EUGENE CITY COUNCIL
September 20, 1976
Adjourned meeting of the Common Council of the City of Eugene, Oregon, was
called to order by His Honor Mayor Les Anderson at 7:30 p.m., in the Council
Chambers with the following Council members present: Eric Haws, Wickes Beal,
Tom Williams, Neil Murray, Ray Bradley, D. W. Hamel, and Edna Shirey.
Gus Keller was absent.
1. PUBLIC HEARINGS
I-A-I A. Liquor License (new) - La Primavera, 388 West 7th Avenue, RMB
OLCC reports no objectors. Staff has no objections.
Public hearing was held with no testimony presented.
Mr. Haws moved, seconded by Mr. Hamel, to recommend
approval. Motion carried unanimously.
I-A-2 B. Code Amendment re: Operation of Sign Code Board of Appeals
Recommended by Planning Commission August 3, 1976.
C.B. 1246 - Amending City Code re: Operation of Sign Code

and title only, there being no Council member
present requesting it be read in full.
Mr. Haws moved, seconded by Mr. Hamel, that the bill
be read the second time by council bill number only,
with unanimous consent of the Council, and that
enactment be considered at this time. Motion carried
unanimously and the bill was read the second time by
council bill number only.
Mr. Haws moved, seconded by Mr. Hamel, that the bill
be approved and given final passage. Rollcall vote.
All Council members present voting aye, the bill was
declared passed and numbered 17763.
l-A-3 C. Annexation of area between Southern Pacific tracks, Franklin Boulevard,
and Henderson Street (Lane County)(Z 76-9)
Recommended by Planning Commission September 13, 1976. Mr. Saul said
the annexation was initiated by Lane County, proposing annexation of
20 acres. The County is developing a solid waste facility and is
wanting to connect that with sanitary sewers. An application has
been received from Dale Fischer requesting 36.9 be included in the
area to be annexed. Staff review indicated sewer service could be
provided, police and fire also.

Vern.Gleaves, 975 Oak, reiterated that the property is served by sewer
and that it was desired that the property be considered for annexation
at this time along with the other request. -

Res. No. 2560 - Forwarding to Boundary Commission recommendation
to annex area between Southern Pacific tracks,
Franklin Boulevard, and Henderson Street was read
by number and title.
Mr. Haws moved, seconded by Mr. Hamel, to adopt the
resolution. All Council members present voted aye,
except Mr. Hamel abstaining.
I-A-4 D. Rate Increase - Airport Limousine Service
Recommended by Airport Commission June 1976.
Public hearing was held with no testimony presented.
Res. No. 2561 - Authorizing rate increase for aiport limousine
service to $3.00 per trip was read by number
and tit 1 e .
Mr. Haws moved, seconded by Mr. Hamel, to adopt the
resolution. Rollcall vote. Motion carried unanimously.
I-A-5 E. Improvement of Highway 99N from Roosevelt Boulevard to north city limits e
Planning authorized by the Council March 1976. Initiated by joint actions
of the City and State. Public Works Director noted the improvement was
initiated by joint City and State action. Public Works staff has had one
public hearing as well as meetings with property owners. Staff is asking
to proceed now with final design. There will be one other hearing at the
time of contract award. Staff would encourage that, if the Council
wishes to deny, it do so at this point rather than later.
Dave Reinhard, Transportation Planner, presented slides. $994,00 is the
total estimated cost, $518,000 to be paid by state and city, $476,000
by property owners, $290,000 state share, and $228,000 is city share.
$32 per front foot for each highway side is the cost to the property
owner.
Public hearing was opened.
Arden Munkres, ABC Chairman, mentioned the improvement is part of the
Bethel area refinement plan. He feels that $32 per fron foot does not
seem too far out of line for commercial zoning since $28 was the cost
on both Barger and Royal. He also spoke to the need for the raised center
median to accommodate pedestrian traffic due to wideness of the street.
Mary Sherriffs, 137 W. 37th, was impressed with city staff efforts. She
believes improvements should be the best kind devised with limitations of
financing. She supports the raised median, to divide through traffic --
from turning cars and to act as a haven for pedestirans. It would also
enhance the appearance, she said. Street trees, etc., are increasingly
important for an ever-growing area.

Betty Belknap, 671 Taney, spoke in favor of a raised landscape median.
As a main road into the city, especially from the airport, it is an
e important first impression.
Don Hatfield, 2189 Dewey, felt the area to be one of the largest
growing areas in Eugene. He feels the center median should be left
in. He feels that people who do not have any controls do not seem to
control themselves.
Clark Cox, 1085 Patterson, felt pedestrian traffic is in danger as it
is now.
Ruth Bascom, 2114 University, spoke in support of bike lanes.
Rick Cleveland, 600 Citizens Building, handed in a petition containing
232 signatures in opposition. He said there are two types of concerns:
(1) no frills concerned citizen approach against spending much money,
especially for a nebulous benefit; (2) adequacy of data on which the
decision might be based. Mr. Cleveland submitted an approach is needed
to analyze available data. Is this the right project? He was concerned
if road surface is reduced to allow for bikes, since traffic is so heavy.
He also noted he has not seen many bikes on Highway 99. There are other
direct routes freer from risk. The desire, he feels, is to have a good
safe alternative for bikers--not provide a safe place just for them.
There are indications staff has investigated alternative funding for the
property owners involved. He feels, too, that all citizens should pay
for beautification to a city entrance, not just property owners on
- Highway 99. Mr. Cleveland also wondered if the project would fare
better when rated as a higher priority than 8th out of 9 state priorities.
He wondered why federal funds were not sought, and was opposed to the
median strip.
Kay Poole, 1700 Bailey Hill, and a property owner on Highway 99, spoke
in opposition due to cost.
Belva Keller, 1955 Highway 99N, wondered about aesthetics from Barger
north, questioning the advisability of beautifying the area north of Barger
only.
Andy Caldwell, 642 Highway 99N, felt the road should be left alone, at
least until it can rate higher with the State.
Robert Hanigan, 228 Kingsbury, felt further study should be done before
improvement.
Bryce Poole, 1700 Bailey Hill Road, and property owner on Highway 99,
felt there are higher priorities at present.
Richard Gilbert, 3303 Kevington, is in favor of the project but not
in its. present form. He feels Federal aid should be sought.
Donald Roberts, Highway 99 property owner, is opposed to the funding, but
e not the project.

Donald J. Moorehead, 3590 Dove Lane, manager of Dorsey Buslines, feels .
the staff proposal is unsafe for school buses on Highway 99N. All
traffic stops when school buses do unless there is a solid barrier.
With four feet on the right hand side plus a six-foot bike path, it invites
motorists to pass illegally on the right side allowing no protection for
passengers. Also, it clogs up the area without a shoulder area as is
present now. He is opposed to the center median. It seems a refuge
area, he said.
Public hearing was closed, there being no further
testimony presented.
Public Works Director responded that the bike issue does not have to
be settled at this time. If a decision were made to remove the bike
lane, it would be merely a matter o~ removing the band. The cross
section would be identical. Re Federal funding, that is a long and
arduous process, with no assurance of funding.
Al Williams, Traffic Engineer, maintained it is unfair to base decisions
on present number of pedestrians. Experience has shown that that should
not be the basis of those kinds of decisions. When facilities are
available, they do become used. Re: proposed striping for bike lane,
he said the Bike Committee has reviewed this corridor carefully and feels
in their judgment that the design and the inclusion is still valid.
Re: school bus situation, he does not know if school buses will still
be run on Highway 99 with the construction of the sidewalk because the
school district may be in a position to eliminate some bus routes. .
Mr. Haws moved, seconded by Mr. Hamel, to postpone
a decision until the next regular meeting October 11,
pending staff response to material submitted "tonight".
Motion carried unanimously.

was read by council bill number and title only, there
being no Council member present requesting it be read

Mr. Haws moved, seconded by Mr. Hamel, that findings supporting the
rezoning as set out in Planning Commission staff notes and minutes
of August 3, 1976 be adopted by reference thereto; that the bill be
read the second time by council bill number only, with unanimous .

The following council bill, read the first time on September 13, 1976 and
held lacking unanimous consent for second reading at that time, is brought
back for second reading and adoption of findings.
C.B. 1234 - Rezoning to C-2 SR area at southeast corner of 29th
Avenue and Willamette Street was read by council bill
number and title only, there being no Council member
present requesting it be read in full.
Mr. Haws moved, seconded by Mr. Hamel, that findings supporting the rezoning
as set out in Planning Commission staff notes and minutes of July 26, 1976,
be adopted by reference thereto, and that the bill be approved and given
final passage.
Mrs. Beal said a lady had called her saying the matter had not received
enough attention and she wishes to speak. City Attorney noted that if
Council wishes to reopen the matter, it will have to reopne the entire
matter.
Mrs. Beal moved, seconded by Mr. Bradley that the hearing be reopened.
Mrs. Beal felt the matter has rather serious implications on the whole 1990 e
Plan. Also, she does not believe the people concerned about additional
traffic have had an opportunity to voice their feelings.
City Attorney noted that, if reopened, it would necessitate informing
the applicant. Also, he said this is the first time he recalled Council
asking to reopen a quasi-judical hearing. It must therefore be shown
that there was some testimony not available at the time of the first
hearing.
With consent of the second, Mrs. Beal withdrew the motion.
Vote was taken on the motion which failed, with Murray and Hamel
voting aye; Haws, Bradley, Beal and Shirey voting nay, and Williams
abstaining.

Com 9/15/76 A. Lane County Social Services Advisory Committee - Mrs. Beal expressed
Approve interest in filling the vacancy on the above commdttee.
Mr. Keller moved seconded by Hr. Haws to recomnend appointment
of Mrs. Beal to the County Social Services Advisory Committee.

Com 9/15/76 B. AFSCME Opposition to Charter Revision - Mrs. Beal requested explanation
File of AFSCME's recent action in expressing opposition to the revised charter
provisions on collective bargaining. Community Relations Director
explained that a statement by the city in response is being released to
the media. "today" and Personnel Department has wri tten a letter to
AFSCME as well.
Manager further noted Personnel feels that Mr. Smith of AFSCME originally
agreed to the charter revisions and then subsequently reversed his position.
Com 9/15/76 C. Skinners Butte Cross Inclusion in Charter - Mr. Bradley wondered if Council
File or staff had a position, in light of the recent Supreme Court decision
upholding renr:>val of the cross, on whether it should be inc1 uded in the new
e- charter or weeded out.
Manager has asked the City Attorney about a clause that, in the event the
Supreme Court upheld the decision, there would be automatic deletion from
the charter. The Attorney felt that could not be done since litigation was
in process at that time. Now there can be no change since the revised
charter has been presented to the voters.
Com 9/15/76 D. Citizen Interest Forms Month - Mr. Murray mentioned that October is Citizen
File Interest Form Month - time for letters to be sent to those whose terms are
expiring as well as advertising for citizens interested in filling vacancies
on boards and commissions during the year to complete a form.
Com 9/15/76 E. Speed Zoning - Council has previously discussed the subject of speed zoning
File and Mr. Murray wishes the subject re-opened in light of recent complaints
he has received, particularly regarding Oak Patch Road.
Manager explained the City has had problems, and is in a standoff deadlock,
in resolving certain speed zoning matters with the State Speed Control
Board. Staff suggests that the old and new Council meet in November along
with staff to attempt to resolve conflicts with the State Board regarding
unrealistic limits, etc.
Com 9/15/76 F. Air Pollution Resolution - The proposed resolution accepts the adoption of
Approve the State Implementation Plan for the phase-down of open field burning
but suggests that no further open burning should be allowed after 1978. .
-- The State Plan reduces the acreage burned by open field methods to 50,000
e acres by 1978.

Com 9/15/7$. Amendment to Grant Agreement through FAA - The grant agreement is for
Approve airport capital improvements, and the amendment, which must be submitted
by September 28, increases the FAA share by $7,900.27 - to a total of -.
$113,436.27 on the project completed in 1975.
Mr. Keller moved seconded by Mr. Haws to adopt the resolution.

Com 9/15/7&1. state Revenue Sharing Program Meeti~ - Manager announced that the League
File of Women voters and the Chamber of Commerce are sponsoring a state
revenue sharing task force meeting at 7 :30 p.m. on September 27, with
Mayor Goldschmidt of Portland to be in attendance. He said it would be
helpful if all council members were to attend.
Com 9/15/7f1. Planning Commission and ERA Appointments - After Council discussion, it
Affirm was agreed to select finalists at 11:00 a.m. Wednesday, September 22,
with interviews conducted beginning at 5 p.m. Monday, September 27, prior
to the state revenue sharing task force meeting.

IV - Vacation of 36th between Hilyard and West Anazon - First and second reading
Com 9/15/760f the ordinance on the vacation was November 24, 1969. It was held for

the payment of certain sums of money to the city. Payments ha ve now arrived
and all is in order. Staff recommends finalizing the vacation.
Mr. Keller moved seconded by Mr. Haws to schedule final reading
for September 20. Motion carried unanimously.
Com 9/1g/76Amendment to Sign Code re: Sign Code Board of Appeals - Section 8.802 - August
Pub Hrg 3 reports from Planning Department have been distributed to Council, regarding
amendment to the sign code as it affects the operation of the sign code board
of. appeals. The amendment calls for election rather than appointment of
the chairman, defines what constitutes a quorum, and requires a majority vote
of, the members present rather than a concurring vote of three members.
Mr. Keller moved seconded by Mr. Haws to call a public hearing for
September 20. Motion carried unanimously.
VI - Amendment to Zoning Ordinance re: Fences and Walls in Front Yards in Residential

IX - Friendly Neighbors Petition Re: "Dragging the Gut" - Letter accompanying
Com 9/15/76 petitions has been distributed to Council along with Public Works Department
Affirm menrJ and menrJ Erom Manager's office outlining the history oE "dragging the
gut" on Willamette.
The problem began in 1940 and -has nrJved southward as street improvements were
made. Assistant Manager said that the majority oE misdemeanor arrests occur
in that area. StaEf is not totally optimistic about reducing the problem to a
satisfactory level and Eeels caution should be exercised so as not to simply
displace the problem to a far worse location.
. Jon Sil vermoon, 47~ W. 25th, stated he has been working with Public Works
on the problem of traffic on the side streets. Meetings have been held in
the neighborhood as well. Mr. Silvermoon said the problem seems to be more than
one of law enforcement. He added that, in talking to SOme of the cruisers, they
have said they would do it in spite of law enforcement, some said they would go
to a speedway if available and some would favor a night club for minors. Mr.
Silvermoon asked that Council commit itself to solving the problem.
Rosalie Lemert, 10 E. 40th, agreed with Mr. Silvermoon that there is merit in
developing alternatives as well as continuing the law enforcement effort.
Virginia Gregory, 2760 Willamette, Manager of the Olympic Villa Apartments,
stated her tenants feel they are getting a "raw deal", that some other area of
town should "host" the problem for a time.
City Manager noted that, in staff discussions, suggestions have included
redesign oE the street, as well as stepping up oE police enforcement activity.
Acting Police Chief Pat Larion said the problem cannot be totally eliminated
in a free society. All that can be done is to attempt to bring the problem
within at least tolerable limits. The Police Department has assigned seven
officers to the area both Friday and Saturday nights to handle violations.
Captain Larion said that several years ago 40 police personnel set up road
blocks and cleared the area in about l~ hours. As a result, someone wrote
to the attorney general saying the right to drive on a public street was
- violated; the attorney general then responded that the police were constitutionally
. wrong in their actions. Captain Larion also Eeels that creating diversionary
activities will not help that much - these individuals wish to drive their cars

up and down the street, meet people, talk and mingle. Assistant City
Manager added that a 1971-72 study on the cruising phenomenon revealed --.
that these individuals do not want to be separated from their cars for
more than 20 minutes. Their car is an extension of their ego. He said
too that staff feels efforts to alleviate the side-street traffic would
be successful but that relocating the cruising to some other locale would
hpve a more serious impact because of higher residential density in other
areas.
Glen Stadler disagreed that an individual has a constitutional right to drive
a' car - he contends it is a privilege. Captain Larion responded he meant
that law enforcement officers cannot prevent an individual from driving
on a particular street as opposed to another street.
Mr. Bradley suggested looking at theproblem in terms of education of the
youngsters now so that their desired activities will not include "dragging
the gut" by the time they reach driving age. He also suggested that perhaps
the business people on Willamette could block off their parking lots on Friday
and Saturday, or perhaps some "substitute dragging the gut" areas could be
established. He also mentioned the possibility of the City's Technology
Coordinator working on the problem. "He has come up with other innovations
which have impressed me", said Mr. Bradley.
Sam Silvermoon, 47~ w. 25th, wondered about enforcement efforts due to high
noise level. captain Larion said many of the arrests were due to a noise
violation.
Mr. Haws suggested that the problem might best be assigned to the new Youth
Commission. --
Mayor Anderson does not feel the whole problem should be dumped in the
Youth commission's lap. He feels they could be involved in the process
along with residents, police, traffic department, etc. and he feels too that
neighborhood groups could render valuable assistance.
At Mayor Anderson's suggestion, it was understood the matter would be brought
back to the September 22 Commi ttee meeting; in the meantime, Council can
consider various proposals for studying the problem.
X - Annexation of property belonging to Lane County, Dale Fisher and S.P.

September 20 and authorize preparation of a resolution. Motion
carried, all council members present voting aye except Mr. Hamel
abstaining.
XI - Rate Increase - Airport Limousine Service - Reports have been distributed to
Com 9/15/76 .Council indicating that the Airport Department recommends a 20% increase in
Pub Hrg service between the airport and the Eugene Hotel. The Airport Commission
recommends approval of the increase to $3.00.

4ItIV. Ordinances
. The following council bill, read the first and second time on November 24, 1969,
and held pending agreement between the city and Robert Suess concerning considerations
about the vacation, is brought back for final reading and approval.
C.B. 9029 - Vacating 36th Avenue from east margin of Hilyard to west margin
of West Amazon Drive, subject to reservation of utility easement
was read by council bill number and title only, there being no
council member present ,requesting it be read in full.
Mr. Haws moved, seconded by Mr. Hamel, that the bill be approved and given final
passage. Rollcall vote. All Council members present voting aye, the bill was
declared passed and numbered 17767.
V. Resolutions
Res. No. 2562 - Concerning Oregon State Implementation Plan (field burning) was
read by number and title.
