HomeMy WebLinkAbout10/05/1977 Meeting M I NUT E S e EUGENE CITY COUNCIL October 5, 1977 Adjourned meeting from September 28, 1977, .of the City Council of the City of Eugene, Oregon, was called to order by His Honor Gus Keller at 12:00 noon at King's Table, Oakway Mall, with the following Council members present: Eric Haws, D. W. Hamel, Ray Bradley, Jack Delay, Scott Lieuallen, and Betty Smith. Tom Williams and Brian Obie were absent. I. Items from Mayor and Ccuncil A. Dragging the Gut Experimental Program--Mr. Bradley questicned why the temporary barricade .on 24th Place had been remeved. Don Allen said it had been installed to record traffic counts. The intent is to replace it with a gate~which is in process now. B. League of Oregon Cities Task Force--Mr. Delay expressed interest in serving .on the Energy Task Force and wondered if City wculd reimburse expenses. City Manager replied it would. C. Department of Ccmmerce Economic Development Brochure--Mr. Delay ex- pressed thanks for receiving the brechure and requested information regarding two statements: 1) the program very definitely has a multi-county orientation; and 2) the definitien .of a grcwth center as a necessity which ccntrasts with the satellite concept. John Porter e will relay those concerns to Ed Whitelaw fer discussion October 19. D. Tree Preservation Committee--Mayer is in process .of making selection and will present final committee membership October 12. E. Council Assistance--Memc distributed to Council. Manager noted this outlined dates for steps in the process, with jOb descriptions hopefully to be presented next week. Council would be asked for input at that time. F. Southwestern Oregon American Institute .of Architects Special Award-- Manager presented to Mayor, on behalf .of the City, the award recog- nizing the City of Eugene for its role in develeping and continuing to refine Eugene-Springfield Metropolitan Area 1990 General Plan. G. Neighberhood Organizatien Report--Manager called to Council's atten- tion the repert which summarizes activities and accomplishments te date. He noted this would be a chance for evaluating the neighbcr- hood organizations. H. League .of Oregon Cities Ccnference--Infcrmation distributed to Council. Manager asked Council to cemplete the forms indicating desired participation in various events. He noted the difference in cost of $15 for one day's attendance as oppesed tc $25 for attendance for three days. He requested hotel preferences and e request forms be executed and turned in to the Manager's office as soon as possible. 10/5/77--1 /54 - II. Revised Civic Center Prcject Six-Mcnth Action Schedule-- Schedule distributed to Council. Manager noted one change in that Ccuncil action was requested relative . October 31 meeting fcr selecticn of the architect. Ccuncil has no meeting scheduled then and he suggested a special meeting November 7. Dean Baumgartner, Civic Center Director, repcrted to Ccuncil 26 appli- cations had been submitted for architectural responses. A subccmmittee has been set up to review and select finalists. He requested Counci 1 consider action either November 2 .or Nevember 7 for selectien to allow letting a contract fer the first 45-day phase. He noted the dates on the schedule were maximum-completion dates, that most wcrk would be completed before these dates. He felt ccnfident the schedule .of ground- breaking in the fall of 1978 could be met. The Civic Center Commission is leoking at twe different kinds of facilities: a theater which would seat as few as 300 tc 500 persons .or a maximum of 2,200 tc 2,800; and a multi-purpcse center .of 35,000 tc 50,000 square feet. He ncted the Commission was net looking at a larger sports arena at this time, pend- ing the outccme .of the Fair Board's prope~al for the latter. Ms. Smith wondered if the Ccmmissien were leeking at a pcssible May bond issue electien. Mr. Baumgartner replied the Cemmission would be ready at that time, but was mcre geared te a fall electien. Mr. Haws wondered why the overwhelming respcnse .of 26 applicants for the architectural selection had occurred, and whether the selecticn could be limited to a Eugene-Springfield architectural firm to encour- age local econemy. Mr. Baumgartner replied the Commission was very e definitely lceking at a lccal firm whc would have the kind .of expertise necessary .or cculd obtain it. The Ccmmissien wculd like to use a lccal firm as the lead architectural firm and had only asked fcr six applica- tions, but had received 26, indicating this to be a very werthwhile project as 20 national firms wish to be considered. Mr. Lieuallen neted his previeusly expressed cencerns regarding holding to a strict time schedule as cppcsed to getting the job done preperly. He had nc cbjecticns to what had been presented to him, but he hoped the Ccmmission did not feel pressured to adhere strictly to that time schedule. He hoped Council wculd give the Ccmmission suppcrt in taking the time it needed tc complete the prcject prcperly. He concurred with the idea of finding a lccal architectural firm to be the lead coordi- nator for the project as .one possible way to proceed. In pursuant discussion, it was noted the Commission had scheduled a public hearing November 9 for site selection and would prefer tc have Council's selectien of the architect dcne prier tc that time se the architect could participate in the site selection process. No. 2766--Authorizing acceptance .of treatment plant design was read by number and title. Mr. Haws moved, seconded by Mr. Hamel, to adopt the resolutien. Roll call vote. Motion carried unanimously. IV. Loan Agreement by which Three Agencies Support Matching 25% for Grant-- Memo and agreement distributed. Manager noted this would authorize the City's matching suppcrt, with the percentage based en usage as set out in the jCint power agreement signed by the three jurisdicticns. He introduced Mr. William Pye, Manager, Metropolitan Wastewater Commissicn, whc was available tc answer questions. Mr. Haws questioned the basis for the percentage, whether it was on actual usage, or potential usage, as he wanted to be sure the City did not pay for more than its fair share. Mr. Pye replied it was based on the agreement forming the Wastewater Management COllll1ission, referring to Section XIII--"the administrative .or other expenses of the CClll11issien pricr to the adcption of a financial plan and receipt of revenues there- from shall be borne 63 percent by Eugene, 24 percent by Springfield, and 13 percent by Lane Ccunty, subject to bUdgetary limitations .of the governing bodies." The 25 percent being requested from the City of e Eugene is its share of the first nine months' estimated cost .of waste treatement facilities planning. The City will be paid back its invest- ment by the direct sale of bonds at a later date. Ms. Smith noted'the Springfield City Council had apprcved the agreement Monday and the Lane County COlll11issioners had approved it Tuesday. Mayc r Keller noted the .original agreement had been set up on a population basis and implemented also as to what the suggested plant cculd handle. Res. Ne. 2767--Authorizing an agreement with the Metropelitan Wastewater Management Commission concerning Eugene's share of the nine-month estimated ccst of waste treatment facilities planning was read by number and title. Mr. Haws moved, seccnded by Mr. Hamel, to adcpt the resolution. Rell call vote. Motion carried unanimously. V. Status Repert of Funding for High Cost Bikeway Facilities--Memo distributed to Council. Manager said this report was in response to a request by a Ceunciler, and noted the meme listed the various facilities and possible fundings, with therecommendaticns that the Bicycle Committee prioritize its requests for facilities. e 10/5!7 7--3 iSY. ----.- ~ Don Allen reported the staff had checked .on all pcssible funding seurces <- and found no funds available at this time. It was staff's recommendaticn to prepare additienal applications for submissien to be on file in case . some funds become available. He ncted for Council there was no response to the questicn in reference to the Amazon West bikepath. He noted it would be bid this spring under the current budget prccess. Mr. Haws questioned the establishment .of a bike path at the end of Rocsevelt, acrcss the railrcad tracks, and across the river. Mr. Allen replied that item was listed as No.2 .on the distributed memc. Staff did not feel it to be a viable prcject until the ESATS matter is settled. It might be incorpcrated in that study and could be funded through that project. He said that process would be ccmpleted by the end .of July 1978. Mayor Keller expressed appreciaticn te Mr" Allen for the infcrmaticn supplied. Mr. Allen ncted also fcr Council that staff had been very successful in getting mcney for prejects and were continually en the alert trying to find additional funds .other than the general fund fcr these facilities. VI. Calling public hearing Octcber 24 fer Assessments at 10th and Oak Overpark C.B. 1550--Calling public hearing Octcber 24 to levy assessments on preperty at nerthwest ccrner .of 11th and Oak fer cest .of 10th and Oak Overpark was read by council bill number and title only, there being no Ccuncil member present requesting it be read in full. - Mr. Haws moved, seccnded by Mr. Hamel, that the bill be read the seccnd time by council bill number .only, with unanimous consent of the Council, and that enactment be censidered at this time. Moticn carried unanimously and the bill was read the second time by ceuncil bill number only. Mr. Haws moved, seconded by Mr. Hamel, that the bill be apprcved and given final passage. Rcll call vote. Calling public hearing November 9, 1977 for street and easement vacations C.B. 1551--Calling public hearing November 9, 1977 re: right-of-way vacation lccated between South Willamette and Donald Streets seuth of Ccachman (Leavitt) (SV 77-4) was read by council bill number and title only, there being no Council member present requesting it be read in full. Mr. Haws moved, seccnded by Mr. Hamel, that the bill be read the seccnd time by ccuncil bill number only, with unanimous consent .of the Council, and that enactment be censidered at this time. Motion carried unanimcusly and the bill was read the second time by council bill number .only. Mr. Haws moved, seconded by Mr. Hamel, that the bill be approved and given final passage. Mr. Haws moved, seccnded by Mr. Hamel, that the bill be read the second time by council bill number only, with unanimous censent of the Council, and that enactment be ccnsidered at this time. Motion carried unanimeusly and the bill was read the seccnd time by council bill number only. Mr. Haws moved, seconded by Mr. Hamel, that the bill be approved and given final passage. No. 2770--Setting fcrth services provided by the City .of Eugene as required under Oregon Revised Statutes to be eligible to receive state Shared Revenues was read by number and title .only. Mayor Keller recalled that one requirement for receiving revenue funds from the state was a five-year financial plan and wendered how that was progressing. Assistant Manager replied Council would be briefed .on that plan by the end .of December or first of January. Mr. Haws moved, secended by Mr. Hamel, tc adcpt the resolution. Roll call vote. Metion carried unanimeusly. X. Request tc Federal Gevernment tc Pretest Abeve-Greund Nuclear Testing Res. No. 2771--Concerning the atmospheric testing .of nuclear weapons .or devices by the People's Republic of China was read by e number and title. Mr. Haws moved, seconded by Mr. Hamel, to adcpt the resoluticn. Ro 11 ca 11 vcte. Motion carried unanimously. XI. Approval .of Ceuncil Minutes Mr. Haws moved, seconded by Mr. Hamel, to apprcve Council minutes da ted : September 13, 20, and 22, 1976; Ncvember 8 and 22, 1976; December 13 and 20, 1976; September 26 (special meeting) and 28, 1977 . Roll ca 11 vete. Moticn carried unanimously. XI 1. Constructien en Spy Glass Drive Mr. Hamel requested staff information regarding the development .on Spy Glass Drive off Cal Ycung. He noted a great concern regarding wood homes being built in a wcoded area with .only .one entrance and one I exit. Manager replied.John Perter, Planning Department, wculd respcnd. XI II. Field Burning Maycr Keller said he would share with Council next week a letter from Senate President Jason Boe and a letter frcm the seed industry in which they cancelled twe cenventions that were to be held in Eugene. .- 10 /5 /77--6 1Sr Ms. Smith wondered if there was a request for citizens to give input to the Ci ty. Mayor Keller noted many letters had been received; with e the exception of the above-named twc, most were in favcr of the City's positicn. Mayor wondered if there was seme plan fer response and in- put by the citizens. Assistant Manager said staff was not ready tc receive such input yet, as the attorneys and staff were still doing ground work. XIV. Quasi-Judicial Hearings Scheduled October 10,1977 A.
