HomeMy WebLinkAbout01/16/1980 Meeting e M I NUT E S EUGENE CITY COUNCIL January 16, 1980 ------------------------------------------------------------------------------- Adjourned meeting from January 14, 1980, of the City Council of the City of Eugene, Oregon, was called to order by His Honor, Mayor Gus Keller at 11:45 a.m., Council Chamber, with the following Councilors present: Betty Smith, Scott Lieuallen, Jack Delay, Eric Haws, D.W. Hamel, Brian Obie, Gretchen Miller, and Emily Schue. ------------------------------------------------------------------------------- I. ITEMS FROM MAYOR AND COUNCIL, APPOINTMENTS, ANNOUNCEMENTS, AGENDA ADJUSTMENTS A. Appointments and Announcements 1. Council committee assignments--Mayor urged Council members to make their wishes known concerning committee assignments for this year. Manager said an up-to-date list will be distributed by the end of the week. e 2. Lighting the cross on Skinner Butte--Manager explained that the Veteran's group has requested permission to light the cross on Skinner Butte during the Iranian crisis. The City asked the attorney to prepare an opinion on the legality of this action. Mr. Spickerman, Hearings Official, prepared a memorandum for the Council which said that, within the terms of the City charter and the opinion of the US Court of Appeals, the City would be violating the law by participating in this activity. 3. Condominium conversion--Manager said they will be preparing a release on the City's interpretation of the litigation in Portland on the condominium conversion moratorium ordinance after receiving the judge's eight-page opinion. Mr. Long explained that Judge Burns has issued a 20-day prelimi- nary injunction against enforcement of Section 1 of the ordinance. It provides that any action taken by the developer during that period of time would have to be contingent upon their successfully avoiding the moratorium. Anything the developers do has to be conditional. The order is expected today. Mr. Long said they had looked at the actions that might be taken. Newspaper accounts from Portland indicate the judge's opinion contains language suggesting it would enable veterans whose benefits might expire by January 31, 1980, to make application for veteran's loans on the condition that the loan would go forward when the moratorium is lifted. e 1/16/80--1 4. Designation of members of the Assessment Panel--Manager suggested, in order to avoid appointment of another subcommittee, the members of the Assessment Panel be used to hear exemption requests to the moratorium ordinance. - Ms. Smith moved, seconded by Mr. Lieuallen, to designate the members of the Assessment Panel to hear exemption requests to the moratorium ordinance. Mr. Lieuallen suggested the Condominium Conversion Study Task Force hear the exemption requests, as they are more familiar with and involved in these issues. He asked for a response from the Study Task Force members. Mr. Delay responded that the Study Task Force was very busy working on the long-term solution. He felt there were set procedures and guidelines that are to be followed. Each case would be considered on its merits within those procedures and guidelines to determine hardship and, therefore, Study Task Force members are not better equipped than other Councilors to handle these cases. He preferred the members of the Assessment Panel hear the individual cases. Ms. Smith supported Mr. Delay's comment. Motion carried unanimously. II. ROUTINE ITEMS FOR COUNCIL APPROVAL A. Approve Council Minutes of January 2, 1980 Ms. Smith moved, seconded by Mr. Lieuallen, to approve Council minutes of January 2, 1980. e Motion carried unanimously. B. Call For Public Hearings 1. Easement Vacation for L. J. Campbell (EV 79~12) (Map distributed) CB 2049--Call for public hearing for February 20, 1980, re: vacation of a 10'-wide by 553.5'-long bike/pedestrian easement located east from Spyglass Drive south of Fairway View Drive. Ms. Smith moved, seconded by Mr. lieuallen, that the bill be read the second time by council bill number only, with unanimous consent of the Council, and that enactment be considered at this time. Motion carried unanimously, Mr. Obie abstaining, and the bill was read the second time by council bill number only. Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be approved and given final passage. Roll call vote. All Councilors present voting aye, except Mr. Obie, who abstained, the bill was declared passed and numbered 18555. 1/16/80--2 . 2. Alley vacation for the 5th Street Public Market Partnership (AV 79-2) (Map distributed) e CB 2050--Call for public hearing for February 20, 1980, re: vacation of a 14'-wide alley located in the block bounded by High Street, Pearl Street, East 5th Avenue, and East 6th Avenue. Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be read the second time by council bill number only, with unanimous consent of the Council, and that enactment be considered at this time. Motion carried unanimously, Mr. Obie abstaining, and the bill was read the second time by council bill number only. Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be approved and given final passage. Roll call vote. All Councilors present voting aye, Mr. Obie abstaining, the bill was declared passed and numbere~ 18556. C. Ordinances For First Reading 1. Levying assessments and referring to Hearings Panel, January 21, 1980 e CB 2051--Levying assessments for paving, sanitary sewer, and storm sewer within and adjacent to CJH Estates Subdivision and Alban-Tate Subdivision (78-43). Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be read for the first time and referred to the Hearings Panel for hearing January 21, 1980, with Panel recommendations to be brought back for Council consideration January 28, 1980. Motion carried unanimously. CB 2052--Levying assessments for street paving on Jessen Drive from Highway 99 North to 180 feet west of Elizabeth Street (78-47). Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be read for the first time and referred to the Hearings Panel for hearing January 21, 1980, with Panel recommendations to be brought back for Council consideration January 28, 1980. Motion carried unanimously. CB 2053--Levying assessments for street paving, sanitary sewer, and storm sewer construction to serve Panorama View IV Subdivision (78-50). e 1/16/80--3 Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be read for the first time and referred to the Hearings Panel for hearing January 21, 1980, with Panel recommendations to be brought ~ back for Council consideration January 28, 1980. Motion carried ~ unanimously. CB 2054--Levying assessments for paving, sanitary sewer, and storm sewer to serve First Addition to Sweetbriar Subdivision; sanitary sewer to serve area within 160 feet of the east boundary of First Addition to Sweetbriar Subdivision; sani- tary sewer and storm sewer within Sweetbriar Subdivision; and sanitary sewer to serve area within 160 feet of the southeast boundary of Sweetbriar Subdivision; storm sewer to serve Tom's Plat (78-52). Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be read for the first time and referred to the Hearings Panel for hearing January 21, 1980, with Panel recommendations to be brought back for Council consideration January 28, 1980. Motion carried unanimously. CB 2055--Levying assessments for street paving on Adams Street between Sycamore Avenue and Lewis Avenue (78-54). Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be read for the first time and referred to the Hearings Panel for. hearing January 21, 1980, with Panel recommendations to be brought back for Council consideration January 28, 1980. Motion carried ~ unanimously. ~ CB 2056--Levying assessments for paving 13th Avenue from Bertelsen Road to approximately 300 feet east of Ocean Street (79-04). Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be read for the first time and referred to the Hearings Panel for hearing January 21, 1980, with Panel recommendations to be brought back for Council consideration January 28, 1980. Motion carried unanimously. CB 2057--Levying assessments for sanitary sewer to serve Coast Hills Vista Subdivision (79-15). Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be read for the first time and referred to the Hearings Panel for hearing January 21, 1980, with Panel recommendations to be brought back for Council consideration January 28, 1980. Motion carried unanimously. CB 2058--Levying assessments for paving, sanitary sewer, and storm sewer within and adjacent to Court Royale Subdivision (79-19). e 1/16/80--4 e Ms. Smith moved, seconded by Mr. lieuallen, that the bill be read for the first time and referred to the Hearings Panel for hearing January 21, 1980, with Panel recommendations to be brought back for Council consideration January 28, 1980. Motion carried unanimously. III. PUBLIC HEARING A. New liquor license Outlet 1. Grand Illusions (retail malt beverage); located at 412 Pearl Street; Greg Willener, Doug Mykol, Doug Vaughan, Grand American Discos, Inc. Manager explained this request has been checked by the City departments, including Police, Fire, Public Works Building Division, etc. Everything is in order and it should be for- warded with approval to the OlCC. Public hearing was opened. e William Farrell, 609 East 14th Avenue, was not for or against the granting of the liquor license to Grand Illusions. While Grand Illusions was running as an underage disco, there were allegations that there was discrimination where the full accom- modations of the establishment were denied to gay men and women. He asked to hear from the owners what their policy will be in the future. Bill Wiley, Butler Husk Gleaves & Swearingen, representing the owners of Grand Illusions, was aware of the incident alluded to and believed it had been resolved amicably. It is not the intention of the owners in any way to decline the use of the premises to anyone for any reason, other than requesting that people conduct themselves in an acceptable manner so the premises are not destroyed or create a danger for other people. Public hearing was closed. Ms. Smith moved, seconded by Mr. lieuallen, to forward to the OlCC with recommendation for approval. Motion carried unanimously.
