August 11, 1980
Regular meeting of the City Council of the City of Eugene, Oregon, was called
to order by His Honor Mayor Gus Keller at 7:30 p.m., August 11, 1980, with
the following councilors present: Betty Smith, Scott Lieuallen, BrianObie, Eric
Haws, D. W. Hamel, Gretchen Miller, and Emily Schue. Councilor Jack Delay was
absent.
Mr. Henry noted that there would'be an International Youth Association dinner
held on Wednesday. Those who wish to attend should notify Jean Paul.
I. PUBLIC HEARINGS
A. Concurrent Annexation/Rezoning
1. Property located on the east side of Bertelsen Road between West
18th Avenue and Bailey Hill Road from County RA Suburban District
to City R-1 Low-Density Residential (Eugene Rouch, Jr.) (A/Z 80-1)

Mr. Henry stated that this item has been recommended for approval
by the Planning Commission which voted 6:0 on annexation and 4:2
on zoning on July 1, 1980. This is a zone change and a request
for annexation to the Lane County Metropolitan Wastewater Service
District. He introduced Bill French, Planning, to provide back-
ground information.
Mr. French stated that Adrienne Lannom also is present from the
Planning Commission if questions need to be directed to her. He
referred to page II-A-15 on the agenda for the map of where this
property is located. It is on the east side of Bertelsen Road
between West 18th and Bailey Hill Road. Presently, it is vacant
and the applicant is requesting annexation. The land use is
basically residential, but to the west is property that is still
within the county.
No ex parte contacts or conflicts of interest were noted. Staff
notes and minutes were entered into the record.

Res. No. 3410--A resolution for the recommendation to the Boundary
Commission for annexation of property located on the east
side of Bertelsen Road between West 18th Avenue and Bailey
Hill Road to the City of Eugene and the Lane County Metro-
politan Wastewater Service District.
Ms. Smith moved, seconded by Mr. Hamel, that findings supporting
the annexation as set forth in Planning Commission staff notes
and minutes of July 1, 1980, be adopted by reference thereto;
and that the resolution be adopted.
Roll call vote; motion carried unanimously.
CB 2182--Authorizing rezoning from County RA Suburban District to City
R-1 Low-Density Residential District for property located on
the east side of Bertelsen Road between West 18th Avenue and
Bailey Hill Road.
Ms. Smith moved, seconded by Mr. Hamel, that findings supporting
the rezoning as set forth in Planning Commission staff notes and
minutes of July 1, 1980, be adopted by reference thereto; that e
the bill be read the second time by council bill number only,
with unanimous consent of the council; and that enactment be
considered at this time. Roll call vote; motion carried unan-
imously.
Council Bill 2182 was read the second time by council bill
number only.
Ms. Smith moved, seconded by Mr. Hamel, that the bill be approved
and given final passage. Roll call vote; all councilors present
voting aye, the bill was declared passed and numbered 18688.
B. Rezoning
1. Property located on the west side of Mistletoe Street north of
Mist Court from RA Suburban Residential District to R-2/SR
Limited Multiple-Family Residential District with Site Review
Procedures (L. C. Jarnagin) (Z 80-13)

Mr. Henry noted that this item comes to the council without a
recommendation from the Planning Commission, since their vote
on July 1, 1980, was 3:3. He introduced Jerry Jacobson, Plan-
ning, to provide background information.

Mr. Jacobson indicated that this parcel contains 3,700 square
feet and is located on the west side of Mistletoe. The property
e is vacant and there are no significant natural characteristics.
There is a PUD, Bailey Meadows, on the north side of the property.
On the west side, a parcel was recently rezoned from RA to R-2/SR
zoning with single-family residential properties. The R-2/SR
zoning would permit 13 units on the subject property.
Mr. Haws asked what the density of the property to the north
was and how many units per acre are allowed. Mr. Jacobson
responded that there are up to 16 units per acre allowed. Ms.
Schue asked if the reason for suggesting inclusion of site review
procedures was to state that access would only be from Bailey
Hill Road. Mr. Jacobson indicated that this recommendation came
from Commissioner Thwing; it is not a staff recommendation.
Ms. Smith asked if access is going to be from both Bailey Hill
Road and Mistletoe. She asked if there was a possibility of
eliminating Mistletoe as an access street. Mr. Jacobson stated
that that might be difficult since that is the only frontage,
especially if the property should be sold before it would be
developed.
No ex parte contacts or conflicts of interest were noted.

Speaking in favor:
Leon Jarnagin, the applicant, stated they can funnel most of
the trattlc out onto Bal ley Hill Road if it is necessary.
Speaking in opposition:
Richard Plumb, 3465 West 15th, pointed out that there is a
large sectlon north of Tax Lot 200 where there are 40 to 80
apartments on a lot which is zoned RA. He thinks that is an
error. He would like the council to consider this carefully
and what could happen if apartments go in. If this access on
Mistletoe were allowed, it would create more confusion on an
already busy street.
There being no further testimony, public hearing was closed.
Mr. Jacobson noted that the property to which Mr. Plumb referred
is zoned RA and developed with a Planned Unit Development, and
that is why there are apartments there.

CB 2183--Authorizing rezoning from RA Suburban Residential District to

Ms. Smith moved, seconded by Mr. Hamel, that findings supporting
the rezoning as set forth in Planning Commission staff notes and
minutes of July 1, 1980, be adopted by reference thereto; that
the bill be read the second time by council bill number only,
with unanimous consent of the council; and that enactment be
considered at this time.
. Mr. Obie noted that since the Planning Commission had a split
vote, he took the time today to visit the property. Mistletoe
is basically undeveloped, adjacent to the property. Mr. Jacobson
agreed that it is an unimproved street. Mr. Obie stated that it
is narrow and all adjacent lots are single-family residences.
He feels the traffic observations are valid, and although he
would normally be supportive of higher density, he would like
to limit access to Bailey Hill Road.
Mr. Lieuallen arrived at the meeting.
Mr. Jacobson stated that under the present RA zoning, the prop-
erty could be developed with four units under the cluster subdi-
vision or it could be developed by using panhandle lots, all with
access from Mistletoe Street. -
Mr. Obie asked if these things could happen without a zone change
and the access be limited. Mr. Farah responded that they could
and they would try as part of the site review to send a major
portion of traffic to Bailey Hill Road. This could be done,
but it would be creating a touchy situation for the owner in
the future. -
James Weathers, the developer, stated that there is a 12-foot
buffer zone for fire and police access with the rest of the
traffic going to Bailey Hill Road.
Mr. Obie noted that the council could approve this with access
only for emergency vehicles on Mistletoe.
Ms. Schue stated concern about the traffic and asked if there
is access to Mistletoe from the apartments to the north. ~.
Jacobson responded that there is a 12-foot-wide emergency vehicle
access. Ms. Schue then asked where the traffic is coming from
that causes the confusion. ~. Jacobson responded that Mistletoe
is unimproved and used by the surrounding area for access onto
18th. Ms. Miller noted that it is appropriate that a street

e is unimproved and does not necessarily mean that it will never
be improved. She would not mind if access were limited to
Bailey Hill Road, a major arterial. She noted that the council
is attempting to provide affordable housing and that is why
this should be approved.
Mr. Obie moved, seconded by Ms. Smith, to place special emphasis
on Site Review Procedure #5, Exhibit "B" of the ordinance, for
safe and efficient ingress, egress, and on-site traffic cir-
culation which uses Mistletoe Street only for emergency vehicular
traffic.
Mr. Farah indicated that this wi" not be going back to the
Planning Commission.
Roll call vote on the amendment; motion carried unanimously with
Mr. Lieuallen abstaining.

Council Bill 2183 was read the second time by council bill number
only.
Ms. Smith moved, seconded by Mr. Lieuallen, that the bill be

C. Public Works Bid Awards (tabulation attached)--Mr. Henry stated
that all blds are belng recommended wlth the exception of Bid Number
7, speed devices on Augusta Street, which is not being recommended
at this time since there will be a hearing on this matter later.
Don Gilman, Public Works, said that these bids consist of 17 projects,
the bids for which were opened on August 5 and August 7. The bid
summaries were distributed with the recommendation to award to the
appropriate bidders in each case. Six bids would be at City cost,
three were petitions by the property owners, and seven were regarding
subdivision development. They would recommend awarding all except
for Project 2 of Bid Number 7, speed devices on Augusta Street.
This is in the Laurel Hill neighborhood and it is a Community
Development project. It would narrow the street from 36 feet to
24 feet. There is one protest on this project and a hearing is
scheduled for September 8, 1980.
Public hearing was opened; there being no testimony, public hearing
was closed.
Ms. Smith moved, seconded by Mr. Lieuallen, to award all the
low bids and sign the contracts with the exception of project
e 2 of bid number 7, speed devices on Augusta Street.

Ms. Miller asked why the cost to the City is higher than the amount
of the contract. Mr. Gilman responded that this includes the e~gi-
neering costs. e

II. ORDINANCE FOR FIRST READING
A. Property located south of 30th Avenue, east of Spring Boulevard at
Dogwood Drive and Kimberly Drive, from County AGT Agricultural,
Grazing, Timber-Raising District to City RA Suburban Residential
District and from County AGT Agricultural, Grazing, Timber-Raising
District to City'RA/PD Suburban Residential District with Planned
Unit Development procedures (City of Eugene: Firland Heights)
(Z 80-12) (map distributed).
Mr. Henry stated that this item had been held over for one month. At
the council's request, a tour of the area was made. This property had
been annexed but not converted from county to city zoning. He intro-
duced Jerry Jacobson, Planning, to provide background information.
Mr. Jacobson stated this is a city-initiated zone change for property
which never received city zoning after annexation in 1976. On July 14,
the zoning matter was heard and tabled to allow a tour and to receive
information from the County regarding the 30th Avenue interchange.
This information has been distributed to the council. The earliest
possible construction date for this interchange would be 1983-84. e

, Ms. Smith asked how this coincides with development of the property.
Mr. Jacobson stated that the property would be developed in three
phases with the earliest occurring possibly in 1982. The majority
of the development on the property would take place in 1983-84.
Ms. Smith noted that the interchange would not accommodate traffic
during construction, but it would after that. Mr. Jacobson indicated
agreement with her statement.
Ms. Schue stated that she had missed the public hearing and would
abstain from the item.

III. REPORT FROM ENERGY CONSERVATION POLICY BOARD--STAFF PRESENTATION (memo
and report distributed)
Mr. Henry indicated that there are two motions to be acted upon, one to
refer the board's recommendations to establish weatherization standards
for existing residences to the City Attorney's office to be heard as an
ordinance in October; the second motion is to forward recommendations
regarding solar access and land use to the Planning Commission with a
high priority within the revisions to the zoning ordinance. Mr. Henry
stated there are several proposals which the Policy Board believes should
be retained by the City Council until a later time. These recommendations
include: a) The establishment of an electrical space heating connection
service charge where natural gas is available--this charge could be
reduced for certified energy-efficient residences; (b) The development
of energy-efficient standards as a requirement of new electrical hookups
where natural gas is available; and (c) The development of measures which
would lead to the eventual prohibition of electrical space heating hook-
ups where natural gas is available.

Mr. Henry introduced Gretchen Miller, chairperson of the Energy Conser-
vation Policy Board, and Greg Page, Technology Coordinator, City Manager's
office, to provide background information. e
Ms. Miller stated that the memo describes the recommendations of the
Board. She noted that Camilla Pratt and Adrienne Lannom, Planning Com-
missioners, and members of the Energy Conservation Policy Board, are
available to answer questions. As the proposals come back to the council
in October, they will need to anticipate how the Northwest Regional
Power Bill will affect Eugene. If it fails, it is unknown what will
happen with -EWEB's loan program to implement weatherization.
Mr. Page stated that in the past six months the Energy Conservation
Policy Board has developed a series of proposals. The board should be
given credit for imagination and ability to adapt. When the work first
began, there was large participation by the banks and community in the
State's 6-1/2 percent loan program. With rising interest costs, this is
no longer so available. If EWEB is successful through the test case in
the court, and the bond sale, this would provide $20 to $40 million to
this area without requiring Federal or State assistance. These would be
matching grants, and the loans would be deferred for payment until the
time of sale of the residence. Weatherization requirements in existing
residences will be effective January 1, 1985. Prior to that time, strong
educat ional programs wi 11 be developed by the City and EWEB, emphas i zing
economic reasons for voluntary implementation of weatherization and what
the consequences will be if they are not implemented. By 1990, most
residences would be weatherized, which is when load shortages are pro-
jected. Eugene's proposal is different from Portland's in the following e
ways: a) it does not affect the sale of the property; b) the proposal
will include financing without appeal to State or Federal governments;
c) it will apply only to residential residences up to four-plexes; and
d) there is utility certification. There is also an appeals process for
on-site variances or through the City's appeals process. The cost for
enforcement would be incurred by EWEB, not the City. On the emergency
fuel energy shortage contingency planning, they are working with the
Federal Department of Transportation and Department of Energy. They
are also developing a solar efficiency manual. They are sending out
information in the Parks Department Fall Leisure Schedule and received
permission from Garry Trudeau to use some of the Doonesbury cartoons as
part of this information.
Ms. Miller stated that she would like to make it clear that these ideas
are being referred to the Planning Commission and Planning Department
and that they are being referred with a high priority. Mr. Obie noted that
these are just referrals at this time for the public to properly respond.
It will be more effective to get proposals back from the attorneys and
then get public input. Ms. Smith noted that it is easy to refer, but
the council has no way of knowing when these would come back; she asked
if it would be this year. Mr. Farah responded that many items are coming
in as high priority, and he could give them a definite time in about a
week. Ms. Smith asked if this is perceived as a high priority with the
Planning Department. Mr. Farah responded that it is high priority with
both the Planning Commission and the Planning Department. .
