M I NUT E S - EUGENE CITY COUNCIL Special Meeting June 29, 1978 -__6 - Special meeting of the City Council of the City of Eugene, Oregon, was called to order by Vice President Ray Bradley at 10:00 p.m., June 29,1978, McNutt Room at City Hall, for the purpose of preparing for a special city budget election to be held August 8, 1978. Councilors present were: Tom Williams, Eric Haws, Jack Delay, Scott Lieuallen, and Betty Smith. Councilors D. W. Hamel and Brian Obie were absent. ------ I. Cal~jLfubli~__~earings July 19, 1978, re: Water Withdrawals Because the public hearings had been called for July 5, 1978, and that meeting was sUbsequently cancelled, it was necessary to call the hearings for July 19, to allow sufficient time for advertising. Res. No. 2949 -- Calling public hearing July 19, 1978 re: Withdrawal from Oakway Water District property located both sides of Arcadia Drive, north of Harlow Road (Tronrud, O'Donnell et al)(A/Z 77-1) was read by number and title. - Mr. Delay moved, seconded by Mr. Haws, to adopt the resolution. Motion carried unanimously. Res. No. 2950 -- Calling public hearing July 19, 1978 re: Withdrawal from Oakway Water District, property located between Calvin Street and Arcadia Drive, north of Harlow Road (Nelson/ Gent)(A/Z 78-1) was read by number and title. Mr. Delay moved, seconded by Mr. Haws, to adopt the resolution. Motion carried unanimously. II. Ca.LLtng )pecia] City Budget Election August 8, 1978 The Budget Committee had approved, by a 7:6 vote, a motion by Eric Haws to adopt staffoption #1 (see attached). C.B. 1710 -- Ordering a special election to be conducted by the Lane County Election Department on the 8th day of August, 1978, for the purpose of submitting to the legal voters of the City of Eugene (1) a measure authorizing the Eugene City Council to levy throughout the City $6,020,749 more in tax revenues than is not authorized by the Oregon Constitution, Art. XI, Sec. 11; adopting polling places, and providing for all acts necessary for the carrying onof said election; and declaring an emergency was read by council bill number and title, there . being no Councilor present requesting it be read in full. Haws moved, seconded by Mr. Delay, that the bi 11 be read the second time by council bill number only, with unanimous - consent of the Council, and that enactment be considered at this time. Ms. Smith moved, seconded by Mr. Lieuallen, to amend the motion to reduce the property tax levy by $668,086. This would take the recommended resource adjustments of $200,000, and the deferred capital improvements of $100,000; delay new hires for a total of $170,000 and eliminate the Building permit counselor for $13,700, the Police Department's word processing center for $30,147, the Police Patrol Supervisor for $37,430, and Housing for $50,000. The adjusted tax levy outside the six percent limitation would be $5,732,992. Mr. Delay stated he felt the public voted for convenience sake. He said this was a nonsense cut and that the budget should be presented to the people on its own 1 eve 1 . Mr. Henry said that last year there was much less property tax increase. He believed that this budget will have to be cut at least as Ms. Smith requested. Vote was taken on the amendment to the motion, which carried with Lieuallen, Delay, and Smith voting aye; Haws and Bradley voting no; and Williams abstaining. It was noted the main motion would then be levying a tax of $5,732,992. - Vote was taken on the main motion, which carried unanimously, and the bill was read the second time by council -bill number only. Mr. Delay moved, seconded by Ms. Smith, that the bill be approved and given final passage. A lengthy and heated debate took place, with a threat from Mr. Williams to vote II no II and eliminate the possibility of an August election. He stated his great dis- satisfaction as to the process the Council was following, and suggested the meeting be adjourned without further action. Mr. Williams felt the Council's action did not give dignity to the Budget Committee's process. He said he wanted the Budget Committee back for another meeting. Mr. Bradley raised the question as to what impact this would have on the August or September election. He said it was the Council's responsibility to give voters something to vote on. Ms. Smith said that without the unanimous support from the Committee and Council, how could anyone even expect the budget to pass an election. She suggested the Budget" Committee be reconvened July 5, 1978 to inform them of the different position taken by the Council. Assistant Manager said this date was not practical because of the holiday weekend, and suggested that the Budget Committee reconvene at a more convenient time. Council agreed to meet the week of July 10, and suggested that possibly Monday, July 10, before the regular Council meeting would be best. Finance . Administration will poll the lay budget members. Special Meeting 6/29/78 -- 2 I ""2. ~ ~ Mr. Williams then consented to approve the motion after Council agreed to reconvene . the Budget Committee to inform them of the Council's action, with the possibility of actually levying less property tax than is nresently being submitted. Vote was taken on the motion. All Councilors present voting aye, the bill was declared passed and numbered 18221. Res. No. 2951 -- Setting forth the ballot measure to be voted on in a special election August 8, .1978, was read by number and title. Mr. Delay moved, seconded by Ms. Smith, to adopt the resolution.
