office, advised the council that its action was not necessary on this item. V. ORDINANCES CONCERNING THE GATEWAY REFINEMENT PLAN City Manager Mike Gleason introduced the item. Jan Childs, Planning and Development Department, presented the staff report. On January 29, 1992, the council held a joint meeting with the elected officials of Springfield and Lane County, both of which have since adopted the plan and have forwarded three implementing ordinances for approval by Eugene. The plan does not require adoption by Eugene. She said that Susie Smith, Project Manager for the Gateway Refinement Plan, was present to answer questions concerning the plan. Mr. Boles moved, seconded by Mr. Green, that the bill, with unanimous consent of the council, be read the second time by council bill number only, and that enactment be consider.ed at this time. Roll call vote; the motion passed unanimously, 7:0. Council Bill 4421 was read the second time by number only. Mr. Boles moved, seconded by Mr. Green, that the bill be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed and became Ordinance No. 19886. C8 4422--An ordinance amending the Eugene-Springfield Metropolitan Area Transportation Plan. Mr. Boles moved, seconded by Mr. Green, that the bill, with unanimous consent of the council, be read the second time by council bill number only, and that enactment be considered at this time. Roll call vote; the motion passed unanimously, 7:0. Council Bill 4422 was read the second time by number only. Mr. Boles moved, seconded by Mr. Green, that the bill be approved . and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed and became Ordinance No. 19887. CB 4423--An ordinance amending the Eugene-Springfield Metropolitan Area Public Facilities Plan. Mr. Boles moved, seconded by Mr. Green, that the bill, with unanimous consent of the council, be read the second time by council bill number only, and that enactment be considered at this time. Roll call vote; the motion passed unanimously, 7:0. Council 8i11 4423 was read the second time by number only. Mr. Boles moved, seconded by Mr. Green, that the bill be approved and given final passage. Roll call vote; all councilors present voting aye, the bill was declared passed and became Ordinance No. 19888. The meeting adjourned at 7:39 p.m. .
