Home My WebLink About06/11/1979 Meeting M I NUT E S EUGENE CITY COUNCIL June 11, 1979 - Regular meeting of the City Council of the City of Eugene, Oregon, was called to order by His Honor Mayor Gus Keller at 7:30 p.m., Council Chambers, June 11,1979, with the following Councilors present: Jack Delay, D. W. Hamel, Eric Haws, Scott Lieuallen, Brian Obie, Gretchen Miller, Emily Schue, and Betty Smith. I. REPORT ON SISTER CITY KAKEGAWA VISIT BY DR. ROBERT CLARK, SISTER CITY PROGRAM CHAIRMAN Dr. Clark introduced some of the members who visited the sister city. A detailed draft of the visit will be finalized and filed with the City. He showed a picture of the famous Kakegawa Bridge. He stressed the serious- ness of the growing relationship between the two cities. They visited schools, iris gardens, tea fields; stayed in Japanese homes; exchanged gifts; attended formal banquets. .A poster of pictures was distributed and it was requested that Carol Baker develop some posters for further distri- bution. Mayor Keller received an elegant fabric picture from the Mayor of Kakegawa. A delegation from Kakegawa headed by the Mayor will be in Eugene August 3 through August 5, and Council voiced their thanks and support for the program. II. PUBLIC HEARINGS e A. . Rezoni ngs 1. Rezoning from M-2/SR Limited Industrial District and Industrial Sign District to R-1 Single-Family Residential with Residential Sign District property located on the west side of Bertelsen north of 18th (Hecker) (79-8 )-- (Map di st ributed )--Unanimously recommended by the Planning Commission on April 3, 1979. Mr. Greg Byrne said that the rezoning involves a single tax lot bounded on three sides by residential zoning; a single tax lot to the south retains limited M-1 industrial zoning. No ex parte contacts or conflicts of interest were declared by the Councilors. Staff notes 'and mi flutes were entered into the record. Public hearing was held, and Mr. Jim McAlexander, representing Dick Becker, endorsed recommend~tion of staff and said that he. is available for questions from City Council. Public hearing closed. ~ 6111/79--1 321 CB 1903--Authorizing rezoning from M-1/SR to R-1 property located on the west side of Bertelsen north of 18th was read by council bill number and title only, there being no Councilor present reques- ting it be read in full. Mr. Delay moved, seconded by Ms. Smith, that findings supporting the rezoning as set forth in Planning Commission staff notes and minutes of May 1, 1979, be adopted by reference thereto; that the bill be read the second time by council bill number only, with unanimous consent of the Council; and that enactment be considered at this time. Motion carried unanimously and the bill was read the second time by council bill number only. ..... e Mr. Delay moved, seconded by Ms. Smith, that the bill be approved and given final passage. Roll call vote. All Councilors present voting aye, the bill was declared passed and numbered 18415. 2. Rezoning from RA Suburban Residential to R-2/PD property located on the north si de of West 18th between Buck and Oak Patch (McCornack) (Z 79-5)--(Map distributed)--Recommended by the Planning Commission May 1, 1979, vote 6:1. Mr. Byrne said that the property consists of two irregularly shaped tax lots, a total of approximately 5.5 acres. Each tax lot is occupied by one single-family residence per density of approximately one-third acre. Property surrounded by residential zoning; west property zoned RA; north and east--R-2 Limited Multiple-Family; south--R-1 Single-Family Residential. Planning Commission cited a ,need to preserve natural vegetation to provide safe and efficient ~ traffic circulation and encourage flexible design in placement of buildings on the site. No ex parte contacts or conflicts of interest were declared by Councilors. Ms. Miller said that a property owner, after receiving a notice from the City, started to mention the subject to her, and she responded that it would be inappro- priate for her to discuss. Staff notes and minutes were entered into the record. Public hearing was held, with no testimony presented. Public Benefit Definition for Multi le-Unit Pro erty Tax Exem tion ram Memo, resolution, and Standards and Guidelines distributed e Mr. Kupper said that this is a matter that the Council approved in concept a month ago. He said that, in composition, the Project Advisory Committee shall be comprised of five members--two from JHC, two from Westside, Whiteaker, or West University Neighborhood, and one from CDC. A preapplication procedure has been formed in order to discuss public benefits prior to the development of a project. Application fee will be increased to $350; developer will share cost of architect's fees with City. Followingpreapplication meeting, developer will file application for the actual abatement, review, and recommendation of the Project Advisory Committee to JHC, and then to Council. In answer to Mr. Delay's question as to including the Renewal Area in the Exemption Program, Mr. Kupper said that there are two considerations, one being that there is no Renewal Agency-owned land for residential use, and that the tax increment for the Renewal Agency is an important factor, and property tax abatement on Renewal Agency land would run counter to the notion of trying to develop the maximum tax increment. The entire Renewal Agency area is exempt and recommendation will be made to include Renewal Agency area in the abatement program. Public hearing was opened. Philip Gall, Architect, president of Southwestern Oregon American Institute of Architects, noted that his executive committee supports the bill, with a concern for quality housing and public benefit. Steve Wood, 971 West 10th, member of JHC, referred to housing quality issue. Brad Perkins, 1691 Mill Street, feels that the guidelines suggest a good way to work out problems between the developer, the community, and the City officials. He asked if there is a formal approval on - 6/11/79--3 323 Fogelstrom's project on 8th and Lawrence. He expressed criticism for the project, and Mayor Keller suggested that Mr. Perkins' request be added at a later time to the City Council's agenda on this issue, and that Mr. Perkins direct his comments at this time to the present .4IJ. agenda item. Public hearing was closed, there being no further testimony. Mr. Kupper mentioned that there has been no formal or informal approval of the Fogelstrom project, that it had not appeared before JHC or Council yet. Mr. Kupper said that Mr. Fogelstrom designed his project knowing that he had a public benefit requirement to meet, but that the Project Advisory Committee review will be a new element to him. Ms. Schue expressed Mr. Fogelstrom's complete cooperation at the JHC 1 eve 1 . Res. No. 3165--Adopting amended and restated standards and guidelines for processing applications for multiple-unit rental housing local property tax exemptions was read by number and title. Mr. Delay moved, seconded by Ms. Smith, to adopt the resolution. Roll call vote. Motion carried unanimously. C. Public Works Bid Awards--Mr. Gilman said that there are a total of nine bids awarded and corrected the amount budgeted for storm sewers on Item 1 to $170,000. He said that the most important project is No.5, Paving and Sidewalk on Cal Young Road to Willagillespie Road. Public hearing was held, with no testimony presented. e Mr. Delay moved, seconded by Ms. Smith, that the low bids be granted as listed by the staff. Roll call vote. Motion carried unanimously. III. ORDINANCES FOR FIRST READING CB 1905--Levying assessments for sanitary sewer on Willakenzie Road from Cal Young Road to 520 feet north (1603) (78-32) was read by council bill number and title only, there being no Councilor present requesting it be read in full. Mr. Delay moved, seconded by Ms. Smith, that the bill be read the first time and be referred to Hearings Panel for hearing June 18, 1979, with panel recommendations to be brought back for Council consideration and final reading June 25, 1979. The motion carried unanimously. CB 1906--Levying assessments for paving, storm sewer, and sidewalk in Lewis Street from Van Buren Street to Jackson Street (1597) (78-56) was read by council bill number and title only, there being no Councilor present requesting it be read in full. 6/11/79--4 e 32.4 e Mr. Delay moved, seconded by Ms. Smith, that the bill be read the first time and be referred to Hearings Panel for hearing June 18, 1979, with panel recommendations to be brought back for Council consideration and final reading June 25, 1979. CB 1907--Levying assessments for sanitary sewer in Fox Hollow Street from 300 feet south of Princess Street to 100 feet north of Saratoga Street (1659) (78-64) was read by council bill number and title only, there being no Councilor present requesting it be read in full. Mr. Delay moved, seconded by Ms. Smith, that the bill be read the first time and be referred to Hearings Panel for hearing June 18, 1979, with panel recommendations to be brought back for Council consideration and final reading June 25, 1979. The motion carried unanimously. CB 1908--Levying assessments for sanitary sewer to serve Branson Subdi- vision (1615) (78-65) was read by council bill number and title only, there being no Councilor present requesting it be read in full. Mr. Delay moved, seconded by Ms. Smith, that the bill be read the first time and be referred to Hearings Panel for hearing June 18, 1979, with panel recommendations to be brought back for Council consideration and final reading June 25, 1979. The motion carried unanimously. - IV. RESOLUTIONS A. Res. No. 3166--Concerning room tax funds and supplementing Res. No. 3046 adopted by the City Council on November 15, 1978, was read by number and title only. Manager said that, during discussion at Room Tax Committee meeting last May 2, 1979, it was concluded that, instead of offering the full 25 percent of current recommended tax funds to the Chamber of Commerce, that the allotment, under the resolution of an exclusive vendor, should contain an increase equivalent to the general overall City budget increase of about 7.8 percent. . Resolution 3046 specifies the exact dollar amount, and would need amendment, and Resolution 3166 amends the amount to $59,110.20. Manager said that there will have to be a request for an amendment again next year. Mr. Lieuallen asked if the resolution could be made permanent, and City Attorney said that Council cannot commit future councils to a level of expenditure. e 6/11/79--5 3ZS , In response to Ms. Miller's question, City Manager said that the 7.8-percent increase is a result of the general feeling that a general increase should occur and that a standard guideline apply, and that it ~ would be unwise for the percentage to be greater than that of the City .., budget. Ms. Schue commented on the fact that conventions to support Eugene's area are lodged outside Eugene. Mr. Don Buchanan, manager Convention Bureau, said that each of the motels pays money to the Chamber of Commerce budget, which aids the convention budget, but not as much as the amount from City Room Tax Funds. Mr. Delay said that the amount of Room Tax funds left over up to 25 percent will be allocated elsewhere, and he feels that the move is counterproductive, and that they will indirectly receive the money twice. Mr. Lieual1en thinks that the City should not take a tight position in dispensing of convention funds, since any convention will have an impact on the entire metropolitan area. He suggested that the Chamber strongly urge the County and Springfield to participate in promotion of the activities. In response to Mr. Delay's comments, Manager said that extra money not allocated to the Chamber should be used for promotional projects, and not necessarily used by the Chamber of Commerce. In reply to Mr. Haws' question, Mr. Long said that, if an activity becomes a special benefit to the city of Eugene, then it is a legiti- mate expenditure. ~ It was the gener.al consensus of the Council that tourism should be promoted and that it needs to be a regional effort. Ms. Miller, however, suggested that the issue be postponed until the June 27 meeting, in order that the results of the June 26 election be taken into consideration. Manager reported that timing problems could arlse in the execution of the contract with the Chamber if the reso- lution is not approved now. Mr. Obie moved, se.conded by Mr. Hamel, to adopt the resolution. Roll call vote. The motion carried, all Councilors voting aye, except Mr. Haws and Ms. Miller voting no. Res. 3167--Authorizing payment of bills, claims, and progress payments for peri od May 29, 1979 through JUne 11, 1979 was read by number and title. Mr. Delay moved, seconded by Ms. Smith, to adopt the resolution. Roll call vote.
