HomeMy WebLinkAbout05/16/1979 Meeting - M I NUT E S EUGENE CITY COUNCIL May 16, 1979 Adjourned meeting from May 14, 1979, of the City Council of the City of Eugene, Oregon, was called to order by His Honor Mayor Gus Keller at 11:45 a.m., Council Chamber, with the following Councilors present: Jack Delay~ D. W. Hamel, Eric Haws, Scott Lieuallen, Gretchen Miller, Brian Obie, and Emily Schue. Councilor Betty Smith was absent. I. ITEMS FROM MAYOR AND COUNCIL A. Lane Council of Governments Study Ms. Schue told the Council that the rough draft of the L-COG Study commissioned by the Board has been presented and will soon be completed. B. Request to Reconsider Systems Development Tax Exemption Mr. Obie noted that the Easter Seal School had asked the Council for an exemption from the Systems Development Tax for the new therapy pool. He asked for staff recommendations for a pOSitive way to handle this request. Manager noted that preliminary work by the legal staff had indicated that it could not be exempted. He asked if the Ordinance could be amended to deal with this situation. Manager said that they would re-study the issue. e C. Economic Development Application Mayor noted that the Economic Development applications are coming in. Not all positions are filled at this time. It is hoped that, by the end of the month, responses will be back and the review process will begin. D. Tri-Agency Dog Control Meeting Mayor met with the Mayor of Springfield and the County Commission Chairman and staff last week. There will be a proposal from the Director of Tri-Agency Dog Control in two weeks. E. Youth Commission Appointments Manager noted that because of more than three absences in a 12-month period Pam Maillet and Tim Chase will be replaced by alternate Sally Reidy, 2207 Harris, and Dorothy Ford, 3846 Peppertree Drive, to fill the respective unexpired terms. - Mr. Delay moved, seconded by Mr. Hamel, to appoint Sally Reidy to fill an unexpired term ending January 1, 1982, and Dorothy Ford to fill the unexpired term ending January 1, 1980. Motion carried unanimously. 5/16/79--1 27~ F. CETA Council Manager noted CETA is forming a five-member private-industry council . (PIC): five are assigned to the City of Eugene. Eugene has been requested to submit names. There is very little time; the names are needed by next week. Mr. Randy Miller explained that there is a new Title VII~ Private Initiatives Program. One of the prerequisites of getting into that program is establishing a private-industry council, two members from small business (fewer than 500 employees) one representative from community-based organizations with a record of demonstrated effective- ness with the business community, one member from an educational agency or institution with a record of effectiveness in providing education or vocation training oriented to the needs of the business community, one member from apprenticeship training. The appointees' names have to be back to the Employment and Training Division by 5 p.m. on May 25. This item will be on the Council agenda next week and in the ensuing week they will be recruiting and selecting candidates. G. Meeting Schedule 1. Governor's Commission on Growth--May 16, 1979, 7:30 p.m., Council Chambers. It will be a discussion of the T-2000 Plan. II. ROUTINE ITEMS FOR COUNCIL APPROVAL A. Council Minutes--May 2, 1979 Mr. Delay moved, seconded by Mr. Hamel, to approve Council minutes as noted. Motion passed unanimously. . B. Res. No. 3142--Concerning application of grant for Federal Environmental Protection Agency funds to establish a Noise In Control Progra~ Manager noted that this is a Noise Control in Eugene Grant. The Grant as outlined in the memorandum is for $54,000 a year, running for two years. The matching money is $2,880. It would add two Police personnel within the Patrol Division budget. Dr. Doug Moore indicated that Federal funds were available and noise was an increasing problem in Eugene. Mr. Hamel asked what happens to the two positions at the end of two years. Dr. Moore said they would like to add them to the roster. He said they give the Federal government a good-faith intention, but a commitment to hire is not necessary. Ms. Schue asked if it will affect the Willamette Gut on weekend nights. Dr. Moore said definitely, it would; one test site would be the Willamette area. e 5/16/79--2 ~5 . Calling Public Hearing June 27, 1979, re: Alley Vacation CB 1900--Calling public hearing June 27, 1979, re: Alley vacation located north on Second Street, west of Taylor Street (Ralls) (AV 78-3) and retaining public utility easement over the entire area was read by number and title only, there being no Councilor present requesting that it be read in full. Mr. Delay moved, seconded by Mr. Hamel, that the bill be read the second time by council bill number only, with unanimous consent of the Council and that enactment be considered at this time. Motion carried unanimously and the bill was read the second time by council bill number only. Mr. Delay moved, seconded by Mr. Hamel, that the bill be approved and given final passage. Roll call vote. All Councilors present voting aye, the bill was declared passed and numbered 18395. AIRPORT USER CHARGE RATES FOR LIQUID WASTE DISPOSAL Manager noted the Resolution attached. He said the old Ordinance needed to be repealed. Mr. Long said that when the 1971 Code was adopted this ordinance was not repealed. The new Code says that charges are set by resolution. CB 1901--Concerning user charge rates; repealing Ordinance No. 13657; and declaring an emergency was read by number and title only, there being no Councilor present requesting that it be read in fu 11 . Mr. Delay moved, seconded by Mr. Hamel, that the bill be read the second time by council bill number only, with unanimous consent of the Council and that enactment be considered at this time. BALLOT MEASURE RE: PARK LAND ACQUISITION CB 1906--Authorizing ballot measure June 26, 1979, converting balance of ~ $4.0 million Park Serial Levy to a 20-year General Obligation Bond issue and declaring an emergency was read by number and title only, there being no Council member present requesting that it be read in full. Mr. Delay moved, seconded by Mr. Hamel, that the bill be read the second time by council bill number only, with unanimous consent of the Council and that enactment be considered at this time. Motion carried unanimously and the bill was read the second time by council bill number only. Mr. Delay moved, seconded by Mr. Hamel, that the bill be approved and given final passage. Roll call vote. All Councilors present voting aye. The bill was declared passed and numbered 18397. Res. No. 3144--Revoking the authorization by the voters of the City on September 21, 1976, for an annual levy for acquiring park land and authorizing the City Council to issue general obligation bonds in the amount of $4 million for acquiring park land was read by number and title. Mr. Delay moved, seconded by Mr. Hamel, to adopt the resolution. Roll call vote. The motion carried unanimously. V. BALLOT MEASURE RE: 1979-80 TAX RATE e Manager reported on the action taken by the Budget Committee on a split vote 8-5. The Budget Committee decided on a total budget figure of $28,329,670. That was more than was recommended. It was a total budget increase of 8.6 percent. The Budget Committee was also split on how to finance the budget. The alternative measures being suggested were approved by the same split vote. Manager went over 15 items on a memorandum entitled "Possible Further Adjust- ments to Recommended 1979-80 Budget." If these deletions were made, the budget would be a 7.6 percent increase. The total deletions were $274,640. Manager explained the proposed cuts. He said he wanted a ballot measure that will have a reasonable chance of passing on the June ballot with a high level of consensus within the Council. If the measures do not pass, the next election is in August or September. If the measure does not pass on either of those, a November election will be necessary. Mr. Obie asked how much of an increase in property taxes this represents. Manager told him it was an increase of 19.5 percent. Mr. Lieuallen objected to the new positions in Police being cut. He urged funding in order for the Police to take a creative approach to problems. Mr. Obie agreed with Mr. Lieuallen. e 5/16/79--4 2il . Mr. Obie said that a 7.6- or 8-percent increase in expenses is very reasonable, but 22.8- or 25-percent increase in property taxes is unreasonable. It is a difficult year with the Federal cutbacks to cities. He was concerned about people's ability to pay and felt the City should adjust backwards. We are preparing a minority report to present to the City before the deadline,he said. Manager reported May 22 at 5 p.m. the Council has to deliver their decision to the County concerning a ballot measure for the June election. Mr. Delay noted he would accept the Manager's proposal to cut the budget. He felt that the city was growing and that there was absence of any clear mandate to make that reduction. The 22 or 25 percent seems like a big number; that is why we need to seek another source of income, he said. We should give the people the opportunity to vote on a new revenue source. Mr. Delay moved, seconded by Mr. Hamel, to accept the Manager's recommendations to further reduce the general operating funds with the exception of the two new Police positions. The motion carried 6:1, Mr. Obie voting no. The total reduction was changed to $224,040. Manager said that the Council could pass all the election bills unanimously or they could give first reading to all four and have a meeting Monday night to discuss the tax measures, hold a public meeting, distribute the information, and discuss in depth any of the measures. The Minority Report could be presented Monday night. ~ Mr. Haws left. e Mr. Delay moved, seconded by Mr. Hamel, for first reading at this time and schedule the second readings at a special meeting Monday, May 21, 1979, at 7:30 p.m., Council Chambers. Motion carried, all Councilors present voting aye except Mr. Obie voting no. Mayor asked the Councilors to be aware that the public needs to know if the Council decides that a 22-percent raise in property taxes are what they want. Then, the Councilors must be prepared to sell it. It will be a commitment of time. CB 1902--0rdering special election to be conducted by Lane County Election Department on the 26th day of June 1979, for purpose of submit- ting to legal voters of City of Eugene a measure authorizing the Eugene City Council to levy throughout the City $7,504,210 more in tax revenues than is now authorized by the Oregon Constitution, Article XI, Section 11 adopting polling places and providing for all acts necessary for carrying on election; and declaring an emergency was read by number and title only, there being no Council member present requesting that it be read in full. Mr. Delay moved, seconded by Mr. Hamel, that the bill be read the first time and held over to May 21 for second reading and final action. Motion carried 5:1, Mr. Obie voting no. 5/16/79--5 218 Res. No. 3145--Authorizing the Council to levy for the City in general . $7,753,143 more in tax revenues than is now authorized . by the Oregon Constitution, Article XI, Section 11. Held until May 21, 1979. CB 1903--0rdering Special Election to be conducted by Lane County Election Department on the 26th day of June 1979, for purpose of submit- ting to legal voters of City of Eugene a measure authorizing the Eugene City Council to levy on the ownership of real property in the Downtown Development District $211,568 more in tax revenues than is now authorized by the Oregon Constitution, Article XI, Section 11, adopting polling places and providing for all acts necessary for carrying on said election; and declaring an emer- gency was read by number and title only, there being no Councilor present requesting that it be read in full. Mr. Delay moved, seconded by Mr. Hamel, that the bill be read the first time and held over to May 21 for second reading and final action. Motion carried unanimously. Res. No. 3146--Authorizing the Council to levy on the ownership of real property in the Downtown Development District $211,568 more in tax revenues than is now authorized by the Oregon Consti- tution, Article XI, Section 11. Held until May 21, 1979. Mr. Delay moved, seconded by Mr. Hamel, that the bill be read the first time and held over to May 21 for second reading and final action. Res. No. 3147--Submitting to the voters an ordinance amending the Eugene Code, 1971, which imposes tax on gross receipts of busi- nesses. Held until May 21, 1979. CB 1905--A measure submitting to the voters an ordinance amending the Eugene Code, 1971, which imposes tax on the gross receipts of businesses was read by number and title only, there being no Councilor present requesting that it be read in full. Mr. Delay moved, seconded by Mr. Hamel, that the bill be read the first time and held over to May 21 for second reading and final action.
