M I NUT E S EUGENE CITY COUNCIL May 23, 1979 Adjourned meeting from May 21, 1979, of the City Council of the City of Eugene, Oregon, was called to order by Council President Jack Delay at 11:50 a.m., Council Chambers, with the following Councilors present: Betty Smith, Scott Lieuallen, Eric Haws, D.W. Hamel, Brian Obie, Gretchen Miller, and Emily Schue. Mayor Gus Keller was absent. I. ITEMS FROM MEMBERS OF THE COUNCIL . e A. Systems Development Tax Exemptions Mr. Obie indicated he would make a motion in regard to the Sytems Development Tax at the next meeting. Manager noted the memo distri- buted and indicated this item would be discussed under announcements. B. Request for Report on Building Permit System in the Whiteaker Neighborhood Mr. Hamel said that people in the Whiteaker Neighborhood had been working very hard on the historic part of the area around Skinner Butte. It was their understanding that before building permits were issued they would go before the Historic Review Board. The neighbor- hood feels that when an ordinance is passed it should become effective immediately. Mr. Hamel asked that consideration of this problem be put on the agenda for next Wednesday and that the public be able to testify. Mr. Lieuallen asked staff for an answer to the process being followed. Manager said the City had received the letter and the Public Works Department is pursuing t"e matter. A report will be brought to the Council next Wednesday. Resolution Commending Verner J. Adkison and Extending Sympathy to His Family Res. No. 3157--Commending Verner J. Adkison and Extending Sympathy to his family was read by number and title. C. Ms. Smith moved, seconded by Mr. Lieuallen, to approve the resolu- tion commending Verner J. Adkison and extending sympathy to his family. Mr. Delay said this had been a tremendous loss to the community as well as to his family. In his duties as elected official serving on the Board of Directors of the Lane Regional Air Pollution Authority, he had gotten to know Vernis work. His death was a real loss to the community. Proclamation in Commemoration of the 25th Anniversary of Brown Vs .Board of Education Manager noted this was a nationwide observance on the part of the NAACP. He would forward the proclamation to the Human Rights Commission and to the Minority Commission for their consideration. E. Announcements 1. City Council Meeting. Tuesday, May 29, 1979, 7:30 p.m. Prior to the City Council meeting there will be a presentation of a plaque to a retired employee. After the presentation will be a 30-minute slide show of City projects. 2. ~udget Committee ~eeting. Tuesday, May 29, 1979, 6:45 p.m. 3. Systems Development Tax Exem~tions--Memorandum Distributed. Mr. Long noted the Sytems Development Tax is placed on the owner of land upon which new construction or improvement occurs. The exemptions currently available are listed in the memorandum. Oregon and United States Constitutional limits set standards that tax exemptions ,must meet, the primary principle being the equal protection clause. The classifications for exemptions must be broad and cannot apply to one business or one organiza- . tion. Common exemptions are granted to charitable, religious, ~ educational, and scientific groups. The theory supporting this is that each of these groups in some way relieves the public of a burden it would otherwise have to meet. The exemption from the tax is self serving to the tax body. In creating such exemptions, it is necessary for the City to provide an application and moni- toring process. Creating an exemption for the Easter Seal School from its development tax obligations would involve relieving all similarly situated organizations from their development tax obligations. It was understood that the Attorney's Office would prepare an impact statement and response to the request for exemptions and bring back to Council. F. ~earings Panel May 21, 1979--Verbal Report Manager noted there was not a formal meeting, but four property owners did appear. Public Works thinks it will be able to accommodate their objections in a short time and it will not be necessary to set another date. e MINUTES--Eugene City Council May 23, 1979 2.'t2 Page 2 - G. ~~intment,of Members to lane County Prime Sponsor's Private .1 ndustry Council [PIC} Manager said the Council had been given a week's extension from the 5:00 p.m. May 25 deadline to make appointments. There are four applicants with one position not filled. Mr. Miller asked that four positions be approved at this time and next week the final applicant be approved. Ms. Smith moved, seconded by Mr. Haws, to appoint the applicants who have applied for the PIC and extend the deadline for one week in order to fill the other vacancy. Motion carried unani- mously and the following applicants were appointed: Michael Schwartz, 2390 Lariat Drive; Ray McIver, 2540 Snelling; Carl Horstrup, 1820 Elanco~ and Margaret Battleson, 86187 Franklin. II. ROUTINE ITEMS FOR COUNCIL APPROVAL A. Council Minutes~-May 9, 1979 e Ms. Smith moved, seconded by Mr. Hamel, to approve Council minutes of May 9, 1979. Motion carried unanimously. B. ~alling a Public Hearing June 6, 1979, re: Water Withdrawal Res. No. 3149--Calling public hearing June 6, 1979, re: Withdrawal from Junction City Water Control District was read by number and title. Ms. Smith moved, seconded by Mr. Hamel, to adopt Resolution No. 3149. Rollcall vote. Motion carried unanimously. III. ,REQUESTS FOR OISCUSSION OF JOINT PARKS COMMITTEE [Memorandum distributed] Manager noted the statement [November 22, 1977] defining the general pur- pose and specific guidelines used by the Joint Parks Oepartment in the past. The Committee meets on call. It is not established by ordinance or formalized. The discussion is whether the Committee is to continue and in what form. The request for consideration was from Councilor Lieuallen. Mr. Obie indicated after serving on the Committee a need for a more active and involved Parks Committee. Members at large that are interested in the Parks should be involved and concerned for the long-term planning. The Committee should be responsible to the City Council. When we reach for support for the Parks we will have people concerned, he said. Mr. Lieuallen agreed and asked for a more broad-based Committee. He said the Committee should not be top-heavy with staff. He called for the Committee itself to bring its suggestions back to the Council. .' He would not wish to have a more complex and less efficient ~ committee. The Parks Department works well with the neighborhood groups ,.., and would want to continue that approach. Ms. Schue asked that the meetings be more open and that it be like Joint Housing Committee where the citizens can come and present ideas. Mr. Haws noted that the memorandum seemed to emphasize facilities and he would like to see services stressed as well. Mr. Lieuallen called for a five-to-seven member committee. It was understood that the Joint Parks Committee will be asked to bring recommendations back to the Council. IV. PUBLIC HEARINGS: FINANCIAL ASSISTANCE REQUESTS FOR 1979 [Memo and other material distributed] Manager noted that these requests were approved by the Historic Review Board by unanimous approval March 15, 1979. He introduced Ms. Judy Rees to make a presentation of seven requests. Ms. Rees noted the application for financial assistance for maintenance, restoration, and repair of historic landmarks in the city. The Historic Review Board takes into consideration the resolution of the City Council concerning the allocation of financial assistance monies as well as their own guidelines based on Federal regulations for restoration of historic structures. Ms. Rees referred to "Summary of 1979 Financial Assistance ~ Requests and Historic Review Board Recommendations" for an outline of each project. She told the Council the amount of money of each project and what was requested as outlined in that document. Council members questioned their action last year in refusing a request and asked if there were criteria concerning ability to pay and funding of commercial buildings. (They turned down the Smeede Hotel request last year.) Ms. Rees said they had checked and found no basis for turning down such a request. Manager said one concern expressed last year was whether there were any guidelines on ability to pay for restorations. No ex parte contacts or conflicts of interest were declared by Councilors except Mr. Haws who abstained concerning No.3 (Christian House). Staff notes and minutes were entered into the record. MINUTES--Eugene City Council May 23, 1979 Page 4 ~~ e Martha Filer, 235 East 3rd, Whiteaker Neighborhood Advisory Group, spoke for the restoration of the balustrade at the Oregon Electric Depot and for repainting of the Lane Building in its original colors. She stressed the need to continue the historic preservation of that intersection and indicated that neighborhood improvement work by the University as well as the neighborhood was progressing. Rose Grant, 2991 Harlow Road, owner of the Harlow House, emphasized the need for the house to be painted in its original colors. Sharon Poticha, 767 Willamette, told the Council as of yesterday they had a barricade at the corner of the Smeede Hotel Building and hopefully no more damage can be done to the canopy of the Hotel. Public hearing was closed, there being no further testimony. Res. No. 3150--Authorizing financial assistance request for the Oregon Electric Depot in the amount of $5,000 was read by number and title. Ms. Smith moved, seconded by Mr. Lieuallen, that findings suppor- ting financial assistance as set forth in Historic Review Board staff notes and minutes of March 15~ 1979, be adopted by reference thereto; and that the resolution be adopted. Roll call vote. Motion carried unanimously. e Res. No. 3151--Authorizing supporting financial assistance for the Harlow House in the amount of $2,500 was read by number and title. Ms. Smith moved, seconded by Mr. lieuallen, that findings suppor- ting financial assistance as set forth in Historic Review Board staff notes and minutes of March 15, 1979, be adopted by reference thereto; and that the resolution be adopted. Roll call vote. Motion carried unanimously. Res. No. 3152--Authorizing financial assistance request for the Christian House in the amount of $847 was read by number and title. Ms. Smith moved, seconded by Mr. Lieuallen, that findings suppor- ting financial assistance as set forth in Historic Review Board staff notes and minutes of March 15, 1979, be adopted by reference thereto; and that the resolution be adopted. Roll call vote. Motion carried, all Council members present voting aye except Mr. Haws abstaining. Res. Ms. Smith moved, seconded by Mr. Lieuallen, that findings suppor- ting financial assistance as set forth in Historic Review Board staff notes and minutes of March 15, 1979, be adopted by reference thereto; and that the resolution be adopted. Roll call vote. Motion carried unanimously. Res. No. 3156--Authorizing financial assistance request for the Soults- ~ Westfall Duplex in the amount of $5,000 was read by number ~ and title. Ms. Smith moved, seconded by Mr. lieuallen, that findings suppor- ting financial assistance as set forth in Historic Review Board staff notes and minutes of March 15, 1979, be adopted by reference thereto; and that the resolution be adopted. Roll call vote. Motion carried unanimously. V. ORDINANCE CHANGES RE: APPOINTMENT PROCESS FOR CITY BOARDS/COMMISSIONS Manager noted that this ordinance was not prepared and would be presented at a later meeting.
